PLANTING DESIGN
THIS AMENDMENT, dated for reference purposes only as February 23, 2024, is by and between
the City of Renton (the “City”), a Washington municipal corporation, and AHBL, Inc
(“Consultant”), a Washington corporation. The City and the Consultant are referred to collectively
in this Amendment as the “Parties.” Once fully executed by the Parties, this Amendment is
effective as of the last date signed by both parties.
Whereas, the City engaged the services of the Consultant under Agreement CAG-23-206, dated
December 22, 2022, to provide necessary services for the Gateway Planting Design (referred to
herein as the “Agreement”);
Whereas, the Parties wish to amend the Agreement to change the scope of work, and change
the compensation in order to coordinate with Western Neon for artwork design and
incorporation into the roundabouts.
NOW THEREFORE, It is mutually agreed upon that CAG-23-206 is amended as follows:
1.Scope of Work: Section 1, Scope of Work, is amended by adding Tasks 47, 48, 49 and
amending Task 90 as specified in Exhibit A-1, which is attached and incorporated herein.
2. Compensation: Section 4, Compensation, is amended so that the maximum amount of
compensation payable to Consultant is increased by $7,360 from $46,950.00 to $54,710,
plus any applicable state and local sales taxes. The additional compensation shall be paid
based upon Work actually performed according to the rate(s) or amounts specified in
Exhibit A-1 which is attached and incorporated herein.
3.All terms of the Agreement not explicitly modified herein shall remain in full force and
effect and such terms shall apply to Work performed according to this Amendment as if
fully set forth herein.
IN WITNESS WHEREOF, the Parties have voluntarily entered into this Amendment as of the date
last signed by the Parties below.

Subject: Proposal for Landscape Architecture Lighting and Art Coordination Services
Dear Sam:
We are excited to continue working with your team at City of Renton and further develop the
Renton Gateway roundabouts. Our understanding of the project is based on our conversations
regarding art coordination.
Overarching project assumptions and understanding of scope:
•The scope of work for this project will begin after the completion of the
Washington State Department of Transportation (WSDOT) I-405/Renton to
Bellevue Widening and Express Toll Lanes Project at the Exit 7, 44th Street
Interchange, and no coordination with WSDOT will be required to complete this
art installation and lighting project.
•Because this project occurs in the public right-of-way, it will be designed to meet
City of Renton Public Works standards.
•Project team to include City of Renton Planning and Public Works departments.
•We understand that areas of scope are limited to:
o Areas indicated on attached Exhibit A1.WHICH IS THE SAME AS
EXHIBIT A1 TO EXHIBIT A OF THE ORIGINAL AGREEMENT
o In those areas, AHBL will coordinate art design and installation with
Subconsultant Western Neon.
•We will address from Preliminary Design through the Construction phase:
o Art coordination by Western Neon.
•No permit submittals are required for this project.
•We will provide an art plan via Western Neon.
•We will use as-built sleeving provided by WSDOT.
•Art element shop drawings, fabrication, transportation, and installation are not
included in this contract.

Art Coordination – Task 47
1.Coordinate with Western Neon on concepts for two primary and one secondary art
element.
2.Coordinate with project team members regarding art element preferences for the project.
3.Revise construction documents with planting design revisions, art element and base
locations, and coordinate with Public Works.
4.Attend online project meetings/conference calls:
a.Project team meetings – four meetings.
Art Element Concept Design (by Subconsultant) – Task 48
5.Western Neon will provide art design services as a subconsultant to AHBL. The fee
below includes a 15% markup. The Western Neon proposal is also attached.
a.Initial concepts for two primary and one secondary art element with four rounds of
revisions.
b.Conduct code research.
c.Provide an estimate for fabrication, transportation, and installation.
Art Design Bidding/Construction Phase Services – Task 49
6.Assist the owner and the architect with answering bidders’ questions for clarification and
assist in the preparation of bid addenda. This task allows 2 hours.
7.Respond to contractor-initiated questions (RFIs) during construction as they relate to the
design.
8.We will review art element shop drawings and report findings to the project team.
9.This task allows for a total of two site visits for art coordination:
a.One site inspection (including site observations with report) during construction to
ensure the intent of the design is being met, including art element placement and
lighting placement.
b.One site visit post construction (one punchlist visit and one follow-up/back-punch
visit).
10.Prepare final letter of substantial project conformance/completion.
This scope of work will be billed on a time and expense basis, with an estimate provided
below. Reimbursable Expenses – Task 90 (ADDITIONAL EXPENSES NOTED BELOW)
11.Reimbursable expenses such as mileage and reprographics. This scope of work will be
billed on a time and expense basis, with an estimate provided below.

You may not want us to provide some of the services listed above. We can discuss these
services and the number of hours with you and make adjustments, as necessary.
Some of the tasks listed are influenced by factors outside of our control. Based on our
experience, we have estimated the number of hours required to complete these tasks. During
the course of the project, if it is determined that more hours are required to complete any of
these tasks due to circumstances outside of our control, we will notify you immediately. We will
not perform additional work until we have your written authorization. The task numbers on the
invoice will correlate with this proposal.
Exclusions
This proposal does not include fees associated with agency reviews, submittals, or
permits, nor does it include any work associated with the following services:
a) Professional services of subconsultants, e.g., arborist, geotechnical and traffic
engineers, or wetlands, wildlife, and other specialists, if required by the review
agency.
b) Preparation, submittal, or securing of permits including, but not limited to:
1) Forest Practices Applications or permits from the Department of Natural
Resources for logging operations.
2) National Pollutant Discharge Elimination Systems Baseline General
Permits or the associated Notice of Intent from the Department of Ecology
for stormwater discharge to surface waters.
3) Hydraulic Permit Applications from the Washington State Department of
Fish and Wildlife for work in stream buffers or floodplain areas.
c) Preparation, submittal, or securing of extensions or renewals for expiring or
expired applications or permits. Monitoring of applications or permit expiration
dates is the responsibility of others.
d) Environmental impact statement.
e) Costs associated with the excavation of soils logs for the evaluation of onsite
soils.
f) Offsite improvements.
g) Design of retaining wall features in excess of 3 feet or miscellaneous site features,
unless otherwise noted.
h) Wetland mitigation design and monitoring.

i)Costs associated with reconsiderations of agency decisions.
j)Costs associated with preparing and filing variances, etc.
k)Costs associated with the publication of legal notices in the newspaper.
l)Costs associated with the preparation and installation of public notice signs.
m)Costs associated with title reports or other legal documents.
n)Costs associated with substantial redesign after preparation of design
development drawings.
o)Preparation of maintenance manuals, reports, or certification testing of installed
improvements.
p)Additional inspections that are a result of contractor non-compliance to the plans
or specifications.
q)Development of an opinion of probable construction costs, except where noted
above.
r)Preparation of documents using metric units of measure.
s)Dividing the design work into more than one phase of work.
Although we do assist the owner during the construction process, this proposal is for design
services only and in no way implies we are construction managers.
If you find this proposal acceptable, please prepare your standard contract. Our receipt of the
signed contract or your written authorization will be our notification to proceed.

Requirements prior to the start of production: approved design, signed contract, 50% deposit as well as any
necessary permits, building owner or officiating committee approvals, and engineer’s stamp if needed. All
deposits are non-refundable. Credit Card payments exceeding $2,500 are subject to a 3% processing fee.
Shipping -
Buyer assumes all physical, conditional, and financial responsibility of any project, product or package that
leaves Western Neon’s premises. Should any damages occur in shipment, it is the Buyer’s sole responsibility
to file claim with carrier.
