This includes 3.5 acres, divided into three properties to the south of the existing Center. Study Area 2 is approximately 16.5 acres to the south of Study Area 1. It will be evaluated for a lower density residential designation. ISSUE SUMMARY: 1. Does enlargement of the Center meet the objectives of the Comprehensive Plan? 2. What is the appropriate designation around the Center? RECOMMENDATION SUMMARY: The Planning Commission recommends denial of the request to expand the Center boundary. The Commission felt that a more intensive Center designation was inappropriate at this location because of potential impacts on the surrounding single family neighborhood. The Commission also had reservations about expanding the Center boundary since development capacity still exists within the Center. The Commissioners noted that the original intent of the Centers designation was to protect single family neighborhoods. The Commission recommends that Residential Options Land Use with R 10 zoning be designated for Area 1 and that Residential Single Family with R-8 zoning be designated for Area 2. The Commission reviewed the range of development allowed in the Residential Options and noted that single family up to fourplex units could be developed for 50% of a project. These uses could give the petitioner some additional development potential over what he could realize under King County zoning, and could also provide a transition in density from the Center designation. ANALYSIS: Issue 1: Enlargement of the Center The intent of the Center Neighborhood district is to encourage a mixture and intensity of uses that contribute to and serve the adjacent community. The existing Center already consists of townhomes and shopping center to the north, and multi-family buildings to the west. Currently, the uses in the Center do not maximize the development potential of this designation, so additional capacity is not needed for development opportunities to occur. Although additional land is not needed in the Center, and expansion could be justified based on the configuration of the existing boundary. A peninsula of Single Family designation is mapped into the existing Center at N.E. 11th St., creating a`pocket"of CN to the north and RM-N to the east and west A more logical boundary could be developed which would meet policy objectives. However, issues of neighborhood compatibility and transition densities are also important around Center designations. Study Area 1 abuts existing townhouses to the north, Duvall Ave NE to the east, single family uses to the south and multi-family uses to the west. Compatibility within the neighborhood will be most affected by how density transitions from the Center to the single family to the south. Issue 2: Appropriate Designation Around the Center An intermediate density between the Center single family areas may be the best way to protect existing neighborhoods. Staff evaluated four options: a) Designate RO (R-10 zoning) in Study Area 1 and RS in Study Area 2 as a transitional density between the existing Center and the RS neighborhood to the south. This option allows a transitional density increase while not expanding the Center. P&DMAP3.DOC b) Designate Center for Study Area 1 and RO in Study Area 2 as the intermediate designation between the Center and the RS south. The City has used RO in limited areas as a transitional designation for Centers. If a more gradual transition to the south is desirable then the RO designation is the only designation that fits between the Center and RS. c) Designate Center for Study Area 1 and part of Study Area 2 to eliminate the `peninsula"of RS surrounded by the Center. Expansion of the Center beyond Study Area 1 does not meet the distance and criteria for Center boundaries. The property owners in Study Area 2 that are abutting Area 1 have not indicated support for a change to CN. d) Designate CN in Study Area 1 and maintain the existing RS in Study Area 2. The three parcels abutting Study Area 1 are less than an acre and, therefore, by code can achieve 9.7 du/ac in RS. To amend these parcels to RO would give them the development potential of 10 du/ac. COMPLIANCE WITH THE COMPREHENSIVE PLAN: The Comprehensive Plan criteria for adjusting Center boundaries can be interpreted to support the request. Policy LU-91. Center boundaries should be designated according to the following criteria: a. The boundary should coincide with a major change in land use type or intensity. b. Boundaries should consider topography and natural features such as ravines, hills, and significant stands of trees. c. Boundaries should occur along public rights-of-way including streets or utility easements, or at rear property lines where justified by the existing land use pattern. Boundary lines should not be drawn through the interior of parcels.. d. As a maximum distance, the boundary should be drawn within 1,200-1,500 feet from one or two focal points which may be defined by intersections, transit stops or shopping centers. Policy LU-93. Transitional land uses which surround the Center are designated to provide buffers to the less intensive uses. Policy LU-94. Changes to adopted boundaries should only be made in the following circumstances: a. The original mapping failed to consider a major natural feature or significant land use which would make implementation of the boundary illogical. The boundary change coincides with a major change in land use to the west (apartments) and to the north (townhomes and shopping center). There are no major natural features to respond to. The proposed boundary is within 1,500 feet from the focal point intersection of Duvall Ave NE and Sunset Ave NE and 800 feet from the shopping center to the north. The proposed boundaries occur at rear property lines. The existing CN boundary appears illogical.. The existing "peninsula"may have been created because it was outside the City boundaries when the Land Use Map was adopted in 1993. CAPACITY ANALYSIS: The proposed CN amendment in Study Area 1 would replace the single family capacity of 22 units with a multifamily capacity of 46 units. CONCLUSION: Staff recommends that the Planning Commission recommendation of RO for Study Area 1 and Residential Single Family with R-8 zoning for Study Area B. II AMENDMENT 2 - COMMERCIAL USES IN BURNSTEAD AREA DESCRIPTION: The owners of three parcels (2.1 acre total) at the southeast corner of SE 128th St. and 144th Ave SE (see map) requested of the City Council to amend the Land Use Map of the Comprehensive Plan from a Residential Rural (RR) to a Convenience Commercial (CC) designation with concurrent CC zoning. The owners intent is to allow the existing uses to continue as conforming uses. The existing uses include a donut shop, mini mart and vegetable stand. These parcels are currently zoned Neighborhood Business in King County. ISSUE SUMMARY: 1. Advantages of maintaining conforming rather that nonconforming uses. 2. Appropriateness of a Convenience Commercial designation for this site. 3. Request to add additional parcels to this designation RECOMMENDATION SUMMARY: The Planning Commission recommended approval of redesignation of the three parcels from Residential Rural to Convenience Commercial with concurrent Convenience Commercial zoning. The Commission did not favor expanding this designation to include adjacent parcels. Staff concurs in this recommendation. ANALYSIS: Issue 1: Property owners are requesting zoning which allows existing uses to continue as conforming uses when annexation occurs. Area residents also supported continuation of the existing commercial uses as a service to their neighborhood. Maintaining conforming uses allows the existing businesses to improve or redevelop their property, which can improve the neighborhood with viable, appropriately scaled commercial services. The City's goal for CC designations (Objective LU-FF) is to maintain viable small scaled commercial uses which support the population in residential areas. A designation change to keep the uses conforming is desirable. Issue 2: The City Council directed staff to evaluate the site for a redesignation to CC. These parcels abut each other and are similar in size to other CC designations in the City. The Comprehensive Plan supports small areas of CC in residential areas. The parcels are sited along a major arterial (SE 128th Street) and they serve a commercial need for the area residents. The existing uses of a donut shop, restaurant/mini mart and vegetable stand are conforming in the Convenience commercial designation. The existing vegetable stand is operating out of a non conforming structure consisting of a refrigeration truck with an awning. This structure is legal and could continue to be used. Convenience Commercial also allows small-scale, retail and services such as video, salons, newsstands and laundromats. The parcels are sited along a major arterial (SE 128th Street). These uses serve a commercial need for the area residents. The proposed designation is small enough not to detract from the commercial area to the west. Issue 3 Property owners of adjacent parcels at the SW corner of 128th St. and 144th Avenue SE and at 14415 SE 128th Street requested inclusion of these lands in the CC designation at the public hearing. Expansion of the designation could allow additional commercial development along N.E. 128th street. As neither of these properties is presently used for commercial purposes these properties would not become non-conforming uses under residential zoning. P&DCMAP4.DOC/ COMPLIANCE WITH THE COMPREHENSIVE PLAN: The Comprehensive Plan policies support the proposed land use change to Convenience Commercial. Objective LU-FF: Permit small-scale commercial uses which serve the personal needs of the immediate population in residential areas and reduce automobile travel. Policy LU-219. Commercial structures in adjacent Convenience Commercial designations should be compatible with the single family character of the residential area in height,front yard setbacks, lot coverage, and building design. Policy LU-220. Small-scale commercial uses should be located: a. within pedestrian range of existing and planned residential areas. b. outside of the trade area of other small-scale commercial uses offering comparable goods and services. c. contiguous to a street classified at the collector level. The Convenience Commercial uses are small-scaled, have served the neighborhood and reduced travel distances but have no sidewalk connections. The existing development is compatible with the residential area because it is of low intensity for height, scale, setback and lot coverage. Existing building design is a commercial style. There are no other Convenience Commercial areas in the Burnstead Annexation. The parcels are separated from the Suburban Center to the west. The commercial uses are adjacent to residential neighborhoods. The parcels are adjacent to SE 128th St. which is classified as a Principal Arterial CAPACITY ANALYSIS: The change of land use designation has little effect on the City's land capacity because of the size of the parcels. The proposed change from a redevelopment potential of 5 du/ac without commercial (potential R-5 zoning) to a small number of existing retail jobs with a potential of 5 du/ac (proposed CC zoning). A change to a Convenience Commercial designation will increase job capacity by 17 retail jobs. There are an estimated 10 jobs with the existing commercial uses on the site. There is no change in the capacity potential for housing because both designations allow up to 5 du/ac. CONCLUSION: The land use map amendment to a Convenience Commercial designation is appropriate because it reestablishes conforming uses, provides neighborhood services, and is clearly supported by the policies of the Comprehensive Plan. The site is located at the southwest corner of Raymond Ave SW and SW 16th Street(see map). Parcel size is 22 acres. ISSUE SUMMARY: 1. Should the City shift land from office to industrial uses? RECOMMENDATION SUMMARY: The Planning Commission recommends approval of the request. ANALYSIS: The intent of the Employment Area Office (EAO) designation is to promote intensive office activity (Objective LU-CC) in the City. The uses in the designation are primarily a variety of office uses with limited secondary uses of service and retail. Currently, the City has a 30 to 35% vacancy rate for office space. The intent of Employment Area Industrial (EAI) designations are to create and sustain industrial areas as employment activity areas with the supporting businesses, office, and services. The major issue in this application is whether the City should shift Office designated land to Industrial use. The City has 1,493.53 acres or about 16.99% of its land zoned CO. The Medium Industrial designation is 5.57 % of the total City land area. Office zoned acreage in the Valley includes 547.30 acres representing 33.87% of the Valley land area. Medium Industrial zoning also accounts for 28.31 percent of Valley acreage, or 457.38 acres. Given the equal distribution of these two use types, staff finds that this change would not significantly affect either industrial or office land. The existing office vacancy rate suggests that the market demand supports the industrial designation at this time. COMPLIANCE WITH THE COMPREHENSIVE PLAN: Policies LU-W, LU-144, LU-145, LU- 148, and LU-EE support the proposed amendment. These policies state that Renton should support its industrial base,and encourage the City to create more industrial lands. Policies LU-146 and LU-CC do not preclude the amendment because there is additional office development potential in Renton. Policy LU-144. The City should endeavor to keep its present economic base, including the heavy industrial development, light and medium industrial users, supporting commercial and office land uses. Policy LU-145. The City should provide incentives including adequate land supply and land use guidance for new businesses and for existing businesses relocating within the City. Policy LU-146. Adequate amounts of land suitable for all types of industrial, light industrial, office and commercial uses should be available for present and future development. Using the growth assumptions, criteria for determining "adequate amounts of land"for the employment area should be based on the following. b. Industrial: Sustain the land use base for existing industrial users. Traditionally, Renton has provided 20% of its land base for industrial uses, a higher percentage than many other of the area's cities. This percentage should not be substantially reduced. c. Office: Provide for stand alone office uses, and offices that support industrial uses in order to reach future employment levels. P&DMAP2.DOC/ Policy LU-148. In each employment designation, an appropriate mix of commercial, office, light industrial and industrial uses should be encouraged The mix will vary depending on the employment area emphasis. Employment Area-Office Objective LU-CC: Promote intensive office activity including a wide range of business,financial and professional services to local, regional, national, and global markets, supported by service and commercial activities. Employment Area-Industrial Objective LU-EE: Create and sustain industrial areas which function as integrated employment activity areas and include a core of industrial uses and other related businesses and services, transit facilities and amenities. Policy LU-196. A mix of offices, light industrial warehousing and manufacturing should be encouraged as the secondary uses in the EmploymentAreaIndustrial classification with conditions as appropriate. CAPACITY ANALYSIS: The site is 22.24 acres. Office uses which have a .50 floor area ratio have a greater development potential than industrial uses which have a .45 floor area ratio. This site could support 484,387 square feet of potential office or 435,948 square feet of potential industrial development(different 48,439 sq. ft.). The applicant is proposing a mixed use development with a total of 416,000 square feet of building. Based on the assumption that 300 square feet is needed per office employee and 550 square feet per industrial employee, office capacity is 1,614 jobs while industrial capacity is 784 jobs. The actual development proposal is speculative at this point and is a mix of office, warehouse, and manufacturing uses. Based on the square foot to job ratio,the proposed Technical Center may provide 188 jobs if the use is manufacturing, and 142 jobs if the use is warehousing. CONCLUSION: Staff supports the amendment because it maintains Renton's industrial base as stated in the policies, is an extension of adjacent industrial zones, and will likely fit in with the amendment to the entire Valley. The following criteria should be the basis of establishing such a line. a. location of environmentally sensitive areas b. desired density for future development; d. efficient utilization of urban infrastructure, such as sewer, water and roads f adopted plans and policies of the City and King County h. identification of community separator areas Analysis: The boundaries and designations proposed for Area 1 (May Valley) and Area 3 (Jones Rd.)reflect existing sensitive areas. An estimated 1,184 potential dwelling units, all single family, could be added to the capacity of the urban designations. Urban infrastructure is available in areas 1, 2, 3 and 6. The 4 to 1 program is part of the adopted King County policies. While Areas 4, 5, and 6 are not designated community separators, dedicated open space will be created through the 4 to 1 program. CONCLUSION: Staff recommends approval of the adjusted boundaries. The Area 1 boundary change applies to the west portion only as it effects Renton. Staff also recommends land use designations within the new areas be the same as the abutting Renton Comprehensive Plan designation. Maps of the proposed boundary changes are attached. SE 207th St • - - - — - - . i , AMENDMENT 5 - NE 44TH/EXIT 7 MAP AMENDMENT DESCRIPTION: This amendment re-considers the land use designation for properties at the NE 44th St./Exit 7 Interchange. This area is currently designated Center Suburban. Property owners of R-8 zoned areas to the south of the Center requested the City to amend the land use and zoning designations for their properties to commercial as part of the discussion. Both of these issues are combined in this City initiated amendment. These amendment will evaluate the Employment Area Commercial designation with Commercial Arterial zoning for both the existing commercial properties and a portion of the single family zone R-8 area immediately to the south. ISSUE SUMMARY 1. Whether Exit 7 is appropriately zoned for district scaled commercial uses at the present time, and whether other uses might do better in the existing market context. Such other uses might include multi-family residential uses and/or CA uses. 2. Whether the R-8 zoned properties lying between 36th Ave. and the existing Center boundary at 40th Ave should be re-designated for commercial use. 3. Whether higher intensity residential options are viable for the area south of NE 40th. RECOMMENDATION SUMMARY: 1. The Planning Commission recommends adoption of the Employment Area Commercial designation with Commercial Arterial zoning to replace the existing CS designation. Staff concurs in this recommendation. 2. The Planning Commission recommends that the request for commercial re-designation of the residential area south of N. E. 40th be denied and that this area remain R-8. Staff concurs in this recommendation. ANALYSIS: 1. Appropriateness of Existing Center Suburban Designation: Typically Centers draw populations from approximately one half [1/2] mile surrounding the development. In the case of this Center, however, the surrounding population base within the one half mile radius is fairly low density. This level of development is determined more by geographical • constraints than land use policy. The Center is isolated from the surrounding area, in that it sets next to Lake Washington,to the west, and below the East Renton Plateau to the east and south. This isolation creates potential service area problems for businesses offering community oriented goods and services which support a residential population. Staff concluded that these location and geographic constraints to limit the ability of the existing center to support such uses. Changing the existing designation of CS to the more diverse, regionally oriented designation, CA,would allow a more intense auto oriented style of development. The CA designation will allow the market a greater amount of flexibility in the type,amount and location of development around Exit 7. In terms of style, character, and location of development, the existing Center is very auto oriented. It is unlikely that the existing pattern of development will change to a more pedestrian and community oriented pattern in the near future. A major change in development patterns(i.e. style) might occur with the P&DMap5/ buildout of the Port Quendall site on the opposite side of I-405. Given the existing pattern of development,the vehicular access to the I-405 corridor, and the lack of a viable residential service area, an Employment Area Commercial designation seems more appropriate than the current CS designation. 2. Request for expansion of the commercial designation to the south. The impetus for review of this area came from a request to amend the zoning for four[4] parcels south of the Center for extension of the CS zone. The analysis was then broadened to encompass the remaining parcels south the existing Center. The study area was determined to have many environmental constraints(i.e. wetlands, greenbelt, floodplain, shoreline) that control the extent of development in the existing Center. The conclusion based upon the evidence of this analysis is that the land in the study area could not support such an intensive or extensive types of development like either the CS or the CA. In addition, staff found that land within the existing commercial center is underutilized. Vacant parcels exist, and several of the existing uses are light industrial, and warehousing or other uses which are non conforming under either the SC or CA designation. A more intensive land use and zoning in the area seems inappropriate based upon both the intensity of existing development and the environmental capacity of the land. 3. Alternative Residential Designations As an alternative to the existing R-8 designation, staff evaluated the possibility of allowing more intensive residential uses in this area. Initial staff recommendations supported an Residential Options Land Use designation with R-14 zoning for this area. However, the R-14 designation requires a land area of 20 acres. The area south of N. E. 40th is too small by itself to support this designation. Staff evaluated re-zoning existing underutilized and vacant commercial properties into a new proposed R-14 designation and made a preliminary proposal to the Planning Commission. There is sufficient land(+34 acres) to designate the study area R 14 if commercial properties were included. However, property owners did not support this idea, and testimony at the public hearing opposed any downzoning of commercial properties. CAPACITY ANALYSIS Staff analyzed the potential change in capacity from a CS to CA designation, and the potential change in capacity with a re-zone to R-14 of the residential area to the south. The existing Center is significantly under potential capacity. The current housing capacity for the area is approximately 24% of the projected capacity for the Center by the year 2010. The total number of jobs forecast for 2010 are only at 15%of projected capacity. Current uses would have to be redeveloped in order to increase the densities to the projected levels in 2010. There are approximately 17-25 acres in vacant or partially developed land left in the existing Center. A change in land use from CS to CA and from CS to R-14 would result in a five percent change in the overall capacity. If the proposed boundary adjustment were to occur in the south end of the center, a net gain of 100-173 units is possible with the formation of the R-14 zone. The proposed R-14 rezone would eliminate some capacity and jobs from the existing Center. P&DMap5/ COMPREHENSIVE PLAN COMPLIANCE: Employment Area- Commercial The EAC designation is designed to ensure that Renton will have adequate reserves of land as one tool in its economic development efforts. The EAC designation is appropriate for land with high visibility and access for large volumes of automobile traffic. This concept fits the current development pattern in the existing Center, as illustrated with the following policies: Objective LU-AA: Provide for commercial and residential uses requiring large amounts of land and/or high visibility and access to large volumes of automobile traffic in areas outside of Centers and the Center Downtown designations. Policy LU-168. Employment Area - Commercial designations should only be located on, and have access to, streets classified as major arterials or above. Policy LU-171. Residential uses in the Employment Area - Commercial designation may be a single use development and should be limited to a maximum density of 20 du/acre. Policy LU-176. Increased demand for commercial uses should be accommodated through redevelopment and intensification of Employment Area - Commercial designations rather than expansion of those areas. Policy LU-177. Special design considerations (e.g. landscape, streetscape, signage, building design) should be encouraged for areas which are designated as gateways for the city. Economic development policies ED-9 and ED-11, pertaining to responsible economic development and adequacy of land availability for commercial/retail development, also support the redesignation of CA in lieu of CS. Policy ED-9. Adopt land use and zoning that is supportive of responsible economic development. Policy ED-11. Ensure an adequate amount of land is designated for retail/commercial uses based on site characteristics,market demand, community need, and adequacy of facilities and services. CONCLUSION: The Planning Commission and staff concur that the present Center Suburban designation for this area does not fit the N. E. 44th St/Exit 7 area. The Employment Area Commercial designation appears to be more appropriate for this area given both the existing use patterns and the potential of future development in the area. While staff would like to see some more intensive residential use allowed for the property to the south of the commercial area, the expansion of the commercial designation into the area is not supported. After review of public testimony and review of environmental issues in the area the Planning Commission felt that the R-14 option for this area was also not viable. Staff concurs in the final recommendation for retaining R-8 south of NE 40th Ave. P&DMap5/ I .. 111� � h S:.
