The applicant requests an exemption from Critical Areas Regulations per RMC
4-3-050.C.5.a.iii and RMC4-3-050.C.5.c.iii) in order to remove dead and/or
diseased poplar trees located within the 35-foot wide buffer along a Class 4
stream (Kennydale Creek). The trees were assessed by City of Renton Code
Compliance and the City's Arborist/Urban Forester, with permission to remove
the trees granted via email on April 23, 2014 (email from Donna Locher in Code
Compliance). As the trees are located in a Critical Area Buffer, an exemption
from Critical Areas Regulations is required.
As part of the effort to remove the dead and diseased trees, a number of
cottonwood trees were also removed within the stream buffer. The applicant
was required to provide a restoration plan that provided for replacement ofthe
function and value lost when the other trees were removed. The restoration
plan includes keeping 9 down logs with a minimum length of 15 feet; retaining
the poplar tree stumps intact and felling the poplars as high as possible for
habitat; planting trees and shrubs. The planting plan requires that trees be
planted with 15-foot on-center spacing, and that minimum 2-gallon sizes be
planted. The plant schedule includes 9 Vine Maple (multi-stemmed), 7 Oregon
Ash (single trunk), 6 Western Crabapple (single stem), 9 Sitka Spruce (full and
bushy), and 4 Western Red Cedar (full and bushy). The plant schedule also
includes 53 Black Twin-Berry (1-gallon minimum, multi-stem), 16 Pacific
Ninebark (1-gallon minimum, multi-stem), 40 Clustered Rose (1-gallon
minimum, multi-stem), 72 Scouler Willow (4' cutting, 1/2" diameter, bark intact
and 44 Snowberry (1-gallon minimum, multi-stem).
Installation of the restoration requires a Critical Areas Exemption per RMC
4-3-050.C.5.a.iii which allows for buffer restoration for Class 2-4 streams with

an approved restoration plan.
CRITICAL AREA:
EXEMPTION JUSTIFICATION: RMC 4-3-050.C.5.a.iii: Approved Restoration/Mitigation: Any critical area
and/or buffer restoration or other mitigation activities which have been approved by the City.
and
RMC 4-3-050.C.5.b.iii: Dead or Diseased Trees: Removal of dead, terminally
diseased, damaged, or dangerous ground cover or hazard trees which have been certified as such by a
forester, registered landscape architect, or certified arborist, selection of which to be approved by the City
based on the type of information required, or the City prior to their removal.
FINDINGS: The proposed development is consistent with the following findings pursuant to
RMC section 4-3-050C.5:
1. The activity is not prohibited by this or any other chapter of the RMC or state or federal law or regulation.
2. The activity will be conducted using best management practices as specified by industry standards or
applicable Federal agencies or scientific principles if submitted plans are followed and the conditions of
approval of this exemption are met.
3. Impacts will be minimized and disturbed areas will be immediately restored, if submitted plans are followed
and the conditions of approval of this exemption are met.
4. Where wetland or buffer disturbance occurs during construction or other activities in accordance with this
exemption, the site will be revegetated with native vegetation as required as a condition of approval for this
exemption.

CONDITIONS:
An exemption from the Critical Areas Regulations is hereby Approved with
The applicant shall maintain the restored area per the annual maintenance
schedule shown on the approved restoration plan.
An inspection of the planting installation is required. Please contact the project
manager to schedule the inspection. (Jennifer Henning, 425-430-7286)
The applicant shall follow the specifications within the approved buffer
restoration plan, including installation of the trees and shrubs between
December 1, 2014 and April 30, 2015.
A maintenance surety device is required to be provided to City of Renton. The
surety device will be held for 5 years and can be released at the conclusion of 5
years if the planting installation is performing to acceptable standards. Survival
of at least 80% of the plantings is required.

The above land use decision will become final if the decision is not appealed within the 14-day appeal
period (RCW 43.21.C.07S(3); WAC 197-11-680).
APPEALS: An appeal of this administrative land use decision must be filed in writing together with the
required fee to the City of Renton Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA
980S7, on or before S:00 p.m., on December 09, 2014. RMC 4-8-110 governs appeals to the Hearing
Examiner and additional information regarding the appeal process may be obtained from the Renton City
Clerk's Office, (425) 430-6510.
RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be
reopened by the approval body. The approval body may modify his decision if material evidence not readily
discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After
review of the reconsideration request, if the approval body finds sufficient evidence to amend the original
decision, there will be no further extension of the appeal period. Any person wishing to take further action
must file a formal appeal within the 14-day appeal time frame.
EXPIRATION: Five (5) years from the date of decision (date signed).

endangering lives & property, downed cottonwood trees (8).
Process of tree removal
Drop Zone area cleared of downed trees.
Trees will be attached with a chain to a tractor and tractor will drag tree out of NGPE.
Tractor will operate outside the NGPE.
Limb and debris will be removed by hand out of NGPE.
A lift will be used to place rope on standing dead dangerous trees to help secure tree to drop in
drop area. The lift will enter the NGPE for securing rope.
The dead and dangerous trees will be dropped and then removed in same manner, chained and
pulled out by tractor operating outside of the NGPE.
Limb and debris will be removed by hand out of NGPE.
Fencing and signage will be re-installed.
