Bridge connecting Riverview Park to Maplewood Roadside Park
The applicant is requesting a shoreline exemption to repair the historic train
trestle bridge that crosses the Cedar River at Maplewood Roadside Park,
zoned Resource Conservation (RC). The bridge is a part of a regional
non-motorized trail system, that extends from the boundary of the City of
Seattle's Cedar River Watershed, to the mouth of the Cedar River at Lake
Washington. The bridge is located approximately 40 feet above the OHWM, at
the point where it crosses the Cedar River, and at some locations close to 90
feet above the OHWM. The bridge crosses the river in Reach C which has two
shoreline designations. The north bank is designated Shoreline High Intensity
and the south bank is designated Urban Conservancy. A structural review is
completed for the bridge every three years. In 2014 the engineer found that
the exposed transverse deck timbers that support the concrete trail were
showing deterioration at their ends due to water dripping from the trail above
The engineer recommended that the ends be trimmed and galvanized flashing
be attached for protection. No work would be performed below the OHWM or
on the banks of the river. No trees and/or vegetation would be removed as a
result of the maintenance work. The applicant has obtained an HPA for the
proposed work, which incudes a number of conditions. Staff recommends a
condition be added to the subject project requiring the applicant to comply
with all the conditions of the HPA.

An exemption from a Shoreline Management Substantial Development Permit is hereby Approved with
Conditions* on the proposed project in accordance with RMC 4.9.190C 'Exemption from Permit System' and
for the following reasons:
a. "Normal maintenance" includes those usual acts to prevent a decline, lapse, or cessation from a
lawfully established condition.
b. "Normal repair" means to restore a development to a state comparable to its original condition,
including but not limited to its size, shape, configuration, location and external appearance, within a
reasonable period after decay or partial destruction, except where repair causes substantial adverse effects
to the shoreline resource or environment.
c. Replacement of a structure or development may be authorized as repair where, such replacement is the
common method of repair for the type of structure or development, and the replacement structure or
development is comparable to the original structure or development including, but not limited to, its size,
shape, configuration, location and external appearance and the replacement does not cause substantial
adverse effects to shoreline resources or environment and for the following reasons :
The proposed development is:
Consistent with the policies ofthe Shoreline Management Act.
Not Applicable to the guidelines of the Department of Ecology where no Master Program has been finally
approved or adopted by the Department.
Consistent with the City of Renton Shoreline Master Program.
CONDITIONS: Administrative Decision Condition
The applicant shall comply with all the conditions of the Hydraulic Project
Approval, issued April 1, 2015.

Project Name: Cedar River Trail -Trestle Bridge Repair
Project Description: A structural report on the trestle bridge over the Cedar River stated that the city should
remove the ends of exposed wood beams supporting the concrete trail surface by cutting
them back about two inches, then installing a galvanized flashing over the cut ends, to protect
them from the elements. Where the work is near or over the Cedar River, a diapering system
for protection will be used.
PROVISIONS
1. The project may begin immediately and shall be completed by March 31, 2020, provided over water work (i.e.,
modification of the bridge superstructure) may occur at any time, but only in a manner to prevent materials which are
deleterious to fish life from entering state waters.
2. NOTIFICATION REQUIREMENT: The Area Habitat Biologist (AHB) listed below (e-mail to fisheldf@dfw.wa.gov) and
the Enforcement Program Officer (e-mail to capeljlc@dfw.wa.gov) shall receive e-mail notification from the person to
whom this Hydraulic Project Approval (HPA) is issued (penmittee or authorized agent) no less than three working days
prior to start of work and again within seven days of completion of work to arrange a compliance inspection. The
notification shall include the penmittee's name, project location, starting date of work or completion date of work, and
the penmit number of this HPA.
3. Work shall be accomplished per plans and specifications approved by the Washington Department of Fish and
Wildlife (WDFW) entitled, "2013 Inspection Report Cedar River Railroad Bridge Inspection", dated January 2014,
except as modified by this HPA. A copy of these plans and the HPA shall be available on site
during construction.
4. Removal of bridge structural components shall be accomplished by mechanical means.
5. A containment system shall be deployed and maintained in a functional manner to collect any debris generated
during the bridge rehabilitation work. Removal of the existing structures shall be accomplished so the structures and
associated materials do not enter the river. Materials shall be disposed of so they will not enter the river.
6. All waste material such as construction debris, silt, excess dirt or overburden, and soils containment and absorbent
materials resulting from this project shall be deposited above the limits of floodwater in an approved upland disposal
site.

7. Disturbance of the riverbed and banks and their associated vegetation shall be limited to that necessary to perform
the project. Affected streambed and bank areas shall be restored to pre-project or improved habitat configuration. Prior
to December 31 of the year of project construction, any areas of disturbed woody vegetation shall be replanted with
native riparian species approved by the AHB. Plantings shall be maintained as necessary for at least three years to
ensure a minimum 80 percent survival of each species or a contingency species approved by the AHB and shall not be
trimmed or removed without WDFW approval.
8. Equipment used for this project shall be free of external petroleum-based products while working around the river
and wetlands associated with the river. Accumulation of soils or debris shall be removed from the drive mechanisms
(wheels, tires, tracks, etc.) and undercarriage of equipment prior to its working below the ordinary high water line
(OHWL). Equipment shall be checked daily for leaks and any necessary repairs shall be completed prior to
commencing work activities along the river and wetlands associated with the river.
9. Extreme care shall be taken to ensure that no petroleum products, hydraulic fluid, fresh cement, sediments,
sediment-laden water, chemicals, or any other toxic or deleterious materials are allowed to enter or leach into state
waters.
10. If at any time, as a result of project activities, fish are observed in distress, a fish kill occurs, or water quality
problems develop (including equipment leaks or spills), immediate notification shall be made to the Washington
Emergency Management Division at 1-800-258-5990, and to the AHB.

(s) to whom this Hydraulic Project Approval is issued and operator(s) performing the work.
This Hydraulic Project Approval does not authorize trespass.
The person(s) to whom this Hydraulic Project Approval is issued and operator(s) performing the work may be held liable
for any loss or damage to fish life or fish habitat that results from failure to comply with the provisions of this Hydraulic
Project Approval.
Failure to comply with the provisions of this Hydraulic Project Approval could result in a civil penalty of up to one
hundred dollars per day and/or a gross misdemeanor charge, possibly punishable by fine and/or imprisonment.
All Hydraulic Project Approvals issued under RCW 77.55.021 are subject to additional restrictions, conditions, or
revocation if the Department of Fish and Wildlife determines that changed conditions require such action. The person(s)
to whom this Hydraulic Project Approval is issued has the right to appeal those decisions. Procedures for filing appeals
are listed below.
MINOR MODIFICATIONS TO THIS HPA: You may request approval of minor modifications to the required work timing
or to the plans and specifications approved in this HPA. Any approved minor modification will require issuance of a letter
documenting the approval. A minor modification to the required work timing means any change to the work start or end
dates of the current work season to enable project or work phase completion. Minor modifications will be approved only
if spawning or incubating fish are not present within the vicinity of the project. You may request subsequent minor
modifications to the required work timing. A minor modification of the plans and specifications means any changes in the
materials, characteristics or construction of your project that does not alter the project's impact to fish life or habitat and
does not require a change in the provisions of the HPA to mitigate the impacts of the modification. Minor modifications
do not require you to pay additional application fees or be issued a new HPA. If you originally applied for your HPA
through the online Aquatic Protection Permitting System (APPS), you may request a minor modification through APPS.
A link to APPS is at http://wdfw.wa.gov/licensing/hpa/. If you do not use APPS you must submit a written request that
clearly indicates you are seeking a minor modification to an existing HPA. Written requests must include the name of the
applicant, the name of the authorized agent if one is acting for the applicant, the control number of the HPA, the date
issued, the permitting biologist, the requested changes to the HPA, the reason for the requested change, the date of the
request, and the requester's signature. Send by mail to: Washington Department of Fish and Wildlife, PO Box 43234,

MAJOR MODIFICATIONS TO THIS HPA: You may request approval of major modifications to any aspect of your HPA.
Any approved change other than a minor modification to your HPA will require issuance of a new HPA. If you paid an
application fee for your original HPA you must pay an additional $150 for the major modification. If you did not pay an
application fee for the original HPA, no fee is required for a change to it. If you originally applied for your HPA through

APPEALS INFORMATION
If you wish to appeal the issuance, denial, conditioning, or modification of a Hydraulic Project Approval (HPA),
Washington Department of Fish and Wildlife 0/VDFW) recommends that you first contact the department employee who
issued or denied the HPA to discuss your concerns. Such a discussion may resolve your concerns without the need for
further appeal action. If you proceed with an appeal, you may request an informal or formal appeal. WDFW encourages
you to take advantage of the informal appeal process before initiating a formal appeal. The informal appeal process
includes a review by department management of the HPA or denial and often resolves issues faster and with less legal
complexity than the formal appeal process. If the informal appeal process does not resolve your concerns, you may
advance your appeal to the formal process. You may contact the HPA Appeals Coordinator at (360) 902-2534 for more
information.
A. INFORMAL APPEALS: WAC 220-110-340 is the rule describing how to request an informal appeal of WDFW actions
taken under Chapter 77.55 RCW. Please refer to that rule for complete informal appeal procedures. The following
information summarizes that rule.
A person who is aggrieved by the issuance, denial, conditioning, or modification of an HPA may request an informal
appeal of that action. You must send your request to WDFW by mail to the Washington Department of Fish and Wildlife
HPA Appeals Coordinator, 600 Capitol Way North, Olympia, Washington 98501-1091; e-mail to
HPAapplications@dfw.wa.gov; fax to (360) 902-2946; or hand-delivery to the Natural Resources Building, 1111
Washington St SE, Habitat Program, Fifth floor. WDFW must receive your request within 30 days from the date you
receive notice of the decision. If you agree, and you applied for the HPA, resolution of the appeal may be facilitated
through an informal conference with the WDFW employee responsible for the decision and a supervisor. If a resolution
is not reached through the informal conference, or you are not the person who applied for the HPA, the HPA Appeals
Coordinator or designee will conduct an informal hearing and recommend a decision to the Director or designee. If you
are not satisfied with the results of the informal appeal, you may file a request for a formal appeal.

Project Description: The Cedar River Trail crosses the Cedar River at Maplewood
Roadside Park over the historic train trestle and bridge. Structural reviews are
completed every three years of the wood and steel trestle and bridge. In 2014, the
engineer found that exposed transverse deck timbers that support the precast concrete
trail were showing deterioration at their ends due to water dripping from the trail
above. The engineer recommended that the ends be trimmed, and galvanized flashing
be attached for protection. This work is being proposed by Community Services.
The Cedar River Trail is a non-motorized trail that follows an historic railroad route along
the Cedar River from where it enters Lake Washington in Renton, upriver for over 17
miles to the community of Landsburg at the boundary of the City of Seattle's Cedar River
Watershed.
This project type is considered to be normal maintenance or repair of existing structures
or developments. The property is owned by WSDOT, which allows the City to maintain
the trail (see attached WSDOT letter dated April 7, 1994).
Work is anticipated to occur between late April 2015 and late May 2015. A Hydraulic
Project Approval from the Washington Department of Fish and Wildlife has been
obtained (see attached HPA No. 2015-199-+01).
The trestle bridge is approximately 40 feet above the point where it crosses the Cedar
River, and is never more than 90 feet from the ordinary high water mark of the
shoreline. No part of the trestle bridge is being lowered for this project, nor will the
work allow anything to touch the river banks. No fill will be a part of this project, and
there will be no impact to existing trees.
The total construction cost for this project is approximately $90,000.00

Project Description: The Cedar River Trail crosses the Cedar River at Maplewood
Roadside Park over the historic train trestle and bridge. Structural reviews are
completed every three years of the wood and steel trestle and bridge. In 2014, the
engineer found that exposed transverse deck timbers that support the precast concrete
trail were showing deterioration at their ends due to water dripping from the trail
above. The engineer recommended that the ends be trimmed, and galvanized flashing
be attached for protection. This work is being proposed by Community Services.
The Cedar River Trail is a non-motorized trail that follows an historic railroad route along
the Cedar River from where it enters Lake Washington in Renton, upriver for over 17
miles to the community of Landsburg at the boundary of the City of Seattle's Cedar River
Watershed.
This project type is considered to be normal maintenance or repair of existing structures
or developments. The property is owned by WSDOT, which allows the City to maintain
the trail (see attached WSDOT letter dated April 7, 1994).
Work is anticipated to occur between late April 2015 and late May 2015. A Hydraulic
Project Approval from the Washington Department of Fish and Wildlife has been
obtained (see attached HPA No. 2015-199-+01).
The trestle bridge is approximately 40 feet above the point where it crosses the Cedar
River, and is never more than 90 feet from the ordinary high water mark of the
shoreline. No part of the trestle bridge is being lowered for this project, nor will the
work allow anything to touch the river banks. No fill will be a part of this project, and
there will be no impact to existing trees.
The total construction cost for this project is approximately $90,000.00

Project Name: Cedar River Trail -Trestle Bridge Repair
Project Description: A structural report on the trestle bridge over the Cedar River stated that the city should
remove the ends of exposed wood beams supporting the concrete trail surface by cutting
them back about two inches, then installing a galvanized flashing over the cut ends, to protect
them from the elements. Where the work is near or over the Cedar River, a diapering system
for protection will be used.
PROVISIONS
1. The project may begin immediately and shall be completed by March 31, 2020, provided over water work (i.e.,
modification of the bridge superstructure) may occur at any time, but only in a manner to prevent materials which are
deleterious to fish life from entering state waters.
2. NOTIFICATION REQUIREMENT: The Area Habitat Biologist (AHB) listed below (e-mail to fisheldf@dfw.wa.gov) and
the Enforcement Program Officer (e-mail to capeljlc@dfw.wa.gov) shall receive e-mail notification from the person to
whom this Hydraulic Project Approval (HPA) is issued (permittee or authorized agent) no less than three working days
prior to start of work and again within seven days of completion of work to arrange a compliance inspection. The
notification shall include the permittee's name, project location, starting date of work or completion date of work, and
the permit number of this HPA. ·
3. Work shall be accomplished per plans and specifications approved by the Washington Department of Fish and
Wildlife (WDFW) entitled, "2013 Inspection Report Cedar River Railroad Bridge Inspection", dated January 2014,
except as modified by this HPA. A copy of these plans and the HPA shall be available on site
during construction.
4. Removal of bridge structural components shall be accomplished by mechanical means.
5. A containment system shall be deployed and maintained in a functional manner to collect any debris generated
during the bridge rehabilitation work. Removal of the existing structures shall be accomplished so the structures and
associated materials do not enter the river. Materials shall be disposed of so they will not enter the river.
6. All waste material such as construction debris, silt, excess dirt or overburden, and soils containment and absorbent
materials resulting from this project shall be deposited above the limits of floodwater in an approved upland disposal
site.

7. Disturbance of the riverbed and banks and their associated vegetation shall be limited to that necessary to perform
the project. Affected streambed and bank areas shall be restored to pre-project or improved habitat configuration. Prior
to December 31 of the year of project construction, any areas of disturbed woody vegetation shall be replanted with
native riparian species approved by the AHB. Plantings shall be maintained as necessary for at least three years to
ensure a minimum 80 percent survival of each species or a contingency species approved by the AHB and shall not be
trimmed or removed without WDFW approval.
8. Equipment used for this project shall be free of external petroleum-based products while working around the river
and wetlands associated with the river. Accumulation of soils or debris shall be removed from the drive mechanisms
(wheels, tires, tracks, etc.) and undercarriage of equipment prior to its working below the ordinary high water line
(OHWL). Equipment shall be checked daily for leaks and any necessary repairs shall be completed prior to
commencing work activities along the river and wetlands associated with the river.
9. Extreme care shall be taken to ensure that no petroleum products, hydraulic fluid, fresh cement, sediments,
sediment-laden water, chemicals, or any other toxic or deleterious materials are allowed to enter or leach into state
waters.
10. If at any time, as a result of project activities, fish are observed in distress, a fish kill occurs, or water quality
problems develop (including equipment leaks or spills), immediate notification shall be made to the Washington
Emergency Management Division at 1-800-258-5990, and to the AHB.

documenting the approval. A minor modification to the required work timing means any change to the work start or end
dates of the current work season to enable project or work phase completion. Minor modifications will be approved only
if spawning or incubating fish are not present within the vicinity of the project. You may request subsequent minor
modifications to the required work timing. A minor modification of the plans and specifications means any changes in the
materials, characteristics or construction of your project that does not alter the project's impact to fish life or habitat and
does not require a change in the provisions of the HPA to mitigate the impacts of the modification. Minor modifications
do not require you to pay additional application fees or be issued a new HPA. If you originally applied for your HPA
through the on line Aquatic Protection Permitting System (APPS), you may request a minor modification through APPS.

and any additional parcels the City may need for right of way certification extending back
to the mainline track for the construction, maintenance, and access of the trail.
The location of the trail easement will be on the existing track bed of the railroad as
shown on the Exhibit Map ( enclosed). The location of the easement to be used for

Project Description: A structural report on the trestle bridge over the Cedar River stated that the city should
remove the ends of exposed wood beams supporting the concrete trail surface by cutting
them back about two inches, then installing a galvanized flashing over the cut ends, to protect
them from the elements. Where the work is near or over the Cedar River, a diapering system
for protection will be used.
PROVISIONS
1. The project may begin immediately and shall be completed by March 31, 2020, provided over water work (i.e.,
modification of the bridge superstructure) may occur at any time, but only in a manner to prevent materials which are
deleterious to fish life from entering state waters.
2. NOTIFICATION REQUIREMENT: The Area Habitat Biologist (AHB) listed below (e-mail to fisheldf@dfw.wa.gov) and
the Enforcement Program Officer (e-mail to capeljlc@dfw.wa.gov) shall receive e-mail notification from the person to
whom this Hydraulic Project Approval (HPA) is issued (permittee or authorized agent) no less than three working days
prior to start of work and again within seven days of completion of work to arrange a compliance inspection. The
notification shall include the permittee's name, project location, starting date of work or completion date of work, and
the permit number of this HPA.
3. Work shall be accomplished per plans and specifications approved by the Washington Department of Fish and
Wildlife (WDFW) entitled, "2013 Inspection Report Cedar River Railroad Bridge Inspection", dated January 2014,
except as modified by this HPA. A copy of these plans and the HPA shall be available on site
during construction.
4. Removal of bridge structural components shall be accomplished by mechanical means.
5. A containment system shall be deployed and maintained in a functional manner to collect any debris generated
during the bridge rehabilitation work. Removal of the existing structures shall be accomplished so the structures and
associated materials do not enter the river. Materials shall be disposed of so they will not enter the river.
6. All waste material such as construction debris, silt, excess dirt or overburden, and soils containment and absorbent
materials resulting from this project shall be deposited above the limits of floodwater in an approved upland disposal
site.

7. Disturbance of the riverbed and banks and their associated vegetation shall be limited to that necessary to perfomn
the project. Affected streambed and bank areas shall be restored to pre-project or improved habitat configuration. Prior
to December 31 of the year of project construction, any areas of disturbed woody vegetation shall be replanted with
native riparian species approved by the AHB. Plantings shall be maintained as necessary for at least three years to
ensure a minimum 80 percent survival of each species or a contingency species approved by the AHB and shall not be
trimmed or removed without WDFW approval.
8. Equipment used for this project shall be free of external petroleum-based products while working around the river
and wetlands associated with the river. Accumulation of soils or debris shall be removed from the drive mechanisms
(wheels, tires, tracks, etc.) and undercarriage of equipment prior to its working below the ordinary high water line
(OHWL). Equipment shall be checked daily for leaks and any necessary repairs shall be completed prior to
commencing work activities along the river and wetlands associated with the river.
9. Extreme care shall be taken to ensure that no petroleum products, hydraulic fluid, fresh cement, sediments,
sediment-laden water, chemicals, or any other toxic or deleterious materials are allowed to enter or leach into state
waters.
10. If at any time, as a result of project activities, fish are observed in distress, a fish kill occurs, or water quality
problems develop (including equipment leaks or spills), immediate notification shall be made to the Washington
Emergency Management Division at 1-800-258-5990, and to the AHB.

Project Name: Cedar River Trail -Trestle Bridge Repair
Project Description: A structural report on the trestle bridge over the Cedar River stated that the city should
remove the ends of exposed wood beams supporting the concrete trail surface by cutting
them back about two inches, then installing a galvanized flashing over the cut ends, to protect
them from the elements. Where the work is near or over the Cedar River, a diapering system
for protection will be used.
PROVISIONS
1. The project may begin immediately and shall be completed by March 31, 2020, provided over water work (i.e.,
modification of the bridge superstructure) may occur at any time, but only in a manner to prevent materials which are
deleterious to fish life from entering state waters.
2. NOTIFICATION REQUIREMENT: The Area Habitat Biologist (AHB) listed below (e-mail to fisheldf@dfw.wa.gov) and
the Enforcement Program Officer (e-mail to capeljlc@dfw.wa.gov) shall receive e-mail notification from the person to
whom this Hydraulic Project Approval (HPA) is issued (permittee or authorized agent) no less than three working days
prior to start of work and again within seven days of completion of work to arrange a compliance inspection. The
notification shall include the permittee's name, project location, starting date of work or completion date of work, and
the permit number of this HPA.
3. Work shall be accomplished per plans and specifications approved by the Washington Department of Fish and
Wildlife (WDFW) entitled, "2013 Inspection Report Cedar River Railroad Bridge Inspection", dated January 2014,
except as modified by this HPA. A copy of these plans and the HPA shall be available on site
during construction.
4. Removal of bridge structural components shall be accomplished by mechanical means.
5. A containment system shall be deployed and maintained in a functional manner to collect any debris generated
during the bridge rehabilitation work. Removal of the existing structures shall be accomplished so the structures and
associated materials do not enter the river. Materials shall be disposed of so they will not enter the river.
6. All waste material such as construction debris, silt, excess dirt or overburden, and soils containment and absorbent
materials resulting from this project shall be deposited above the limlts of floodwater in an approved upland disposal
site.

7. Disturbance of the riverbed and banks and their associated vegetation shall be limited to that necessary to perform
the project Affected streambed and bank areas shall be restored to pre-project or improved habitat configuration. Prior
to December 31 of the year of project construction, any areas of disturbed woody vegetation shall be replanted with
native riparian species approved by the AHB. Plantings shall be maintained as necessary for at least three years to
ensure a minimum 80 percent survival of each species or a contingency species approved by the AHB and shall not be
trimmed or removed without WDFW approval.
8. Equipment used for this project shall be free of external petroleum-based products while working around the river
and wetlands associated with the river. Accumulation of soils or debris shall be removed from the drive mechanisms
(wheels, tires, tracks, etc.) and undercarriage of equipment prior to its working below the ordinary high water line
(OHWL). Equipment shall be checked daily for leaks and any necessary repairs shall be completed prior to
commencing work activities along the river and wetlands associated with the river.
9. Extreme care shall be taken to ensure that no petroleum products, hydraulic fiuid, fresh cement, sediments,
sediment-laden water, chemicals, or any other toxic or deleterious materials are allowed to enter or leach into state
waters.
10. If at any time, as a result of project activities, fish are observed in distress, a fish kill occurs, or water quality
problems develop (including equipment leaks or spills), immediate notification shall be made to the Washington
Emergency Management Division at 1-800-258-5990, and to the AHB.

materials, characteristics or construction of your project that does not alter the project's impact to fish life or habitat and
does not require a change in the provisions of the HPA to mitigate the impacts of the modification. Minor modifications
