3. REPLACE ANY AND EVERY TREE LOST OR, IN THE OPINION OF THE OWNER'S
REPRESENTATIVE, IRREPARABLY DAMAGED AS A RESULT OF FAILURE OF THE
CONTRACTOR TO PROTECT OR TO ADEQUATELY MAINTAIN EXISTING TREES.
PROTECTED TREES WHICH FAIL FULLY TO FOLIATE LESS THAN 50% OF CANOPY IN
THE FIRST SPRING FOLLOWING COMPLETION OF CONSTRUCTION OPERATIONS WILL
BE PRESUMED LOST DUE TO CONSTRUCTION OPERATIONS.
4. THE CONTRACTOR SHALL GUARANTEE THAT ALL PROTECTED TREES SHALL LIVE
AND SHOW NO SIGNS OF DECLINE FOR A PERIOD OF ONE YEAR FROM FINAL
ACCEPTANCE. IN THE EVENT THAT AN EXISTING TREE FAILS TO SURVIVE FOR THE
ONE YEAR PERIOD, THE TREE SHALL BE REPLACE IN KIND WITH A HEALTHY TREE
FIFTY FEET (50') INDICATING THE WORDS, "NO TRESPASSING -PROTECTED
TREES," OR ON EACH SIDE OF THE FENCING IF LESS THAN FIFTY FEET (50'). 5.
SITE ACCESS TO INDIVIDUALLY PROTECTED TREES OR GROUPS OF TREES
AT A MINIMUM SIXTEEN FOOT HEIGHT, AT THE CONTRACTOR'S EXPENSE.
COMPLETELY REMOVE AND DISPOSE OF ANY TREE KILLED OR IRREPARABLY
DAMAGED AS A RESULT OF CONTRACTOR'S FAILURE TO PROTECT OR MAINTAIN SHALL BE FENCED AND SIGNED. INDIVIDUAL TREES SHALL BE FENCED ON
FOUR (4) SIDES. IN ADDITION, PROVIDE SUPERVISION WHENEVER EQUIPMENT
OR TRUCKS ARE MOVING NEAR TREES.
c. PROTECTION FROM GRADE CHANGES: IF THE GRADE LEVEL ADJOINING TO A
TREE TO BE RETAINED IS TO BE RAISED, CONSTRUCT A DRY ROCK WALL OR
ROCK WELL AROUND THE TREE. THE DIAMETER OF THIS WALL OR WELL
SHALL BE EQUAL TO THE TREE'S DRIP LINE.
d. RESTRICTIONS ON GRADING WITHIN THE DRIP LINES OF RETAINED TREES: THE
GRADE LEVEL AROUND ANY TREE TO BE RETAINED SHALL NOT BE LOWERED
WITHIN THE GREATER OF THE FOLLOWING AREAS:
d.1. THE AREA DEFINED BY THE DRIP LINE OF THE TREE, OR
d.2. AN AREA AROUND THE TREE EQUAL TO ONE AND ONE-HALF FEET
( 1 -1 /2') IN DIAMETER FOR EACH ONE INCH ( 1 ") OF TREE CALIPER. A
LARGER TREE PROTECTION ZONE BASED ON TREE SIZE, SPECIES, SOIL,
OR OTHER CONDITIONS MAY BE REQUIRED.
e. MULCH LAYER REQUIRED: ALL AREAS WITHIN THE REQUIRED FENCING SHALL
BE COVERED COMPLETELY AND EVENLY WITH A MINIMUM OF THREE INCHES
(3") OF BARK MULCH PRIOR TO INSTALLATION OF THE PROTECTIVE FENCING.

6. IN THE EVENT A DAMAGED OR LOST TREE CANNOT BE REPLACED IN KIND,

a. A SUM EQUAL TO THE VALUE OF EACH LOST TREE AS DETERMINED BY THE
MOST CURRENT "GUIDE FOR ESTABLISHING VALUES OF TREES AND OTHER
PLANTS" BY THE COUNCIL OF TREE AND LANDSCAPE APPRAISERS, ISA, PLUS
AN AMOUNT OF $2,000.00 PER TREE IN COMPENSATION FOR THE EFFORTS
OF THE OWNER'S REPRESENTATIVE AND PROJECT ARBORIST IN ADMINISTERING
AND OVERSEEING THE REPLACEMENT; OR
b. A SUM OF $8,000.00, WHICHEVER IS LARGER.
7. LOCATE AND INSTALL REPLACEMENT TREES IN ACCORDANCE WITH THE
INSTRUCTIONS OF THE OWNER'S REPRESENTATIVE AND PROJECT ARBORIST.
8. IN THE EVENT OF INJURIES TO THE CROWN, TRUNK OR ROOT SYSTEM OF ANY
TREE TO REMAIN RESULTING FROM THE CONTRACTOR'S FAILURE TO PROTECT
AND/OR MAINTAIN SUCH TREE, THE OWNER'S REPRESENTATIVE MAY ELECT TO
RETAIN THE TREE AND HOLD THE CONTRACTOR LIABLE FOR COMPENSATION, THE
JUST VALUE OF WHICH IS DETERMINED BY THE "GUIDE FOR ESTABLISHING
VALUES OF TREES AND OTHER PLANTS" REFERENCED ABOVE.
9. GRUB STUMPS OF DEAD TREES TO THE FULL DEPTH OF THE ROOTS, AND
REPAIR THE GROUND SURFACE AS DIRECTED BY OWNER'S REPRESENTATIVE.
COSTS FOR STUMP REMOVAL SHALL BE BORNE BY THE CONTRACTOR.

10. ENSURE THAT EXISTING VEGETATION REMAINING ON THE PROJECT SITE SHALL BE
IN AS GOOD CONDITION AT COMPLETION OF THE WORK AS AT THE

COMPLETION OF THE WORK, THE CONTRACTOR WILL BE RESPONSIBLE TO
