AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON �
ANNEXING CERTAIN TERRITORY OF THE CITY OF RENTON
(LEE ANNEXATION; FILE NO A-00-002)
WHEREAS, under the provisions of RCW 35A.14.120 as amended, a petition in
writing requesting that certain territory contiguous to the City of Renton, as described below,
be annexed to the City of Renton, was presented and filed with the City Clerk on or about
October 19, 2000; and
. �
WHEREAS, prior to the filing and circulation of said petition for annexation to the
City of Renton, the petitioning owners notified the City Council of their intention to commence
such proceedings as provided by 1aw, as more particularly specified in RCW 35A.14.120, and
upon public hearing thereon, it ha�ing been determined and the petitioning owners having
agreed to assume the pre-e�sting bonded indebtedness of the City of Renton as it pertains to
the territory petitioned to be annexed; and to accept that portion of the City's Comprehensive
Plan as it pertains to the territory including the applicable Zoning Code relating thereto; and
WHEREAS, the King County Department of Assessments has examined and verified
the signatures on the petition for annexation and determined the assessed valuation of all the
properties, the same being in excess of sixty percent (60%) of the area to be annexed, in value,
as provided by law, and the petition aLso setting forth the legal description of the property
according to government legal subdivision or plat, and the Economic Development,
Neighborhoods and Strategic Planning Department of the City of Renton having considered
and recommended the annexing of said property to the City of Renton;and

WHEREAS, the City Council fixed April 23, 2001, as the time and place for public
hearing in the City Council Chambers, City Hall, Renton, Washington, upon the petition and
notice thereof having been given as provided by law;and
WIiEREAS, pursuant to said notices public hearings have been held at the time and
place specified in the notices, and the Council having considered all matters in connection with
the petition and further determined that all legal requirements and procedures of the law
applicable to the petition method for annexation have been met; and
WHEREAS, the King County Boundary Review Board having deemed the "Notice of
Intention" approved as of July 16, 2001;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON, DO ORDAIN AS FOLLOWS:
SECTION I. T'he findings, recitals, and determinations are hereby found to be
true and correct in all respects. All requirements of the law in regard to the annexation by
petition method, including the provisions of RCW 35A.14.120, 130, 140 and 150, have been
met. It is further deternuned that the petition for annexation to the City of Renton of the
property and territory described below is hereby approved and granted;the following described
property being contiguous to the City lirnits of the City of Renton is hereby annexed to the City
of Renton, and�such annexation to-be effective on and after the approval, passage, and
publication of this Ordinance; and on and after said date the property sha11 constitute a part of
the City of Renton and shall be subject to all its laws and ordinances then and thereafter in
force and effect;the property being described as follows:

and the owners-petitioners of the property shall assume the pre-e�sting bonded indebtedness
of the City of Renton as prescribed in RCW 35A.14.120 as it pertains to the property, and the
property to be subject to the City's Comprehensive Plan and Zoning Code.
SECTION II. T'his Ordinance sha11 be effective upon its passage, approval, and
five days after its publication.
A certified copy of this Ordinance shall be filed with the King County Council, State of
Washington, and as otherwise provided by law.

That portion of the Northeast Quarter of Section 10, Township 23 North, Range 5 East, W.M., in King
County,Washington described as follows:
BEGINNING at the intersection of the easterly right-of-way line of Hoquiam Avenue NE(142nd Ave SE),
and the north line of the south half of the south half of the southeast quarter of the northwest quarter of
said northeast quarter, being a point on the City Limits of Renton as annexed by Ordinance 4819, thence
easterly along said north line to an intersection with the easterly line of west half of said northeast quarter;
Thence southerly along said east line, to an intersection with the south line of the northeast quarter of the

WELCOME TO THE CITY OF RENTON! We are proud of our City and glad you have joined us as part of the Lee
annexation. Effective October 24, 2001, your property/residence is officially annexed to the City of Renton, a
community strong in tradition and spirit. We hope you enjoy the many features that put Renton ahead of the curve —
beautiful parks, safe streets, a growing downtown, and a great quality of life.
While Renton's rich history stretches back to the 1850's, it officially became a city in 1901 and is celebrating its 100"'
birthday this year. As a full service and financially sound community, the city offers outstanding police and fire
protection, superior street maintenance, and our own supply of water that comes from an underground aquifer. In
addition, as a Renton resident you can enjoy the benefits of a central location, attractive parks, abundant recreational
opportunities, great neighborhood programs, a public library, and the presence of major employers such as The Boeing
Company, PACCAR, and many new emerging hi-tech firms.
We hope you will take full advantage of all Renton has to offer. Enjoy the natural beauty of the Cedar River Trail, spend
a relaxing afternoon at Gene Coulon Memorial Beach Park on the shores of Lake Washington, or chase a golf ball around
Maplewood Golf Course. Take part in our exciting community events such as IKEA Renton River Days, Clam Lights,
and the Centennial festivities. We want you to be a part of our community!
Renton residents have several different choices when looking for information about city issues, events and activities. You
can read CitySource, our community newsletter published in the Renton Reporter, or check out the city's website,
www.ci.renton.wa.us, which is packed with useful information. Another option is Renton's government access channel,
Cable Channel 21, which offers a variety of civic-oriented programming, weekly City Council meetings, and notices
about upcoming events and activities. If you are interested in getting involved in the city, we offer a variety of
opportunities to serve on special boards, commissions, or committees, as well as other volunteer opportunities working
with kids or helping in the community.
We have built a solid foundation for the next century and are in an excellent position to respond to future needs, stay
ahead of the curve, and ensure that the city continues to be an outstanding place to live, work, and play. Please don't
hesitate to contact the City if we can do anything to make our home feel more like your home.
On more routine matters, your current solid waste hauler will continue to provide service for the next seven years. After
that, the City contractor will begin garbage collection in your neighborhood. Water District#90 will continue to provide
water service. If you have questions,please contact the Public Works Customer Service staff at 425-430-7200.
Enclosed you will find a letter with your new address (made necessary by this annexation and the need for your residence
address to follow a logical progression for emergency police and fire response), as well as a listing of City government
phone numbers for your convenience in getting answers to your questions or concerns. If you have questions, please do

NEW BUSINESS Reporting that King County Executive Ron Sims presented his budget to the
King County: Budget King County Council today, Councilwoman Keolker-Wheeler noted that the

Budget's$41 million deficit will affect Renton, especially in the area of child
care assistance. Councilwoman Nelson pointed out that Human Services
Manager Karen Bergsvik is investigating how the reduction in funding for the
child care subsidy program will affect Renton residents. Chief Administrative
Officer Jay Covington commented that Renton residents contribute over$10
million per year in taxes to King County, and every year,residents receive
fewer services from King County.

Renton.
We hereby advise the City Council of the City of Renton that it is our desire to commence
annexation proceedings under the provisions of RCW 35A.14.120 of all or any part of the area
described below.
The territory proposed to be annexed is within King County, Washington, and is contiguous to
the City of Renton. A map (Exhibit 1) and legal description (Exhibit 2) are included as part of
this petition.
The City Council is requested to set a date not later than sixty days after the filing of this request
for a public meeting with the undersigned.
1. At such meeting,the City Council will decide whether the City will accept, reject or
geographically modify the proposed annexation;
2. The City Council will decide whether to require simultaneous adoption of zoning
regulations; zoning to be determined after two public hearings and guided by the
City's Comprehensive Land Use Plan; and,
3. The City Council will decide whether to require the assumption of existing city
indebtedness by the area to be annexed.

LEE ANNEXATION - 10%NOTICE OF INTENT
PROJECT NARRATIVE
T'he City is in receipt of a Notice of Intent petition to request annexation of about 12 acres east of
Hoquiam Avenue NE. The annexation method is direct petition. The area immediately to the north
was annexed in 1999 as the Smith Annexation.
The subject area includes five single family homes on five lots that ranging from .9 to 5.3 acres. The
topography is generally flat. No hazard areas are shown in the City's Critical Areas maps.
At current development, the City would receive no additional public right-of-way with the proposed
annexation. The adjacent roadway, Hoquiam Avenue NE, is currently within the city limits.
The area is designated Residential Single Family in the Comprehensive Plan. Typical zoning within
the designation is R-8. Since the subject area is within one-half mile of the urban growth boundary, it
is eligible for R-5 zoning. Residential Manufactured Home Park is also a potential zone under the
Residential Single Family designation. Zoning will be addressed at later point in the process, after the
proponents have submitted a 60%Petition to Annex.
Upon receipt of comments from staff, a public meeting will be scheduled before the City Council to

moratorium and acknowledged that the pursuit of a business plan and the
zoning changes were compatible with one another and could proceed in tandem.
There being no further public comment, it was MOVED BY PARKER,

Responding to Councilman Parker's comments about the addition of the
proposed airport and airport related uses list to the IM zone,Councilman
Corman agreed that the list would provide protection for existing and future
airport tenants.
Annexation: Lee,R-8 Zoning This being the date set and proper notices having been posted and published in
accordance with local and State laws, Mayor Pro Tem Clawson opened the
public hearing to consider R-8 (Residential Single Family; eight dwelling units
per acre)zoning for the Lee Annexation; approximately 12 acres located east of
Hoquiam Ave. NE(142nd Ave. SE), north of NE 9th St. (if extended)and west
of 144th Ave. SE(if extended).
Owen Dennison, Senior Planner, stated that subsequent to the public hearing on
the 60% annexation petition on Apri123rd, the King County Boundary Review
Board approved the proposed annexation on July 16th. He explained that this
is the second of two required public hearings on the proposed zoning for the
annexation area. Describing the subject area,Mr. Dennison noted that the site
contains five single-family homes and a small wetland.
Continuing, Mr. Dennison indicated that the site is designated Residential
Single Family under Renton's Comprehensive Plan. Potential zones are R-5
(five dwelling units per acre), RMH(Residential Manufactured Home Park),
and R-8. He noted that R-8 zoning would allow for eight dwelling units per net
acre compared to the existing King County zoning of R-4 which equates to
approximately 7.1 units per net acre without constraints. Mr. Dennison
concluded that staff recommends approval of the annexation and adoption of R-
8 zoning as proposed which is consistent with the Comprehensive Land Use
Map.
Public comment was invited. There being none, it was MOVED BY
PERSSON, SECONDED BY NELSON,COUNCII.CLOSE THE PUBLIC

APPEALS Planning and Development Committee Chair Keolker-Wheeler presented a
Appeal: Vazquez report regarding the Vazquez variance appeal (V-01-048). The Committee
Administrative Variance, convened to consider the appeal of the decision of the Hearing Examiner dated
Windsor Way NE(V-01-048) May 4,2001. The subject property is located at 411 Windsor Way NE. The
applicant seeks an administrative variance from the required side yard setback
in the R-8 zone. The variance would allow the construction of a stairway from
the sidewalk to a second floor entrance.
The applicant appealed the decision of the Hearing Examiner upholding the
denial of the variance by City staff.
FINDINGS OF FACT
1. The lot has a unique topography, making construction of any structure a
challenge.

ISSIJE:
The City has accepted a 60%Petition to Annex for about 12 acres of residential land. (Figure 1,
Vicinity Map)With annexation,City of Renton zoning must supplant existing King County
zoning for the affected parcels.
RECOMI��NDATION:
Council approve R-8 zoning for the subject pazcels,consistent with the adopted Residential
Single Family Comprehensive Plan land use designation.
BACKGROUND SLTMMARY:
On Apri123,2001,the Council held combined public hearings on acceptance of the Petition to
Annex and on zoning proposed for the annexation. No public comment was offered. Following
the hearing,the Council accepted the Petition and authorized the Administration to submit a
Notice of Intention to the Boundary Review Board. The Board approved the proposed
annexation without review,effective July 16,2001.
The Council's last statutory requirement in the annexation and concurrent zoning process,prior to
adoption of the ordinances,is to hold a second and fmal public hearing on zoning for the subject
properties.
EXISTING CONDITIONS:
The site is adjacent to medium-density single family development on the west,within the city
limits,and to vacant and very low density single family development on the north, south and east.
(Figure 2,Existing Structures) The subject area includes five single family homes on lots ranging
from.9 to 5.3 acres.

Field observation and the City's mapped data suggest the presence of one wetland of less than
one-half acre. No other critical azeas have been identified. The topography is generally flat.
(Figure 3,Topography)
Existing zoning under King County is R-4. The R-4 Zone has a base density of four units per
gross acre. With density bonuses and transfer of density credits,the maximum density is six units
per gross acre. Six units per gross acre equates to about 7.1 units per net acre,assuming a road-
area requirement of about 15%of the original site.
The site is designated Residential Single Family. Typical implementing zoning is R-8. Other
potential zones include Residential Manufactured Home Park and,since the subject properties aze
within one-half mile of the Urban Growth Boundary,R-5. (Figure 4,Comprehensive Plan Land
Use Designations)
NSTIFICATION:
R-8 is proposed to supplant the existing King County R-4 zoning. Comments from City staff
noted no significant costs to the City and no significant environmental impacts that would result
from the application of the proposed R-8 zoning. R-8 is consistent with the adopted
Comprehensive Plan land use designation,and consistent with the intent of the Urban Growth
Area. No issues have been raised that would recoinmend lower densities. Further,no known
activities would be made nonconfornung as a result of the proposed change in zoning. R-8 is a
logical continuation of the same zoning to the north and west.
CONCLUSION:
The zoning and annexation ordinances are drafted and available for first reading following the
Public Hearing, unless the Council finds issues with the zoning proposal that recommend referral
to Committee.

ANNEXING CERTAIN TERRITORY OF THE CITY OF RENTON
(LEE ANNEXATION; FILE NO A-00-002)
. WHEREAS, under the provisions of RCW 35A.14.120 as amended, a petition in
writing requesting that certain territory contiguous to the City of Renton, as descnbed below,
be annexed to the City of Renton, was presented and filed with the City Clerk on or about
October 19,2000;and
WHEREAS, prior to the filing and circulation of said petition for annexation to the
City of Renton,the petitioning owners notified the City Council of their intention to commence
� such proceedings as provided by law, as more particularly specified in RCW 35A.14.120, and

� upon public hearing thereon, it having been determined and the petitioning owners ha.ving

� agreed to assume the pre-existing bonded indebtedness of the City of Renton as it pertains to

WHEREAS, under Section 4.2.020 of Chapter 2, Land Use Districts, of Title IV

SUMMARY OF ACTION:
On Apri123, 2001, the Council held Public Hearings on the 60°Io Petition to Annex and on proposed
zoning for the Lee Annexation. Following the Public Hearing, the Council accepted the Petition and
authorized the Administration to submit a Notice of Intention to the Boundary Review Board. The
Board approved the proposal, effective July 16, 2001.
The Board's approval releases the Council to conclude the annexation process. The last statutory
requirement in the annexation and concurrent zoning process, prior to adoption of the ordinances,is
to hold a second and final public hearing on zoning for the parcel to be annexed.

SUBJECT: Proposed Lee Annexation-Zoning
ISSIJE:
The City has accepted a 60°Io Petition to Annex for about 12 acres of residential land. (Figure l,
Vicinity Map)With annexation,City of Renton zoning must supplant e�sting King County
zoning for the affected parcels.
RECOMMENDATION:
Council approve R-8 zoning for the subject parcels,consistent with the adopted Residential
Single Family Comprehensive Plan land use designation.
BACKGROUND SUMMARY:
On Apri123, 2001,the Council held combined public hearings on acceptance of the Petition to
Annex and on zoning proposed for the annexation. No public comment was offered. Following
the hearing,the Council accepted the Petition and authorized the Administration to submit a
Notice of Intention to the Boundary Review Board. The Board approved the proposed
annexation without review,effective July 16,2001.
The Council's last statutory requirement in the annexation and concurrent zoning process,prior to
adoption of the ordinances,is to hold a second and final public hearing on zoning for the subject
properties.
EXISTING CONDITIONS:
The site is adjacent to medium-density single family development on the west, within the city
limits,and to vacant and very low density single family development on the north, south and east.
(Figure 2,Existing Structures) The subject area includes five single family homes on lots ranging
from.9 to 5.3 acres.

Field observation and the City's mapped data suggest the presence of one wetland of less than
one-half acre. No other critical areas have been identified. The topography is generally flat.
(Figure 3,Topography)
Existing zoning under King County is R-4. The R-4 Zone has a base density of four units per
gross acre. With density bonuses and transfer of density credits,the m�imum density is six units
per gross acre. Six units per gross acre equates to about 7.1 units per net acre,assuming a road-
area requirement of about 15% of the original site.
The site is designated Residential Single Family. Typical implementing zoning is R-8. Other
potential zones include Residential Manufactured Home Park and,since the subject properties are
within one-half mile of the Urban Growth Boundary,R-5. (Figure 4, Comprehensive Plan Land
Use Designations)
JUSTIFICATION:
R-8 is proposed to supplant the existing King County R-4 zoning. Comments from City staff
noted no significant costs to the City and no significant environmental impacts that would result
from the application of the proposed R-8 zoning. R-8 is consistent with the adopted
Comprehensive Plan land use designation,and consistent with the intent of the Urban Growth
Area. No issues have been raised that would recommend lower densities. Further,no known
activities would be made nonconfornung as a result of the proposed change in zoning. R-8 is a
logical continuation of the same zoning to the north and west.
CONCLUSION:
The zoning and annexation ordinances are drafted and available for first reading following the
Public Hearing, unless the Council finds issues with the zoning proposal that recommend referral
to Committee.

LEE ANNEXATION - 10%NOTICE OF INTENT
PROJECT NARRATIVE
The City is in receipt of a Notice of Intent petition to request annexation of about 12 acres east of
Hoquiam Avenue NE. The annexation method is direct petition. The area immediately to the north
was annexed in 1999 as the Smith Annexation.
The subject area includes five single family homes on five lots that ranging from .9 to 5.3 acres. The
topography is generally flat. No hazard areas are shown in the City's Critical Areas maps.
At current development, the City would receive no additional public right-of-way with the proposed
annexation. The adjacent roadway, Hoquiam Avenue NE, is currently within the city limits.
The area is designated Residential Single Family in the Comprehensive Plan. Typical zoning within
the designation is R-8. Since the subject area is within one-half mile of the urban growth boundary, it
is eligible for R-5 zoning. Residential Manufactured Home Park is also a potential zone under the
Residential Single Family designation. Zoning will be addressed at later point in the process, after the
proponents have submitted a 60%Petition to Annex.
Upon receipt of comments from staff, a public meeting will be scheduled before the City Council to
allow public comment on the proposed annexation. Additional lands may be added to the annexation
proposal if interest is expressed prior to or during the public meeting. If the Council amends the
annexation boundaries, staff comments on the modified proposal would be requested at the 60%
Petition phase of the annexation.
