MAPLEWOOD EAST ANNEXATION AND
ZOlvING PUBLIC HEARING
COUNCIL CONSIDERATION OF ANNEXATION
WITH R-4 ZONING
April 25,2005
The City has been notified that the Boundary Review Board approved the Maplewood East
Annexation on April 11, 2005. T'hose signing the petition agreed to accept new zoning
consistent with Renton's Comprehensive Plan Land Use Map as well as assume their fair share
of the City's existing outstanding indebtedness. Tonight public hearing is the second of two
required for rezoning the site from the County's R-4 zone to Renton's R-4 zone upon annexation.
As noted before,the site was one of three annexations that were vested with the density
provisions, lot size and minimum lot configuration provisions of the former R-5 zone that was
replaced with the R-4 zone, adopted by Council in November 2004.
The subject site is within the City's East Renton Plateau Potential Annexation Area and is
designated Residential Low Density (RLD)on the City's Comprehensive Plan Land Use Map.
King County has zoned it R-4 which allows up to 6 units per gross acre compared to a m�imum
of 4 units per net acre under Renton's R-4 zoning. Unlike the County zoning,which allows both
attached and detached units,Renton's new zoning only allows detached single-family dwelling
units. Pursuant to Council direction staff have prepared both R-4 zoning and annexation
ordinances for this annexation.
Recommendation:
The Administration is asking Council:
• To support R-4 zoning, at four units per net acre and consistent with the Comprehensive
Plan land use designation of Residential Low Density, on the subj ect site if it decides to
accept the subject annexation;
• To accept the Maplewood East Annexation and effectuate it with adoption of the
annexation ordinance and concurrently zone the subject site, excluding public streets,R-4
consistent with the Comprehensive Plan land use designation of Residential Low Density.

The City of Renton proposes the annexation of 26.14 acres, known as the Maplewood East Annexation.
This annexation was proposed under the 60% petition method), pursuant to RCW 35A.14. Renton City
Council adopted the petition for annexation in November of 2004.
The site is located on the east side of the City of Renton. The western boundary of the site abuts the
eastern boundary of the City of Renton at 152"d Avenue SE. The southern boundary of the Maplewood
East Annexation is generally formed by SE 136thd Street (SE 2"d Court.) The northern boundary is
generally formed by SE 134t''Street�f extended.) The eastern boundary is formed by 156th Avenue�E.
The unincorporated area is included in the "Annexafion Element"of the City of Renton Comprehensive
Plan and is located within the Renton Potential Annexation Area. The proposed action is consistent
with City of Renton Comp�ehensive Plan policies addressing annexation, including those provisions
which call for inclusion of urban areas within the City(e.g., LU-378—LU-380) and provision of senrices
to incorporated areas(e.g., LU-383; LU-386, LU-392).
The Maplewood East property owners are seeking annexation in order to develop properties under City
of Renton regulations and to receive public services (e.g.,sewer services)from Renton. Presently the
area includes approximately nine single-family residences. At full development,Maplewood East would
include a total of approximately 78 homes.
The City of Renton has planned for growth at this level of urban density and has established standards
to guide ongoing uses and new development on the Maplewood East properties following annexation.
Annexa6on would also permit protection for environmentally sensitive areas (e.g., storm watedflood
management). More specifically,the City of Renton is prepared to provide development review and
environmental review to the annexation area based upon local, regional and state regulations for
protection of environmentalfy sensitive areas.
The City of Renton can directly provide (or contract for) urban services to the area. For example, the
City of Renton would provide police services. The City will provide sewer service, storm water
management, and refuse collecfion. The City will con6nue to contract with Fire Protection District No.
25 to provide fire service and emergency senrice. King County Water District No. 90 will continue to
provide water senrice to the Maplewood East Annexafion Area.
Library facilities and recreation facilities would be available to the community. Children would attend
schools in Issaquah School District No.411 or Renton School District No.403.
The City of Renton reports that the proposed annexa6on conforms to the State Growth
Management Act (RCW 36.70A.) For example,the annexation is supported by RCW 36.7020,which
requires community planning goals, for urban growth, services and infrastructure, and environmental
preservation. Additionally, the application reportedly is consistent with RCW 36.70A.020 (1),
encouraging development in urban areas where there are adequate public services. It is also
consistent with RCW 36.70A.020 (12}, which calls for public services to support permitted
development. Annexation would also permit development of primary land uses and corollary
public services (e.g., roadways) envisioned in the Act. Environmentally sensitive areas would also
be preserved under the provisions of this annexation.

Further, the Mapiewood East Annexation is reported to be consistent with the King County
Comprehensive Plan. Following are examples of King County Comprehensive Plan/Countywide
Planning Policies that are addressed by the proposed Maplewood East Annexation:
FW-13:Cities are the appropriate providers of local urban services to Urban Areas.
LU-31: The County should identify urban development areas within the Urban Growth Area
LU-32: The County should encourage cities to annex territory within their designated potential
annexation area
LU-33: Land within a city's potential annexation area shall be developed according to local and
regional growth phasing plans
U-203: Population growth should be encouraged in Urban Grov,rth Areas
U-208: Land capacity shall be provided for residential,commercial and industrial growth
U-304: Growth should be focused within cdy boundaries.
The proposed Maplewood East Annexafion is reportedly consistent with the provisions of RCW 36.93
(Boundary Review Board Regulations). For example, this annexation would be consistent with
Objective 1, which calls for the preservation of neighborhoods. Tl�is area is linked to east Renton by
social fabric (e.g.,similar land uses and open spaces,shared sense of community) and by natural/built
geographic features (e.g., relatively flat to gentle sloping terrain). This annexation would also be
consistent with Objective 3, which calls for creation of logical senrice areas, and Objectives 4-7,which
call for the achievement of reasonable boundaries for a jurisdiction. Local residents have petitioned for
annexation in order that all services and land use regulations affecting their area may be efficiently
coordinated by a single local government unit. This annexation would also be consistent with Objective
8,which calls for inclusion of urban areas within municipalities.
The City of Renton has conducted fiscal analyses related to the proposed Maplewood East Annexation.
There are sufficient funds to serve the area. The addition of Maplewood East is not expected to have a
significant impact on cost and adequacy of senrices, finances, debt structure or rights of other
governmental units. Upon annexation, property owners will assume their share of the regular and
special levy rate of the City for capital facilities and public services. At full development, city
expenditures are estimated at $115,832 and revenues are estimated at $121,100. Future capital
needs and costs will be examined and funded through the Renton Capital Investment Program.
The City of Renton supports this annexation in order to serve cfizens of the area. New residential
development and coordinated services would benefit the greater Renton community.

The City of Renton proposes the annexation f 26.14 acres, known as the Maplewood Ea Annexation_
This annexation was proposed under the 60� petition method), pursuant to RCW 35A.1 . Renton City
Council adopted the petition for annexation n November of 2004.
The site is located on the east side of t e City of Renton. The western boundary of the site abuts the
eastern boundary of the City of Renton t 152"d Avenue SE. The southern bound ry of the Maplewood
East Annexation is generally formed by E 136thd Street (SE 2nd Court.) The northern boundary is
generally formed by SE 134�h Street('�f extended.) The eastern boundary is formed by 56th Avenue�E.
The unincorporated area is included in the "Annexafion Element"of the City of Renton Comprehensive
Plan and is located within the Renton Potential Annexation Area_ The proposed action is consistent
with City of Renton Comp�ehensive Plan policies addressing annexafion, including those provisions
which calf for inclusion of urban areas within the City(e.g., LU-378—LU-380) and provision of services
to incorporated areas(e.g.,LU-383; LU-386, LU-392).
The Maplewood East property owners are seeking annexation in order to develop properties under City
of Renton regulations and to receive public services(e.g.,sewer services)from Renton. Presentty the
area includes appro�amately nine singte-family residences. At fuil development,Maplewood East would
include a total of approximately 78 homes.
The City of Renton has planned for growth at this level of urban density and has established standards
to guide ongoing uses and new development on the Maplewood East properties following annexation.
Annexation would also permit protection for environmentatly sensitive areas (e.g., storm water/flood
management). More specifically,the City of Renton is prepared to provide development review and
environmental review to the annexation area based upon local, regional and state regulations for
protection of environmentally sensitive areas.
The City of Renton can directly provide (or contract for) urban services to the area. For example, the
City of Renton would provide police services. The City will provide sewer service, storm water
management, and refuse collection. The City will continue to contract with Fire Protec6on District No.
25 to provide fire service and emergency service. King County Water District No. 90 will continue to
provide water service to the Maplewood East Annexafion Area.
Library facN�des and recreation facilities would be available to the communiry. Children would attend
schools in Renton School District No.403.
The City of Renton reports that the proposed annexation conforms to the State Growth
Management Act(RCW 36.70A.) For example,the annexa6on is supported by RCW 36.7020,which
requires community planning goals, for urban growth, services and infrastructure, and environmental
preservation. Addifionally, the applica6on reportedly is consistent with RCW 36.70A.020 (1),
encouraging development in urban areas where there are adequate public services. It is also
consistent with RCW 36.70A.020 (12), which calls for public services to support permitted
development. Annexation would also permit development of primary land uses and corollary
public services (e.g., roadways) envisioned in the Act. Environmentally sensitive areas would also
be preserved under the provisions of this annexation.
Further, the Maplewood East Annexation is reported to be consistent with the King County
Comprehensive Plan. Following are examples of King County Comprehensive Pian/Countywide
Planning Policies that are addressed by the proposed Maplewood East Annexation:
FW-13:Cities are the appropriate providers of local urban senrices to Urban Areas.
LU-31: The County should identify urban development areas within the Urban Growth Area
LU-32: The County should encourage cities to annex territory within their designated potential
annexation area
LU-33: Land within a city's potential annexation area shatl be developed according to local and
regional growth phasing plans
U-203: Population growth should be encouraged in Urban Growth Areas
U-208: Land capacity shal� be pravided for residential,commercial and industrial growth
U-304: Growth should be focused within city boundaries.
The proposed Maplewood East Annexation is reportedty consistent with the provisions of RCW 36.93
(Boundary Review Board Regulations). For example, this annexation wvuld be consistent with
Objecfive 1, which calls for the preservation of neighborhoods. Tf�is area is linked to east Renton by
soaal fabric (e.g.,similar land uses and open spaces,shared sense of community) and by natural/built
geographic features (e.g., relatively flat to gentle sloping terrain). This annexation would also be
consistent with Objective 3, which calls for creation of logical service areas, and Objectives 4-7,which
call for the achievement of reasonable boundaries for a jurisdiction. Local residents have petitioned for
annexation in order that all services and land use regulations affecting their area may be efficiently
coordinated by a single local government unit. This annexation would also be consistent with Objective
8,which calls for inclusion of urban areas within municipalities.
The City of Renton has conducted fiscal analyses related to the proposed Maplewood East Annexation.
There are sufficient funds to serve the area. The addition of Maplewood East is not expected to have a
significant impact on cost and adequacy of services, finances, debt structure or rights of other
govemmental units. Upon annexation, property owners will assume their share of the regular and
special levy rate of the City for capital facilities and public services. At full development, city
expenditures are estimated at $115,832 and revenues are estimated at $121,100. Future capital
needs and costs will be examined and funded through the Renton Capital Investment Program.
The City of Renton supports this annexation in order to serve atizens of the area. New residential
development and coordinated senrices would benefit the greater Renton community.

Staff has reviewed the enclosed legal description and found it to be unsatisfactory. The
boundary descriptions are too ambiguous and leave much open for interpretation. Staff
recommends using the following rewritten legal description using the boundaries highlighted on
the accompanying Assessor's map.
Those portions of Section 14, Township 23 North, Range 5 East, W.M., in King County
Washington. Described as follows:
BEGINNING at a point which is the intersection of the westerly extension of the south line of
the plat of Willowbrook Lane, as recorded in Volume 170 of Plats, Pages 1 through 4, records
of King County, Washington, and the existing City Limits of Renton line as annexed by
Ordinance #4760, which is also the east line of the west half of the Northwest quarter of said
section.

SUMMARY OF ACTION:
The Council accepted a 10%Notice of Intent petition to initiate annexation of approximately 26.14-
acres located between 152°a Avenue SE on the west, 156th Avenue Se on the east, Willowbrook Lane
Subdivision on the north, and SE 136th Street on the south on May 3, 2004. The proponents have
submitted a 60% Petition to Annex that has been certified as sufficient by the King County
Department of Assessments on September 13, 2004.
Under State law, two public hearings are required to be held on the zoning that would be applied if
the proposed annexation is accepted. Council is being asked to accept the 60%Direct Petition to
Annex and hold the first public hearing on future R-4 zoning. The Administration is also seeking
authorization to forward the Notice of Intent package to the Boundary Review Board for King
County for its 45-day review.
STAFF RECOMMENDATION:
Council set November 22, 2004 for a public hearing to accept the Maplewood East Annexation 60%
Direct Petition to Annex, to hold the first of two required public hearings on future zoning, to
authorize the Administration to send the Notice of Intent package to the Boundary Review Board for
King County, to prepare a zoning ordinance consistent with Comprehensive Plan land use

value is represented by its signers?
If the Council accepts the 60% Direct Petition,what zoning classification should be applied at
the time of annexation since the RLD designation allows three different zones?
If the Council accepts the 60%Direct Petition, does it authorize the Administration to forward
the Notice of Intent package to the Boundary Review Board to begin its 45-day review period,
pursuant to RCW 36.93.090?
RECOMMENDATION:
On the basis of the following analysis, the Administration recommends that Council accept the
60%Direct Petition to Annex for the Maplewood East Annexation. If Council concurs with
this recommendation, the Administration further recommends that Council take the following
action:
• Accept the 60% Direct Petition to Annex for the Maplewood East Annexation;
• Authorize it to prepare a zoning ordinance consistent with the current Comprehensive
Plan land use designation of Residential Low Density(RLD) for the 26.14-acre non-
street portion of the annexation site; and,

can be effectuated by ordinance.
• Authorize it to forward the Notice of Intent package for the Maplewood East
Annexation to the Boundary Review Board, beginning its 45-day review period.
BACKGROUND SUMMARY:
The City received the 10%Notice of Intent to Commence Annexation petition on March 8,
2004 and after having the signatures certified by the King County Department of Assessments
the Council held a public meeting with the applicants on Apri122, 2004. Council at that time
required that the annexation area be zoned consistent with the Comprehensive Plan and that
property owners within it assume their proportionate share of the City's outstanding
indebtedness. Under the Residential Low Density land use designation three zones are
allowed: Resource Conservation(RC) with one dwelling per 10 acres; R-1 with one unit
maximum per each net acre; and, R-4 with four units maximum per net acre. Given that the
current King County zoning allows up to six units per gross acre with bonuses or development
rights transfers, the City is recommending R-4 zoning for this site. Because this annexation is
at the 60% Direct Petition level it must be rezoned consistent with the Comprehensive Plan,
which in this case is the R-4 zone. However, because it has already achieved 60% sufficiency
as a direct petition it and two other similar annexations with certified 60% Direct Petitions will
be allowed to use the lot size and density provisions of the R-5 zone. This latter zone is being
replaced by the City's new R-4 zone.
On August 17, 2004 the City received a 60% Direct Petition to Annex for this 26.14-acre site
and forwarded it to the County for verification of the validity of the signatures and the assessed
value they represent. On September 13, 2004, the King County Department of Assessments
notified the City that the signatures listed were sufficient under the provisions of RCW
35.13.002 to equal or exceed 60% of the area's assessed value.
Pursuant to RCW 35A.14.340, the City is required to hold two public hearings before rezoning
the subject annexation site. The first of these would be at the time the Council accepts the 60%
Direct Petition to Annex. The second would be after the Boundary Review Board for King
County completes its review and approves the proposed annexation.
In the 10% issue paper for this annexation staff noted that City reviewers had raised no major
obstacles to annexation. Parks noted that there was a shortage of neighborhood and community
parks in the area and that future parks development for this annexation would require an
eventual public expenditure of$27,773 in excess of what the City would receive in terms of
parks mitigation fees. And, Surface Water noted that the 1998 King County Surface Water
Design Mani{al Level-2 flow control requirements should be required of new development,
unless the City adopts stricter standards in the future, in which case they would apply. The
fiscal analysis conducted by staff for this project indicated that at full development there would
be a surplus of$6,515 per year, in 2004 dollars.

The proposed Maplewood East Annexation has been certified by the County as having
sufficient signatures to represent 60% or more of the area's assessed valuation. It also has
reasonable boundaries and appears to comply with relevant Boundary Review Board
objectives. Reviewing staff raised no significant obstacles to this annexation. The proposed
Maplewood East Annexation appears to further the City's business goals and be in the general
welfare and interest of the City.

THIS IS TO CERTIFY that the petition submitted September 9, 2004
to the King County Department of Assessments by Don Erickson,
Senior Planner for the City of Renton, supporting the annexation to
Renton of the properties described as the Maplewood East
Annexation, has been examined, the property taxpayers, tax parcel
numbers, and assessed value of properties listed thereon carefully
compared with the King County tax roll records, and as a result of
such examination, found to be sufficient under the provisions of the
New Section of Revised Code of Washington, Section 35.13.002.
The Department of Assessments has not verified that the signature
on the petition is valid through comparison with any record of actual
signatures, nor that the signature was obtained or submitted in an
appropriate time frame, and this document does not certify such to

Location : Subject parcels are located in the NW 1/4 of 14-23-05 in the
Briarwood Hills area. The annexation site, including adjacent street
right-of-way, is 26.14 acres. It is bounded by 152"d Ave SE and
Maplewood Estates on the east, SE 136th Street on the south, 156th
Avenue Se on the east, and approximately SE 134th Street, if
extended, on the north. 156�'Avenue SE is the major north/south
community collector in the area, connecting SR 169 to SE 128tn
Street.

1. Does this annexation represent any unique or significant problems for your
departmenUdivision?
The Maplewood East annexation area is located in the Cedar River basin. Maplewood East
drains to a natural stream (Orting Hills Creek), which flows through densely vegetated open
space at the SW corner of the annexation area. Eventually, Orting Hills Creek discharges to the
Cedar River at 149th Ave SE and SE Jones Road. There are erosion, water quality and fish
habitat problems within the Orting Hills sub-basin, per the Cedar River Basin Plan Current and

Future Conditions Report. The downstream drainage course is in unincorporated King County,
except for the runoff of 152"d Ave SE, which drains to the existing Maplewood Plat stormwater
pond. If 152"d Ave SE is extended, then the additional pavement should not drain to the same
storm water pond, unless it is proven that the pond can absorb the extra runoff volume and still
mee � utflow limits within a c�tain margin of safety.

During any future engineering review for development, the City of Renton shoutd require a
thorough downstream analysis from the design engineer. This is always important, but
especially when we discharge to another jurisdiction. Euture development within the proposed
annexation area shall be required to comply with the 1998 Kinq Countv Surface Water Desi'gn
,117fanual L-------eveT-2 flov�control and water quality requirements or.s�#he.r�ligl���s�n�dds,that ra e
adopted at th___ e_time of development. Wetland investigation and reports may be required for
projects that devetop in the propose annexation area.
2. Are you aware of any problems or deficiencies in existing infrastructure or service provision
to the area?
� The west side of 156th Ave SE doesn't have any drainage facilities, and road runoff sheet flows
onto private properties. This could lead to storm drainage complaints and maintenance
requests. No related drainage complaints have been recorded with the County, though.
3. Does this proposed annexation represent a logical extension of services provided by your
department/division?
The existing portion of 152NDAve SE was built as part of the existing Maplewood development,
and drains to the Maplewood stormwater pond to the West, within Renton city limits. Otherwise
�9��the upstream and downstream storm drain systems are in King County. However, we do not
��; anticipate any problems with regard to these drainage systems, provided adequate stormwater
��;j design standards are required as part of any development within the proposed annexation area.
4. Can you provide an estimated rough dollar figure of the cost to provide service to this area at
current development and at build out (maintaining existing, city-wide levels of service)? Can you
identify any other costs, e.g. one-time capital costs, the City would incur as a result of this
annexation?
The existing drainage features that would add to the maintenance responsibilities of the City of
Renton Surface Water Utifity are located along 156T" Ave SE, SE 136T" Street, and 152ND Ave
SE.
The existing drainage system along 156T" Ave SE, is comprised of 782 ft 12-inch diameter,
corrugated plastic pipes (CPP), 45 ft 12" concrete culvert, 5 type I, and 3 type II catch basins.
Along SE 136'h Street, we found 9 type I catch basins, 1345 ft 12"diameter CPP, and 140 ft 12"
diameter ductile iron pipe (DI).
At 136T"Ave SE, we located 3 type I, and 3 type II catch basins, 820 ft 24"diameter corrugated
polyethylene pipe (CPEP), 25 ft 12" CMP, and 100 ft 12" CPEP.

The existing public storm systems in the proposed annexation area and the estimated cost
for maintenance only of these storm systems are summarized below in Table 1 - Existing

With an additional 3565 linear feet of street length at full build-out, we estimate the additional
assets that would be constructed to serve the streets are 4100 lineal feet of 12 to 36-inch
diameter storm pipe, along with 36 Type 1 and 18 Type 2 catch basins, depending on the final
civil engineering plans. We would still have 750 linear feet of grass-lined ditches. The Surface
Water Utility would have to maintain and operate only the storm systems in the public right-of-
way.
The future public storm systems in the proposed annexation area, after full build-out, and the
estimated cost for maintenance only of these storm systems are shown below in Table 2-

The undersigned are the owners of not less than ten percent (10°Io) of the assessed value of
property within the proposed annexation area which they desire to annex to the City of Renton.
We hereby advise the City Council of the City of Renton that it is our desire to commence
annexation proceedings under the provisions of RCW 35A.14.120 of all or any part of the area
described below.
The territory proposed to be annexed is within King County, Washington, and is contiguous to
the City of Renton. A legal description (Exhibit A) and map (Exhibit B) are included as part of
this petition.
The City Council is requested to set a date not later than sixty days after the filing of this request
for a public meeting with the undersigned.
1. At such meeting, the City Council will decide whether the City will accept, reject or
geographically modify the proposed annexation;
2. The City Council will decide whether to require simultaneous adoption of a
proposed zoning regulation, such a proposal having been prepared and filed for the
area to be annexed as provided for in RCW 35A.14330 and 35A.14.340; and,
• 3. The City Council will decide whether to require the assumption of existing city
indebtedness by the area to be annexed.
