NOTICE OF INT�NTION
PROPOSED FALK II ANNEXATION TO THE CITY OF RENTON
I. BACKGROUND/MAPS
1. The description of and reason for seeking the proposed action:
The proposed action is to annex approximately 6.29 acres to the City of Renton.
Annexation is sought by the proponents to develop under City of Renton regulations and
processes and to receive Renton public services.
The annexation was initiated through the 50/50 Petition method under RCW 35A.14.010,
011, 012, 013,and 040(SSB 5409).
The proposed annexation area is located in the south half of NW %4 of the NW %4 of the SW
1/4 of Section 32,Township 23 North,Range 5 East.
2. Copies of the Renton City Council minutes for actions taken relative to the proposed
annexation:
A. Exhibit A: Certified minutes of the December 6, 2004 public meeting of the
Renton City Council accepting the Falk II Annexation 10% Notice
of Intent to Commence Annexation Proceedings petition and
authorizing the circulation of a Direct Petition to Annex.
B. Exhibit B: Certified minutes of the August 1, 2005 public hearing of the
Renton City Council accepting the 50/50 Petition to Annex and
declaring the City's intent to annex the area, subject to the actions
of the Boundary Review Board.
3. Exhibit C: Certification of Sufficiency for the 50/50 Petition to Annex made by the King
County Departrnent of Assessments dated June 7,2005.

II. FACTOItS THE BOARD MUST CONSIDER
1. Overview
A. Population: The population of the proposed annexation area is estimated to be
about 92 persons at full build out based upon 2.3 persons per household and a total
of 40 households. The City of Renton population as of Apri12004 was 55,360.
B. Territorv: The proposed annexation area includes approximately 6.29 acres.
C. Population Densitv: The proposed population density of the Falk II Annexation
area is estimated to be about 14.63 persons per gross acre at build-out.
D. Assessed Valuation: The current assessed value of the properties proposed for
annexation is approximately$1,221,000.
2. Land Use
A. Exi•sting: Existing uses include five single-family homes with an estimated
population of 11 persons.
B. Proposed: Although no specific proposal has been submitted it is anticipated that
, portions of the site will develop as new subdivisions or short plats under Renton's
proposed R-8 zoning. This zoning allows single-family residential development at
up to eight(8)units per net acre.
3. Comprehensive Plans/Franchise(s)
A. Conformance with Countv Countywide Planning Policies adopted bv King Count�
The proposed action is consistent with the Countywide Planning Policies in general,
and the following policies in particular:
LU-31 In collaboration with adjacent counties and cities and King County, and in
consultation with residential groups in affected areas, each city shall
designate a potential annexation area. Each potential annexation area
shall be specific to each city....

LU-32 A city may annex territory only within its designated potential annexation
area. All cities shall phase annexations to coincide with the ability for the
city to coordinate the provision of a full range of urban services to areas to
be annexed.
The City of Renton has designated a Potential Annexation Area in the City's
Comprehensive Plan. (Exhibit H) Renton has the ability to provide a full range of
urban services to the area proposed for annexation and is the designated sewer
service provider for the East Renton Plateau.
LU-33 Undeveloped lands adjacent to that city should be annexed at the time
development is proposed to receive a full range of urban services.
New development is likely to proceed upon annexation into the City of Renton and
the availability of sewers. Sewer certificates have already been issued for new
housing developments to the west and south of the site and can easily be extended to
serve the subject annexation site when it develops.
FW-13.Cities are the appropriate providers of local urban services to urban areas
either directly or by contract.
Renton is prepared to provide a full anay of local urban services to the area
including police, fire, local government, and an anay of other community services.
The Soos Creek Water and Sewer District is the designated purveyor of water and
sewer,under agreement with King County, for the entire annexation site.
B. Kin�C�tv Comprehensive Plan/Ordinances
1) King County Planning under the Growth Management Act.
The subject area is designated Urban - 4-12 du/ac in the King County
Comprehensive Plan and is identified as being within Renton's Potential
Annexation Area on the County's Potential Annexation Areas Map. King
County planning efforts under the Growth Management Act have included
ensuring that development in the Urban Growth Area occurs at urban
densities and with urban level services available. The City of Renton has
planned for urban densities for this area and can provide urban services
within its negotiated service areas should annexation occur.
2) The following adopted King County Comprehensive Plan policies
specifically support the proposed annexation:
Chapter Two, Urban Land Use, Section II.B, Directin� Growth to Cities
and Urban Areas
U-203 King County should encourage most population and employment
growth to locate in the contiguous Urban Growth Area in western
King County, especially in cities and their potential annexation
areas.
Annexation would allow development of the subject properties to occur
within the City of Renton with urban services such as wastewater, police,
libraries, local government, and parks.

Chanter Two, Urban Land Use, Section II.C, Urban Growth Area
Tar�ets
U-208 King County shall provide adequate land capacity for residential,
commercial and industrial growth in the urban unincorporated
area. This land capacity shall include bolh redevelopment
opportunities as well as opportunities for development on vacant
lands.
R-8 zoning on the subject properties would only slightly exceed the base
capacity represented by the County's R-6 zoning. Renton's R-8 zoning
would result in a slight decrease in capacity if the County's R-6 zoning
were maximized to its full potential of 9 units per gross acre. Renton
_ calculates density based upon net acreage and the County's calculates
density based upon r�oss acreage. If maximized out, an estimated 56 units
could be provided under the County's R-6 zoning and a maximum of 40
units could be provided under Renton's proposed R-8 zoning.
Chapter T�vo, Urban Land Use, Section III.A, PlanninQ with Kin�
Countv's Cities for Future Annexation
U-301 King County should work with cities to focus counrywide growth
within their boundaries and should support annexations within the
Urban Growth Area when consistent with the King County
Comprehensive Plan and Countywide Planning Policies.
U-304 King County should support annexation proposals when:
a. The proposal is consistent with the King County
Comprehensive Plan;
b. The proposed area is wholly within the Urban Growth Area
and within the city's designated Potential Annexation Area
(for annexations);
c. The city is planning for urban densities and e�cient land
use patterns consistent with the Countywide Planning
' Policies and King County land use plans;and,
d. Adopted Countywide goals and policies for urban services,
environmental and cultural resource protection will be
supported.
The proposal is generally consistent with the King County Comprehensive
Plan and Land Use Map. The area proposed for annexation is wholly
within the Urban Growth Area and within Renton's Potential Annexation
Area.. The City's Comprehensive Plan policies and development
regulations support countywide goals and policies for urban densities,urban
services and environmental and cultural resource protection. The proposed
R-8 zoning is urban, small lot zoning, which will achieve urban densities
and efficiencies consistent with adopted countywide goals and policies for
urban services.

3) Adopted Kin�ty Comp Plan desi ation: The adopted King County
Comprehensive Plan land use designation for the proposed annexation area is
Urban Residential - 4-12 du/ac. This designation is implemented with the R-6
zone, which bonuses up to nine units per gross acre, on the subject site.
Previously, this area along the west side of 102nd Avenue SE had R-1 zoning.
As noted above, the County's new zoning using TDRs and/or other bonuses,
would allow up to 56 units compared to 40 units under Renton's zoning.
4) Comparison of City and Coun, reQulations for sensitive areas, etc.: With
annexation, King County ordinances and regulations would be supplanted with
those of the City of Renton. City of Renton ordinances and regulations
applicable to the proposed action include the following:
a. Regulations for the protection of sensitive areas: The City of Renton's
Critical Areas Ordinance (RMC 4-3-050) describes pernutted and
prohibited activities and uses,waivers,modifications and variances,and
additional criteria and permit processes for development in critical
areas. Critical areas regulated by the Ordinance include aquifer
recharge areas, flood and geologic hazard areas, native habitat and
wetlands. Although specific regulations vary, Chapter 21A.24,
Environmentallv Sensitive Areas, of the King County Code, provides
comparable regulatory protection of sensitive areas. The City of Renton
Critical Areas Ordinance is available upon request.
b. Regulations for the preservation of aQricultural or other resource lands:
Regulations preserving agricultural uses are not applicable to the
subject area, as the proposed annexation area is not within any of the
agricultural districts identified for first, second, or third priority for the
purchase of development rights. Further, the property is not designated
for agricultural production or other resource lands in the King County
Comprehensive Plan and is not currently under agricultural use. The
City of Renton does not have a program authorizing transfer or
purchase of development rights.
c. Preservation of Landmarks or Landmark Districts: The City of Renton
has no regulations comparable to Chapter 20.62, Protection and
Preservation of Landmarks. Landmark Sites. and Districts, in the King
County Code.
d. Surface Water Control: The City of Renton has adopted the 1990 Kin�
County Surface Water Design Manual, by reference, in the City's
Drainage (Surface Water) Standards (RMC 4-6-030) as the design
standard for surface water control in development projects. Higher
standards such as those of the2005 King Countv Surface Water Design
Manual, Level 2 standard, are often applied through environmental
and/or project review.
C. City of Renton Comprehensive Plan/Franchise
1) City Plannin�Under the Growth Management Act
Renton City Council adopted the current Comprehensive Plan in 1995,
consistent with the requirements of the Growth Management Act. The 1995
Comprehensive Plan was updated in the 2004 Mandated Growth

Management Act Comprehensive Plan Review. The Comprehensive Plan
Land Use Map identifies Potential Annexation Areas, including the area
currently proposed for annexation,and shows land use designations for such
areas. (See Exhibit H,City of Renton Land Use Designations)
The proposal is consistent with the Land Use Element policies of the
Renton Comprehensive Plan that support annexation of lands:
• that are within Renton's Potential Annexation Area where the
availability of infrastructure and services allow for the development
of urban densities(Objective LU-1);
• that are vacant and subject to development pressure(LU-37.3);
• that are available for urbanization under county comprehensive
planning,zoning, and subdivision regulations(LU-37.5);
• for which the City of Renton should logically be the primary
provider of urban infrastructure and services(LU-36);
• that would include those who already use City services or who
impact City infrastructure(LU-41); and
• that includes environmentally sensitive areas and vacant land where
future development could adversely influence the environmental
and land use character of Renton(LU-42).
2) PAA status and PAA agreements with other cities, if anX: The City of
Renton has an adopted Potential Annexation Area. This area includes two
or three sub-areas, which are shown on Renton's Comprehensive Plan and
on the King County Interim Potential Annexation Area Map. The City has
also negotiated a PAA boundary agreement with the City of Kent. No PAA
agreement was necessary for the area currently proposed for annexation.
3) Required Comprehensive Plan amendments, if anX: No amendment to
Renton's Comprehensive Plan is necessary to process the current proposed
annexation.
4) Comprehensive Plan approval date: Renton's current Comprehensive Plan
was initially adopted on February 20, 1995, with annual amendments in
subsequent years. The latest, 2004 Mandated GMA Comprehensive Plan
Review was completed in November 2004.
5) Required franchises to serve area: No franchise will be required for the
City of Renton to provide services to the subject area.
6) Pre-annexation Zonin�Agreements: The subject area has not been the
subj ect of a pre-annexation zoning agreement.
7) Proposed land use desi ation: The subject area is designated Residential
Single Family in the City's Comprehensive Plan. R-8 zoning is proposed to
supplant the existing King County R-4 zoning, consistent with this adopted
land use designation, upon annexation. Under Renton's annexation process,
zoning is adopted concurrent with the adoption of the implementing
annexation ordinance.

4. Planning data
A. Revenues/Expenditures
This analysis identifies the General Fund revenues and costs associated with
annexing the subject properties as they are currently developed, as well as
estimating the annual fiscal impact of their full development at some undetermined
point in the future. "Full development" does not equate to the absolute zoned
capacity. Rather, it includes an assumption that a portion of the subject properties
will not develop within the foreseeable future due to market forces and the choices
of individual property owners. All assumptions regarding revenues and costs are
based on existing standards or other comparable data,but actual results are likely to
vary from these estimates. In general, costs associated with utilities have been
assumed to be supported by the rates charged for those services.

3) Estimated Net Fiscal Impact

4) Estimated County revenues lost: The estimated reduction in County
revenues would be$2,886 at current development(road and library levies,
excluding library bonds)for Levy Code 4260.
5) Estimated reduction in Countv expenditures: The estimated reduction in
County expenditures is anticipated to be minimal, as only a minor amount
of improved King County roadway exists in the proposed annexation area.
6) Estimated fire district revenue lost: The area proposed for annexation lies
within Fire District No. 40. The City anticipates taldng over this service upon
annexation and has a station(Starion No. 13)less than 3/a mile away.
7) Estimated fire district expenditures reduced: The estimated savings to Fire
District No. 40, because of this annexation, is minimal based upon service
to an estimated 13 residents.
B. Services
1) Water Service
The proposed annexation is within the Soos Creek Water and Sewer District
water and sewer service areas. These service areas would not change as a
result of the proposed annexation.
a) DirecdContract: Future development will have to notify Soos
Creek Water and Sewer District regarding water availability and
obtain a certificate of availability prior to future development.
b) Storage locations/Capacitv: The zoned residential capacity under
the existing King County zoning is higher than the capacity under
the proposed City of Renton R-8 zoning. Since population growth
under the City of Renton's proposed R-8 zoning is approximately
25% less than allowed under the County's current R-6 zoning, the
District's capacity should be adequate for the water demand
generated by post-annexation development in the subject area. If
anything, the change in zoning that would occur upon annexation of
this small area would theoretically increase storage capacity.
c) Mains to serve the area: Soos Creek Water and Sewer District will
require developers to extend mains into the annexation area as part
of their future development proposals.
d) Financin�of pronosed service: This will be financed by developers
and normal user fees for existing and new residents.

2) Sanitarv Sewer Service
a) DirecdContract: Sewer service would be provided directly to the
proposed 6.29-acre annexation area by the Soos Creek Water and
Sewer District.
b) Mains to service area: None of the annexation site is currently
being served by the City of Renton. The Soos Creek Water and
Sewer District will most likely require developers to extend sewer
to the area if they wish to develop.
c) Disposal: Sewage disposal will be through METRO's treatment
facilities.
d) Capacitv Available: It is assumed that the Soos Creek Water and
Sewer District's sanitary sewer system has sufficient capacity to
accommodate full buildout of the proposed annexation area, i.e.
accommodate up to 40 new single-family dwellings on sewer.
e) Financing of proposed service: Improvements within this
annexation area would be anticipated to be made through deyeloper
extensions or homeowner extensions in the future when residents
decide they want sewer hook-up.
3) Fire Service
a) DirecbContract: Fire District No. 40 currently provides fire service
to the subject site. Following annexation,the City of Renton would
directly provide prevention and suppression services to the subject
area. The City currently serves the area to the north on the west
side of 102nd Avenue SE.
b) Nearest stations: The annexation area is located between Fire
Station #13 to its northeast and Fire Station #14 to its northwest,
both in the City of Renton. Fire Station #13 is located at 17030
108�' Avenue SE. The latter is approximately 3/a mile to the
northeast of the subject site.
c) Response time: Response time to any point within the proposed
annexation boundaries could range from four to six minutes since
Fire Station#13 is very close to the subject site and will not change
because of this annexation. Staff does not anticipate any reduction
in the response time due to this annexation.
d) Staffin : Station#13 is fully manned, with five firefighters on duty
per shift.
e) Major equipment: Major equipment located at Station#13 includes
two 1,500 gallon per minute pumpers and one aid car.

g) Fire Ratin�: Renton's fire rating is three, as determined by the
Washington State Survey and Rating Bureau.
h) Source of dispatch: Valley Communication 911 service is the
source of emergency vehicle/aid dispatch.
5. General
A) Annexation a�,reements for extensions of service: No applicable annexation
agreements are in effect for the subject area.
B� Topo�raphy and natural boundaries: The site slopes to the west where the
topography breaks and drops nearly 300 feet to the floor of the Green River Valley
� and Panther Creek wetlands, below. There is an approximate 13-foot change in
elevation between the easternmost boundary of this annexation and its western
boundary.
B) Projected 10-year�rowth: The area is too small to make reasonable inferences from
large-area growth forecasts. The City projects about 35 new single-family units in
addition to the existing five dwellings on the site. This is based on existing
citywide R-8 densities and assumptions regarding identified physical and regulatory
constraints to development of the site and the probable market availability of land
for new development.
D) Municipal or community services: With annexation, the property owners and
residents would have access to a full range of urban services including police, fire,
parks, libraries, community services and classes, the senior center, the City's new
neighborhoods program, annual community events, and local, readily accessible,
government.
E) Potential delays in implementing service deliverx: T'he area is currently
underserved in regards to park facilities according to the City's adopted level of
service standards. This shortfall is identified in the City's Parks, Trails and Open
Space Plan update.- Staff estimates a one-time cost in excess of the parks/recreation
mitigation fees of$22,381 it would collect from new housing, as well as on-going
maintenance costs of$1,490 as the prorated cost for new parks associated with this
annexation.
The current waste hauler would continue to provide solid waste removal for seven
years after annexation, according to State law. At that time, the area would then be
included in the contract with the City's waste hauler. With the exception of parks
and solid waste removal,no delays are expected in implementing service delivery to
the area. City departrnents reviewing the annexation proposal indicated that they
would be able to adequately serve existing and future development. The Soos Creek
Water and Sewer District is expected to continue to provide water service to the
subject area, and has not indicated any major obstacles to providing sewer service to
the area at this time.

F) Evaluation of adequacy, costs, or rates of service to area: Existing services to the
area appear to be generally adequate. As development occurs in the proposed
annexation area, demand for services will,however, increase. It is assuxned that the
cost of such services will be largely offset by increases in property taxes, services
charges, and other revenues based on population. If the City were to assume this
annexation at current levels of development, it would have to subsidize it for
approximately $521 per year. At full development, in an estimated 10 years, the
City would realize an annual surplus of an estimated $8,025 per year, in 2005
dollars. �
King County is the only alternative service provider for services that would be
assumed by the City of Renton upon annexation. Fire suppression services will
change as a result of the proposed annexation since the City will take over these
services from Fire District No. 40. School district boundaries will not change, as
school district boundaries are not affected by annexations. As a result, the subject
area will remain within the Renton School District. Residents will continue to
provide water rates established by the Soos Creek Water and Sewer District. At the
time they hook-up for sewer, they will have to pay the rates also established by that
district.
III. OBJECTIVES
, The proposed Falk II Annexation generally complies most of the objectives of the Boundary Review
Board. These include the following:
1) Preservation of natural neighborhoods and communities.
No detrimental impacts to existing neighborhoods or communities are anticipated to result
from the proposed action. Established subdivisions located on the east side of 102°d
Avenue SE are not affected by this annexation.
2) Use of physical boundaries,including but not limited to bodies of water, highways and
land contours.
The proposed annexation follows the existing city limits on its north and west. The
boundary of the annexation is defined by Renton city limits on the west and north,and the
east side of 102°d Avenue SE, on the east. Its southern boundary is defined by existing
parcels that are intended to remain in unincorporated King County at this time.
3) Creation and preservation of logical service areas.
City staff that have reviewed the proposed annexation have stated that the proposed
boundaries appear to represent logical extensions for City of Renton services. Also,the
Countywide Planning Policies state that cities are the appropriate providers of local urban
services to Urban Areas. With the exception of sewer and water,Renton will be the
provider of these services. The proposal therefore furthers both the intent of the City's and
the County's planning policies.
4) Prevention of abnormally irregular boundaries.
The boundaries do not create abnormally inegular boundaries. The surrounding to the
southeast is also within Renton's Potential Annexation Area and is anticipated to be

eventually annexed into the City. Therefore, any irregularities are considered to be only
interim.
5) Discouragement of multiple incorporations of small cities and encouragement of
incorporation of cities in excess of ten thousand population in heavily populated urban
areas.

6) Dissolution of inactive special purpose districts.
Not applicable.
7) Adjustment of impractical boundaries.
This annexation is not being undertaken to adjust impractical city boundaries.
8) Incorporation as cities or towns or annexation to cities or towns of unincorporated
areas,which are urban in character.
King County has designated this area for urban development and it is located within
Renton's designated Potential Annexation Area.
9) Protection of agricultural and rural lands which are designated for long term
productive agricultural and resource use by a comprehensive plan adopted by the
county legislative authority.

Annexation: Wedgewood accordance with local and State laws,Mayor Keolker-Wheeler opened the
Lane, 144th Ave SE&SE public meeting to consider the revised 10%Notice of Intent petition for the
115th St proposed Wedgewood Lane Annexation,consisting of 25.63 acres bounded on
the north by SE 115th St., if extended; on the south by approximately SE 121st
St., if extended; on the east, south of SE 117th St. by Honey Creek, and north of
SE 117th St.by 148th Ave. SE.
Don Erickson, Senior Planner,explained that Council considered the 10%
Notice of Intent petition on 10/4/20Q4,and at that time Council authorized
expansion of the boundaries,adding eleven properties to the north and east.
The annexation area contains approximately 20 single-family dwellings, and
slopes down from the northwest and northeast corners towards Honey Creek at
� a 10% to 15% slope. Wetlands exist near the southern and eastern edges of the
site, and Honey Creek and its wetlands buffers comprise 20% of the site. Mr.
Erickson stated that public services are provided by Fire District#10,Water
District#90,Renton sewer,and the Issaquah School District.
Continuing,Mr.Erickson reported that current King County zoning is R-4(four
dwelling units per gross acre). Renton's Comprehensive Plan designates this
area as Residential Low Density, for which R-4 (four dwelling units per net
acre)zoning is proposed. He stated that the fiscal impact analysis indicates a �
surplus of$8,640 at full development, and an estimated one-time parks
acquisition and development cost of$52,188.
In conclusion,Mr.Erickson reported that the revised annexation proposal
serves the best interests and general welfare of the City, and is consistent with

City policies. He noted some potential flooding in the area, and suggested

REPORT report summarizing the City's recent progress towards goals and work
programs adopted as part of its business plan for 2004 and beyond. Items noted

Perfomung Arts Center on December 9th at 7:30 p.m. The Renton Youth
Symphony Orchestra's Holiday Concert will be held at Carco Theatre on

� The City received a federal "earmark" grant of$750,000 for the SW 27th
St. and Strander Blvd. project.
� The Police Department was granted re-accredited status on December 4th
by the Commission on Accreditation for Law Enforcement Agencies.
Legislature: 2005 Council Alex Pietsch,Economic Development Administrator, presented a report on
Legislative Priorities Renton's 2005 legislative priorities. He explained that the basic legislative
premises for the priorities include local flexibility, opposition to unfunded
- mandates, opposition to the increase of municipal fees to fund State regulatory
activities, and the maintenance of local control such as in the areas of rights-of-
way management, land use, and taxation. Mr. Pietsch reviewed the major
issues as follows:
Capital Budget. Pursue a$5 million line item request for stormwater and
utility infrastructure upgrades associated with the Boeing surplus property
redevelopment.
Municipal Finance. Support standardization and streamlining of sales tax
definitions that leads to sales tax on catalog and Internet sales. Oppose the
changes in local sales tax sourcing rules that are not fully mitigated.
Transportation. Seek new sources of local funding,funding for freight
mobility,funding for I-405 expansion,Regional Transportation Improvement
District modifications,High Occupancy Toll lanes, and maintaining a seat on
� Puget Sound Regional Council.
Economic Development Tools. Support innovative tax incentives such as
establishing a new State fund to help address infrastructure and capital costs for
qualified projects.
Land Use. Includes zoning authority over gambling institutions, annexation
tools, and Growth Management Act related issues.
Water Rights: Includes expediting well replacements and relocations,
instream flow protection, and City assumptions of water/sewer districts.

Law &Justice. Includes Municipal Court funding,Driving While License
Suspended penalties, separate licensing for nightclubs,photo-radar authority,
and DNA data collection.
Liability Reform. Includes joint and several liability, reference checks,and

services,public health, and parks.
Mr. Pietsch recommended that Council authorize the Administration to lobby
these issues and initiatives on Council's behalf. He assured that Council will be
provided with updates during the 2005 Session of the State Legislature.
Council President Persson suggested the addition of a legislative priority
regarding residential speed limits.

Plannin� &Developanent Planning and Development Committee Chair Briere presented a report
Committee regarding the R-1 zone community separators. The Committee reviewed staff
Planning: R-1 Zone analysis and the recommendation of the Planning Comtnission on the R-1 zone
Community Separators cluster and open space requirements in the City's designated Urban Separators.
The Planning Commission recommended that clustered development be
required and that a mandatory 50% open space tract be established to meet
Urban Separator policies. The Committee concurred with this recommendation
and further recommended that staff develop an ordinance that provides
equivalent or better implementation of the Urban Separator than currently set
forth in the King County code.
The Committee further recommended that the implementation of Urban
Separators include a mechanism to grant a density bonus up to the maximum
density presently allowed by the King County code,provision of utilities,
including sewer connections to parcels, and/or consideration of a means to
achieve a connected and contiguous open space corridor within the Urban
� Separator. Further review should consider issues such as fencing requirements,
the location of the open space corridor within a parcel, and the threshold for
establishing the open space tract on individual parcels. This item will remain in

PUBLIC MEETING This being the date set and proper notices having been posted and published in
Annexation: Querin II, accordance with local and State laws,Mayor Keolker-Wheeler opened the
Hoquiam Ave NE public meeting to consider the 10%Notice of Intent petition for the proposed
Querin II Annexation;7.3 acres located between Hoquiam Ave.NE on the west
and 144th Ave. SE,if extended,on the east, south of SE 112th St.
Don Erickson, Senior Planner,explained that this annexation was originally
submitted for 10.14 acres, and the applicant was unable to obtain the signatures
for the 60%petition. Therefore,the annexation was resubmitted for 7.3 acres.
Mr.Erickson stated that the subject annexation site contains three existing
single-family dwellings and three vacant parcels. The topography of the
western portion of the site is relatively flat,whereas the eastern portion
contains steep slopes as a result of Honey Creek and its ravine. He noted that
King County's 1998 Surface Water Design Manual,Leve12 flow control
standards or greater are recommended at the time of development.
Reviewing the public services,Mr.Erickson reported that the site is served by
Fire District#25,Water District#90,Renton sewer,and the Renton School
District. He pointed out that the site is currently zoned R-4(four dwelling units
per gross acre)in King County,and Renton's Comprehensive Plan designates
the site as Residential Single Family,for which R-8 (eight dwelling units per
net acre)zoning is proposed. Mr.Erickson reviewed the fiscal impact of the
proposed annexation,indicating a surplus of$236 at current development and a
surplus of$9,278 at full development. He noted the estimated one-time parks
acquisition and development cost of$27,176.
Mr.Erickson stated that the annexation proposal is generally consistent with
City policies and relevant Boundary Review Board objectives. He concluded �
that the annexation appears to further City business goals and is in the best
interests of the City.
Public comment was invited.
Martin Kenney, 18719 Yew Way, Snohomish, 98296, stated that he owns
property within the annexation area,and noted the successful development to
the south of the annexation site. Pointing out that Renton is a progressive city,
Mr. Kenney complimented the City's planning staff for their responsiveness.

Ave SE&S SOth St public hearing to consider the 50/50 Direct Petition to annex for the proposed
Falk II Annexation, which consists of 6.4 acres, including the abutting 102nd
Ave. SE right-of-way, located west of 102nd Ave. SE and south of SE 185th
Pl.,if extended.
Don Erickson,Senior Planner,explained that the subject annexation site was
originally part of larger annexation that was split into two pieces(the 6.3-acre
Falk Annexation was approved in December 2003). He reported that the site
contains five single-family dwellings,and is essentially flat with steeper slopes
on the western side. Public services aze provided by Fire District#40, Soos
Creek Water and Sewer District, and Renton School District. Mr.Erickson
noted that roadway and stormwater improvements are likely.
Continuing,Mr.Erickson reported that existing King County zoning for the site
is R-4(four dwelling units per gross acre). The Renton Comprehensive Plan
designates the site as Residential Single Family,for which R-8 (eight dwelling
units per net acre)is recommended. He pointed out that the R-8 zoning is
compatible with King County's R-6(six dwelling units per gross acre)zoning to
the east of the site.
- Mr.Erickson stated that the fiscal impact analysis indicates a surplus of
$12,715 at full development, and an estimated one-time parks acquisition and
development cost of$22,381. Mr.Erickson concluded that the proposed
annexation is generally consistent with City policies and Boundary Review
Boazd criteria. He noted that the 50/50 Direct Petition annexation method is
not used very often,but is a valid method. Mayor Keolker-Wheeler
emphasized that the applicant made the deternunation to use this method,not
the City.
In response to Councilman Clawson's inquiry regarding access to the
annexation site from the north,Mr.Erickson explained that the topography of
the area to the north of the subject annexation is limiting as two major ravines
transverse the property.
Public comment was invited.
Correspondence was read from Joseph and Martha MacKenzie, 18533 102nd
Ave. SE,Renton, 98055, expressing the following concerns regarding the
construction occuning on the Falk Annexation site: property line dispute; the
removal of trees; flying debris from the wood grinder;the moving,compression
and leveling of dirt; the noise; and the dust. The MacKenzies questioned who

is liable for any damage to their house due to the vibrations, and they expressed
unhappiness that construction will continue if the Falk II Annexation is
approved.
• Joseph MacKenzie, 18533 102nd Ave. SE,Renton,98055,expanded on his
concerns regarding the construction occurring on the Falk Annexation site as
stated in the previously read correspondence. Responding to the Mayor s
inquiry,Mr. MacKenzie expressed his opposition to the proposed Falk II
_ Annexation due to the construction. _
Mayor Keolker-Wheeler indicated that City staff will investigate the
MacKenzies'concerns regarding the construction related issues.
Robert McIntosh, 10104 SE 187th St.,Renton,98055, stated that he lives
adjacent to the southem boundary of the annexation area,and when
construction begins,he too will be experiencing the construction related
problems. He noted that water runs through the annexation site,and expressed
concern regarding the loss of the wildlife when the area is developed.

Councilmembers Corman and Briere sympathized with the speakers,each
saying that development construction occurred near their homes as well.
Councilman Clawson noted that there will be an approval process for the
development of the subject site, and conditions conceming the construction
may be imposed. He indicated that under the State Growth Management Act,
smaller wild areas are sacrificed in order to have a more contiguous area on the
other side of the urban growth boundary.

ADMIIVISTRATIVE Linda Herzog,Interim Assistant to the CAO,reviewed a written administrative
REPORT report summarizing the City's recent progress towards goals and work
programs adopted as part of its business plan for 2005 and beyond. Items noted
included:
� The City distributed 15,548 copies of the Renton Community Resource
Directory, which is printed in eleven languages,in the first six months of
2005. �
� The King County Department of Public Health requested that the east end
of the swimming beach at Gene Coulon Memorial Beach Park be closed to
swimmers until further notice. This action was taken because levels of
fecal coliform and E. coli fluctuate widely from day to day in that section
only. The City is in the process of contracting a water quality consulting
firm to deternune the origin of the contamination.

� Residents are encouraged to participate in the Salmon Watcher Program by
observing salmon-bearing streams during the salmon run season. An

NEW BUSINESS Referring to the 2006 Budget schedule,Council President Briere expressed
Budget: 2006 Schedule concern regarding the review of fees and rates and the associated ordinances
prior to the presentation of the budget to Council. Discussion ensued
concerning the timing of the approval of any proposed fee and rate ordinance.
Mayor Keolker-Wheeler stated that the budget schedule will be reviewed.
Council: Information Request Councilman Persson requested status reports on the following items: the hiring
on Various Issues of a new librarian; the proposed parks maintenance facility; the Skyway
Towing court case;the prostitution arrests at massage parlors and related City

SUMMARY (File No. 2220)
The City of Renton proposes the annexation of approximately 6.29 acres, known as the Falk II
Annexation. This annexation was proposed der the 50%/50% petition method, pursuant to RCW
35A.14.010. Renton City Council adopted th petition for annexation in August of 2005.
The site is located on the southeast side of he City of Renton. The northern and western boundaries
of the site abut the existing City of Renton The northern boundarx is formed by SE 185th Street and
the western boundary is generally formed 9x�''Rla�e-Soutla-(if-�nded') The southern boundary of
the site is generally between SE 186th Street and SE 187th Street (if extended). The eastern boundary
of the site is generally formed by 102"d Avenue SE.
The unincorporated area is included in the "Annexation ElemenY' of the City of Renton
Comprehensive Plan and is located within the Renton Potential Annexation Area. The proposed
action is consistent with City of Renton Comprehensive Plan policies addressing annexation, including
those provisions which call for inclusion of urban areas within the City together with protection of and
provision of services to incorporated areas (e.g., LU-1; LU 37.3; LU-37.5; LU-36; LU-41, and LU-42).
The Falk II property owners are seeking annexation in order to develop properties under City of
Renton regulations and to receive public services (e.g., sewer services)from Renton. Presently the
area includes approximately five single-family residences. The City of Renton proposes residential
zoning at R-8 (up to 8 dwelling units per net acre) in order to achieve urban densities and efficiencies
consistent with adopted Countywide goals and City policies for urban growth. At full development,
Falk II would include a total of approximately 40 homes which would house approximately 100
persons.
The City of Renton has planned for growth at this level of urban density and has established
standards to guide ongoing uses and new development on the Falk II properties following annexation.
More specifically, the City of Renton is prepared to provide development review based upon local
standards and applicable King County guidelines. Similarly, the City will provide environmental
review to the annexation area based upon local, regional and state regulations for protection of
environmentally sensitive areas (e.g., sloped terrain, vegetated areas).
The City of Renton can directly provide (or contract for) urban services to the area. For example,
upon annexation, the City will provide the Falk II Area police services. The City and Fire Prevention
District No. 40 will provide fire services and emergency medical services. The City will also establish
storm water management system requirements for the Falk il Area. Soos Creek Water and Sewer
District will continue to provide water service and sewer service to the Falk II Annexation Area.
City and County library facilities, law and justice facilities, and parks and recreation facilities (slated for
improvements)would be available to the community. Children would attend schools in Renton School
District No. 403.
The City of Renton reports that the proposed annexation conforms to the State Growth
Management Act (RCW 36.70A.) For example, fhe annexation is supported by RCW 36.70.20,
which requires community planning goals, for urban growth, services and infrastructure, and
environmental preservation. Additionally, the application reportedly is consistent with RCW
36.70A.020 (1), encouraging development in urban areas where there are adequate public
services. It is also consistent with RCW 36.70A.020 (12), which calls for public services to
support permitted development. Annexation would also permit urban growth — and protection of
environmentally sensitive areas — as envisioned in the Growth Management Act.
Further, the Falk II Annexation is reported to be consistent with the King County Comprehensive
Plan. Following are examples of King County Comprehensive Plan/Countywide Planning Policies
that are addressed by the proposed Falk II Annexation:
FW-13:Cities are the appropriate providers of local urban services to Urban Areas.
LU-31: The County should identify urban development areas within the Urban Growth Area.

LU-32: The County should encourage cities to annex territory within their designated potential
annexation area.
LU-33: Land within a city's potential annexation area shall be developed according to local and
regional growth phasing plans. .
U-203: Population growth should be encouraged in Urban Growth Areas.
U-204: The County should support annexations that are consistent with Countywide Planning Policies
and the State Growth Management Act.
U-208: Land capacity shall be provided for residential, commercial and industrial growth.
U-304: Growth should be focused within city boundaries.
The proposed Falk II Annexation is reportedly consistent with the provisions of RCW 36.93 (Boundary
Review Board Regulations). For example, this annexation would be consistent with Objective 1,
which calls for the preservation of neighborhoods. This area is linked to Renton by geographic
features social fabric(e.g., similar land uses, open spaces, common terrain features).
Similarly, the annexation would be consistent with Objective 2, which calls for the use of physical '
bounclaries to demarcate an annexation area. For the Falk II Area, boundaries are primarily formed
by roadways and by existing City boundaries.
The Falk II Annexation would also be consistent with Objective 3, which calls for creation of logical
service areas. Local residents have petitioned for annexation in order that all services and land use
regulations affecting their area may be efficiently coordinated by a single local government unit. The
City of Renton is prepared to govern and serve the area.
The proposed annexation is also reportedly consistent with Objectives 4-7, which call for the
achievement of reasonable boundaries for a jurisdiction. While the proposed annexation is small in '
size, the area lies withiri the Renton PAA and so this incorporation is consistent with City plans to
govern and serve the area. This annexation would also be consistent with Objective 8, which calls for
inclusion of urban areas within municipalities.
The City of Renton has conducted fiscal analyses related to the proposed Falk II Annexation. At full
development, City expenditures are estimated at $58,331 and revenues are estimated at $66,356.
Upon annexation, property owners will assume their share of the regular and special levy rate of the
City for capital facilities and public services. As such, the City will have sufficient funds to serve the
area at present without a significant impact on cost and adequacy of services, finances, debt structure
or rights of other governmental units. Future capital needs and costs will be examined and funded
through the Renton Capital Investment Program.
The City of Renton supports this annexation in order to serve citizens of the area. New residential
development and coordinated services would benefit the greater Renton community.

ISSUE:
The City is in receipt of a 10%Notice of Intent to Commence Annexation petition to annex about 6.29
acres to the City of Renton by direct petition(see Figure 1). State law requires that the Council hold a
Public Meeting with annexation proponents to decide whether to accept,reject or geographically modify
the proposal. The Council also decides whether to require the assumption of existing indebtedness and
whether to require the simultaneous adoption of zoning consistent with the Comprehensive Plan upon
potential annexation.
RECOMMENDATION:
• Accept the 10%Notice of Intent to Commence Annexation petition,however,modifying the
annexation site to include the abutting 102nd Avenue SE street right-of-way;
• Authorize the circulation of a 60%Direct Petition to Annex for the enlarged annexation site with the
following provisions:
■ That property owners within the annexation area shall support the adoption of future City
zoning consistent with the Comprehensive Plan Land Use Map upon annexation; and,
■ That property owners within the annexation area shall assume a proportional share of the
City's existing outstanding indebtedness.
BACKGROUND SUMMARY:
Location: The subject area is bounded on the north and west by existing city limits, on the east by the
western edge of the 102°d Avenue SE right-of-way, and on the south by South 50`i'Street.

Assessed Value: The assessed value at current development is $1,221,000.
Natural Features: The subject site generally flat but slopes gradually towards the north. The
southwestern portion of the site has steeper slopes as does the northeastern corner(see Figure 3).
Existin�Land Uses: Most of the subject annexation site remains underdeveloped. There currently are
five single-family detached residents spread over the 6.29 acres for an average density of less one unit
per acre
Existin z� oning: The subject site is currently zoned R-1 by King County, although properties along the
east side of 102°d Avenue SE are zoned R-8 by King County.
Public Services:Natural Features: The subject site generally flat with a gradual slope to the north. The
southwestern portion of the site has steeper slopes (Figure 3).
l. Comprehensive Plan: Renton's Comprehensive Plan designates the annexation site as Residential
Single Family with either R-8 or RMH zoning allowed. R-8 allows a base density of eight units per
net acre and RMH zoning is for manufactured housing developments. Staff is recommending R-8
zoning for this annexation if the Council authorizes circulation of the 60%Petition to Annex and the
applicants are successful in obtaining the signatures of property owners representing at least 60%of
the area's assessed value.
2. Public Services: No impediments to service delivery or unusual costs were noted by responding
departments and divisions.
Water Utilitv: The subject area is within the Soos Creek Water and Sewer District service area.
By agreement under the East King County Coordinated Water System Plan, Soos Creek Water and
Sewer Utility is the designated service provider for this area.
A certification of water availability from the District will be required prior to the issuance of
development permits within the subject area,following its annexation to the City. Hydrant flow
test and hydraulic analysis of the District's system will also be required for new development in the
annexed area. The District must provide adequate water supply and pressure for new development
within the City and must meet Renton's standards for fire protection and domestic water service.
Sewers: The area currently is not served by sewer. The annexation area is located within the Soos
Creek Water and Sewer District service area. Sewers could be extended either by developer
extension or local improvement district.
Parks: There are two park facilities within three fourths of a mile of the annexation area. One is
Springbrook Park,located within the City and the other is the Cleveland Park site(undeveloped)
and outside of the City near SE 196"'Street and Talbot Road South. The Community Services
Department notes a deficiency in developed parks in the area. The prorated one-time cost of
acquiring and developing parks for the projected 100 future residents of this annexation at build out
in ten years is an estimated$68,379.
Fire: The area is currently served by Fire District No.40. Upon annexation the City will be the
service provider for this area.
Public Works Maintenance: Maintenance staff has noted no infrastructure issues at the current
level of development.

Surface Water: Surface Water Utility staff note that any new construction that would occur as a
result of this proposed annexation should be required to comply with the 1998 King County

An inventory of existing drainage infrastructure within the proposed annexation area will also need
to be conducted to better assess the financial impact of the proposed annexation to the City.
ANALYSIS OF THE PROPOSED ANNEXATION:
(Pursuant to City Council Resolution 2429)
Consistency with the Comprehensive Plan:
The annexation policies generally support the proposed annexation. The subject annexation site is
located within Renton's Potential Annexation Area and is within an area seeing increased development
pressure (Policies LU-378 and LU-379). Renton's Comprehensive Plan Land Use designation for this
area is Residential Single Family,which allows up to 8 dwelling units per net acre.
Renton is the logical service provider of most urban services and infrastructure for this area(Policy LU-
383). Policy LU-388 states that in general, the greater the contiguity with the city limits,the more
favorable the annexation. The proposed annexation is adjacent to the city limits along approximately
50% of its perimeter. Policy LU-388 states that annexation boundaries should be"readily identifiable in
the field". The proposal follows lot lines along its northern and eastern boundaries and existing parcels
on its western and southern boundaries. There are no alternative boundaries to the south that would be
more consistent with this policy,without substantially increasing the size of the proposed annexation.
Consistency with the Boundarv Review Board Objectives:

a. Preservation of natural neighborhoods and communities;
The proposed annexation would cause no disruption to the larger community.
b. Use of physical boundaries, includi�ag but not limited to bodies of water, highways, and land
contours;
The proposed annexation follows lot lines on two sides, city boundaries on two sides, and streets on
two sides. No alternative physical boundaries exist in the vicinity.
c. Creation and preservation of logical service areas;
With the exception of water and sewer service provided by the Soos Creek Water and Sewer
District,the city is capable of providing all urban services to the proposed annexation area. The
City currently serves the area north of South 49`i'Street and west of the proposed annexation.
d. Prevention of abnormally irregular boundaries;
The proposed annexation has regular boundaries and is rectangular in shape.
e. Discouragement of multiple incorporations of small cities and encouragement of incorporations of
cities in excess of ten thousand population in heavily populated urban areas;

Neither the existing City boundary nor the proposed new boundaries are impractical.

This area is designated for urban development in that it is located within King County's Urban
Growth Boundary.
i. Protection of agricultural and rural lands which are designated for long terrn productive
agricultural and resource use by a comprehensive plan adopted by the county legislative authority.
Not applicable. No portions of the proposed Falk Annexation area are rural or designated for long-
term productive agricultural use in the King County Comprehensive Plan. As noted above,the King
County Comprehensive Plan currently designates this area as Greenbelt/Urban Separator.
CONCLUSION:
The proposal is generally consistent with City of Renton Comprehensive Plan policies related to
annexations and Boundary Review Board objectives for annexation. No impediments to the provision
of City services to the area have been identified at this early stage. Discussions are underway with King
County regarding their designation of the annexation area and area to the south as Greenbelt/iJrban
Separator.
A fiscal analysis has been prepared and indicates under current conditions this annexation would cost
the City$819. However, at full development this is anticipated to result in a surplus of$3,851,in
today's dollars
CONCLUSION:
The proposed Falk II Annexation appears to be in the public interest. Relevant City Comprehensive
Plan Land Use policies are complied with and it appears to be consistent with relevant City of Renton
Business Goals. It also appears to comply with all relevant Boundary Review Board objectives.
Reviewing staff has not identified any major pitfalls to this proposed future annexation although parks
acquisition and development could result in an estimated one-time cost of$68,379 to the City. At full �
development the net annual fiscal impact to the City would be an estimated$3,851, in today's dollars

about 1300 feet downstream. The proposed annexation area discharges to Panther Creek
via a small tributary stream that flows down steep slopes with potential for downstream

provision to the area?
An existing 6" diameter culvert under 102"d Ave SE may be undersized for conveying the
increased developed peak flows from the Falk-II Annexation. Other culverts conveying the
stream from the east side of 102"d Ave SE may also be undersized. These need to be
upgraded to larger diameter culverts, as part of a future development.
3. Does this proposed annexation represent a logical extension of services provided by �
your department/division?
Yes, this annexation is a logical extension of surFace water utility services as the
downstream area is in Renton's jurisdiction.
4. What additional facilities or staff would be required to serve this area? Can you
identify any other costs the City would incur as a result of this annexation?
In existing conditions, little drainage facility maintenance would be required, costing about
$50 per year. However, when the proposed annexation area is developed, additional public
storm systems will be constructed that will increase the Surface Water Utility maintenance
needs. This will incrementally require additional resources for maintenance of infrastructure
from this annexation, other annexations and new development within existing City limits. At
some point in time additional resources will be needed for maintenance due to new
development and annexations.
5. Would the City assume ownership or responsibility for facilities currently owned or
managed by another jurisdiction? Would new agreements or franchises be required
as a result of this annexation?
In the existing state, the City of Renton would assume ownership of 145 If of grass
ditches, 35 If 6" diameter concrete pipe, 45 If 12" diam. concrete pipe, and 75 If of 12"
diameter corrugated polyethylene pipe. Future development will add more facilities.
6. Would alternate boundaries create a more logical annexation for provision of City
services? (If yes, please indicate on the attached map.)
The current boundaries are fine.
General recommendation and comments:
The area downstream of the annexation is a sensitive area due to erosion potential in the
streambed of Panther Creek. Therefore, future development in the proposed annexation area
should be required to comply with the 1998 KCSWDM standards and provide level II flow
control for storm water detention or stricter standards if required by the City at the time of ,
development.
