' � CITY OF RElOiTON PLANNING/BUILDING/PU�LIC WOIZKS 1VIEl0�I0ItAl�TDUM DATE: February 15, 2006 TO: Don Erickson FROM: Technical Services��� SUBJECT: King County January 27,2006 Memo for Akers Farms Annexation Legal Description Review Bob Mac Onie and Sonja Fesser have reviewed the above referenced memo submittal and have the following comments concerning the legal description noted therein: We have prepared a revised legal description for the above referenced annexation using the text that was submitted to us by King County. However, we found said text to have a number of problems that could not be overlooked and are listed as follows: The word "entire" when used with "portion"is very confusing. In this case, "entire"implies the � full width(60' feet) of the street(108`h Ave SE). However, only 30 feet is meant to be annexed. The other 30 feet was annexed (in part)by the City of Renton via Ordinance No.1909. The use of the word "aligned" several times in said legal description is also troubling. We do not use this word in legal descriptions, as it offers no specific meaning,but implies such. A semi-colon needs to be inserted just before the "together with". Note that we did capitalize the two words "TOGETHER WITH" in our revised legal to create a more defining separation in the legal description text. Need there be so many references to "Section 29"? Finally, in the second paragraph of said memo, there is a reference to "differing alignments for SE 164`�'Street at the center-section line". We do not see an alignment for SE 164`i'Street on the center-section line, except that the center-line for SE 164"'Street ends at the center-section line. Only 108`�'Ave SE is on the center-section line and there does not appear to be a problem there. The southerly right-of-way margin of SE 164`i'Street is extended across both 109`�'Avenue SE and 108`h Avenue SE(at their junctions with SE 164`t'Street)to establish the city limits along the southerly right-of-way margin of SE 164`h Street. Is this concern resolved, or is further study needed? To our knowledge, Lots 1 and 12 of Block 9 of the plat of Akers Farms No. 6 are not a part of the annexation request, and were not included, in any way, in the legal description. We cannot respond to the remark concerning the fact that the legal description does not coincide with the highlighted boundary on the accompanying Assessor's map. We did not prepare said Assessor's map and have no knowledge of what was highlighted. Our legal description reflects what is noted as the proposed annexation area on"Exhibit Fl: Proposed Annexation Boundary". The proposed action is consistent with City of Renton Comprehensive Plan policies addressing annexation, including those provisions which call for inclusion of urban areas within the City together with protection of and provision of services to incorporated areas (e.g., LU-1; LU 37.3; LU-37.5; LU-36; LU-41, and LU-42). The Akers Farms property owners are seeking annexation in order to develop properties under City of Renton regulations and to receive public services (e.g., sewer services) from Renton. Presently the area includes approximately five single-family residences. The City of Renton proposes residential zoning at R-8 (up to 8 dwelling units per net acre) in order to achieve urban densities and efficiencies consistent with adopted Countywide goals and City policies for urban growth. At full development, Akers Farms would include a total of approximately 79 homes which would house approximately 182 persons. The City of Renton has planned for growth at this level of urban density and has established standards to guide ongoing uses and new development on the Akers Farms properties following annexation. More specifically, the City of Renton is prepared to provide development review based upon local standards and applicable King County guidelines. Similarly, the City will provide environmental review to the annexation area based upon local, regional and state regulations for protection of environmentally sensitive areas (e.g., sloped terrain, vegetated areas). The City of Renton can directly provide (or contract for) urban services to the area. For example, upon annexation, the City will provide the Akers Farms Area police services, fire services and emergency medical services. The City will also establish storm water management system requirements for the Akers Farms Area. Soos Creek Water and Sewer District and the City of Renton will share responsibilities for provision of water service and sewer service to the Akers Farms Annexation Area. City and County library facilities, law and justice facilities, and parks and recreation facilities (slated for improvements)would be available to the community. Children would attend schools in Renton School District No. 403. The City of Renton reports that the proposed annexation conforms to the State Growth Management Act (RCW 36.70A.) For example, the annexation is supported by RCW 36.70.20, which requires community planning goals, for urban growth, services and infrastructure, and environmental preservation. Additionally, the application reportedly is consistent with RCW 36.70A.020 (1), encouraging development in urban areas where there are adequate public services. It is also consistent with RCW 36.70A.020 (12), which calls for public services to support permitted development. Annexation would also permit urban growth — and protection of environmentally sensitive areas — as envisioned in the Growth Management Act. Further, the Akers Farms Annexation is reported to be consistent with the King County Comprehensive Plan. Following are examples of King County Comprehensive Plan/Countywide Planning Policies that are addressed by the proposed Akers Farms Annexation: FW-13:Cities are the appropriate providers of local urban services to Urban Areas. LU-31: The County should identify urban development areas within the Urban Growth Area. i b —` LU-32: The County should encourage cities to annex territory within their designated potential annexation area. LU-33: Land within a city's potential annexation area shall be developed according to local and regional growth phasing plans. U-203: Population growth should be encouraged in Urban Growth Areas. U-204: The County should support annexations that are consistent with Countywide Planning Policies and the State Growth Management Act. U-208: Land capacity shall be provided for residential, commercial and industrial growth. U-304: Growth should be focused within city boundaries. The proposed Akers Farms Annexation is reportedly consistent with the provisions of RCW 36.93 (Boundary Review Board Regulations). For example, this annexation would be consistent with Objective 1, which calls for the preservation of neighborhoods. This area is linked to Renton by geographic features social fabric(e.g., similar land uses, open spaces, common terrain features). Similarly, the annexation would be consistent with Objective 2, which calls for the use of physical boundaries to demarcate an annexation area. Akers Farms Area boundaries are primarily formed by existing City boundaries, by roadways, and by property lines. The Akers Farms Annexation would also be consistent with Objective 3, which calls for creation of logical service areas. Local residents have petitioned for annexation in order that all land use regulations and services affecting their area may be efficiently coordinated by a single local government unit. The City of Renton is prepared to govern and serve the area. The proposed annexation is also reportedly consistent with Objectives 4-7, which call for the achievement of reasonable boundaries for a jurisdiction. While the proposed annexation is small in size, the area lies within the Renton PAA and so this incorporation is consistent with City plans to govern and serve the area. This annexation would also be consistent with Objective 8, which calls for inclusion of urban areas within municipalities. The City of Renton has conducted fiscal analyses related to the proposed Akers Farms Annexation. At full development, City expenditures are estimated at $101,134 and revenues are estimated at $115,288. Upon annexation, property owners will assume their share of the regular and special levy rate of the City for capital facilities and public services. As such, the City will have sufficient funds to serve the area at present without a significant impact on cost and adequacy of services, finances, debt structure or rights of other governmental units. Future capital needs and costs will be examined and funded through the Renton Capital Investment Program. The City of Renton supports this annexation in order to serve citizens of the area. The description of and reason for seeking the proposed action: The proposed action is to annex approximately 10.84 acres to the City of Renton. Annexation is sought by the proponents to develop under City of Renton regulations and processes and to receive Renton public services. The annexation was initiated through the 60% Direct Petition method under RCW 35A.14.120, 130, 140, and 150. Population Densitv: The proposed population density of the Akers Farms Annexation area is estimated to be about one persons per gross acre. D. Assessed Valuation: The current assessed value of the properties proposed for annexation is approximately$799,000. 2. Land iTse A. Exi•stine: Existing uses include five single-family homes with an estimated population of eleven persons. B. Proposed: A portion of the subject annexation has been looked at as a preliminary application for a preliminary plat. The annexation is proposed to facilitate the development of these properties for single-family residential uses at up to eight (8) units per net acre. 3. Co�nprehensive Plans/�ranehise(s) A. Conformance with Coun Countvwide Planning Policies adopted by Kin�unty_ The proposed action is consistent with the Countywide Planning Policies in general, and the following policies in particular: LU-31 In collaboration with adjacent counties and cities and King County, and in consultation with residential groups in affected areas, each city shall designate a potential annexation area. Each potential annexation area shall be specific to each city. (Exhibit I� Renton has the ability to provide a full range of urban services to the area proposed for annexation and is the designated sewer service provider for the northern portion of the site. LU-33 Undeve[oped lands adjacent to that ciry should be annexed at the time development is proposed to receive a full range of urban services. New development is likely to proceed upon annexation into the City of Renton and the availability of sewers and urban services. FW-13.Cities are the appropriate providers of local urban services to urban areas either directly or by contract. Renton is prepared to provide a full array of local urban services to the area including sewer, water, police, fire, local government and an array of other community services. Soos Creek Water and Sewer District is the designated water purveyor for the whole site and the designated sewer purveyor for the lower third of the annexation site under agreement with King County. B. King Countv Comprehensive Plan/Ordinances 1) King County Planning under the Growth Management Act. The subject area is designated Urban - 4-12 du/ac in the King County Comprehensive Plan and is identified as being within Renton's Potential Annexation Area on the County's Potential Annexation Areas Map. King County planning efforts under the Growth Management Act have included ensuring that development in the Urban Growth Area occurs at urban densities and with urban level services available. The City of Renton has planned for urban densities for this area and can provide urban services within its negotiated service areas should annexation occur. 2) The following adopted King County Comprehensive Plan policies specifically support the proposed annexation: Chaqter Two, Urban Land Use, Section II.B, Directin� Growth to Cities and Urban Areas U-203 King County should encourage most population and employment growth to locate in the contiguous Urban Growth Area in western King County, especially in cities and their potential annexation areas. Annexation would allow development of the subject properties to occur within the City of Renton with urban services such as wastewater (2/3's of site),police,libraries,local government, and parks. R-8 zoning on the subject properties would approximate the capacity represented by the existing King County zoning,which is R-8. Renton's R- 8 zone would result is approximately 20% less capacity than the current County base zoning since Renton calculates density based upon net acreage and the County's calculates density based upon oss acreage, and approximately 47% less capacity than the County's R-8 zone if it were bonused up to its maximum of 12 units per gross acre. An estimated 130 units could be provided under the County's R-8 zoning (with bonuses) and approximately 69 units could be provided under Renton's proposed R-8 zoning. This designation is implemented with the R-8 Zone,which bonuses up to 12 units per gross acre,on the subject site. 4) Comparison of City and Countv re�ulations for sensitive areas, etc: With annexation, King County ordinances and regulations would be supplanted with those of the City of Renton. City of Renton ordinances and regulations applicable to the proposed action include the following: . a. Regulations for the protection of sensitive areas: The City of Renton's Critical Areas Ordinance (RMC 4-3-050) describes permitted and prohibited activities and uses,waivers,modifications and variances, and additional criteria and permit processes for development in critical areas. Critical areas regulated by the Ordinance include aquifer recharge areas, flood and geologic hazard areas, native habitat and wetlands. Although specific regulations vary, Chapter 21A.24, Environmentallv Sensitive Areas, of the King County Code provides comparable regulatory protection of sensitive areas. The City of Renton Critical Areas Ordinance is available upon request. b. Re�ulations for the preservation of a�ricultural or other resource lands: Regulations preserving agricultural uses are not applicable to the subject area, as the proposed annexation area is not within any of the agricultural districts identified for first, second or third priority for the purchase of development rights. Further, the property is not designated for agricultural production or other resource lands in the King County Comprehensive Plan and is not currently under agricultural use. The City of Renton does not have a program authorizing transfer or purchase of development rights. c. Preservation of Landmarks or Landmark Districts: The City of Renton has no regulations comparable to Chapter 20.62, Protection and Preservation o�Landmarks. Landmark Sites and Districts, in the King County Code. However, no landmark sites or districts are,lrnown to ' exist for this area or the subject annexarion site. d. Surface Water Control: The City'of Renton has adopted the 1990 KinQ Countv Surface Water Desi�n Manual, by reference, in the City's Drainage (Surface Water) Standards (RMC 4-6-030) as the design standard for surface water control in development projects. Higher standards such as those of the new 2005 King Countv Surface Water Design Manual. Level 2 standard are often applied through environmental review. C. City of Renton Comprehensive Plan/Franchise 1) City Plannin�Under the Growth Mana�ement Act Renton City Council adopted the current Comprehensive Plan in 1995, consistent with the requirements of the Growth Management Act. The 1995 Comprehensive Plan was updated in the 2004 Mandated Growth Management Act Comprehensive Plan Review. The Comprehensive Plan Land Use Map identifies Potential Annexation Areas, including the area Washington State Boundary Review Board for King County Proposed Akers Farms Annexation 11/16/OS Page 6 eurrently proposed for annexation,and shows land use designations for such areas. (See Exhibit H,City of Renton Land Use Designations) The proposal is consistent with the Land Use Element policies of the Renton Comprehensive Plan that support annexation of lands: • that are within Renton's Potential Annexation Area where the availability of infrastructure and services allow for the development of urban densities(Objective LU-1); • that are vacant and subject to development pressure(LU-37.3); • that are available for urbanization under county comprehensive planning,zoning,and subdivision regulations(LU-37.5); • for which the City of Renton should logically be the primary provider of urban infrastructure and services(LU-36); • that would include those who already use City services or who impact City infrastructure(LU-41); and • that includes environmentally sensitive areas and vacant land where future development could adversely influence the environmental and land use character of Renton(LU-42). 2) PAA status and PAA agreements with other cities, if anx: The City of Renton has an adopted Potential Annexation Area. This area includes two or three sub-areas, which are shown on Renton's Comprehensive Plan and on the King County Interim Potential Annexation Area Map. The City has also negotiated a PAA boundary agreement with the City of Kent. No PAA agreement was necessary for the area currently proposed for annexation. 3) Required Comprehensive Plan amendments, if any: No amendment to Renton's Comprehensive Plan is necessary to process the current proposed annexation. 4) Comprehensive Plan approval date: Renton's current Comprehensive Plan was initially adopted on February 20, 1995, with annual amendments in subsequent years. The latest, 2004 Mandated GMA Comprehensive Plan Review was eompleted in November 2004. The City is currently processing amendments that are expected to be acted upon before the end of 2005, none of which would affect this area. 5) Required franchises to serve area: No franchise will be required for the City of Renton to provide services to the subject area. 6) Pre-annexation Zonin�greements: The subject area has not been the subject of a pre-Annexation Zoning Agreement. 7) Proposed land use desi ation: The subject area is designated Residential Single Family in the City's Comprehensive Plan. R-8 zoning is proposed to supplant the existing King County R-8 zoning, consistent with the adopted Residential Single Family land use designation, upon annexation. Under Renton's annexation process, zoning is adopted concurrent with the adoption of the implementing annexation ordinance. Revenues/Expenditures This analysis identifies the General Fund revenues and costs associated with annexing the subject properties as they are currently developed, as well as estimating the annual fiscal impact of their full development at some undetermined point in the future. "Full development" does not equate to the absolute zoned capacity. Rather, it includes an assumption that a portion of the subject properties will not develop within the foreseeable future due to market forces and the choices of individual property owners. All assumptions regarding revenues and costs are based on existing standards or other comparable data,but actual results are likely to vary from these estimates. Based upon current levy rates for fire, District No. 40 would lose approximately $793 in 2005 dollars at current development levels. 6) Estimated fire district expenditures reduced: The estimated savings to Fire District No. 40 because of this annexation is also minimal. Using Renton's estimated response cost of $1.25 per person the district is currently only spending around $14.00 a year to serve the current population of an estimated 11 people. B. Services 1) Water Service The proposed annexation is within Soos Creek Water & Sewer DistricYs water service area. This service area would not change as a result of the proposed annexation. a) DirecbContract: Future development in this annexation area will have to notify the District regarding water availability and obtain a certificate of water availability prior to future development. b) Storage locations/Capacitv: The zoned residential capacity under the existing County R-8 zoning is considerable more than the capacity under the proposed City of Renton R-8 zoning. As noted above, this is beoause the County zoning allows bonuses up to 12 units per gross acre and the City's zoning restricts new development to a maximum of 8 units per net acre. Since zoning capacity under Renton's zoning is almost 30% less than what is currently allowed by the County, the District's capacity should be adequate for the water demand generated by post-annexation development. c) Mains to serve the area: Soos Creek Water & Sewer District will most likely require developers to extend mains into the annexation area as part of their future development proposals. d) Financing of proposed service: This will be financed by developers and normal user fees for existing and new residents. Renton would provide sewer the northern two thirds of the site and Soos Water to the southern one third of it. b) Mains to serve area: None of the annexation site is currently being served by the City of Renton. However, the City Wastewater Utility serves development to the north and west of the proposed annexation,where it abuts City boundaries. ' c) Disposal: Sewage disposal will be through METRO's treatment facilities. d) Capacity available: Renton's sanitary sewer system has sufficient capacity to accommodate full buildout of the proposed annexation area. Capacity for the southern third of the site should be verified through the Soos Creek Water&Sewer District. , e) Financing of proposed service: Improvements within this annexarion area would be anticipated to be made through developer extensions in the future and/or when residents decide they want sewer hook-up. 3) Fire Service a) DirecdContract: As noted above, fire prevention and suppression services are currently provided through Fire District No. 40. Following annexation, the City of Renton would directly provide prevention and suppression services to the subject area through its own fire department. b) Nearest stations: The annexation area is located between Fire Station#13 in the City of Renton and Station#42 in District No.40. Fire Station #13 is located at 17030 108�' Avenue SW approximately %2 mile south of the site and Station #42 is located approximately 4/5 mile south of the site at 10810 SE 176�'Street. c) Response time: Response time to any point within the proposed annexation boundaries could range from four to six minutes. Since both Fire Station #13 and Fire Station 42 are very close to the subject site response time is not expected to change much. d) StaffinQ: Station#13 is fully manned,with five firefighters on duty per shift. Station#42 is also fully manned and has three firefighters on duty per shift. e) Major equipment: Major equipment located at Station#13 includes two 1,500 gallon per minute pumpers and one aid car. General A) Annexation agreements for extensions of service: No applicable annexation agreements are in effect for the subject area. B� Topoaraphy and natural boundaries: The site slopes gently down to the northeast towards the east fark of Rolling Hills Creek with a slope of approximately 5%. This represents a 45.5-foot change over approximately 800 feet. B) Projected 10-year growth: The area is too small to make reasonable inferences from large-area growth forecasts. The City projects about 79 new single-family units in addition to the existing five units on the site. This is based on existing citywide R-8 densities and assumptions regarding identified physical and regulatory constraints to development of the site and the probable market availability of land for new development. D) Municipal or community services: With annexation, the property owners and residents would have access to a full range of urban services including police, fire, parks, libraries, community services, the City's neighborhoods program, annual community events, recreational programs and classes, and readily accessible local government. E) Potential delays in implementin� service delivery: The area is currently underserved in regards to park facilities according to the City's adopted level of service standards. This shortfall is identified in the City's Parks, Trails and Open Space Plan update. Staff esrimates a one-time cost in excess of the parks/recreation mitigation fee ($531 per house) of$32,107, as well as on-going parks maintenance costs of$2,592 annually for new parks associated with this annexation. The current waste hauler would continue to provide solid waste removal for seven years after annexation, according to state law. At that time, the area would then be included in the contract with the City's waster hauler. With the exception of parks and solid waste removal,no delays are expected in implementing service delivery to the area. City departments reviewing the annexation proposal indicated that they would be able to adequately serve existing and future development. Soos Creek Water & Sewer District is expected to continue to provide water service to the whole site and sewer service to the bottom 1/3'�. Renton's Wastewater Utility will provide sewer service to the northern 2/3rds of the site. No major obstacles to service delivery have been identified at this time. F) Evaluation of adequacy, costs, or rates of service to area: Existing services to the area appear to be generally adequate. As development occurs in the proposed annexation area, demand for services will increase. It is assumed that the cost of Washington State Boundary Review Board for King County Proposed Akers Farms Annexation 11/16/OS Page 11 such services will be largely offset by increases in property taxes, services charges and other revenues based on popularion. If the City were to assume this annexation at current leuels of development it would have to subsidize it for approximately $651 per year. At full development,in an estimated 10 years,the City would realize an annual surplus of an estimated$14,406 per year. King County is the only alternative service provider for services that would be assumed by the City of Renton upon annexation. Fire suppression services will change as a result of the proposed annexation. School district boundaries,however, are not affected by annexation. As a result the subj ect area will remain within the Renton School District. III. OBJECTIVES The proposed Akers Farms Annexation generally complies with all of the objectives of the Boundary Review Board. These include the following: 1) Preservation of natural neighborhoods and communities. No detrimental impacts to existing neighborhoods or communities are anticipated to result from the proposed action. 2) Use of physical boundaries,including but not limited to bodies of water, highways and land contours. The proposed annexation follows the existing city limits on its north. The boundaries of the annexation is defined by 108`�Avenue SE, if extended on the west,the south side of SE 164�''Street on the south,the Bonneville power transmission line corridor on the northeast, and a north-south line approximately 150 east of the eastern edge of 109`�'Avenue SE, if extended, on the east. 3) Creation and preservation of logical service areas. City staff that have reviewed the proposed annexation have stated that the proposed boundaries appear to represent logical extensions for City of Renton services such as police, fire and sewer. Also,the Countywide Planning Policies state that cities are the appropriate providers of local urban services to Urban Areas. The proposal would therefore further both the intent of the City annexation objectives and the Countywide Planning Policies. 4) Prevention of abnormally irregular boundaries. The boundaries do not create abnormally irregular boundaries. The surrounding area to the southeast is also within Renton's Potential Annexation Area and is anticipated to be eventually annexed into the City. Therefore,any irregularities that do occur are considered to be only interim. 5) Discouragement of multiple incorporations of small cities and encouragement of incorporation of cities in excess of ten thousand population in heavily populated urban areas. SPECIAL Bob Edwards,Port of Seattle Commission President, gave an update on the P1tESENTATIONS following Port of Seattle issues: the resolution of the third runway litigation at Transportation: Port of Seattle Seattle-Tacoma International Airport and creation of the Highline Forum; the Update opening of the new airport central ternunal in May; the impacts of the potential relocation of Southwest Airlines to Boeing Field and the Port of Seattle's opposition to this action; the light rail airport link connection; the increase in cargo container and cruise ship business at Seaport; and the upgrade of Fishermen's Terminal and the Shilshole Bay Marina. Commissioner Edwards noted the 17% increase in the port's net revenues in 2004, and the potential of exceeding those 2004 revenues in 2005. He concluded that overall, the Port of Seattle is in good shape. In response to Council inquiries, Commissioner Edwards reported that the Seaport is able to handle a capacity of three cruise ships at a time,and � explained that the advancements in cruise ship technology have increased the cruise ship business. Mr.Edwards further reported that the airport's third runway project is on course to be completed in 2008. Sound Transit: Phase 2 Update Sandra Meyer,Transportation Systems Director, reported that on August 12th, the Eastside Transportation Partnership (ETP)recommended approval of the Sound Transit amendments to Sound Move to allocate$19 million to the Rainier/Hardie and SW 27th St./Strander Blvd.projects, and the proposal will be presented to the South County Area Transportation Board (SCATBd)on August 17th. She introduced Joni Earl, Sound Transit Chief Executive Officer, � who presented an overview of Sound Transit and Sound Transit 2. Ms.Earl reviewed the project list of all the capital programs at Sound Transit, and noted the growth in ridership since 2004. In regards to light rail, she reported that there are cunently 14 miles under construction, and the Seattle- Tacoma International Airport link connection was recently approved. Ms.Earl also reported that of the 25 projects in the East King County Subarea, five projects are completed and in operation, seven projects are in construction, and the.balance are in engineering and design. � August 15,2005 Renton City Council Minutes Page 289 Continuing with Sound Transit 2 (ST2),Ms.Earl stated that on July 7th, after „ many public hearings, the Sound Transit Board adopted six changes to its long- range plan, which was originally adopted in 1996. The changes increase the emphasis on serving the designated urban centers, and stick with commuter rail, light rail, and bus rapid transit transportation technologies. She reviewed the ST2 preliminary project lists for the East and South King County Subareas, and ehe timeline for setting the ST2 project priorities, deternuning the financial needs,and bringing the package to a public vote. Ms. Earl concluded by reviewing the project evaluation criteria, such as ridership,costs,reliability, system integration and customer experience, which the Sound Transit Board must consider when making a.choice among competing transportation technologies. Mayor Keolker-Wheeler expressed her appreciation to Councilmembers Persson and Palmer for serving on SCATBd and ETP. Councilman Corman � noted that the Transportation Committee will review on 9/1/2005 the list of prioritized projects within Renton for inclusion in the ST2 work plan. In response to Councilman Persson's inquiry regarding annexing areas to the Sound Transit District,Ms.Earl explained that per Sound Transit's policy, jurisdictions must want to be annexed. Community Event: Renton Community Relations Specialist Sonja Mejlaender introduced Bill Hulten, River Days Recap IKEA Renton River Days Board of Directors Chairman, who presented a report on the 2005 City of Renton community festival held during the week of July 19th through July 24th. Mr. Hulten thanked the City of Renton, the sponsors and contributors, the media partners, and the Renton service clubs for their assistance and support. He reviewed the festival events, activities, entertainment, and exhibitions that took place, such as Kids'Day,Art in the Park,Nibble of Renton,Library Book Sale, and the Skate Park Exhibition. In conclusion,Mr.Hulten expressed his appreciation for the many volunteers who contributed over 9,500 hours in planning for and assisting with the festival. PUBLIC HEARING This being the date set and proper notices having been posted and published in Annexation: Akers Fartns, accordance with local and State laws,Mayor Keolker-Wheeler opened the 108th Ave SE&Puget Dr S public hearing to consider the 60% Notice of Intent to annex petition and R-8 zoning for the proposed 13.3-acre Akers Farms Annexation,located south of Puget Dr. S. and east of 108th Ave. SE, if extended. Alex Pietsch, Economic Development Administrator,reported that the site contains five single-family dwellings, and slopes downward from the southwest corner to the northern point at a 3% slope. The northern portion of the site contains an unclassified coal mine hazard area. In regards to the public services, he indicated that the site is within Fire District#40, the sewer service areas of Renton and the Soos Creek Water and Sewer District, the water service , area of Soos Creek Water and Sewer District, and the Renton School District. Mr. Pietsch noted that the site is currently zoned R-8 (eight dwelling units per gross acre) in King County. Renton's Comprehensive Plan designation for the site is Residential Single Family, for which R-8 (eight dwelling units per net acre)zoning is proposed. Reviewing relevant City policies and Boundary Review Board criteria,he explained that this smaller than normal annexation is limited to the future development of 84 or fewer single-family lots and has poor connectivity to the City because of the power line corridor to the northeast. However;the annexation proposal is a potential catalyst for the annexation of a � August 15,2005 Renton City Council Minutes Page 290 larger area to the east, and will facilitate upgrading this portion of Benson Hill under City development standards. Continuing,Mr.Pietsch said the fiscal impact analysis indicates a surplus of $25,990 at full development, and an estimated one-time parks acquisition and . development cost of$33,708. He noted that staff suggests Leve12 flow control for new development, and that the cumulative impact of recent annexations will eventually require more police staff. Mr. Pietsch concluded that the proposed annexation serves the best interests and general welfare of the City,particularly if the annexation facilitates higher quality development near Nelsen Middle School. Public comment was invited. Robert Ableidinger, 10908 SE 164th St.,Renton, 98055, expressed his opposition to the inclusion of his property in the annexation proposal, which consists of approximately 2.5 acres and is located on the eastern edge of the site. He explained that he has been out of town for over three years, and did not have any input into whether he wanted to be a part of the annexation or not. Mr. Ableidinger asked that his property be removed from the annexation area. Additionally,he noted that it is difficult to afford and obtain building pernuts from the City of Renton. Mayor Keolker-Wheeler countered that Renton is lrnown for its quick,easy, and predictable pernut activity. Councilman Corman also noted the City's fast pernut issuance process, and stated that he does not want to force Mr. Ableidinger to come into the City if he objects. Mr. Ableidinger noted the potential of developing more units on his property if it remained in King County. Mr. Pietsch stated that there may be a net reduction in Mr. Ableidinger's ability to develop his property if it were in Renton; however, the City's development fees are approximately an eighth of the cost of the fees in King County. In response to Mr. Corman's inquiry, City Attorney Larry Warren confirmed that at this point in the process,property can be withdrawn from a proposed annexation. Councilman Clawson expressed concerns regarding setting a precedence and creating holes or irregular boundaries if property were to be removed from an annexation area,in this instance or in any other,unless there were extreme circumstances. On the East Renton Plateau: • Incremental annexation of the area should continue at the adopted density and development standards. • Staff should develop a strategy for annexation and provision of services to this area in the most efficient and cost-effective manner. 7. Incremental annexation of the Talbot Ridge/Springbrook Watershed areas should continue at the adopted density and development standards, particularly in areas where the City owns park lands or is the established provider of sewer service. 8. The City should work with the Boundary Review Board to expand the boundaries of the proposed Maplewood Addition annexaCion to include the entire SR-169 Corridor, including Maplewood Ridge Estates. At a minimum, the City should ask the Boundary Review Board to remove this area from the proposed Fairwood incorporation. 9. The Council would like more information about the long-term fiscal impacts of annexing the.West Hill before any decisions are made about annexation or establishing this area as a new potential annexation area. 10. The proposed annexation is 80% undeveloped except for the houses along SE 164th Street. About half a mile downstream, the proposed annexation drains to the East Fork of Rolling Hills Creek. Flooding problems exist in the lower reaches of Rolling Hills Creek on the Renton Village site. Any development of the annexation should, therefore, be subject to stream protection storm water detention standards. Future development should be required to comply with the 1998 King County Surface Water Design Manual standards for water quality and provide Level 2 Flow, unless the City has adopted an equivalent or stricter % standard at the time of development application. The on-site topography includes areas that appear to be wetlands and an open drainage course, so that any development of the site should be required to provide a wetland delineation report and may be subject to wetland protection regulations per the Renton Municipal Code, if wetlands are identified on the site. The proposed annexation is bordered on the west by Nelson Middle School, and on the northeast Cypress Point Condominiums (a.k.a. Puget Drive Condos). The 60 Bowlake Water Pipeline passe"s along the north boundary. To the east is a largely undeveloped residential property, and SE 164th Street runs along the south boundary. The 350 ft wide Bonneville Power Easement overlaps the northeast portion of the annexation. 2. Are you aware of any problems or deficiencies in existing infrastructure or service provision to the area? We observed about 300 ft of 12" diameter culvert along SE 164th Street needs to be cleaned out. Most pipe inlets were buried in sediment. At the north end of the proposed annexation a 10 ft, 18" diameter cmp culvert conveys all runoff from the annexation area wnder an asphalt walk. This culvert has been flattened to a degree and should be replaced when the annexation is further developed. A little farther north, immediately downstream of the annexation, the private storm drain system that services this area is in need of maintenance. This system was built as part of the Cypress Point Condominiums project (a.k.a. Puget Drive Condos). . 3.
