Dear Mr. Dalpay:
This letter is to inform you that the Site Plan Review Committee revised their decision
on the above referenced project. During the appeal period, we received a request for
reconsideration. The Committee was asked to reconsider the size of the driveway from
twenty (20) feet, as shown on the submitted plans, to thirty (30) feet in order to allow
two cars to use the driveway at the same time. In addition, property is being rezoned in
the area (along Aberdeen Avenue N.E.) to allow multiple family developments.
Development of the area will result in additional traffic to Sunset Blvd. N.E. in front of
the subject site. Therefore, the Environmental Review Committee reviewed the request
and determined that there should be a covenant attached to the property stating that, at
such time when the property to the north develops, a joint driveway will be developed
between the two properties.
Since this is a new condition of the Committee on your project, you have the right to
directly appeal the condition. Any requests for reconsideration or appeal are to be in
writing. Reconsiderations of the project are to be addressed to the Environmental
Review Committee and submitted before 5:00 PM on March 20, 1989.
An appeal must be submitted in writing to,the Hearing Examiner before 5:00 PM on
March 20, 1989, and be accompanied by a $75.00 non-refundable fee.

At ERC meeting on 2/8/89, we agreed that Don Erickson would pursue the question
of driveway widths as they relate to arterial streets. We concluded:
1) Re: The specific instance at 715 Sunset:
The adjacent property is owned by the same individual who owns the
715 Sunset property. Don Erickson will pursue the possibility of
' having the owner build an adjoining driveway on the adjacent
property. He will report back on the situation prior to final
approval of the building permit.

2) Re: The general condition:
Gary, please investigate the possibility of. revising the parking &
loading code to mandate 30 feet driveway widths for driveways
leading onto arterials.

relates to Item. #5 in the Findings. The Traffic Engineering Division asked •

contrary to the driveway ordinance. The reasons for our.request are:

Having reviewed the written record in the matter, the Site Plan
Review Committee now makes and enters the following:
Findings:
1. The applicant, James W. Dalpay, has requested site plan
approval to allow the construction of a four-plex.
2 . The applicant' s file containing the application, the State
Environmental Policy Act (SEPA) documentation, the comments
from various City departments, the public notices requesting
citizen comment, and other pertinent documents was entered
as Exhibit No. 1.

SEPA (RCW 43 . 21C, 1971 as amended) , a decision was made by
the Environmental Review Committee that the subject project
action was exempt from SEPA review. An environmental review
was, however, conducted in September 1987 and a
Determination of Non-Significance-Mitigated was issued for a
programtic rezone request to the R-3, Residential-Multiple
Family zone currently on the site. The mitigation measure
imposed on the rezone then was as follows:
a. That the rezoning of the site to R-3 to allow a
multi-family structure on the property .be
conditioned upon an approved site plan review to
mitigate concerns about steep slopes, the narrow
size of the lot, and possible traffic hazards at
the Aberdeen/Sunset intersection.
4. Plans for the proposal have been reviewed by all City
departments affected by the impact of this proposal.
5. The site plan, as presented, complies with the parking
requirements of the Parking and Loading Ordinance of the
City of Renton. The City's Traffic Engineering Division has
asked that the driveway to the site be a minimum width of
thirty (30) feet. This width is also the maximum width
allowed under the City code (See Section 4-2204 (B) 3) . If
the driveway were to be thirty (30) feet as requested, the
width would be in violation with another code provision of
the Parking and Loading Ordinance which states that,
" . . .driveways shall not exceed forty percent (40%) of the
street frontage. " In this case, the lot width is 50.82
feet. Forty percent (40%) of this width is 20.328 feet.
Thus, the applicant's lot width is as wide as it can be,
without a variance.
The applicant has also provided six (6) parking stalls as
required by City code for the four-plex. The parking stalls
meet the Parking and Loading Ordinance.
6. The subject site was annexed into the City in 1959 by the
Adoption of Ordinance No. 1795 and zoned G-1, General Use.
The site was rezoned to R-1, Residential-Single Family, in
1982 ; then in 1988 , the property was rezoned to the present
R-3 , Residential Multiple Family, designation presently on
the site.
7. The site is surrounded by a mix of single-family and
multiple-family uses to the north, single-family uses to the
east, a commercial establishment to the south, and- I-405 and
the Puget Power r.o.w. to the west.
8 . The subject property is narrow (50 feet) and long, with a
depth of approximately 200 feet. The terrain is hilly,
sloping downward from east to west.
9 . The applicant applied for and received approval for a
variance from the Board of Adjustment to allow the proposed
structure to be located within the required ten (10) foot
side yards. The Board conditioned the approval with the
following conditions:
a. Structure is to be two stories as shown on plans and
construction will start within sixty (60) days after
site plan approval.
b. Construction will be completed within one (1) year or
variance will become void.

10. Section 4-738 (D, 1) lists ten criteria that the Hearing is
Examiner is asked to consider along with all other relevant
information in making a decision on a Site Plan Approval
Application. These include the following:
a. Conformance with the Comprehensive Plan, its elements
and policies;
The subject project is in compliance with the
Comprehensive Plan designation of Medium Density
Multiple Family on the site as well as the
Comprehensive Plan policies on multiple family
development. The project is located near an arterial
street; the project design as modified will have
similar amenities as single family dwellings; the
project has been designed in a manner that will provide
minimal view blockage from nearby properties; and
attempts have been made to maintain the existing trees
on site.
The applicant should work with the City's landscape
planner to ensure that sufficient screening has been
provided along the arterial street.
b. Conformance with existing land use regulations;
The R-3 zone requires yard setbacks of thirty (30) feet
from Sunset Blvd N.E. , and rear and side yards of ten
(10) feet. The applicant's proposal meets the street
setback and the rear yard setback. Due to the
narrowness of the lot, the applicant sought approval of
a variance from the Board of Adjustment to allow the
side yards to be reduced to five (5) feet. The request
was granted and the applicant's plan shows five (5)
'foot side yards.
The R-3 zoning regulations have a provision for special
setbacks of development in R-3 zones abutting a single-
family residence provided that the property on which
the residence is located is both zoned and shown on the
Comprehensive Plan as single-family. Under this
provision, no special setbacks are required to buffer
the single-family residential use to the north as
required by the R-3 zone since that zoning and
Comprehensive Plan designations on the property are not
the same. However, the applicant must still provide
some buffering along the property line in compliance
with Section 4-2204 (6) with respect to the landscaping
of parking lots. This section requires a five(5) foot
planting strip or a forty-two (42") inch fence. The
applicant is providing both.
c. Mitigation of impact to surrounding properties and
uses;
The applicant has provided landscaping and a fence
along or near the north property line to buffer the
vehicle movements in the proposed parking lot from the
residential uses to the north. The parking lot is
oriented in a manner that should reduce any light
impacts from vehicles entering and leaving the site.
All parking is provided along the south side of the
property, adjacent to the abutting commercially zoned
property.
The building is setback on the property approximately
seventy-nine (79) feet from the street property line.
This is far enough to the west to prevent residents of

the project, with units on the north half of the
building, from having windows which look into the
adjacent single family residential structure which is .
located much closer to the street (Exhibit 4) .
The height of the building is well within the
limitation of fifty (50) feet for R-3 zoned properties
as specified in Section 4-709 (C) 6(a) . The height of
the applicant's proposed structure is approximately
thirty-one (31) feet and therefore should not interfere
with any views of nearby property owners.
d. Mitigation of impacts of the proposed site plan to the
site;
The project has been designed and located on the site
in a manner which follows the existing grade of the
site and minimizes the amount of grading done on the
site. Further, the proposed plans also show some
modification of the grades on the western portion of
the property, retaining some of the existing vegetation
and incorporating additional landscaping in this
portion of the property.
The plantings proposed in the landscaping plan are
sparse and the applicant will need to work with the
City's landscape planner on a revised landscaping plan.
In addition to more plantings, the applicant should
work with the City's landscape planner on providing
additional passive recreational space for the future
residents which should include some furniture.
e. Conservation of area-wide property values;
The subject proposal is expected to enhance property
values in the immediate area due to the quality of
design of the project and the sensitivity shown in
locating the building on the site.
f. Safety and efficiency of vehicle and pedestrian
circulation;
The applicant's site is narrow which restridts, to a
degree, the ability of the applicant to create a design
which completely separates the vehicular and pedestrian
circulation patterns. Staff does not anticipate any
problems with the circulation pattern due to the fact
that there will be a maximum of six vehicles on the
site at one time and it is not anticipated that all six
would be leaving at the same time. It is anticipated
that there will only be approximately six (6) to (8)
persons on the property as well. Therefore, the
likelihood of major pedestrian/vehicular conflicts
seems remote.
g. Provision of adequate light and air;
The project as designed and oriented on the site
provides sufficient light and air exposure for the
development.
h. Mitigation of noise, odors. and other harmful or
unhealthy conditions;
The proposal is not anticipated to create levels of
noise or amounts of odor above the existing levels in
the area. There will be an incremental increase in
noise due to the addition of the potential of six
potential vehicles at a site which has been undeveloped

and the addition 6 to 8 additional persons to the F,
immediate neighborhood. The five (5) foot high cedar
fence on the south side of the parking lot and a
retaining wall and 3 .5 foot fence near the north side
of the lot will contain most of the noise that will
impact residential properties to the north. In
addition, the fence on the retaining wall will also
provide a degree of safety to keep people from
accidently walking off the retaining wall.
i. Availability of public services and facilities to
accommodate the proposed use; and
The subject site is adequately served by public
services. There is a twelve (12) inch water line along
Sunset Blvd. N.E. and an eight (8) inch sanitary sewer
located near the west property line, on the applicant's
property.
Police and emergency services will be able to
adequately serve the site. The number of new residents
is expected to be less than eight (8) people and should
have minimal impact on these services. In order to
increase the level of safety for future residents, the
applicant should work with the Police Department on
appropriate measures to which provide some security and
safety for future residents as well as enable emergency
personnel to efficiently respond to service calls.
j . Prevention of neighborhood deterioration and blight.
The construction of the proposed development is not
anticipated to have any detrimental impacts on the
neighborhood which might result in neighborhood
' deterioration and/or blight.
Conclusions:
1. The subject proposal generally complies with the policies
and codes of the City of Renton.
2 . Specific issues raised by various City departments and
focused on were:
a. landscaping;
b. fencing;
c. security and adequate unit identification;
d. recreation; and
e. compliance with parking and loading requirements.
3 . The proposal complies with the Comprehensive Plan
designation of Medium Density Multiple Family and the zoning
designation of R-3, Residential-Multiple Family.
4 . This is an infill project which is adequately served with
public services.

Decision:
The site plan for James W. Dalpay, file no. SA-090-88 should be
approved subject to the following conditions:
1. That the applicant shall comply with the conditions of the
variance permit issued by the Board of Adjustment.
2. That the applicant shall work with the. Police Department on
appropriate measures by which to provide security and safety
for future residents as well as enable emergency personnel
to efficiently respond to service calls. �.
3 . That the applicant shall work with the City's landscape
planner to revise the landscaping plan for the site,
increasing the amount of plantings around the property.
4. That the applicant shall work with the City's landscaped
planner to provide some terraced and landscaped open space
for the future residents as well as providing some outdoor
furniture, such as picnic tables, bench seating, .etc, at the
western portion of the site.
For the purpose of these decisions, the term "should" and "shall"
are to be considered mandatory and the term "may" is considered
discretionary.
Notes to Applicant:
An applicant complying with these provisions and willing to hold
the City harmless for any expense or damages incurred for work
begun prior to the exhaustion of the 14-day appeal period and/or
for work which may consequently be stopped by an appeal or for
work required to be altered or returned to its preconstruction
state, may begin construction activities with the issuance of the
proper permits.

REOUESTS FOR RECONSIDERATION must be filed in writing on or
before February 3 , 1989.
Any aggrieved person feeling that the decision of the Site Plan
Review Committee is based on erroneous procedure, errors of law
or fact, error in judgment, or the discovery of new evidence
which could not be reasonably available at the prior meeting, may
make a written request to the Zoning Administrator for review by
the Site Plan Committee within fourteen (14) days of the
decision. This request shall set forth the specific errors
relied upon by such appellant, and the Committee may, after
review of the record, take further action as it deems proper. If
an appeal is made to the Hearing Examiner, requests for
reconsideration will be forwarded to that office for
consideration at the same time as the appeal.
AN APPEAL TO THE HEARING EXAMINER is governed by Title IV,
Section 3011(8) (1) , which requires that such appeals be filed
directly with the Hearing Examiner. Appeals must be made in
writing before 5 p.m. on February 3, 1989 accompanied by a $75. 00
fee and other specific requirements.
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex party
(private one-on-one) communications may occur concerning land use
decisions. The Doctrine applies not only to the initial
committee decision, but to all Request for Reconsideration as
well as Appeals to the Hearing Examiner. All communications
after the decision date must be made in writing through the
Zoning Administrator. All communications are public record and
this permits all interested parties to know the contents of the
communication and would allow them to openly rebut the evidence
in writing. Any violation of this doctrine could result in the
invalidation of the request by the Court.

Dear Mr. Dalpay:
The Renton Board of Adjustment at its regular meeting on May
25, 1988, granted your request for a variance as stated
above with the following conditions.
1. Structure is to be two stories as shown on plans and

1. CALL TO ORDER
The regular meeting of the Board of Adjustment was
called to order by Chairman Young at 8 :00 p.m.
2 . PLEDGE OF ALLEGIANCE
Chairman Young led the Board and audience in the Pledge
of Allegiance to the flag.
3. ROLL CALL
The Secretary called the roll. All members were
. present with the exception of Smock, Lally and Karinen.
ACTION: Motion made by ANDERSON, seconded by CONNEL
that the absent members be excused.
MOTION CARRIED.
4. APPROVAL OF MINUTES
ACTION: Motion made by ANDERSON, seconded by CONNEL
that the minutes of April 27, 1988 be
approved as written and distributed.

5. PUBLIC HEARINGS SCHEDULED
(a) V-536-88 JAMES W. DALPAY requests a variance
to Section 4-709,A-C4, to construct a building
within the sideyard setback: property located in .
the vicinity of 715 Sunset Blvd. N.E.
Mr. Hanson advised that the property was zoned R-
3 , Multi-family and that the lot is a long narrow
piece of property, approximately 50 ' x 200 ' . The
lot also has a substantial slope toward the
highway. The lesser sloping area is proposed for
the parking area, which Mr. Hanson pointed out on
the site map. There would be two levels to the
building although from Sunset, it would appear to
be only one story. As the project is proposed, it
would not block any views. The contractor would
be limited to a 30 ' wide structure because of the
lot size. Mr Dalpay wants to construct his
building five (5) feet from the property line
which would meet the Building Code but not the
Zoning Code.

Continuing, Mr. Hanson said the parking would be
on an upper level with a stairway, down to the
building. He read the letter of justification
which stated in part that:
a. To build within the sideyard setback will
result in a four story building which is
permitted in the R-3 zone but not desirable
to the adjacent properties.
b. Granting of the variance will not be
detrimental to the surrounding property since
the building height will be reduced to
residential scale, two stories in contrast to
possible four stories.
c. Recent developments in the area enjoy similar
benefits. -
It would be too restrictive with the sideyard
setback.

Mr. Hanson then showed slides of the property
noting that with the trees removed, it will have a
good view of the valley and Lake Washington. He
said that most of the vegetation will be removed
and open up the view considerably.
The chairman asked if there were any questions the
Board would like to ask Mr. Hanson. There were
none at this time.
Mr. Young invited comment from the applicant.
James Dalpay, P.O.Box 2436, Renton, WA. 98056, was
present to speak on behalf of his application. He
stated that the lot is narrow and also very steep.
The lot to the north is zoned residential and
enjoy less than a 5 ' setback. The south lot is B-
1 and enjoy a zero lotline setback. Mr. Dalpay
stated that it would not be detrimental to the
surrounding property. He stated that his proposed
building will not be any • larger than some
residential.
Mr. Dalpay said he plans on having four units
although he could have six units. He feels this
will be more aesthetic to the area, will mitigate
the view to the east. Six units would block the
view from Sunset, and developing the property from
the north would block the view: also. He stated
that recent developments to the north enjoy
similar benefits.
In response to an inquiry as to when construction
would commence, Mr. Dalpay said he had been held
up three months because of zoning so he now plans
to start in July or August. He could not do this
without the setback variance and it would not be
feasible because of the lot size. It would be
detrimental, view wise, to construct a four story
structure. He said there is a nice residence
across from the lot and, without the variance, he
would block their view. The trees they see now
are approximately 15 to 20 feet high but if he
would go up with six stories, it would be
considerably higher.
Mr. Dalpay was asked if he would build a four
story structure if the variance was not granted.
He replied that he probably would go to six
stories which would be allowed in the present
zoning. He felt the Ordinance was wrong to have ..

story building, fire trucks would have difficulty
getting around the building.
Mr. Hanson .responded that fire trucks would not be
going onto the property other than possibly into
• the driveway, in any case, because of the steep
slope. Five foot is the minimum setback. Ten
feet is stated in the Zoning Ordinance for R-3 and
R-4 zones, which covers complexes of small nature
such as this and large complexes.
The Chairperson called for further comment in
support of the proposal. There were none.
The Chairperson then called for comments in
opposition. There were none.
The public hearing was then closed.
' The Chairman then opened the matter for
discussion. There being none, Connel asked to
entertain a motion.
• ACTION: Motion by CONNEL,• seconded by ANDERSON, that the
• Board grant the variance request as there are special circumstances. The
property lot is narrow and the topography is such to limit the proposed
construction. Proposed construction is much more desirable than what is
legally permitted and will comply with the ordinance. The following
• conditions will apply. It will be constructed with two stories as shown on
the plan, construction starting by August 30th.
At this point, it was noted that Mr. Dalpay still must go through the Site
Plan approval with the Zoning Division, which could be a lengthy
process.
The construction dale was then changed to sixty days after approval with
completion within one year of the variance would become void.

apartment building within five feet of the property line in a R-3
zone.
BACKGROUND: The subject lot was recently rezoned from single family
residential to R-3 which is medium density multifamily
zoning. The location is abutting Sunset Blvd NE which is a
minor arterial. Presently the lot is vacant and wooded. There
is considerable slope from Sunset to the west where the lot
abuts the freeway. The lot to the north has a single family
residence on it at the present time. The zoning of the
northerly lot is R-1. Most of the houses in the area are one
story or two story in height. The houses across Sunset Blvd
have some view of Boeing and Lake Washington. Construction
of a tall building may partially block some of the neighbors
views.
The subject lot is 50 feet by 207 feet. The long narrow shape
of the lot and the steep topography make locating a building
more difficult. A 10 foot side yard setback is required in an
R-3 zone for a lot that is 50 feet wide. The subject to the
north being zoned R-1 would require a 5 foot sideyard
setback. The maximum width of building allowed on the
subject lot would be 30 feet. The owner has stated that in
order to build four units he would have to go up four stories
rather than the two he is proposing.
RECOMMENDATION: The granting of the variance will preserve some views from
the neighbors properties.

We have received the above-referenced application and have
completed a preliminary review of the proposed project. In
order to proceed further with evaluation of your
application, we must have the following materials:
1. A revised vicinity map (see enclosed instructions) .
2 A revised site plan which includes: a) relocation of
the proposed structures approximately ten (10) feet
toward the western property line; and b) provision of a
front yard area, including landscaping and amenities
(e.g. patios) , to the east of the structures in the
area made available by the proposed westerly
relocation.

action to rezone the subject property to R-3 , Medium
Density Residential Use, which require that site plan
approval be obtained prior to development of the
property.
