TERRITORY OF THE CITY OF RENTON (SMITH ANNEXATION; FILE NO. A-98-002). WHEREAS, under the provisions ofRCW 35A.14.120 as amended, a petition in writing 'requesting that certain territory contiguous to the City of Renton, as described below, be annexed to the City of Renton, was presented and filed with the City Clerk on or about January 25, 1999; and WHEREAS, prior to the filing and circulation of said petition for annexation to the City of Renton, the petitioning owners notified the City Council of their intention to commence such proceedings as provided by law, and as more particularly specified in RCW 35A.14.120, and upon public hearing thereon, it having been determined and the petitioning owners having agreed to assume the pre-existing bonded indebtedness of the City of Renton as it pertains to the territory petitioned to be annexed; and to accept that portion of the City'S Comprehensive Plan as it pertains to the territory including the applicable Zoning Code relating thereto; and WHEREAS, the King County Department of Assessments has examined and verified the signatures on the petition for annexation and determined the assessed valuation of all the properties, the same being in excess of sixty percent (60%) ofthe area to be annexed, in value, as provided by law, and the petition also setting forth the legal description of the property according to government legal subdivision or plat, and the Economic Development, Neighborhoods and Strategic Planning Department of the City of Renton having considered and recommended the annexing of said property to the City of Renton; and I C) .. ORDINANCE NO. 4819 WHEREAS, the City Council fixed May 3, 1999 at 7:30 P.M. as the time and place for public hearing in the City Council Chambers, City Hall, Renton, Washington, upon the petition and notice thereof having been given as provided by law; and WHEREAS, pursuant to said notices public hearings have been held at the time and place specified in the notices, and the Council having considered all matters in connection with the petition and further determined that all legal requirements· and procedures of the law applicable to the petition method for annexation have been met; and WHEREAS, the King County Boundary Review Board having deemed the "Notice of Intention" approved as of October 7, 1999, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION I. The findings, recitals, and determinations are hereby found to be true and correct in all respects. All requirements of the law in regard to the annexation by petition method, including the provisions of RCW 35A.14.120, 130, 140 and 150, have been met. It is further determined that the petition for annexation to the City of Renton of the property and territory described below is hereby approved and granted; the following described property being contiguous to the City limits of the City of Renton is hereby annexed to the City of Renton, and such annexation to be effective on and after the approval, passage, and publication of this Ordinance; and on and after said date the property shall constitute a part of the City of Renton and shall be subject to all its laws and ordinances then and thereafter in force and effect; the property being described as follows: See Exhibit" A" attached hereto and made a part hereof as if fully set forth herein 2 ORDINANCE NO. 4819 () (Said;roperty, approximately 12 acres, is located east of Hoquiam Avenue N.E. SECTION II. This Ordinance shall be effective upon its passage, approval, and five days after its publication. Items noted included: * The City received the State's share of the Cedar River Flood Control project, which amounted to $1,473,750. * The Human Services Division was thanked by an elderly couple of limited income who were grateful for the assistance they received from the City's Housing Repair Program. Mr. Covington then read a memorandum from Planning/Building/Public Works Administrator Gregg Zimmerman, which stated that due to construction delays of the Cedar River Flood Control project, the Cedar River Park between Logan Ave. and Lake Washington Blvd. will not be reopened until next June. Although grass seeding of the park began on October 6th, the new turf will be highly susceptible to damage until sometime next spring. In addition, repair of certain construction deficiences cannot take place until the grass turf is established. The memo added that construction delays have also affected the timing of work at the Senior Center, for which the estimated completion date has changed from January until early spring. Items on the consent agenda are adopted by one motion which follows the listing. City Clerk submitted Quarterly Contract List for July I -September 30, 1999; 73 agreements totaling $8,724,025.19. Information. Community Services Department submitted CAG-98-088, Construction of Renton Municipal Jail; and requested approval of the project, commencement of60-day lien period, and release of retained amount of$127,437.89 to Construction Enterprises & Contractors, Inc., contractor, if all required releases are obtained. Council concur. Court Case filed by Lembhard G. Howell and Mark E. Koontz, 720 Third Ave., Suite #2105, Seattle, 98104, representing Errol Norman, alleging false arrest, assault and battery, intentional and negligent infliction of emotional distress, malicious prosecution, violation of his civil rights, and negligence in connection with his arrest by Renton police officers on 6/28/98 for resisting arrest. Economic Development, Neighborhoods and Strategic Planning Department submitted an application to amend the Comprehensive Plan Land Use Map to change a 1.97 acre site at 2412 Ferndale PI. NE from Rural Residential to Residential Single Family (Anona Ridge). Refer to Planning & Development Committee. Economic Development, Neighborhoods and Strategic Planning Department submitted an application to amend the Comprehensive Plan Land Use Map to change Renton's Potential Annexation Area boundary to include approximately 25 acres in the West Hill area, and to change this site's land use designation to Residential Options. McCorkle & Associates hires students from the Renton School District's work experience program, some of whom have continued to work for them after completing the program. The business also offers job shadow opportunities for students interested in accounting. Robert McCorkle accepted the award on behalf of his company, noting that two of his children attend high-quality Renton schools. This being the date set and proper notices having been posted and published in accordance with local and State laws, Mayor Tanner opened the public hearing to consider the 60% Annexation Petition and proposed zoning for 12 acres located east of Hoquiam Ave. NE (142nd Ave. SE) and generally between SE 113th and I 16th Streets; Smith Annexation. Owen Dennison, Senior Planner, explained that the proposed annexation'area is adjacent to Hazen High School, east of Hoquiam Ave. NE. Signatures representing approximately 85% of the total assessed valuation were, included on the 60% Petition. Existing land uses include three single family homes and a construction business. Existing zoning under King County is R -4. Renton's Comprehensive Plan designations for the area are both Residential Single Family and Residential Rural. The proposed zoning under the City of Renton is R-8 and R-5. Continuing, Mr. Dennison said if the properties are annexed, they would continue receiving water service from Water District 90. All other public services would be provided by Renton. Referring to the fiscal analysis performed by staff, he noted that under both existing development and estimated full development, the properties would pose an annual deficit to Renton ($399 and $635 per year, respectively). The full development scenario assumes 55 single family homes and a population of 138. An additional one-time expense of$30,058 is estimated for the acquisition and development of parks to serve this area (anticipated mitigation fees have bcen taken into account). Mr. Dennison concluded that the proposed annexation is generally consistent with Renton's Comprehensive Plan policies and the objectives of the King County Boundary Review Board. Staff foresees no impediments to the extension of City services to this area. Councilman Parker inquired about the financial impacts and the projected annual deficit to the City upon annexation. Mayor Tanner replied that because this is almost always the case when large, developed residential areas are annexed, Renton is focusing on annexing smaller, relatively undeveloped properties. Council President Edwards added that while it certainly costs to provide services to residential areas, local governments are not motivated solely by financial considerations. For example, municipalities have a strong and valid interest in ensuring that development proceeds in a logical, coordinated manner. Audience comment was invited. This being the date set and proper notices having been posted and published in accordance with local and State laws, Mayor Tanner opened the public hearing to consider the proposed R-S (Residential Single Family; eight dwelling units per acre) zoning for the Davis annexation area; 3. S acres located in the vicinity of 132nd Ave. SE (Union Ave. NE) and NE 26th Street. Owen Dennison, Senior Planner, explained that the proposed annexation area, made up of one parcel, is located in the vicinity of Sierra Heights near NE 26 1h Street. Council accepted the 60% Petition to Annex on February 22, 1999, and authorized the submittal of a notice of intent to annex package to the Boundary Review Board. The BRB waived review and approved the proposed annexation on April Silo. Mr. Dennison said the last remaining issue before Council is the zoning to be applied to the property. Because Renton's Comprehensive Plan designates the area as Residential Single Family, concurrent zoning would be either Manufactured Home Park or R-S. Staff recommends R-S zoning, which would allow future development that would be more dense than both the surrounding area and the maximum density under existing King County zoning. Lower density zoning would require an amendment to Renton's Comprehensive Plan land use map. Mr. Dennison added that the property slopes towards May Creek to the northeast and northwest, with the slope exceeding 40% in several places. Councilman Clawson asked if the City will be able to serve the property with sanitary sewer. Mr. Dennison replied that Utilities staffhave confirmed that an existing sewer line can be extended to the parcel. Councilman Schlitzer expressed concern about the extremely sensitive nature of this area, saying that not only is it fairly steep, but the land contains a layer of clay close to its surface, heightening downhill erosion concerns. He was not comfortable with the proposed R-8 zoning, suggesting that R-5 or R-l might be more appropriate. Noting that the area is above May Creek, which is already impacted by stormwater runoff, Council President Edwards asked about the City's requirements for storm sewers and impacts. He was especially concerned that new development not worsen the scouring of the creek. Mr. Dennison said any development would be required to send the runoff direetly to May Creek without affecting the hillside. He added that, through SEP A, the City can impose higher mitigation standards than those put forth in the City Code. Mike Kattermann, Director ofNeighborboods & Strategic Planning, said because this property has a Comprehensive Plan designation of Residential Single Family and is not within one-half mile of the Urban Growth Boundary, it can only be zoned for mobile homes or as R-S. He suggested that the City can later look at whether the Comp Plan designation and the zoning should be changed. ill the meantime, staff can provide more information to the Council on the specific soil conditions and slopes in this area and how potential development (and its expeeted runoff) would be approached. Renton City Council Minutes Page 155 Councilman Connan commented that, even if the City closely reviewed a development proposal to mitigate the stormwater runoff from the property, those who end up living there could exacerbate the problem ifl the future by building sheds, decks, patios, etc" the effects of which cannot be factored in advance. Mayor Tanner pointed out that if the City changes the proposed zoning from R-8 to a lesser density, the proponents may no longer be interested in annexing. Councilman Edwards noted that even ifR-8 zoning were applied, the property could probably not be developed to that density since it is so affected -and therefore constrained -by sensitive areas. Councilmember Keolker-Wheeler was interested in knowing what, specifically, could be developed on the property under R-8 zoning, Councilman Clawson cautioned that the City should consider whether this area conforms to the May Valley plan, particularly as it relates to future development impacts on May Creek. Chief Administrative Officer Jay Covington reviewed a written administrative report summarizing the City's recent progress towards goals and work programs adopted as part of its business plan for 1999 and beyond, Items noted included: • The latest edition of City View, the City's video magazine show, is now airing on Channel 28. This edition spotlights Renton's Fire Department. • The City's Management Association recently contributed to the Community Services Department's scholarship program, which provides low-and moderate-income children and seniors an opportunity to participate in programs offered at the Community Center and Senior Activity Center. • A public meeting was held on April 29th at Houser Terrace in the Highlands to discuss proposed improvements to NE 23rd Street, including drainage facilities and sidewalks. Chief of Police Garry Anderson reported on a successful nuisance abatement conducted last week in the 200 block of Meadow Ave. North, A particular residence has long been the source of a disproportionate number of calls for service, exceeding 100 calls per year. The subject area is generally adjacent to Hazen High School. With the excepiion of three single family homes and a residential accessory building, the parcels are vacant. Development in the area has been constrained by the lack sanitary sewer service. The City's Critical Areas Inventory maps show high erosion hazard in the northeastern parcel. This parcel also includes a length of Honey Creek and areas where slopes exceed 25%. (see Structures and Features Map) No other sensitive areas are documented. The subject pmperties are designated Residential Single Family and Residential Rural in the Comprehensive Plan. Signatures representing about 49% of the total assessed valuation were included on the 10% Notice of Intent to Annex petition. The subject area includes three single family homes and one residential accessory building, while the remaining area is vacant. King County's current zoning for the properties is R-4. Renton's Comprehensive Plan designates the properties as Residential-Single Family and Residential- Rural. Typical zoning would be R-8 and R-5. All City departments and divisions state that service to the area would represent a logical extension of their respective functions and systems, with the exception of the Water Utility, as the properties are served by Water District 90. Referring to existing water quality, flooding, erosion and habitat problems within the Honey Creek sub-basin, Mr. Schlepp said as a result, any future development would be required to install storm water management facilities to City standards. Responding to Council President Edwards, Mr. Schlepp confirmed that the proposed annexation area is well within the urban growth boundary, which is situated east of 146th Ave. SE. Items noted included: • On October 15th, 28 Renton firefighters honed their skills at a practice bum in a donated Kennydale house. • The Seattle City Council approved the SeattlelRenton water franchise agreement on October 19th. The agreement will be presented to the Renton City Council for its approval on November 2nd. • The City Attorney's Office obtained a reversal of the injunction granted by King County Superior Court to the Lucas Children's Trust Fund, allowing work on the East Kennydale sewer interceptor to proceed. • City Transfer is currently removing the Cedar River dredge materials stockpiled at the Narco site, and expects to complete this job by the end of the year. Kim Browne, 1003 N. 28th PI., Renton, 98056, relayed her objection to Labrador Venture's proposed residential development in the vicinity of Lake . Washington Blvd., Burnett Ave. N., and N. 28'" PI. in the Kennydale area. She was troubled in particular by the proposed site access, which would not allow for sufficient sight distance, thus creating an unacceptable safety hazard. She was additionally concerned by the developer's application for a variance to clear almost 200 lineal feet of quality wildlife habitat along steep slopes. Saying that the plan must be changed to reflect the ideals of the community as well as to ensure public safety and the protection of an environmentally-sensitive area, she said the plat would be deserving of approval only if the following modifications are made: site access is moved from Burnett Ave. to Lake Washington Blvd. in the vicinity oflots 7 and 8; the zoning for the eastern 4.7 acres is maintained as R-l; and the ravine remains undisturbed and a road is not built over it, either by use offill and a culvert or by any other method (including a bridge). H:ldivlptslplanlannxlsmithlsmith _ldltgb9/11l98 Proposed Smith Annexation Project Narrative The property owner of 6.6 acres in a 12 acre area adjacent to the city limits has submitted a Notice ofIntent petition to the City to initiate annexation ofthese properties (12 acre area). The subject properties are east of Hoquiam Ave NE (142nd Ave SE), between SE 113th St (if extended) and SE 116 St (if extended). With the exception of three single family homes and a residential assessory building, the parcels are vacant. The City's Critical Areas Inventory maps show that the northeastern parcel ofthe annexation area is largely covered by Greenbelt and a high erosion hazard. A check of the contours in this area reveals slopes of up to 23%. No other sensitive areas are documented. Under the existing Comprehensive Plan land use designations, Residential Single Family and Residential Rural, post-annexation development would be residential, primarily single family detached. Zoning is not addressed at the 10% Notice ofIntent stage. City zoning will be assigned to the subject properties after two public hearings. Upon receipt of comments from staff, a public meeting wiIl be scheduled before the City Council to allow public comment on the proposed annexation. Additional lands may be added to the annexation proposal if interest is expressed prior to or during the public meeting.
