The address of this request is 225 SW 7th Street, Renton WA 98055 The requested revision would be for a temporary outside dining area directly off the north side of the building. It would be a temporary enclosed fence occupied by dining tables for the summer. The enclosed space would take up four parking stalls and temporarily stop the ability to drive through the north side of the buildings' parking lot. The structure is not on, nor is it attached to the sidewalk in any way. There is also no fire lane on that side of the building or in that parking area. The Committee, on February 04, 1997, issued a threshold Determination of Non-Significance-Mitigated with the following conditions: See enclosed Mitigation Measures document. Because the Environmental Review Committee imposed specific mitigation measures rather than issue a Determination of Significance, there is a required 15 day comment period during which comments are solicited from various agencies, jurisdictions or individuals (including the applicant) who may have an interest in the Committee's decision. The expansion would involve enclosing the northeast covered walkway of the existing building, increasing the interior space from 4,860 to 5,200 square feet. The applicant proposes to extensively remodel to incorporate new exterior and interior finishes, a revised kitchen location, handicap accessible restrooms, new windows, and an upgraded HVAC and electrical system. The applicant would also enlarge the trash enclosure/dumpster area by about 50 square feet, located at the southwest corner of the building. The building would have a maximum height of 17 feet. A sign structure located at the northeast corner of the building would have a maximum height of 26 feet. The proposal would add approximately 3,000 square feet of landscaping to the site. Most of this landscaped area would be added as part of a 20 foot wide landscaped walkway and building entry along the east front of the building. The proposal includes 28 on-site parking spaces and 50 parking spaces would be shared with the adjacent restaurant. The subject site is part of the Bonne!! Retail Center which includes Wal-Mart as the anchor store. The proposal would be accessed off two existing driveway cuts off SW 7th Street that serve the shopping center. Part Two: ENVIRONMENTAL REVIEW In compliance with RCW 43.21C.240, the following project environmental review addresses only those project impacts that are not adequately addressed under existing development standards and environmental regulations. A. Environmental Impacts The Proposal was circulated and reviewed by various City Departments and Divisions to determine whether the applicant has adequately identified and addressed environmental impacts anticipated to occur in conjunction with the proposed development. Staff reviewers have identified that the proposal is likely to have the following probable impacts: 1) Earth Impacts: Minimal site work is expected because the project site is presently developed and covered with impervious surfaces. Any potential erosion impacts would be mitigated by City Codes which require the applicant to provide a Construction Mitigation Plan and a Temporary Erosion and Sedimentation Control Plan (TESCP) prior to the issuance of a Construction Permit. Mitigation Measures No further mitigation is recommended. Policy Nexus NA 2) Air Impacts Impacts to air quality can be anticipated during construction and after occupancy of the proposed project. Impacts during construction would include increased levels of airborne particulates (especially dust) from disturbance of exposed soils. Construction impacts would be short term in nature and would be mitigated through best management practices of the required TESCP and with the Construction Mitigation Plan. Emissions from construction equipment exhaust would have a minor impact on local air quality. Exhaust from construction vehicles is regulated by State and City Codes. Vehicle emissions are regulated by the State of Washington. Mitigation Measures No further mitigation is recommended. Policy Nexus NA 3) Water Impacts The project site is presently developed with over 90% coverage in impervious surface. There is an existing storm drainage system that serves the site. The proposal would be decreasing impervious surface area by adding landscaping and would not be adding additional area subject to vehicular use. Therefore, no new drainage improvements are required. Mitigation Measures No further mitigation is recommended. Policy Nexus NA 4) Fire Protection Impacts The proposal would add new construction to the City which would potentially impact the City's Fire Department. A Fire Mitigation Fee applies to all new construction. The fee has been estimated at a rate of $0.52 per square foot of new construction. For the proposed development the fee is tentatively estimated at $176.80 (340 square feet X $0.52 = $176.80). The Fire Mitigation Fee is payable at the time that Building Permits are issued. Mitigation Measures The applicant shall pay the appropriate Fire Mitigation Fee at a rate of $0.52 per square foot of new construction. This fee is estimated at $176.80. The Fire Mitigation Fee is payable prior to the issuance of Building Permits. Policy Nexus Fire Mitigation Fee Resolution and adopting Ordinance, SEPA Ordinance. 5) Transportation Impacts Access to the project is proposed via 2 existing driveway cuts off SW 7th Street. The proposed expansion of the building is expected to generate a small increase in traffic to the site and therefore would be subject to the City's Transportation Mitigation Fee. Trip generation values are 'based on the ITE Manual and staff estimates an additional 9.52 average daily trips for the project. !The Transportation Mitigation Fee is calculated to be $75 per each average daily trip attributable to the project. The Traffic Mitigation Fee is estimated at$714.00 (9.52 trips x$75 = $714.00). Construction-related truck traffic could impact traffic flows if occurring during AM or PM peak traffic 'flows. This truck traffic should be limited to off-peak hours. Mitigation Measures The applicant shall be required to pay a Traffic Mitigation Fee of$75 for each 'average daily trip associated with the project. The traffic mitigation fee is estimated at$714.00 (9.52 trips x$75 = $714.00). This fee is payable prior to issuance of Building Permits. A construction plan indicating haul route and hours, construction hours and a traffic control plan shall be submitted for approval prior to any permit being issued. Haul hours shall be restricted from 8:30 a.m. to 3:30 p.m. unless approved in advance by the Development Services Division. Because these notes are provided as information only,they are not subject to the appeal process for environmental determinations. PLAN REVIEW WATER 1. There is a 12"water loop serving the site, including a 12"water main in SW 7th St. adjacent to the site. No additional main extensions will be required for this proposal. 2. No system development charges are triggered by this proposal. SEWER 1. The site is currently served by an 8"sanitary sewer main in SW 7th St. No additional main extensions will be required for this proposal. 2. No system development charges are triggered by this proposal. DRAINAGE 1. No additional impervious area, or additional area subject to vehicular use is proposed for this project. Therefore, no new drainage improvements are required. 2. No system development charges are triggered by this proposal. STREET IMPROVEMENTS 1. SW 7th St. adjacent to this site is a fully developed arterial street, with full street width paving, concrete curbs and gutters, and street lighting. The walkway is substandard, consisting of asphalt paving, instead of concrete. This project will require the replacement of the asphalt walkway along SW 7th St. adjacent to the development site with a concrete sidewalk. 2. The expansion of the building is expected to generate a small increase in traffic to the site. A traffic mitigation fee of$714.00 will be required prior to issuance of a building permit for this proposal. PLAN REVIEW-GENERAL 1. All plans shall conform to Renton Drafting Standards. 2. A construction permit is required. When plans are complete three copies of the drawings,two copies of the drainage report, a construction estimate, application and appropriate fee shall be submitted to the fourth floor counter. FIRE 1. An approved fire sprinkler system is required to be installed throughout drinking and dining establishments that exceed 5,000 square feet of unseparated area. The applicant may be able to avoid this requirement by providing a one hour occupancy separation wall(s)to divide the total area below 5,000 square feet. 2. Separate plans and permits are required to be submitted to and obtained from the Renton Fire prevention Bureau for the installation and/or modifications to kitchen hood fire suppression systems. PARKS The turf area is to be maintained by the property owner. AIRPORT The stated height of 26 feet and the location of the restaurant appears to have no impact upon the airport. Approval of the project and issuance of a building permit will constitute a determination that the project and the operation of a restaurant is a use compatible with the operation of the airport. The back, side and front doors need to be solid-core, preferably metal or metal siding, with peepholes for employee safety. All doors need heavy-duty dead- r bolts. This is needed to help prevent commercial burglary. Since there are so many smaller glass paned windows, this might encourage burglary by smashing windows to gain entry. Recommend shatter resistant glass, plexiglass, or Ian application of security film. The exterior needs to be well lit for customer and employee safety, and as a crime 'deterrent. The cash register needs to be out of sight and away from accessibility by customers or potential robbers. During construction/renovation, building materials and tools need to be locked up when not in use. Recommend security fencing around the site during this phase. Consistency with Site Plan Review Criteria: In reviewing the proposal with respect to the Site Plan Approval Criteria set forth in Section 4-31-33(D) of the Site Plan Ordinance, the following Issues have been identified by City Departmental/Divisional Reviewers: A. CONFORMANCE WITH THE COMPREHENSIVE PLAN. ITS ELEMENTS AND POLICIES The Comprehensive Plan designation for the project site is Employment Area - Commercial (EAC). The proposed use is consistent with the Comprehensive Plan designation. Land uses intended for the EAC designation are those that require large amounts of land and high visibility and access to large volumes of automobile traffic. Redevelopment of Employment Areas is preferred over expansion of the areas (Policy LU-176). The proposal utilizes the existing access and circulation pattern of the shopping center, providing for internal circulation among adjacent parcels and uses (Policy LU-170). B. CONFORMANCE WITH EXISTING LAND USE REGULATIONS; The project site is designated Commercial Arterial (CA) on the City zoning map. Eating and drinking establishments are a primary permitted land use in the CA zone. The proposal which is to renovate and expand an existing building complies with the development standards of the CA zone including building setbacks, building height, and lot coverage. The code requires an on-site landscape strip with a minimum width of 10 feet abutting public streets. The required landscaping does not presently exist on the site frontage. However, the applicant would not be required to install this new landscaping as the threshold for the standard is triggered when building expansion exceeds 1/3 the area of the existing building. The applicant would be required and proposes to install a landscape strip (removing existing SITERC.DOC City of Renton P/B/PW Department Environmenta :rmination&Administrative Land Use Action ' HOLE IN THE WALL STEAKHOUSE LUA-97-005,SA, ECF February 4, 1997 Page 8 of 12 asphalt area) and sidewalk improvements within the public right-of-way. There are also two potential landscape areas at the north corners of the project site boundaries which are not presently used for parking. These areas could be landscaped to enhance the entry into the site. The code requires a pedestrian connection between the building entry and the street. The proposal includes a landscaped walkway around the east and south sides of the building. However, it does not appear that the walkways connect to the sidewalk along SW 7th Street. The site plan should be revised to incorporate a pedestrian connection between the building entry and the sidewalk along SW 7th Street. Parking: The proposal is located within the Bonnell Property Retail Development. The shopping center includes Wal-Mart. The Wal-Mart project limits excluded the subject site and the adjacent Billy McHale's Restaurant. Therefore, the parking area that was approved for the Wal-Mart project may not be considered for this proposal. The subject proposal includes 28 on-site parking spaces, parking spaces located immediately adjacent to the building. Another 50 parking spaces are located west of the building and would be shared with Billy McHale's. This equals a total of 78 parking spaces existing for the 2 restaurant uses. The Parking and Loading Ordinance requires restaurants within a shopping center to provide a minimum of 4 parking spaces and a maximum of 5 parking spaces per 1,000 square feet of gross leaseable floor area. The Billy McHale's restaurant is approximately 5,508 square feet and the proposed restaurant 5,200 square feet, for a total of 10,708 square feet. Therefore, a minimum of 43 and a maximum of 56 parking spaces are allowed by the code. 78 parking spaces are presently existing on the site. The applicant should either revise the site plan to reduce the number of parking spaces to the maximum number allowed or apply in writing to the Administrator of Planning/Building/ Public Works for a modification from the parking code standard. The proposed site plan includes a 26 foot high sign structure located on the northeast corner of the building. The applicant will be required to submit a separate sign permit for all proposed signage. C. MITIGATION OF IMPACTS TO SURROUNDING PROPERTIES AND USES; The proposal would renovate and expand a former restaurant in a shopping center. The area is intensely developed with commercial uses and the proposed restaurant would be compatible with surrounding uses. The proposal would not adversely impact surrounding properties or uses. In order to ensure that outdoor lighting does not result in a glare/illumination problem on adjacent properties, the applicant should indicate that the proposed lighting is directed inward on the site. D. MITIGATION OF IMPACTS OF THE PROPOSED SITE PLAN TO THE SITE; The proposal would not result in adverse impacts to the existing developed condition of the site. The proposed landscaping would actually decrease the amount of impervious surface present on the site and the applicant would provide landscape and sidewalk right-of-way improvements. The applicant proposes to enlarge the trash enclosure/dumpster area located at the southwest corner of the building by about 50 square feet. The location is accessible for hauling trucks. CONSERVATION OF AREA-WIDE PROPERTY VALUES; The proposal would renovate and expand an existing building and would add site improvements. This would be likely to improve area-wide property values. F. SAFETY AND EFFICIENCY OF VEHICLE AND PEDESTRIAN CIRCULATION; Access to the project is proposed via two existing driveway cuts that provide access to the shopping center via SW 7th Street. This would provide for a safe and coordinated vehicular circulation system to the site. The site plan indicates the east driveway is a 40 foot ingress/egress access easement. The applicant should provide a copy of the access easement. The proposal includes an attractively landscaped walkway around the east and south sides of the building. However, the walkway does not appear to connect to the sidewalk along SW 7th Street. This connection would promote pedestrian circulation on the site and is recommended as a condition of approval. G. PROVISION OF ADEQUATE LIGHT AND AIR; The existing building that would be renovated in the proposal and the building footprint is sufficiently setback from property boundaries and other structures to allow for adequate light and air circulation. H. MITIGATION OF NOISE, ODORS AND OTHER HARMFUL OR UNHEALTHY CONDITIONS; The proposed land use is generally consistent with existing and anticipated commercial uses in the area. It is not anticipated that the proposal would create any harmful or unhealthy conditions. I. AVAILABILITY OF PUBLIC SERVICES AND FACILITIES TO ACCOMMODATE THE PROPOSED USE; AND The project site is adequately served by utilities and roads to accommodate the proposed land use. See the Advisory Notes section of this report for detailed information concerning utilities and public services. J. PREVENTION OF NEIGHBORHOOD DETERIORATION AND BLIGHT. The proposal would renovate a former restaurant and improve the site with landscaping and right-of-way improvements. The investment into redevelopment would assist in preventing the deterioration of the site and neighborhood. Findings 1) Request: The Applicant, John Wojtacha, has requested Environmental Review& Site Plan Approval for development of the Hole in the Wall Steakhouse. 2) Environmental Review: The applicant's file containing the application, the State Environmental Policy Act (SEPA) documentation, the comments from various City departments, the public notices requesting citizen comment, and other pertinent documents was entered as Exhibit No. 1. 3) Site Plan Review: The applicant's site plan application complies with the requirements for information for site plan review. The applicant's site plan and other project drawings are entered as Exhibits No. 2 thru 5. 4) Comprehensive Plan: The subject proposal is consistent with the Comprehensive Plan designation of Employment Area - Commercial. 5) Zoning: The site plan as presented, complies with the zoning requirements and development standards of the Arterial Commercial zoning designation. 6) Existing Land Use: Land uses surrounding the subject site include: North: Auto dealership and Pacific northwest Bell Telephone Offices across SW 7th St.; East: Burger King restaurant ; South: Bonne!! Retail Center parking lot; and West: Billy McHale's restaurant and parking, Wal-Mart. E. Conclusions 1) The subject proposal complies with the policies and codes of the City of Renton. 2) Specific Land Use (e.g. Site Plan Approval) issues were raised by various City departments. October 29, 1996 Ms. Laureen Nicolay Current Planning Division 200 Mill Avenue South Renton, WA 98055 Dear Ms Nicolay, I am requesting a preliminary project review for the remodel of the existing Shakey's Restaurant (presently closed)to a Hole In The Wall Steakhouse Restaurant at the building on outparcel "C" at Bonnell Retail Development. The location is SW 7th Street and Hardie Avenue SW, Renton, WA. We intend to extensively remodel the building to incorporate new exterior/interior finishes, new windows and locations, upgraded HVAC and electrical system, handicap accessible restrooms and revised kitchen location. In addition to the above, we would be enlarging the dumpster area by about 50 square feet and enclosing a portion of the northeast covered entry walkway to become a part of our interior space. The present building square footage including vestibule is approximately 4860. By enclosing the northeast covered walkway, we will bring the total interior space to 5200 square feet. An Environmental Impact Statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the • quality of the environment. The purpose of.this checklist is to provide information to help you and the •agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can . be done) and to help the agency decide whether an EIS is required. INSTRUCTIONS FOR APPLICANTS: This environmental checklist asks you to describe some basic information about your proposal. Governmental agencies use this checklist to determine whether the environmental impacts of. your proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise information known, or give the best description you can. You must answer each question accurately and carefully, to the best of your knowledge.
