EE23158 CASE# 23-13200 OF COLLISION 11/15/23 13:34 OF CbLLI510N NARRATIVE 23-13200 On 11/15/2023 at approximately 1336 hours, I was dispatched to a vehicle collision with reports of injury at ACE Hardware, located at 4601 NE Sunset Boulevard, within the City Limits of Renton, County of King, State of Washington. While en route, Dispatch advised that the collision involved two vehicles and that one vehicle had "t- boned" the other. Dispatch also reported airbag deployment on at least one of the involved vehicles therefore the Renton Regional Fire Authority (RRFA) was simultaneously dispatched to the scene. Upon arrival, I noticed heavy mechanism to the involved vehicles which was not typical for a parking lot-type collision. RRFA arrived on scene shortly thereafter and evaluated all involved parties at the scene where they were later released. While on scene, I collected each of the involved parties driving documents and their independent recollection of the events leading up to the collision. The driver of Unit#1 stated that he and his girlfriend were inside of his father's vehicle. The driver of Unit#1 stated that his parents did not know he was in possession of their vehicle and that they had no idea he was driving it. The driver of Unit#1 stated that prior to the collision, he was traveling westbound through the parking lot at no more than "30-35mph" and was in an active argument with his girlfriend which may have distracted him. The driver of Unit#1 stated he was intending to drive to McDonald's when a vehicle turned into the parking lot from the north entrance. Upon the involved vehicle (Unit#2) entered the parking lot, Unit#1 collided into the driver's side of Unit#2. Both vehicles then made secondary contact with a stationary vehicle charging station. Unit#1 suffered significant damage to the front of the vehicle because of the collision. The driver of Unit#2 said he was the sole occupant of his vehicle and was traveling westbound in the 4600 block of NE Sunset Blvd (JWO Duvall Ave NE) and had gotten into the two-way center-turn- lane. The driver of Unit#2 stated that he stopped to yield to oncoming traffic with the intent to turn south (left) into the private property parking lot located on the south side of the roadway. The driver of Unit#2 stated that he observed Unit#1 traveling several hundred feet away from the intersecting lanes of the parking lot and assumed Unit#1 was traveling at a safe speed within the parking lot. The driver of Unit#2 believed that he had plenty of time and distance to continue into the parking lot. The driver of Unit#2 stated that he continued through the parking lot when he felt the impact of Unit#1 colliding into the driver's side of Unit#2. The driver of Unit#2 stated that he believed Unit#1 was traveling too fast in the parking lot. Unit#2 suffered significant damage to the side of the vehicle because of the collision. Due to the initial impact, Unit#2 also made secondary contact with a stationary vehicle charging station. Based on the above statements and after examining the heavy mechanism from the three involved vehicles, I believe that the driver of Unit#1 is the predominant factor for the cause of collision due to traveling at unsafe speeds. I estimate that Unit#1 was traveling more than 45+ mph through the parking lot. I believe that the driver of Unit#1 violated RCW 46.61.525-Negligent Driving in the second degree. This RCW is defined as a person being guilty of negligent driving in the second degree if, under circumstances not constituting negligent driving in the first degree, he or she operates a motor vehicle in a manner that is both negligent and endangers or is likely to endanger any person or property. "Negligent" means the failure to exercise ordinary care and is the doing of some act that a reasonably careful person would not do under the same or similar circumstances or the failure to do something that a reasonably careful person would do under the same or similar circumstances. EE23158 CASE# 23-13200 OF COLLISION 11/15/23 13:34 OF CbLLI510N NARRATIVE Upon requesting the driver of Unit#1's driving documents, the driver of Unit#1 admitted to not having a driver's license. The driver of Unit#1 presented me with a pictured `Bates College' school identification card. Upon a DOL records check, I confirmed the driver's identity as Pena Peralta. Pena Peralta was listed as Not Licensed -Eligible in DOL. I believe that the drive of Unit#1 (Pena Peralta) did not exercise ordinary care and that it was reasonable to believe Unit#2 was driving through the parking lot under a practical belief that it was safe to do so. A reasonable driver would not have expected Unit#1 to have been traveling at a high rate of speed through a parking lot, especially during active business hours with heavy vehicle and pedestrian traffic. 1 cited the driver of Unit#1 (Pena Peralta) via mail for Negligent Driving in the second degree and for No Valid Operator's License with ID. Both Unit#1 and Unit#2 had to be impounded due to extensive damage and because they were resting against a stationary charging station that Potelco/PSE crews were attempting to repair. An exchange of information and case number were provided to all involved parties.
