SUBJECT: EAST KENNYDALE SANITARY SEWER INFILL:
SIDE SEWER TRENCH FAILURE
Scott:
This is to inform you that Dayton Avenue NE is experiencing trench settlement in the
location of two side sewers that were installed as part of the East Kennydale Sanitary
Sewer Infill project. The side sewers are located in the cul-de-sac and serve the houses at
2524 and 2516 Dayton Avenue NE. The settlement has resulted in a depression in the
asphalt cul-de-sac.
In addition, the water valve cover located in this cul-de-sac will not seat properly and
occasionally comes off when driven over by a car. It appears that the base of the valve
box extends too far into the top section thereby preventing the cover from seating
completely.
Since these issues have taken place within the one-year warranty period (Section 1-05.10
of the Project Supplemental Specifications), please call me at 425-430-7279 to coordinate
a schedule to make the necessary repairs.

Dear Scott,
Cheryl Bell, who lives at 2310 Aberdeen Ave. NE, Renton, has made a claim against the City of
Renton for damage done to her home from the water main break. Apparently sand and silt came into
the system through the broken pipe while she was doing laundry. The sand plugged her washing
machine causing it to overflow. She has damage to her brand new Pergo floor and a cleaning company
had to be called to dry out other rooms in her home.
I understand you were the contractor working under contract for the City of Renton on the East
Kennydale Sanitary Sewer project when the accident happened. It has been reported that your
employees were compacting crushed rock with a vibrating roller right above the water main when it
burst. The City is named as an additional insured under your liability insurance policy. I am hereby
tendering this claim to you for further handling. Please notify your insurance company immediately.
Because this claim was called in to us on an emergency basis we do not yet have a Claim for Damages

Frank Coluccio Construction Company contracted with the City to do the East Kennydale Sanitary
Sewer Infill and Water Main Replacement job. While compacting the soil above an asbestos concrete
waterline,the line broke. The damage appeared to be to landscaping only until Ms. Bell reported that her
washing machine was full of dirt and sand and the water had run out onto her new Pergo wood floor.

PROPERTY DAMAGE:
Ms. Bell reported there appeared to be water underneath her floor and asked if I had any idea what she
should do. I explained she can use anyone that she wants but Bales would be my recommendation for
the injectidry system. She agreed and they were out to dry the floor within two hours. Their fast action
did save the floor, however there was some water damage done to a small section of the floor. Ms Bell
does not think it is bad enough to replace the floor, but has inquired about the possibility of an
appearance allowance. The floor was not inspected by us because we thought the damages would be
paid by the contractor's insurance. Now that liability is being disputed I will make an appointment with
Ms. Bell to inspect the damage
The bill for Bales to dry the floor was $1,318.59 and their invoice is attached.
LIABILITY:
Frank Coluccio Construction had installed a sanitary sewer line earlier in the immediate vicinity of the
City's asbestos concrete water main. They had then been working at the installation of a new water main
and it had been hooked into the City line just days earlier 12 feet from where the break was going to
occur. Where the new line was hooked into the old line there was only 14 feet of line between two
valves. In hindsight, John Hobson of the City engineering department believes the City should have
required the 14 feet of line just be cut out and replaced. It was an oversight and there was no inspector at
the job site when they were doing this part of the job. Mr. Hobson feels the contractor should have
brought the problem to the attention of the City. The hook up was done without incident, but several
days later when Coluccio was compacting the soil above the line, the line broke.
There are several factors that could be responsible for this loss:
1. The vibrations from the compaction of the soil appear to be the most obvious, but Coluccio
denies that this has anything to do with it.
2. The City specifications probably should have required removing the 14 feet of line and replacing
it.
3. The contractor should have recognized that there could be a problem with the hook up and the
crossing over of the sanitary sewer line.
4. John Hobson thinks the compaction of soil under the line, done by Coluccio when the sanitary
sewer line was installed, may not have been adequate.
5. The line was an old asbestos concrete line and was very fragile to begin with.
Representatives from the City of Renton engineering department will be meeting with someone from
Coluccio to determine what went wrong and who is responsible. They will keep me informed.

CONTRACT:
A copy of the contract between the City of Renton and Coluccio Construction is attached. There is a
hold harmless in the contract, but it reads that it is valid and enforceable only to the extent of the
contractor's negligence. The City has been named as an additional insured under the liability policy for
Frank Coluccio Construction and the certificate of insurance is attached.
FUTURE ACTIVITIES:
I spoke with Scott Clemons at Frank Coluccio Construction and he is adamant that this loss is not their
responsibility and will not turn it into his insurance. I think the best way to go at this point is to let them
have their meeting to discuss what happened. I have requested John Hobson let me know when the
meeting will happen and I will try to attend. It will most likely be after Thanksgiving.
Meanwhile, Bales would like to be paid for their work. I would like to suggest we go ahead and get a
partial release and Claim for Damages form signed and notarized by Ms. Bell and proceed with payment
to Bales.
Bales is also writing up an estimate for me on what it would cost to repair the floor. Even if she does not
opt to repair it, it would be helpful to know when making an offer to her as an appearance allowance.
Please respond back to me with authority to proceed with settling this loss and subrogating a portion of
it to the contractors insurance at a later time. I can be contacted directly at 425-424-2192.

Dear Scott:
In response to your letter dated October 18,2002,regarding the break of the 12-inch transite
water line at NE 24a'St. and Monterey Avenue NE,the City of Renton does not agree with your
statement that Frank Coluccio Construction Company has no responsibility for the break or for
any damage caused by the break. Photographs taken during the excavation for the repair of the
water line indicate that the break occurred in the area where the new sewer pipe crossed under the
existing water line. The transite collar connecting the existing pipe ends was undermined by the
excavation for the sewer line and settled during the grading and compaction of the roadway
subgrade prior to final paving.
We would like to schedule a meeting with you to further discuss this matter and work towards a
mutual resolution between both parties. Please call me at 425-430-7279 to arrange the meeting.

Collucio has submitted their time and material costs related to the A.C. main break in NE 24th Street
which occurred last week.
In addition to the costs incurred by the City crew for the repair of the break, I understand that you have

gather all the facts before we make a joint decision on Collucio's request. This decision will impact how
the City is going to respond to the other claims from property owners.

Broken Water line at Monterey and Twenty Fourth
Dear John:
On October 17`h a break occurred in the existing waterline at the intersection of NE 24`h
and Monterey Avenue NE. At the time our crews were in the area preparing for the
installation of Asphalt, which was scheduled for the 18th. The location of the break was
20 feet away from where our crews had made a tie into that line two weeks before the
date of the break. See the attached photographs for verification of the break location.
The grading operation would not have affected the waterline unless a pre-existing
condition existed. Therefore, we take no responsibility for the break or for any damage
caused by the break.
On the day of the break our crews took action to limit the damage caused by the break
until City of Renton Maintenance crews could be mobilized. The following morning,
additional time was required to re-prepare the sub base for asphalt. Attached are the
Force Account sheets for our costs
