Research shows that the Kyle 2 short plat consisting of 2 homes built by J & J Construction (Jim Jacques) and 2 homes built by Shafer Construction (Lesa and Tom Shafer) were inspected and accepted by the City of Renton in 2003. J&J Construction installed the utility and access improvements in 2002. The short plat was recorded on April 16, 2002. No additional catch basins were required nor were any installed for the project per the plans submitted and approved for the improvements required to serve the project. This was in accordance with city codes and the King County Surface Water Design Manual exemptions. However, subsequent site visits reveal surface water run-off from the short plat private access road is eroding the landscaping, the adjacent driveway and the rockery in the NE Sunset Boulevard right-of-way. The modification of the drainage pattern due to the installation of a retaining wall and the pavement have created a downstream silt and erosion problem from the edge of the short plat improvements to the catch basins in NE Sunset Boulevard. The road providing access to the short plat, and to your home, is private with a maintenance agreement in place of a homeowner's association. On the face of the short plat, the maintenance responsibilities are solely and undivided between the owners of the four lots in the short plat. A copy is attached for your reference. Any direct remedy for your damages will need to be addressed privately between you and the owners. The City of Renton's ability to help in this situation is very limited due to the private access maintenance issues. This is not public right-of-way or publicly maintained streets. This case is being forwarded to our code enforcement officers for review for any possible action against the owners of the paved access for storm related issues. Connection to the existing surface water system in NE Sunset Boulevard may be required, but as the road is a state highway, WSDOT approvals are required even if city crews do the work and will necessarily take some time. This would only be for repairs to the rockery that may have been damaged by water or possibly partially by kids using the hole in the fence as an access point to your property. t vision.s evG ou ra ay- enton, as ington 98055 R E N T O N 1 y This paper contains 50%recycled material,30%post consumer AHEAD OF THE CURVE The City of Renton is pursuing what will be needed in the way of design and construction, and whether a storm connection is possible at this point and would be approved by the state for installation during the repair work. If city crews perform the work within the existing easements and right of way, notice will be provided to you as soon as the work is scheduled. The code enforcement office will be in touch regarding the disposition of any notices of violation or court case if it occurs.
