Because part of the project is within 200 feet of Lake Washington it triggered a Shoreline Substantial Development Permit Review. The project will connect to an existing 24-inch pipe system in Lake Washington Blvd, about 130 feet from the shoreline, that discharges to the lake. The project does not change the existing outfall to the lake, and does not involve any dredging or fill in the lake. The project involves replacing existing stormwater pipes and constructing new pipes in the City ROW in an established residential neighborhood (see attached figure). The existing drainage system consists of 12-inch and 24-inch pipes, and open stormwater ditches and culverts along the side of the street. The new system will replace some of the existing 12-inch pipes, construct a new 24-inch system to connect to an existing 24- inch pipe system, and fill stormwater ditches where they are replaced by new pipes. There are no streams or creeks in the project area. The drainage ditches do not appear to meet the definition of "waters of the United States". The artificially constructed drainage ditches do not appear to meet the definition for a wetland. Filling the ditches after they are replaced with new stormwater pipes does not appear to meet the definition of"discharge of dredged material" or "discharge of fill material". These determinations are supported by part of the description for Nationwide Permit 41 - Reshaping Existing Drainage Ditches contained in the 16 June 2000 Final Regional Conditions 401 Water Quality Certification Conditions. "This NWP does not apply to reshaping drainage ditches constructed in uplands, since these areas are not waters of the United States, and thus no permit from the Corps is required, or to the maintenance of existing drainage ditches to their original dimensions and configuration, which does not require a Section 404 permit..." \\CENTRAL\SYS2\DEPTS\PBPW\DIVISION.S\UTILITIE.S\DOCS\2000-359-memo.doc\DWC\dwc Page 1 of 2 The Corps letter states that a Section 404 permit is required for the discharge of dredged or fill materials in waters of the United States, including wetlands. We reviewed the letter and the project design, and determined that the project does not appear to meet the definitions and requirements for a Section 404 permit. Based on recent letters from the Corps on this and other projects it appears that the Corps is not evaluating the projects when they receive a notification under SEPA or Shorelines, but is sending out the same type of application form letter for all projects. Uhrich Application Review Section Enclosures Nationwide Permits / Seattle District / 16 June 2000 NOTE: Adjacent is as defined in 33 CFR Part 328.3(c). In the riverine systems, a line is drawn perpendicular to the river at the break between lower and upper perennial river systems. This NWP can be used in those wetlands upstream of this line only. These systems are defined in the Definitions section of this SPN. EPA, Puyallup Tribe, and Chehalis Tribe 401 Certification - Denied without prejudice. An individual 401 Certification is required for all Section 404 activities. State 401 Certification — Partially denied without prejudice. An individual 407 Certification is required for projects or activities authorized under this NWP if required by any State Regional General 407 Condition. CZM Consistency Response — Partially denied without prejudice. An individual CZM Consistency Response must be obtained for projects that the Seattle District has not yet determined are in compliance with ESA, or that require individual 401 Certification, and that are located within counties in the coastal zone. Consistency with CZM cannot be determined until any necessary consultation or concurrence required under ESA is completed. The State's CZM review will start upon completion of ESA requirements. 41. Reshaping Existing Drainage Ditches. Discharges of dredged or fill material into non-tidal waters of the United States, excluding non-tidal wetlands adjacent to tidal waters, to modify the cross-sectional configuration of currently serviceable drainage ditches constructed in these waters. The reshaping of the ditch cannot increase drainage capacity beyond the original design capacity or expand the area drained by the ditch as originally designed (i.e., the capacity of the ditch must be the same as originally designed and it cannot drain additional wetlands or other waters of the United States). Compensatory mitigation is not required because the work is designed to improve water quality (e.g., by regrading the drainage ditch with gentler slopes, which can reduce erosion, increase growth of vegetation, increase uptake of nutrients and other substances by vegetation, etc.). The permittee must notify the District Engineer in accordance with General Condition 13, if greater than 500 linear feet of drainage ditch will be reshaped. Material resulting from excavation may not be permanently sidecast into waters but may be temporarily sidecast (up to three months) into waters of the United States, provided the material is not placed in such a manner that it is dispersed by currents or other forces. The District Engineer may extend the period of temporary sidecasting not to exceed a total of 180 days, where appropriate. This NWP does not apply to reshaping drainage ditches constructed in uplands, since these areas are not waters of the United States, and thus no permit from the Corps is required, or to the maintenance of existing drainage ditches to their original dimensions and configuration, which does not require a Section 404 permit (see 33 CFR 323.4(a)(3)). It appears that the City placed the project information for two City projects in the wrong envelopes when they were sent to you. I have enclosed the correct project information for both projects. In our opinion,a permit from the Corps is not required for the Lake Washington Storm System Project. Please review the information, correct your files,and let us know the permit status for both projects. MITIGATION MEASURES No mitigation measures are recommended. D. ENVIRONMENTAL IMPACTS In compliance with RCW 43.21 C. 240, the following project environmental review addresses only those project impacts that are not adequately addressed under existing development standards and environmental regulations. 1. Earth Impacts: The proposed area of construction is developed with asphalt paving or gravel, with the exception of portions of unimproved North 341h Street. The majority of the project area is relatively flat, with slopes of less than 5%. The are portions of Lake Washington Boulevard which contain slopes of about 27%, as well as portions of the unimproved North 341h Street right-of-way that are designated as"moderate"on the City's Sensitive Areas Maps for slope and slide hazards. However, the proposal is not anticipated to adversely impact these areas and includes appropriate erosion and sedimentation control measures to adequately mitigate temporary construction impacts. The project will involve trenching within existing asphalt streets or gravel shoulders. After construction all trenched areas will be restored with asphalt or gravel. In addition, some gravel shoulders or ditches may be restored with asphalt as part of road or sidewalk improvements. The disturbed areas within the unimproved right-of-way will be restored with grass. Approximately 1,200 to 1,500 cubic yards of backfill could be used for restoring trenched areas. The backfill will include existing soils where suitable, and imported backfill or gravel when existing soils are not suitable. Approximately two to four deciduous trees (28-inch to 42-inch in diameter), two to three evergreen fir trees, as well as some shrubs may be removed from the portions of the North 34'h Street right-of-way for project construction. In addition, trees and shrubs in the Burnett Avenue right-of-way may also need to be removed if they are too close to the pipe alignment and interfere with construction equipment. Mitigation Measures: No further mitigation is recommended. Nexus: N/A 2. Water Impacts: There are no surface water bodies or sensitive areas located on the subject site. Project construction is proposed approximately 130 feet from the Lake Washington shoreline. Therefore, the proposal is subject to the City's Shoreline Master Program and requires a Shoreline Substantial Development Permit. The shoreline in this area is designated as"urban", which allow utilities as permitted uses. The shoreline permit will not be issued until the completion of the appeal period for the project's proposed SEPA determination. The purpose of the project is to improve the existing drainage system in Burnett Avenue in order to reduce flooding problems that currently occur in the area. The storm water runoff intended to be controlled by the proposed storm lines comes from residential areas and City right-of-ways around the project site. Storm water runoff is commonly collected in ditches and catch basins on side streets, which then flows to Burnett Avenue and enters the existing storm water system. The replacement system will connect to the existing system in Lake Washington Boulevard, which discharges to the west into Lake Washington. Ground water encountered during construction will be dewatered as needed and treated for sediment removal and pumped to the nearest sewer or storm manhole. Erosion control measures such as storm drain inlet protection, as well as covering of soil stockpiles with plastic sheets will be employed to prevent erosion and sedimentation. Special measures such as erosion control netting and seeding and mulching will also be used on the steeper portions of the unimproved North 34th Street right-of-way. Mitigation Measures: No further mitigation is recommended. Nexus: N/A 2. Transportation Impacts: Minor impacts to local traffic patterns may occur as a result of the project construction. In addition, the project would also include asphalt replacement of portions of the existing road and revegetation of unimproved areas. Any potential impacts to transportation areas would be mitigated by the applicant's construction mitigation description. The plan indicates that work hours would be limited to the hours between 7 am and 5 pm, Monday through Friday. As described, construction transportation routes may include Lake Washington Boulevard, Burnett Avenue North and North 30th Street to reach the construction site. The preliminary traffic control plan consists of permitting one lane traffic within construction areas on Lake Washington Boulevard and Burnett Avenue North. Access to local driveways will be maintained, except when the construction path requires crossing of a driveway. In addition, the bike lane on the east side of Lake Washington Boulevard may be temporarily blocked during project construction. Vehicle, bicycle and pedestrian traffic will be limited to one-way flow depending of site specific work. Mitigation Measures: No further mitigation is recommended. Nexus: N/A E. The soil is typically brown to light olive brown, loamy sand to sand. There is a small area of Alderwood (AgC) gravelly sandy loam along Lake Washington Blvd. d. Bedding Gravel will be used as fill for the new stormwater pipe and Imported Backfill or Bank Run Gravel for backfill above the pipe, if the existing soil is not suitable for backfill. N STORM SYSTEM PROJECT The project involves constructing approximately 1,200 feet of 12- to 30-inch stormwater pipes to replace existing stormwater pipes and ditches in Lake Washington Blvd, Burnett Avenue N, and the unused ROW in N 34th Street. The exact pipe sizes and locations needed will be determined during the final design process. New manholes and catch basins will be placed at various locations. After construction is finished the streets will be restored with asphalt and returned to their existing condition. During construction Lake Washington Blvd and Burnett Avenue N may be restricted to one lane while work is occurring in them. After construction all streets will be restored to existing access. The site is in City right-of-way (ROW). Adjacent properties are primarily zoned R-8 Residential. The site is used for City streets. A portion of the N 34th Street ROW between Lake Washington Blvd and Burnett Ave N is not used as a street. However, a sewer main is located in it. Part of the unused N 34th St ROW is shown on the City of Renton Sensitive Area Map for Slides as "Moderate". The section of the stormwater system in Lake Washington Blvd is located approximately 130 feet from Lake Washington. The soils in the site area are classified as Indianola (InC), typically light olive brown, loamy sand to sand. The residential area and streets drain to ditches, catch basins, and pipes in the City ROW. The existing stormwater system discharges to Lake Washington. The site will remain as City ROW used as streets, or unused except for the utilities located in them. There are no proposed offsite improvements. The estimated construction cost for the project is $150,000 to $170,000. Bedding gravel will be used as fill for the stormwater pipe. The existing soil will be used for backfill if it is suitable. Imported backfill of bank run gravel will be used for backfill if the existing soil is not suitable. Approximately 1200 to 1500 cubic yards of backfill could be used. Approximately 2 to 4 deciduous trees ( greater then 6" caliper, about 28" to 42" in diameter and 40 to 60 feet tall), 2 to 3 evergreen fir trees, and some shrubs may be removed from the unused ROW for construction.
