Beck, Inc. 1001 Fourth Ave, Suite 2500 Seattle, WA 98154-1004 SUBJECT: SPRINGBROOK CREEK LETTER OF MAP REVISION CONTRACT SCOPE OF WORK,BUDGET AND SCHEDULE Dear Mike: Thank you for meeting with the City and NHC staff last Monday to discuss the City's proposal to complete a physical letter of map revisions for Springbrook Creek from the King County pump station to SW 43rd St. This letter is to formally request that R.W. Beck,Inc., as the lead consultant,develop a contract scope of work, budget and schedule for this project. NHC will be included as a subconsultant and will be responsible for work associated with updating the hydrologic model and for providing R.W. Beck,Inc., with technical assistance in determining the base flood elevation. The scope of work shall include, but not be limited to,the following tasks: ♦ Update FEQ model to include the revised hydrologic flows developed by NHC. ♦ Determine base flood elevation. ♦ Develop working map and associated documentation for submittal to FEMA. ♦ Assist City with presentation of map revisions for public meeting. DocumenOa f 1 EXHIBIT A—SCOPE OF WORK Springbrook Creek Channel and Habitat Improvement Project Contract Amendment 1 —February 15,2001 Introduction As noted in the Draft Springbrook Creek and Habitat Improvement Project report, the recent survey cross sections developed by W&H Pacific downstream of SW 27"' Street do not compare very well with the original survey cross sections done in the late 1980's by SCS. The recent cross sections are generally larger and deeper than the previous cross sections. Because the cross sections downstream of SW 27`h Street do not compare well, there is some concern that the older cross sections upstream of SW 271h Street would similarly not match actual field conditions. Cross sections that do not match field conditions could affect decision making on future Springbrook Creek improvements. To address this concern, R.W. Beck will perform some additional analysis to provide data for which the City can move forward implementing improvements to Springbrook Creek. Scope of Work The existing contract will be supplemented with a new hydraulic modeling subtask 1.5 that includes the following work. R.W. Beck will field survey new cross sections between SW 27`h Street and the north side of the Oakesdale Avenue crossing. The new cross sections will be tied into the City elevation datum and compared with prior cross sections. The cross sections will include the creek and extend approximately 50 beyond the top of bank. An exception is at FEQ wetland 6, where the cross section will be wider and extend toward the edge of Lind Avenue. It is estimated that 14 cross sections will be taken. One of the cross sections will be downstream of SW 27`" for comparison with the W&H Pacific survey. It is noted that while Beck will tie into the City elevation data, the horizontal locations along the creek may be less than standard survey accuracy(approximate accuracy 1.5 to 2 feet). The new cross sections will also be input to the recently revised FEQ model (October, 2000). This will be considered as revision no. 1. The FEQ model will be further refined with the following revisions, to be done in order with results tabulated; Rev. 2—Revised the stage storage relationship for FEQ wetland 7A and channel cross section along FEQ wetland 6 based upon the City's recent aerial mapping(the recent aerial mapping indicates that there may be additional flood storage in these wetland than prior mapping) Rev. 3 - Incorporate the proposed modifications to the Renton Wetland modifications (adding culverts to the berm between FEQ wetland 7A and 713 that will add more storage) Rev. 4- Removal of the private bridge north of SW 27t" Street Rev. 5 - Incorporate a new crossing of SW 34`h Street (per ESGRWP Springbrook Creek Alt. 3 — Double box culvert) Rev. 6 - Incorporate the proposed wetland mitigation (per draft wetland mitigation plan, 2000). W. Beck and City of Renton SPRINGBROOK CREEK CHANNEL AND HABITAT IMPROVEMENT PROJECT General The City of Renton Surface Water Utility wishes to design, permit, and construct channel and habitat improvements within Springbrook Creek between the new Oakesdale Bridge and SW 27th Street in Renton, Washington. The City of Renton and the Natural Resources Conservation Service (NRCS) are working together to develop plans and obtain permits to implement the project. The proposed improvements generally follow the Eastside Green River Watershed Plan and EIS (R.W. Beck, 1997). The Consultant will be responsible for the hydraulic analysis necessary to support the channel design by NRCS and will assist in the environmental permitting. For this scope of work, it is assumed that the project area is confined to a 140-foot wide corridor centered along Springbrook Creek through this reach. TASK 1 - HYDROLOGIC AND HYDRAULIC ANALYSIS TASK 1 .1 UPDATE THE EXISTING CONDITIONS FEQ MODEL The existing conditions FEQ model, developed in 1996 as part of the East Side Green River Project, will be updated to current conditions. This includes updating the cross sections for the following reaches: n SW 16th Street to Oakesdale with the newly improved channel, 0 Oakesdale to SW 27th Street with the recently surveyed cross sections, 0 Newly improved cross section between SW 41st Street and SW 43rd Street. In addition, several structures will be updated or added to the model including: 0 New crossing of SR 167 (including downstream channel improvements and upstream weir), 0 Hunter Douglas bridge, 0 Oakesdale bridge, 0 New Oakesdale box culvert at 41st Street, New SW 27th Street crossing, and Olympic Pipeline culvert. The City shall provide needed design drawings for these structures. TASK 1 .2 DEVELOP FUTURE CONDITIONS MODEL The existing conditions model will be modified to reflect the future improvements proposed in the East Side Green River Project upstream of the proposed channel improvements. This is necessary to simulate the ultimate flow conditions for use in designing new channel improvements. This model will be used to analyze the effect of the proposed channel improvements. The future improvements that will be added will be limited to those that could have a significant affect on peak flows and include: 0 SW 341h Street crossing, 0 Oakesdale crossing, 0 SW 43rd Street pipe system. TASK 1 .3 MODEL DESIGN ITERATIONS The FEQ future conveyance conditions model, developed in task 1.2, will be used to evaluate improvements to the channel between the Oakesdale Bridge and SW 271h Street. The cross sections in this reach will be replaced with proposed design cross sections developed by NRCS and rerun under the existing and future land- use 2-year flow event as well as the future land-use 25-year and 100-year peak flow event. It is assumed NRCS will provide channel roughness values for the new cross sections. Based on the initial results, NRCS will provide revised cross sections for additional modeling iterations. Up to 4 iterations of the cross sections is included in the budget. Once the recommended cross sections have been identified, they will be input into the -existing conditions model (developed in Task 1.1) to review the effect on the channel under current conditions for the 2-year existing and future land-use event and the 25-year and 100-year future land-use event. The result of this simulation may be used by the City to consider a FEMA Floodplain Revision. TASK 1 .4 REPORTING AND DOCUMENTATION The results of task 1 will be documented in a brief memorandum. The documentation will include the methodology used and the modifications made to both the existing conveyance conditions model and the proposed improvements between the Oakesdale Bridge and SW 27th Street. It will also describe the future conditions model created for this project. In addition, the memorandum will tabulate the water levels and flows at key locations simulated for existing conveyance conditions models with and without the recommended proposed channel improvements model for the existing and future land-use 2-year flow even and the future land-use 25-year and 100-year peak flow events. Beck SCOPE OF WORK TASK 2 - WETLAND MAPPING VERIFICATION The Consultant will attend one field meeting with the U.S. Army Corps of Engineers to verify the mapping of wetlands as presented in the March 5, 1999 Wetland Delineation Report prepared by Jones 8v Stokes for the Springbrook Creek Flood Control and SW 27th Street Culvert Improvements Projects. This task assumes the wetlands as mapped are satisfactory to the Corps and that they will not require other wetland information for the project. Note that the project design is assumed to be self mitigating and that no wetland mitigation is going to be required. TASK 3 - PERMITTING ASSISTANCE The Consultant will assist the City of Renton/NRCS with preparing environmental resource permits as discussed in the following subtasks. TASK 3.1 REVIEW AVAILABLE INFORMATION. The Consultant will review information related to the project design, construction methods, and project benefits as provided by the City/NRCS. This task includes time for the Consultant to attend a start up meeting with the City/NRCS to review drawings and other information pertinent to the project. The meeting will include a discussion of state and federal environmental permits that will likely be required for the project. TASK 3.2 ATTEND PRE-APPLICATION MEETING. This task includes time for the Consultant to attend one pre-application meeting. This task also includes 8 hours of time for the Consultant's wetland biologist to contact USFWS, NMFS, and WDFW fisheries biologists to identify potential issues and construction methods that should be incorporated into the project design to avoid or reduce impacts on fish. Information received from the agencies, and approved by the City/NRCS, would be included in the section of the JARPA that requires a description of measures that will be used to mitigate potential impacts from the proposed action. TASK 3.3 PREPARE JOINT AQUATIC RESOURCE APPLICATION (DARPA). The Consultant will assist with the preparation of the DARPA based on information presented in the Wetland Delineation Report referenced in Task 2 and information provided by the City/NRCS (Tasks 4.1 and 4.2). The Consultant will prepare a project description and project purpose for the DARPA (Sections 7a and 7b) based on information in the City of Renton East Side Green river Watershed Project Plan and EIS (December 1996) and other information provided by the City/NRCS specific to the current proposed action. It is assumed that information describing construction methods, expected hydrologic conditions in the designed channel, and planting plans along Springbrook Creek will be included in the material provided by the City/NRCS. Descriptions of project impacts (including area and volume of dredge or fill in wetlands and streams) that the Consultant will prepare for the DARPA will be based on project information developed by the Natural Resources Conservation Service (NRCS) and the City of Renton. Other information the Consultant assumes will be provided to prepare the DARPA includes the following: O approximate dates of construction; 0 approximate costs of construction; 0 if applicable, location of offsite disposal of dredged and/or excavated material or source of material if any fill is required; 0 names and addresses of adjacent landowners. Background. In the 1970' s Congress passed the Federal Water Pollution Act (Clean Water Act) and amendments. The law represents our society' s response to a continuing degradation of water quality, fish and wildlife habitat, and other values associated with aquatic lands in the United States . Good water quality and conservation of the other values are important to preserving our quality of life . As stated in the Clean Water Act, the objective is to restore and maintain the chemical, physical, and biological integrity of the Nation' s waters . 2 . Authority. Federal law (Section 404 of the Clean Water Act) prohibits the discharge of dredged or fill material into waters of the United States (U.S . ) , which includes wetlands, without a Department of the Army permit issued by the Corps of Engineers (Corps) . Dredged Material . The term means material excavated or dredged from waters of the U. S. The discharge of dredged material means any addition of dredged material into, inlcuding any redeposit within, waters of the U. S. Examples include sediment dredged from a boat basin that is discharged at an open water site or the soil disturbance actions during mechanized land clearing or excavation of a wetland. Fill Material . The term means material used for the primary purpose of replacing an aquatic area with dry land or of changing the bottom elevation of a waterbody. Examples are soil and/or rock discharged as fill for the construction of roads, buildings, and bulkheads . Grading which changes the surface contour of a wetland is considered fill, as is backfill behind bulkheads and into trenches or ditches . Mechanized landclearing for leveling the land surface in wetlands is also considered to be a wetland filling operation under Section 404 . In fulfilling the permit program under the law, the Corps must follow the Guidelines for Specification of Disposal Sites for Dredged or Fill Material {Section 404 (b) (1) Guidelines) published by the U. S . Environmental Protection Agency (EPA) . These are the rules the Corps uses to determine if a permit may be issued for the disposal of dredged or fill material . The stated goal of the Clean Water Act is to restore and maintain the chemical, physical, and biological quality of the nation' s waters . The Section 404 (b) (1) Guidelines help achieve this goal through the control of discharges of dredged or fill -;aterial . Under these guidelines, wetlands are considered to be special aquatic sites worthy of critical evaluation before a decision is made to permit such areas to be filled. In recent years, wetlands are being recognized as having significant value for the variety of functions that they serve. Some of these functions include : flood reduction, pollution control, support to fish and wildlife, agriculture, storm and erosion control, and water supply. Wetlands also serve as educational and research areas and provide important scenic and recreational values. Discharge of dredcred or fill material into special acruatic sites is generally discouraged under the Section 404 (b) (1) guidelines . 3 . Jurisdiction. In tidal waters jurisdiction extends waterward from the line of Mean Higher High Water, or waterward from the upland boundary of the adjacent wetland. In fresh waters jurisdiction extends waterward from the ordinary high waterline of a waterbody, . or waterward from the upland boundary of the adjacent wetland. Jurisdiction also includes isolated wetlands; that is, those wetlands not connected to another waterbody by a tributary stream or drainage ditch. 4 . Wetland Definition. As defined by the Corps and EPA, wetlands are 11 . . those areas that are inundated or saturated by surface or ground water at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions . Wetlands generally include swamps, marshes, bogs, and similar areas . " For Section 404 permits, the Corps makes the final determination as to whether an area meets this definition, and is thus subject to regulation under the Corps program. S . How Wetland Determinations are Made . To determine whether an area meets the Corps' definition of a wetland, the Seattle District evaluates three parameters : soils, hydrology, and vegetation, according to the methods described in the 1987 Corps of Engineers Wetlands Delineation Manual (Technical Report Y-87-1, dated January 1987) . Use of this 1987 Manual was mandated by the 1992 Energy and Water Development Appropriations Act, enacted on August 17, 1991 . An area which under normal circumstances exhibits positive wetland indicators in all three of the parameters is considered to be a wetland subject to regulation under Section 404 of the Clean Water Act . Quite often, wet pastures, wet meadows, and seasonally saturated or flooded areas meet the Corps/EPA wetland definition even though these areas may be relatively dry through much of the year. 6 . The Process for Obtaining a wetland Determination from the Corps . The steps for obtaining a wetland determination from the Seattle District are : a. The person (applicant) proposing a fill, clearing, or excavation project which may involve wetlands collects information regarding the site' s soils, hydrology, and vegetation, and makes a preliminary wetland boundary delineation. Applicants may assemble the information themselves, but are frequently better served by hiring a consultant familiar with the 1987 Manual . b. The applicant completes a permit application form. This provides for better tracking of the wetland determination request and helps ensure a timely response by the Corps. If, as a result of the wetland delineation, no permit is necessary, the Corps cancels the application. C. The applicant submits the following information to the Regulatory Branch of the Seattle District : * The completed permit application. * The information regarding the soils, hydrology, and vegetation of the site. * The preliminary wetland delineation map showing the site plan, proposed areas to be filled, and the project location. (The applicant may first request a Corps jurisdiction confirmation to design with minimal wetland impacts. ) * An estimate of the wetland acreage to be filled. d. Upon receipt of the application, the Corps gives it a number for filing and tracking purposes . e. The Corps reviews the information for verification of the wetland delineation. The applicant or designated agent may be contacted for additional information as appropriate. f . If necessary, the Corps arranges a site visit with the applicant to confirm the wetland delineation. Depending on the results of the site visit, the applicant may be required to obtain additional information to refine the wetland delineation. g. Upon receipt of the final wetland map, the Corps provides a letter to the applicant confirming the wetland delineation and describing the permit requirements . In cases where no wetlands would be filled and no other work is proposed within waters of the United States, the applicant is informed that the proposal does not fall within the jurisdiction of the Corps . This does not exempt the applicant from complying with other Federal, State, and local permit requirements as they may apply to the proposal . 3 7 . Permit Requirements . Two types of permits apply to wetland fill proposals . These are nationwide permits and individual permits. Nationwide Permits . Regulations governing our permit program contain a series of nationwide permits (NWP) . Each authorizes a specific category of work, provided certain conditions are met . Categories include actions like "minor road crossing fills; " "replacement, repair, and rehabilitation; " and "single-family housing" . NWP must have only minimal impacts and the permittee must be in compliance with all conditions . NWPs as a whole expire every 5 years and are then reissued, modified, or revoked nationally. Regional conditions and water quality certifications can change. The Seattle District has copies of the NWPs with regional conditions and water quality certifications. They are also available on the District' s home page. http : //www.n,gs.usace.army.mil/reg/reg.htm Nationwide Permit 26 . This is the only NWP scheduled to expire on December 13, 1998, and will not be reissued. In Washington State, it allows discharges of up to 2 acres of isolated waters of the U.S. or waters that are above the headwaters (the point at which a tributary waterbody has an average annual flow of less than 5 cubic feet per second) . This includes isolated wetlands and wetlands which are adjacent to waterbodies above the headwaters . Anyone placing fill into wetlands or other waters is at their own risk if they proceed with their own interpretation of the NWP and its application to their project . For impacts over 1/3 acre (14 , 520 square feet) of wetlands or streams/lakes, the NWP requires that the Corps be notified for review of the environmental impacts . The "Pre-Construction Notification" (PCN) may require Corps coordination with EPA, the U.S . Fish and Wildlife Service, the National Marine Fisheries Service, and the Washington State Department of Ecology (Ecology) . These agencies consider the proposal for a limited period of time, and provide comments to the Corps . The Corps decides whether the proposal will receive verification under the nationwide permit . Generally, over 1/3 acre impact, the applicant will reed to include mitigation measures in the proposal to reduce the environmental impacts to a minimal level . Mitigation may be in the form of funds paid to groups who use the funds to restore, enchance, and preserve wetlands . The PCN process takes about 45 days (NWP 26 only) to complete, once full information has been provided to the Corps by the applicant . If verification to use NWP 26 is not received within the 45 days, the permittee may start construction after receiving water quality certification (WQC) and Coastal Zone Management Act concurrence (CZM) __cm Ecology. 4 Other NWPs also apply to certain wetland fills, although they are mostly more project type specific than NWP 26 . Individual permits are required for all wetland fill proposals that cannot be authorized under some NWPs for any reason. The individual permit process . involves a much more detailed review of the proposed wetland fill than the NWP procedures described above. The Corps must evaluate whether the benefits from the project outweigh the predicted environmental impacts . This is called a public interest review. Factors considered during the public interest review include the following * Basic Project Purpose and Need. * water Dependency. * Availability of Practicable Alternatives . The applicant is asked to clearly demonstrate that the proposal involving wetland fill is the only practicable (defined in terms of cost, logistics, and technology) alternative for achieving the project basic purpose. For nonwater-dependent projects, the Corps assumes there is a practicable alternative unless the applicant is able to prove otherwise . * Environmental Impacts . The Corps evaluates whether the proposal is the least environmentally damaging practicable alternative: It may be necessary for the applicant to include mitigation measures in the proposal that will reduce the environmental impacts to an acceptable level . These measures may include : 5 - avoidance of wetland fill - reduction or minimization of the wetland fill - creation or restoration of wetlands - enhancement of the value of an existing wetland Steps in the individual permitting process include : a. Preapplication meetings with the Corps and other resource agencies (optional) . b. Submittal of a permit application to the Corps . The evaluation factors used by the Corps for wetland discharge projects' are specified by the Section 404 (b) (1) Guidelines . See paragraph 2 . , above. C. Corps public notice reviewed for 30 days by agencies, Indian tribes, interest groups, and the general public. Corps permits for Section 404 projects require a WQC and/or CZM from Ecology. The request for WQC/CZM is contained in the Corps public notice. The State of Washington conducts its own review. State agencies also review the Corps public notice and comment through Ecology. For example, projects within the jurisdiction of the State Shoreline Program need a Shoreline Substantial Development Permit from the local government, affirmed by Ecology. If a project is located in the Coastal Zone (15 westside counties on Puget Sound, the Strait of Juan de Fuca, the Pacific Ocean, and the mouth of the Columbia River) , a CZM must also be issued by Ecology. d. Consideration by the Corps of all- comments received from public review, with coordination as needed .with..those who commented. e . The Corps may ask the applicant to provide additional information. f . The Corps decides whether to prepare an Environmental Assessment and Finding of No Significant Impact, or to prepare a Federal Environmental Impact Statement (EIS) . If an EIS is necessary, additional preparation time, review, and coordination will be required. g. A public hearing may be held. h. The Corps prepares the appropriate decision documentation. Documentation includes evaluation of the public interest review factors and the evaluation described in step b. i . The District Engineer makes the decision. The permit is issued or denied and the applicant is advised of _ reason. The permit is not issued if the proposal is found to be _o the public interest (this includes , but is not limited tc, ._:._,=pliance with the Section 104 (b) (1) Guidelines) . For example, 6 the proposal may not be the least environmentally damaging practicable alternative. The permit also is denied if the water quality certification under Section 401 of the Clean Water Act is denied, if the project is not consistent with the Shoreline Management Program, or if any other State or local permit for the project has been denied. k. If the WQC and/or CZM has not been received, but the Corps can make its permit decision, the Corps may issue a "Provisional Permit" to the permittee. Construction may not begin until the WQC and/or CZM have been granted (or waived) and the Corps signed permit has been received by the permittee. 7 . Pertinent Information Available.
