The final cost is $6,918.41 less than the full Surface Water Utility system development charge for the Raden Warehouse project. According to the agreement, payment of the full surface water system development charge($29,282.56)minus the final cost to install the sewer($22,364.15) is to be paid before the Certificate of Occupancy will be issued for the Raden Warehouse project. RECITALS WHEREAS, Raden is the owner of certain real property, hereinafter called "Property," located in the City, legally described as Lots 3 and 4, Block 6, Burlington Northern Industrial Park Renton II (King County Recording No. 7907240890). WHEREAS, the parcel of land adjoining the Property to the west is currently served from the west by a sanitary sewer in SW 34th Street that crosses over the existing culverted SW 34th Street road crossing of Springbrook Creek; WHEREAS, the City is proposing to replace the existing culverts in the future with a new, larger box culvert or other drainage structure as identified in the East Side Green River Watershed Project Plan (LUA-95-205,ECF). The existing culverts are a restriction to flows and their replacement is an important element of the overall goal of resolving current and preventing future flooding problems in the Springbrook Creek Valley(East Side Green River Watershed). WHEREAS, the existing sanitary sewer passes over the top of the existing culverts with very little clearance. Because of the small clearance, the future drainage structure would have to be wider and shallower than what otherwise could be installed if the height of the structure were not restricted by the sewer. WHEREAS, the existing sanitary sewer crossing the creek is not yet active and the option exists to provide replacement service from the east to the single parcel it serves. WHEREAS, the replacement service would lie entirely within a City-owned utility easement (King County Recording No. 8202080435)on the south boundary of the Property owned by Raden. WHEREAS, Raden is currently developing its Property in accordance with the Raden Warehouse project proposal (SA-94-137), formerly referred to as the O'Keefe Wine Warehouse. WHEREAS, the City and Raden desire that the replacement sanitary sewer service be installed concurrent with the Raden development. NOW THEREFORE, it is agreed as follows: AGREEMENT I. As part of its site development, Raden agrees to install a sanitary sewer system along the south line of the Property. The installation shall be to City standards and in accordance with plans approved by the City. The sewer will be installed within the City-owned easement. 2. The City agrees to offset the cost of its share of the sewer installation by reducing Raden's Surface Water Utility system development charge by up to Twenty-nine Thousand Two Hundred Eighty Two H:D0CS:96-726a:SW:ps Agreement Regarding Page I of Sanitary Sewer Installation f v and 56/100 Dollars ($29,282.56), including sales tax. This does not include permit, fee, dewatering (if needed) or any unforeseen items associated with underground work; i.e. contaminated soil, large rocks, etc. Tom, maybe you should propose carrying an allowance of$10,000-$15,000 for dewatering and some other moneys for unknowns. The adjoining property to the west is currently served from the west by a sanitary sewer in SW 34th Street that crosses over the existing culverted SW 34th Street road crossing of Springbrook Creek (see Exhibit A). The existing sanitary sewer passes over the top of the existing culverts with very little clearance. The Surface Water Utility plans to replace the existing culverts in the future with a new, larger box culvert or other drainage structure as identified in the East Side Green River Watershed Project (ESGRWP). Because of the small clearance, the future drainage structure would have to be wider and shallower than what otherwise could be installed if the height of the structure were not restricted by the sewer. Because the existing sanitary sewer crossing the creek is not yet active, the opportunity exists to provide replacement service from the east before the single parcel it serves is developed (see Exhibit A). The replacement service would lie entirely within a City-owned utility easement (King County Recording No. 8202080435) just within the south boundary of the parcel owned by Raden. Since Raden is currently developing the Raden Warehouse project (SA-94-137), it is advantageous to both the City and Raden to construct the replacement sewer now. Installing the sewer will save on restoration costs and avoid temporary disruption of access and other impacts that would result should the sewer be constructed after the Raden site development is completed. It is therefore proposed that the City enter into an agreement whereby Raden would agree to install the sewer, and the City would offset the cost of its share of the sewer installation by reducing Raden's Surface Water Utility system development charge. The adjoining property to the west is currently served from the west by a sanitary sewer in SW 34th Street that crosses over the existing culverted SW 34th Street road crossing of Springbrook Creek. The existing sanitary sewer passes over the top of the existing culverts with very little clearance. The Surface Water Utility plans to replace the existing culverts in the future with a new, larger box culvert or other drainage structure as identified in the East Side Green River Watershed Project (ESGRWP). Because of the small clearance, the future drainage structure would have to be wider and shall o �h what otherwise could be installed if the height of the structure were not restricted by the sewer. Because the existing sanitary sewer crossing the creek is not yet active, the opportunity exists to provide replacement service from the east before the single parcel it serves is developed. Please provide a detailed cost breakdown, including separate material and installation costs and any other cost that you feel may be changed by the proposed sewer extension. For example, 3 cleanouts may be eliminated because of the sewer extension and O'Keefe should realize a cost savings. Also, of the total 330 linear feet of new sewer pipe, 160 linear feet of 6" pipe was needed anyway per the original development plans. The increase in cost then to install 8" instead of 6" may only be the difference in material costs. Please account for this in the cost estimate. New utilities are not listed as allowed within a wetland. However, Section 4-32-4.C.8 states that any activity may be allowed as determined by the Administrator with prior written approval of the Administrator. However, these activities are subject to the standards in Section 4-32-6. Section 4-32-6 requires restoration ratios of 1.5:1 for Category 3 wetlands. It is therefore undesirable to locate the sewer any different than where shown on the current Wine Warehouse plans as this will require work within a wetland and also require restoration beyond the area impacted for construction of the sewer. 2. According to Section 4-32-4.13, the following activities may be permitted within a buffer with administrative review and approval by the Department Administrator: "any activity having minimal adverse impacts as determined by the Responsible Official on buffers and no adverse impacts on regulated wetlands provided all associated buffer impacts are mitigated." Responsible Official is not defined in the ordinance so it is assumed that this reference is equivalent to the Administrator. The existing buffer is degraded, therefore it is assumed that Wine Warehouse should have no problem restoring the buffer to better than existing condition. B. Charges. Reimbursement-2 Water System Extension Documents L, CITY OF RENTON A MUNICIPAL CORPORATION OF THE STATE OF WASHINGTON (1) Amount. City shall collect the fair pro rata share of the cost of installing such facilities as a charge from the owners of benefitted properties set forth on Exhibit C desiring to connect to the Extension Facilities or any lateral or branch connected thereto. The amount of such connection charges to be collected prior to such connection is set forth on Exhibit C. Such charges may include, but are not limited to,pro rats share of City legal, engineering, administrative, set-up, handling and actual costs of the facility. Such reimbursement charges shall be in addition to all other City charges in effect at the time of seeking connection to such extension facilities. Upon application by affected property owners, the City may further segregate reimbursement charges attributed to property benefitted by the Extension Facilities. All costs of such segregation shall be bome by the party requesting such segregation. (2) Payment. City shall first deduct an amount equal to twenty percent (20%) of the collected amount to cover its administrative costs, and the remaining balance shall be paid over to Owner within sixty (60) days after receipt thereof, City to follow its established procedures o depositing such funds received with the County Treasurer and drawing upon the same and effect' g payment by County Treasurer Warrant in the manner provided by law. C. Liens;Satisfaction, ounts payable by benefiting property owners desiring to connect to the Extension Facilities as aforesaid,in the form of th ch es hereinabove described,shall be a lien upon such property until paid. When paid, the lien shall be satisfied and dis arge f record. The Seattle Times site, as you probably know, is located north of SW 34th Street and east of Springbrook Creek. It is currently served from the west by a sanitary sewer that crosses in SW 34th Street over the Springbrook Creek culvert crossing. We will be replacing the creek crossing culverts in SW 34th Street sometime in the future because the culverts are a restriction to flows (too much head loss). The existing sewer just clears the top of the existing culverts and would make it difficult, if not impossible, to put in the needed larger creek culverts. Therefore, since the site at the NW corner of Lind/34th adjacent to and east of the Seattle Times site will be developed this summer by O'Keefe, we have asked the O'Keefe if they would be willing to extend sewer across their site frontage to the Seattle Times site and we would pay them back. This would allow us to eliminate the existing sewer that crosses Springbrook Creek. The proposed sewer extension is shown in the attached plan. The sewer would be extended to the Seattle Times site from a new manhole installed at the end of an existing 8" sewer at the southwest corner of the O'Keefe property. This existing service drains to the southeast to connect to the 8" main sanitary sewer system in the Lind/34th intersection with a tee just downstream of an existing manhole.
