The bid of RJC exceeds the funds budgeted for the project. Therefore, the Utility also requests that Council approve the transfer of $90,000 from the Surface Water Utility Capital Improvement Program (CIP) Wetland Mitigation Bank project to the SW 43rd Street Drainage Improvement project. RECOMMENDATION: The Surface Water Utility recommends that the construction contract be awarded to RJC, Inc. in the amount of $202,023.15, and that the Council authorize the transfer of $90,000 from account 421.000600.018.5960.0038.65.065119 (Wetland Mitigation Bank) to the account for the SW 43rd Street Drainage Project (421.000600.018.5960.0038.65.065270). The transfer will be completed through the year-end budget adjustment. DISCUSSION: The project is needed to increase the capacity of the SW 43rd Street drainage system. The work includes installing open face curb inlets at eight locations on SW 43rd Street between Oakesdale Avenue SW and Lind Avenue SW. The project will also replace an existing 36 inch storm pipe segment with approximately 66 feet of 60 inch storm pipe and related new manhole connections. Award of the SW 43rd Street Drainage Improvement Project Page 2 This project will be constructed at night between the hours of 8:30 PM and 5:30 AM to minimize traffic impacts. Bid proposals for the project were opened on October 29, 1997. Attached is a bid tabulation showing the Engineer's Estimate, the low bid, the other seven contractors bidding the project. The low bid was submitted by RJC, Inc., in the amount of $202,023.15, including sales tax. The engineer's estimate of$162,080.07 was prepared by the City's design consultant, R.W. Beck, Inc. The bids exceeded the engineer's estimate primarily because the cost of night work was difficult to predict, particularity for bid item 17, control density fill (CDF). The low bidder's CDF unit price was 2.5 times higher than the engineer's estimate and accounts for almost all the difference between the low bid and the engineer's estimate. The current amount available in the SW 43rd Street Improvement account is $129,800. An additional $90,000 is needed to cover the full bid amount and provide for construction contingencies and staff time associated with contract management, inspection, and administration of the project. It was intended when the project was bid to use the SW 43rd Street Improvement account and a separate related account to cover the engineer's estimated cost for the project. However,the low bid exceeded the engineer's estimate by$40,000 and necessitates a transfer of funds be approved by the Council in order to award the project. Therefore, the Surface Water Utility requests that Council authorize the transfer of$90,000 from account 421.000600.018.5960.0038.65.065119 (Wetland Mitigation Bank) to the account for the SW 43rd Street Drainage Project (421.000600.018.5960.0038.65.065270). ). The transfer will be completed through the year-end budget adjustment. The funds to be transferred were intended for initiating design and permitting of the wetland bank project in 1997. However, construction of the wetland bank project is not scheduled until the year 2000 because of competing demands for funding from other major projects (i.e., the Cedar River 205 project) and because of a lack of customer interest in the wetland banking project. The funds remaining in the Wetland Mitigation Bank account ($145,012) will be sufficient to cover current work authorized on that project and for initiating design and permitting work now scheduled for the latter part of 1998. The Surface Water Utility reviewed the low bid of RJC, Inc., for completeness, inclusion of all required forms, and mathematical correctness of the bid. There were no irregularities and all the paperwork seemed to be in order. Errors/irregularities were found which affects the attached bid tabulation for B&L Utility. The amount for Items 6 and 13 were not calculated correctly. The corrected totals for these items are shown in the bid tabulation and the total bid amount is,therefore,revised to $279,645.00. Errors/irregularities were also found which affects the attached bid tabulation for CFs Construction. The individual bid items were correct, but the subtotal of all the bid items was not added correctly. The corrected subtotal, tax, and total amounts are shown in the bid tabulation and the total bid amount is,therefore,revised to$280,073.97. The bid of RJC exceeds the funds budgeted for the project. Therefore, the Utility also requests that Council approve the transfer of $90,000 from the Surface Water Utility Capital Improvement Program (CIP) Wetland Mitigation Bank project to the SW 43rd Street Drainage Improvement project. RECOMMENDATION: The Surface Water Utility recommends that the construction contract be awarded to RJC, Inc. in the amount of $202,023.15, and that the Council authorize the transfer of $90,000 from account 421.000600.018.5960.0038.65.065119 (Wetland Mitigation Bank) to the account for the SW 43rd Street Drainage Project (421.000600.018.5960.0038.65.065270). The transfer will be completed through the year-end budget adjustment. DISCUSSION: The project is needed to increase the capacity of the SW 43rd Street drainage system. The work includes installing open face curb inlets at eight locations on SW 43rd Street between Oakesdale Avenue SW and Lind Avenue SW. The project will also replace an existing 36 inch storm pipe segment with approximately 66 feet of 60 inch storm pipe and related new manhole connections.
