LETTER OF UNDERSTANDING WASHINGTON STATE DEPARTMENT OF TRANSPORTATION and the CITY OF RENTON for the SR 405 XL-0560 TUKWILA TO FACTORIA SC&DI-STAGE I HOUSER WAY NORTH STORM SEWER SYSTEM AND CULVERT REPLACEMENT PURPOSE: This is a Letter of Understanding between the City of Renton (Renton) and the Washington State Department of Transportation (WSDOT) regarding the Houser Way North storm system/culvert replacement work associated with the SR-405 XL-0560 (Tukwila to Factoria) project. The Letter of Understanding defines WSDOT and Renton responsibilities as they relate to the Houser Way North storm system/culvert replacement work only. This Letter of Understanding supersedes the previous Letter of Understanding from WSDOT dated October 2, 1995, and signed by the City on October 23, 1995. WSDOT RESPONSIBILITY: . 1. Prepare the engineering design and Hydrologic/Hydraulic Report in accordance with Renton design standards for the Houser Way North Storm System/Culvert Replacement. WSDOT shall design two culvert connections to tie to the existing Renton storm systems via new drainage structures, storm sewer pipe and coalescing plate, oil-water separators contained in maintenance access structures on Houser Way North in accordance with the attached plans, profiles and details(plan sheets H1, H2, H3, DD10, D5, DP5 and details). WSDOT shall also install a 42" x 29" pipe arch system adjacent to Houser Way North from the new WSDOT storm sewer system. WSDOT shall connect from structure H1-10 to the Renton storm sewer system with a 36-inch reinforced concrete pipe. All curb, gutter and asphalt concrete pavement will be restored using the City of Renton Trench Restoration Standards to its original state after installation of the drainage features is complete. WSDOT shall plug existing storm water pipes with concrete, per WSDOT Standard Specs. 7-02.3(5), at the ends of the existing storm pipes that it disconnects from. This includes the existing 24-inch pipe in Houser Way North. 2. Submit the proposed design for the construction of the storm system within Renton Houser Way North right of way for review and approval by Renton. 3. Construction of the storm system as approved by Renton. 4. Transfer of ownership shall occur upon compliance with this Letter of Understanding. WSDOT will supply as-built drawings and cost data inventory for the portion of the constructed storm sewer system located in Renton Houser Way North right of way. 5. WSDOT shall be responsible for correcting any defects, faulty materials, or workmanship in any section of the work which may appear within the period of one(1) year from the date of final acceptance by Renton. 6. WSDOT shall retain ownership and all maintenance and repair responsibilities for the following portions of the storm sewer systems and the coalescing plate, oil- water separators. a. Approximately I-405 Station L 334 + 32 (70' LT), Structure No. H1-1 to H1-7, and all intermediate structures and pipes(plan sheets H1, H2, H3, DD10). b. Approximately I-405 Station L 337 + 55 (76' LT), Structure No. D5-39, D5-45, D5-64, D5-65 and all intermediate pipes(plan sheets D5,DP5 and details). RENTON RESPONSIBILITY: 1. Review of WSDOT design plans and hydrologic/hydraulic report for the portion of the storm system to be constructed in Renton right of way for compliance with Renton design standards. 2. Upon execution of the.Letter of Understanding, Renton will issue a right of way Construction Permit to WSDOT authorizing the construction of the WSDOT storm system in Renton Houser Way North right of way from North 8th Street to the location where WSDOT improvements are completed in Renton Houser Way North right of way. As a condition of the right-of-way Construction Permit, the WSDOT design shall be reviewed and approved by Renton prior to the start of construction. Failure to comply with the conditions of the right-of-way 1 Construction Permit will result in Renton issuing a stop work order to the WSDOT contractor. 3. Renton may inspect all WSDOT construction work within right of way of Houser Way North. WSDOT will notify Renton one week before this work is to begin. 4. Upon final acceptance of the described work by WSDOT, Renton will assume maintenance responsibility for the portions of the constructed storm system listed below. Renton shall be entitled to all warranties as applicable to WSDOT. a. Approximately I-405 Station L 332 + 47 (193' LT), Structure No. H1-7 through H1-10 and to the City system. b. Approximately I-405 Station L 337 + 50 (208' LT), Structure No. D5- 67, D5-63 through D5-66 to the City system. Upon signing the Letter of Understanding, both parties agree to comply with the responsibilities as defined in the Letter of Understanding.
