PURPOSE Amendments to the Comprehensive Plan text or Land Use Map or the Zoning Map change the use or development potential of property. A Comprehensive Plan Amendment (CPA) is for property outside city limits but within Urban Growth Boundary. A Comprehensive Plan Amendment with consistent Zoning is for property inside the City limits. A Rezone (REZ) is to change the Zoning Map designation, conditions, or concomitant agreement applicable to property, within the City, that is consistent with the Land Use Map of the Comprehensive Plan. WHO AND WHEN TO APPLY If you are applying for an amendment to the Comprehensive Plan and/or Rezone you must be a property owner or resident in Renton or within the City's planning area up to the Urban Growth Boundary. You are eligible to apply if you have not applied the previous year for a Comprehensive Plan Amendment or Rezone on the same parcels or for the same policies or text. You must submit your applications between January 1 and March 31 of a given year. Applications will be processed beginning April 1. CONSULTATION Prior to submitting an application, the applicant should discuss the proposal with the Long Range Planning Section (235-2552). The Long Range Planning Section will provide assistance and information on the applications feasibility, decision criteria and review time, etc. APPLICATION MATERIALS If you are applying to amend the Comprehensive Plan's text or policies you must: 1. Describe which text or policies you want changed and how you want them changed. 2. Describe why you want it changed. 3. Submit only application materials 1, 2, and 9 (response to decision criteria) below. 1. Master Application: Provide eleven (11) copies, including the original, of the COMPLETED application form (attached). The legal description of the property must be listed on the back of the application form. If the legal description references any other recorded documents (i.e. easements, public use dedications, restrictive covenants) three (3) copies of the referenced recorded document must also be provided. 2. Environmental Checklist: Provide eleven (11) copies, including original, of the Environmental Checklist (attached). If a particular question does not apply, please do not leave blank. Fill in space with "Not Applicable". 3. Assessors Maps: Please provide three (3) copies of a King County Assessor's Map (scale 1" = 100') denoting the subject site in color and illustrating all property within 300' r , CPA/Rezone Procedures Page 2 of the subject site. If more than one is required to show all surrounding properties with 300 feet, the map sheets must be taped together and cropped to a size less than 18" X 24". 4. Title Report: Provide three (3) copies of a current Title Report documenting ownership and listing all encumbrances. 5. Mailing Labels: Please submit two (2) sets of self-adhesive mailing labels (which also include King County Assessor's account numbers) for all property owners within 300 feet of the boundaries of the subject site. DO NOT provide envelopes, metered postage or stamps. The City staff will provide these items. 6. Certification Form of Current Property Ownership: Please submit two (2) copies of a signed and notarized City staff"Certification Form of Current Property Ownership" listing the surrounding property ownership information and attesting that the information was obtained from the King County Assessor's Office. 7. Legal Documents: Provide three (3) copies of each of the following documents (if applicable): ■ Restrictive Covenants ■ Deeds to City for any reserve strips ■ Easements 8. Fees: The application shall be accompanied by the required application fee (see Fee Schedule) and 32 cents per mailing label. DO NOT provide metered postage or stamps. 9. Project Narrative: Provide eleven (11) copies. The narrative should summarize and describe the proposed project. Please address each of the following: ■ Requested change to Comprehensive Plan or Zoning Map, ■ Size and location of site, ■ Current use of the site and any existing improvements, ■ Special site features (e.g. wetlands, water bodies, steep slopes), ■ Location of existing structures. ■ Specific responses to the following decision criteria. A. The CPA/Rezone bears a substantial relation to the public health, safety, or welfare, and B. The CPA/Rezone addresses changing circumstances or the needs of the City as a whole, and C. The CPA/Rezone is compatible with the provisions of the Comprehensive Plan or other goals or policies of the City, and D. The CPA/Rezone is compatible and not materially detrimental with adjacent land use and surrounding neighborhoods, and E. The CPA/Rezone will not result in development which will adversely impact community facilities, including but not limited to utilities transportation, parks, or schools and, CPA/Rezone Procedures Page 3 G. The subject property is suitable for development in general conformance with zoning standards under the proposed zoning classification. ■ The burden of proof in demonstrating that the change is appropriate lies solely upon the proponent. The proponent must show in a clear and precise manner why the rezoning application should be granted and that the request for rezone is timely. Neighborhood Detail Map: Provide eleven (11) copies. This map should be drawn at a scale of 1" = 200' (or smaller scale, if approved by the Long Range Planning Division). The purpose of the map is to show surrounding properties and zoning within 500 feet (1,000 feet for properties over 5 acres in size) of the boundaries of the subject property. This map will be used to identify the site location on public notices and to review compatibility with surrounding land uses. Please include: Scale, north arrow, lot lines, existing land uses, Street names, City of Renton limits (if applicable). Kroll Map Company (448-6277) produces maps which may serve this purpose or the applicant may use King County Assessors maps as a base for the Neighborhood Detail Map. Additional information (i.e. building, zoning, etc.) will need to be added by the applicant. 11. Property Map: Provide eleven (11) copies. The applicant shall submit a dimensioned plan drawn at a scale of 1" = 20' (or other scale approved by the Long Range Planning Division). We prefer that the site plan be drawn on (1) 22" by 34" plan sheet unless the size of the site requires that several map sheets be used. If you are using more than a single map, please show connecting points on each sheet. The Property Map shall show the following: ■ Name of property owner. ■ Date, scale, and north arrow (oriented to the top of map). ■ Subject property with all property lines dimensioned. ■ Location of the property with respect to the nearest street intersections, (including intersections opposite the property) alleys and other rights of way. Be sure to use City of Renton (not King County) street names. ■ Existing land contours using 5' intervals. ■ Topographic features and other natural features such as streams, lakes, marshes and wetlands. 12. PMT (Photo Mylar Transfer) reductions: Please provide one 8 1/2" by 11" opaque/white reduction of EACH sheet of plans (including Neighborhood Detail Map). A PMT reduction is an original white/opaque (NOT TRANSPARENT) photographic reduction. Xerox reductions cannot be accepted. Also provide one 8 1/2" x 11" photocopy of each PMT sheet. Note: Waterfront Reprographics (467-9889), Kestrel Blueprint (883-1110), and CPA/Rezone Procedures Page 4 Olympic Printing (622-6000) are just a few of the printing companies that provide this service. CPA/REZONE REVIEW PROCESS Once the CPA/Rezone application package has been accepted for review, City staff will post three (3) notices of the pending application at or near the subject site and mail notices to property owners within 300 feet of the project site. Additionally, the City staff will route the proposed plan for review to other City departments, jurisdictions or agencies who may have an interest in the application and schedule the project for Environmental Review Committee (ERC). The ERC is comprised of the Administrator of the Planning/Building/Public Works Department, the Director of Parks and Recreation, and the Fire Chief. The ERC is responsible for determining whether the proposed project will result in significant negative environmental impacts and will consider such issues as environmental health hazards, wetlands, groundwater, energy, natural resources and will then issue its decision (Threshold Environmental Determination). The ERC will either. • Make a determination that the amendment will have no significant negative environmental impacts (issue a Determination of Non-Significance), or • Make a determination that the amendment if modified, would have no significant negative environmental impacts (issue a Mitigated Determination of Non- Significance), or • Make a determination that the amendment will have significant negative environmental impacts (issue a Determination of Significance). See the Development Services Division's SEPA information package for more information. Once the ERC has issued its Environmental Determination (provided an EIS is not required), a public notice of the Determination is printed in the Valley Daily News and three (3) notices are posted at or near the site. A fifteen (15) day public comment period begins and is followed by a fourteen (14) day appeal period. After the 14 day appeal period has ended, the proposed amendment can be scheduled for review by the Planning Commission provided no appeals have been filed. Exception: Applications for a rezone only will require review by the Hearing Examiner Process without the following procedures. A notice of the hearing will be published at least ten (10) days prior to the hearing, the site will again be posted, and parties of record will receive notices via mail. Long Range Planning staff will issue a report to the Planning Commission within seven (7) days prior to the hearing. The Planning Commission will review the CPA/REZ application and issue a recommendation to the City Council, unless at the time of the public hearing, the Planning Commission indicates additional time will be required for the recommendation. The recommendation to approve, conditionally approve, or deny the application will be mailed to the applicant and all parties of record. The Planning Commission's recommendation will be forwarded to the City Council for their review, final recommendation and adoption (if approved) by ordinance of the CPA/REZ. CPA/Rezone Procedures Page 5 Any person, including the applicant, aggrieved by the Planning Commission's recommendation or City Council's decision may address the Planning Commission and City Council during the meeting public comment periods and public hearings. Typical land.proposals requiring notification include variances, platting and site plan approval. The city requires written notice before holding a hearing on the proposed change. The King County Department of Assessments will help property owners in this process. Their Public Information section is on the 7th floor of the King County Administration Building, 500 Fourth Avenue, Seattle. They have staff, computer terminals, maps, and other materials needed to identify all affected parcels. ■ Identify your subject property and obtain its quarter-section-township-range map coordinates. Use the Kroll books, or the self-service terminals, or ask the County's public information staff for assistance. The terminals and staff are located on the 7th floor of the King County Administration Building. ■ Get a copy of the appropriate quarter section map from the County public information staff, plus a scaled template of the required radius. The County can make photocopies if needed of portions of tnese maps. Full size map copies may be ordered from King County Public Works on the 9th floor. ■ Locate your subject property on the map, then use the template to identify all adjacent parcels within the required distance. (Adjacent maps may be necessary in case of overlaps.) Determine the Assessor's account number of the parcels from the information included on the map. Public Information staff can provide you with a handbook of examples to assist you in determining the account numbers. ■ You may use the self-service terminals to look up information on individual accounts. The Tax Information screen includes the taxpayer/owner mailing address. The Property Characteristics screen and the index browse screens contain the property street-addresses in case you need to contact tenants/occupants where different from the taxpayer. Print- outs may be made of any of these screen displays. ■ To Obtain Computerized Address Labels and/or Printouts: Obtain a Batch Request Sheet and Source Sheet(s) from public information staff. Fill out the request sheet and list the parcel/account numbers on the source sheet(s). ■ Examples are contained in the handbook referred to in Step 3. Return the sheets to County staff who will check them and assign a batch request number. ■ Sign and have notarized an agreement limiting allowable uses of the information to be obtained (see example in the handbook). One signed agreement will serve for the entire year.
