Engineering Supervisor Surface Water Utility 200 Mill Avenue South Renton, Washington 98055 Re: Renton' s Proposed Wetland Mitigation Banking Program Dear Mr. Straka: Our firm represents several owners and potential developers of property that are located within the Green River drainage basin. Renton' s proposed wetland mitigation banking program does appear to have some positive aspects . However, we would appreciate the City considering expanding the somewhat limited area of land that would qualify for program participation to include all real property that is located within the Green River drainage basin. Participation in a wetland mitigation banking program based on larger surface water drainage basins, as compared with smaller artificial surface water collection subbasins, presents a reasonable and uniform basis for the regulation and development of those wetlands which are located within a common geohydrologic area. Because the implementation of the proposed wetland mitigation banking program is intended to further the City' s goal of "no net loss of wetlands", the area and types of wetlands that qualify for development should be expanded. Where compensation to the City' s mitigation bank is made, there should be no arbitrary upper limit placed on the size of wetlands that may be filled in exchange. Donated interpretive materials? Volunteer maintenance and monitoring? b. Cost sharing? 1) Percentage split of all costs by public and private? 2) City accept responsibity for all maintenance bonding and contingency costs, or for all of these costs in excess of a certain dollar value? c. Limit the impacts to Catagory 3 isolated wetlands less than one-acre so that permitting is simplied and implementation costs are less expensive? d. Simple eligibility requirements and reduced permit costs for eligible properties? 3. How should users be chosen? a. First-come-first serve, regardless of wetland size, function, and value? b. At what point should a user be considered eligible? 4. Should public and private users be equally eligible? 5. Should the City limits the size of wetlands that are eligible? 6. Is anyone interested? How can the program address your needs in order for you to consider the City mitigation sites as a viable option? 7. Site design questions. a. Should there be public access to the site? Trails? No trails? Perimeter trails? Extensive trails? b. What type of interpretive material would be useful? Displays illustrating the vegetative, wildlife, hydrologic and hydraulic, and geologic features to be observed? Descriptions of wetland value and function? Project objective? Historical background of Green River Valley and project sites? c. What other features should be included? Flood storage? For Springbrook Creek? For private and public development projects? Type of wildlife you would like to see use the site? Wildlife habitat features? Nest boxes? Snags? Wetland Mitigation Bank Project October 21, 1993 Development Community Meeting Questions/Comments: 1. Developer's want to know all the costs and have assurances of closure of responsibility in a reasonable amount of time. a. Ideal scenerio. Construct the site and identify all costs (no hidden costs) so that developer who meets eligibility pays cash and is done. b. Without actual costs set an upper limit on potential costs so that maximum potential liability is known. C. Limit the use of hold harmless and transfer of liability requirements so that the developer can see closure to his responsibility. d. Minimize the amount of time that a developer must be responsible. 2. Development community desires "user friendly" regulations that are not overly restrictive. a. Consider ordinance revisions. 1. Eliminate avoidance/minimize requirement for Category 3 wetlands. 2. Develop single payment scheme. 3. Consider fee-in-lieu program. 4. Allow impact before mitigation. b. Reduce site plan approval time. C. Simple eligibility requirements with minimum of paper work and cost to determine eligibility. Developer typically not willing to sink money into a site unless a specific project is on line. Must be setup to realize some return for the expenditure in order to justify the costs. 3. Suggestions for funding program and increasing developer awareness and confidence in using bank sites for mitigation. a. Fund full bank site development using special assessment district or some sort of general tax and establish successful mitigation prior to issuing credit. Construct entire bank site 2 to mitigate for the 5.33 acre obligation and use excess acreage as pilot mitigation bank and demonstration to development community. C. Amenities, such as trails, should come from City, not developer, funds. Developer should be responsible for basic mitigation for the associated impact. d. The City should consider cost sharing with the developer for the mitigation partly because of the increase in tax base that may result. 4. Other comments/questions. a. Will the program allow other types of credit, such as compensatory storage for filling the floodplain? b. When will a potential user be considered eligible? Following SEPA review, permit issuance, or at some other time? C. Will the program be first come, first serve, and how long will a user remain eligible once accepted? d. Public and private users should both be allowed. e. The program should not exclude greater than one acre impacts if all requirements are met. f. The program should not be limited to only Catagory 3 impacts. g. Corps has rarely issued permits. However, projects that have gone through the Corps process should be allowed to use the bank. h. General interest and support for the banking concept, but need to see more information. Have you measured elevation of water level in wetland south of 27th and east of Longacres and compared with groundwater on bank site #1? 7. Saw program on public TV. Wetland biologist says wetland creation not possible. How do you respond to that? 8. What is longest time period until created wetland established? What is its success? 9. What do you do with canary grass? 10. When do you call a mitigation a success so credit can be withdrawn? 11 . How is bond handled? 12. What department in City is in charge of project? Concerned that developer may try to utilize sites as amenity. Domestic animals should be restricted. Restrict to joggers. Should be meandering. b) What type of interpretive material would be useful? Include signs for: plant species; explanation of why wetland created; historical background; Indian heritage; signs should be restricted to one area. e) Are there any other features that should be included, such as trails, flood storage, and wildlife habitat? Raptor habitat. Possibly go for higher quality habitat on Site 1 . 2. Should public and private users be equally eligible? Both should be allowed. May depend upon timing. 3. Should the City limit the size of wetlands that are eligible? Possibly exclude Category 1 wetlands. Want to see mitigation established before impact. Better to have smaller pilot projects (sending property impacts less than one acre). Introduce team members. Define the purpose of the meeting. It is important to stress that the meeting is for soliciting public input on the proposed wetland mitigation bank plan. Participants must be led to realize that wetlands are protected by local, state, and federal regulations and that we are not meeting to contest or try to redefine these regulations. Instead we are proposing a program that will help achieve the requirements in an economic and efficient manner. It is important to frame the meeting here so if it starts to go off track we can focus the meeting to its stated purpose. It is also important to stress that the program will not be funded by new taxes, but will instead potentially increase the tax base of the City. The City's purpose is to recover the costs of implementation and pass any money saved onto the community, not make a profit. ^n Background. Define mitigation banking. Give brief presentation. The valley was once a � � /✓ vast wetland that has been subjected to development and agricultural pressure. Due to filling and ditching much of these wetlands have been lost. During the inventory of the City's wetlands required by the Growth Management Act, it was found that low quality wetlands have formed on top of the filled land designated for industry that had not been October 19, 1993 Page 2 developed. To balance the community desire for economic development with the responsibility to maintain the wetland the wetland banking framework was set by the Council in the Wetlands Ordinance. The City was fortunate the acquire two parcels to serve as the bank. Goals, Objectives, and Policies. Have copies available for pickup at the sign-up sheet as people enter. Briefly express the importance of these items and relate to the project. Request the participant to make additions/changes to the list and submit at the end of the meeting. Conditions Assessment. Overview wetland communities and categorization. Present the ,�existing conditions of the sites, area, and drainage basin. Overheads include site maps, " area map, and drainage basin map. Conceptual Renditions. Discuss possible opportunities using the David Evans conceptual renditions on the overhead. Say that participants will have opportunity to provide input in the focus groups to follow. Issues for Implementation. Discuss the framework of regulatory requirements in which we must work. Give overview of federal, state, local regulations. site and off-site mitigation. Refer to the goals, objectives, and policies th t proje ncept of off-site mitigation. Stress that the project does not circumvent regulations, but proposes to achieve the requirements in an economic and efficient manner. Before breaking up into small groups, discuss the purpose of the small groups and explain that the group leader (City or PMX staff) will be recording their questions or comments so that their concerns are addressed in the plan. Should public and private users be equally eligible? 6. Should the City limits the size of wetlands that are eligible? The staff member leading the group should carefully record any question or comment made by a participant for later review. This is important to seeing that their concerns are addressed in the plan. Ask for a pause while you record a question, if you feel the pace of the small group is too fast. If you feel you cannot provide an answer to a question, just say so, and add that the project manager will get back to them following the meeting. Make sure you have their name and phone number. Another option is to see if a "rover, is available and call them over for assistance. As a method of achieving this goal, the City is developing a wetland mitigation banking program. The main objective of the mitigation bank project is to provide advanced compensation for expected and unavoidable impacts to wetlands in the Green River Valley. The City has acquired 45 acres of property in the Valley on which it intends to restore historic high quality wetlands (see attachment). This surplus of wetland acreage, or "credit," will be used to offset expected and unavoidable impacts to low quality wetlands due to development. The wetland mitigation bank is a win-win project for developmental, environmental, and regulatory interests. While the mitigation bank will facilitate development of parcels containing low quality wetlands in the Green River Valley, the project will establish a larger, more contiguous system of wetlands which have higher functional value than the scattered low quality wetlands impacted by development. Using the mitigation bank should be less costly than performing on-site mitigation because construction of the bank will have a greater economy of scale. Once the bank is created, qualified projects will have a more efficient way of meeting regulatory requirements for mitigation. As public property, this wetland system will be a public amenity offering trails, wildlife viewing and interpretive information. The project will also benefit the City and the region by improving water quality and providing additional flood water storage. The wetlands will also be protected and managed into perpetuity. The City is soliciting input on this project from the general public through two public meetings as noted in Attachment No. 1 . A separate meeting will be held October 21 with property owners and the development community to gain their input on the project. An additional meeting is planned for early November with the regulatory agencies. You will be receiving a special invitation to the agency meeting under a separate cover. What does this project mean for the developer, the citizen concerned about the environment, and the City of Renton? For the developer the mitigation bank will facilitate full development of parcels } "' low quality wetlands. Using the mitigation bank will be less costly than performing on-site mitigation because construction of the bank will have a greater economy of scale. Once the bank is created, qualified projects will have a more efficient way of meeting regulatory requirements for mitigation. For the environmentally concerned citizen, the mitigation bank project will establish a larger, more contiguous system of wetlands which will have higher functional value than the scattered low quality wetlands in the Valley today. As public property, this wetland system will be a terrific public amenity offering trails, wildlife viewing and interpretive information. The wetlands will also be protected and managed in perpetuity. -� . For the City, the mitigation bank project will facilitate development on restricted parcels currently served by roads, utilities, and mass transit within the City's urban growth area. Development of these parcels will result in increased tax revenue for the City as well as the creation of additional jobs.
