SUBJECT: Wetland Mitigation Bank Site Fence Project—Bid Opening
The Wetland Mitigation Bank Site Fence Project involves the construction of a chain link fence
to protect the Wetland Mitigation Bank Sites along Oakesdale Ave SW.
The bid opening for the subject project was held on Tuesday, August 19, 2003 at 2:30 PM. Two
bids were submitted for the project. The bids were opened and officially read by the City Clerk.
The engineer's estimate for this project is$45,623.34.
The bids from Complete Landscaping, Inc. and L.W. Sundstrom, Inc have been reviewed for
completeness, inclusion of all required forms,bid bond and mathematical correctness.
Upon review of the two bids, the Surface Water Utility has determined that the both bids are
unacceptable due to the following irregularities: one bidder did not complete the word section of
the schedule of prices as required to qualify as a responsive, responsible bid; both bids included
significant mathematical errors in completing the schedule of prices. The mathematical error
consisted of the fact that the bidders did not properly multiply the estimated quantity by the unit
cost correctly to establish the correct total cost for certain bid items. The mathematical errors
would result in each of the total bid amounts for the two bids to be over five million dollars, if the
unit prices were considered to be valid.
Due to the irregularities in both bids,we recommend that all bids for the project be rejected. The
Surface Water Utility intends to re-advertise the project for new bids in the future.

Attached is a set of 90% Design Plans for the Wetland Mitigation Bank Site Fence Project for
your review and comments.
Construction may occur between August and October 2003.
The plans include installing approximately 2,300 linear feet of 6-foot high chain link fence with a
barbed wire top. About two 20-foot wide gates and one 6-foot wide gate will be installed.
At the Southern Site the fence will be installed in one of two possible locations.
In Alternative A the fence is located about 12 feet off the face of the curb. In Alternative B the
Fence is located about 28 feet off the face of the curb. Access to an existing water main, and
apparently a buried telephone line, will need to be considered. Alternate B involves clearing
more of the adjacent trees. The fence location will be selected after comments are received from
the private utilities and other City Departments, and potential permitting issues are reviewed.
Trees and shrubs along the fence line will need to be cleared. In the forest area the clearing will
be about 5 feet on each side of the fence line. In non-forest area the clearing will be about 3 feet
on each side. At the ends of the fence, thick sections of blackberry bushes will be preserved to
discourage people from going around the fence to enter the property.
Please review the Design Plans for utility conflicts and any other concerns that you may have.

SUMMARY OF ACTION:
The Surface Water Utility requests Council approval to transfer$30,000 from the completed Morris Ave.
S. Storm Improvement Project account to the Wetland Mitigation Bank Site Fence Construction Project
account. We intend to carry the transferred funds forward into 2004 to complete the fence project. The
Morris Ave. S. Storm Improvement Project is complete and the remaining funds in the account are
approximately $34,000. The chain link fences are needed to prevent the reoccurrence of vandalism,
dumping of garbage, and environmental degradation caused by sport-utility vehicles four-wheeling on
the sites. The project will reduce the need for City services for site clean-up as well as police and code
enforcement responses to illegal activities.
STAFF RECOMMENDATION:
The Planning/Building/Public Works Department recommends Council approval to transfer$30,000
from the completed Morris Ave. S. Storm Improvement Project account (account#
421.600.018.5960.0038.65.065435) to the Wetland Mitigation Bank Site Fence Project(account#
421.600.018.5960.0038.65.065119) to provide sufficient funding for the project construction.

PROJECT FUNDING
ISSUE:
Additional funding is needed to complete the Wetland Mitigation Bank Site Fence Project.
Surface Water Utility requests approval from Council to transfer funds in our budget and carry
these funds forward into 2004 for the completion of this fence project.
RECOMMENDATION:
The Planning/Building/Public Works Department recommends Council approval to transfer
$30,000 from the completed Morris Ave. S. Storm Improvement Project account (account#
421.600.018.5960.0038.65.065435) to the Wetland Mitigation Bank Site Fence Project (account
#421.600.018.5960.0038.65.065119) to provide sufficient funding for the project construction.
BACKGROUND SUMMARY:
The Wetland Mitigation Bank Site Fence Project will place chain link fences to protect the two
Wetland Mitigation Bank Sites along Oakesdale Ave. South(see attached Project Vicinity map).
The chain link fences are needed to prevent the reoccurrence of vandalism, dumping of garbage,
and environmental degradation caused by sport-utility vehicles four-wheeling on the sites. The
project will reduce the need for City services for site clean-up as well as reduce police and code
enforcement responses to illegal activities. The sites were donated to the City for the creation of
a wetland bank and are zoned for resource conservation.
The illegal dumping of garbage and the off-road vehicle use has required extra code and law
enforcement services, in addition to the costs associated with Public Works Maintenance
Services cleaning up the garbage dumped on the sites. This project will reduce the need for these
services and the associated costs to the public.
The Surface Water Utility had initially planned to construct the Wetland Mitigation Bank Fence
Project in 2003. The construction contract was advertised last August and bids were opened.

Unfortunately, we had to reject the only two bids received due to irregularities in both bids.
From the apparent intent of the bids we deduced that the real cost of construction will be higher
than we had estimated. In addition, the staff costs to produce the construction plans and
specifications, and advertise the project for bid was more than originally estimated. The
additional funding is also needed for staff costs associated with the re-advertisement of the
construction contract, and project management during the project construction.
The 2003 project budget was $45,000. Year-to-date expenditures on the project are $9,474. The
remaining project budget is $35,526. The revised estimated construction cost for the 2,300 linear
feet of fence and other improvements is approximately $55,000. The requested funding transfer
of$30,000, plus the remaining budget of$35,526, would provide for a total project budget of
$65526, which would be carried forward into 2004. The total project budget will fund the
construction and project management necessary for completion of the project. The Wetland
Mitigation Bank Site Fence Project will be re-bid in early 2004.
The Morris Ave. S. Storm Improvement Project was part of an interlocal agreement with King
County. The City of Renton worked with King County to make water and storm utility
improvements in Morris Avenue as part of King County's Eastside Interceptor Sanitary Sewer
Capacity Restoration Project. The Surface Water Utility has paid King County in full for their
work, and approximately $34,000 remains in the account.
CONCLUSION:
The Surface Water Utility recommends the transfer of$30,000 from excess funds from the
completed Morris Ave. S. Storm Improvement Project to the Wetland Mitigation Bank Site
Fence Project for its completion in 2004. The completion of the Wetland Mitigation Bank Site
Fence Project will help protect the sites from environmental damage and reduce City service
requirements from our code enforcement officers, our police, and Public Works Maintenance
Services Division.

SUBJECT: Letter of Exemption for fences at Wetland Mitigation Bank sites
We are proposing to construct a fence along the Oakesdale Avenue SW street frontages of the
city's Wetland Mitigation Bank sites. Our main objective in proposing these fences is to protect
two wetland sites from continued intrusions by four-wheel drive vehicles and from illegal
dumping. Please refer to the attached project narrative.
Trees to be removed:
On the northern Wetland Mitigation Bank Site property, the fence is located so that no trees need
to be removed, except for some young 2"trees.
On the southern Wetland Mitigation Bank Site property, the trees to be removed depend upon
which fence alignment option is selected. The eastern right-of-way line of Oakesdale Ave SW is
17 ft. from the existing curb along the eastern side of the street. If the fence is constructed at an
offset of 12 ft. from the curb(5 ft. inside the right-of-way), then no trees will need to be removed
(Option "A"). If the fence were constructed at an offset of 28 ft. from the curb (11 ft. outside of
the right-of-way), then 5 to 10 trees over 8" may need to be removed (Option `B"). We have
enclosed the plan sheets, which show the fence locations. The two fence locations that are being
considered for the southern site were based on avoiding conflicts with existing utilities and
attempting to minimize vegetation removal.
Letter of Exemption:
The purpose of constructing the fence is to protect the wetland mitigation sites from further
degradation, and to preserve and protect these wetlands, and that is in precise accordance with the
purposes of the wetland regulations per RMC 4-3-050B-7, p. 3-11. Therefore,we are requesting
that you grant a letter of exemption per RMC 4-3-050C-4. We believe that the proposed fence
falls under the intended meaning of the exempt activities for wetlands, listed under RMC 4-3-
050C-5.a.i, 5.e.ii, 5.e.iii, 5.e.v and 5.f.ii.
We believe the fence construction should be granted a shoreline permit exemption for the
following reasons:
Approximately 205-feet of the fence would be constructed within the 200-ft. shoreline setback
from the ordinary high water mark of Springbrook Creek. The estimated cost to construct the
205 ft. feet of the fence that is located within the 200-ft. shoreline setback is$3,485,which is
more than the cost exemption allowed in the city's shoreline master program ($2,500). However,

the cost is less than the new cost exemption that was recently approved by the State Legislature of
$5,000.
In addition,the construction of the fence qualifies for the normal maintenance exemption allowed
by the city's shoreline regulations(4-9-190), since it is intended to prevent a decline in the
condition of the Wetland Mitigation Bank Sites.
By no means would the construction of the fence have as much of an impact on the shoreline as
the construction of a normal protective bulkhead associated with a single family residence,which
per city code is also exempt from having to get a shoreline permit.
Please determine whether these or other exemptions apply or if we need to apply for any specific
permits. If any permits are required please specify them.

Wetland Mitigation Bank Site Fence Project
PROJECT NARRATIVE
The proposed project consists of installing a 6 feet high chain-link fence at two locations along
the right-of-way of Oakesdale Ave SW between SW 41st St. and SW 27th St. along the street
frontages associated with the city's"wetland mitigation bank"sites. The total length of fence to
be constructed is approximately 2300 ft.
We anticipate that the only permits needed for the project is a Shoreline Exemption and a
Certificate of Exemption from Critical Area Regulations.
Both sites are zoned Resource Conservation(RC). The adjacent properties are zoned Industrial—
light to medium, commercial office,and the southern site is bordered on the east by the
Springbrook Creek Greenbelt. The distance from the closest area of work to the ordinary high
water mark of Spring Brook Creek is 47 ft. The nature of the shoreline of Springbrook Creek is
moderately steep(>25°), grassed banks of 10 to 20 ft. in height,with intermittent growth of trees
and shrubs.
The current state of the sites is undeveloped and that will remain until the sites are developed as
official wetland mitigation banks. The purpose of both sites is to create a large protected wetland
area that developers,who are required to perform on-site wetland mitigation, pay to replace their
wetland mitigation in the bank site in lieu of providing on-site wetland mitigation. The existing
improvements on the northern site include the following: 108 in. diameter Metro sewer, 8 in.
diameter city sewer, and a gas stub line. The existing improvements on the southern property
consist of an 8 in. city sanitary sewer.
Both sites may contain small, low quality, isolated wetlands. The southern site near SW 4ft St. is
also bordered by Springbrook Creek. Approximately 205 ft. of the fence will be constructed
within the 200-ft. shoreline setback area associated with Springbrook Creek. The main purpose
for the fences is to keep four-wheel drive vehicles and unauthorized persons out of the Wetland
Mitigation Bank Sites,which are owned and maintained by the City of Renton. At the northern
site the fence will be installed close to the right-oway line,on the wetland bank property. At the
southern site we are presenting two alternatives. The first alternative is to place the fence 11 ft.
within the Mitigation property,requiring more invasive clearing and tree cutting. The second
alternative is to place the fence 5 ft. within the Oakesdale Ave. SW right-o€way, in a grassed
strip. (Refer to the enclosed plans.)
The sites will remain undeveloped and natural features will be enhanced and protected as part of
the wetland mitigation bank program. The placement of a fence is in fact part of this effort.
The fences shall have the following characteristics: 3.25 ft. minimum depth portholes to be set
with concrete fill,poles set at 10 ft. on centers, with a Eft. above ground height;tensioned chain-
link fabric;tie-rods and support wires; 3 strings of barbed wire atop, in addition to the 6-ft.
height; and two 20 ft.wide access gates. The work will include removal of boulders,ecology
blocks,trees and shrubs where necessary.
The only access to both sites is directly off Oakesdale Ave. SW. A 20-ft. chain-link gate will be
provided at each location for maintenance access. There shall not be any off-site improvements.

The total estimated construction cost of this project is$39,100. No significant fill or excavations
are required.

noxious weeds, We make the material on site at our facility.
Our sand is pulled from the bank of our pit. I was unable to find any current testing results for
our bank run sand, You are welcome to come grab a free sample and take it to the testing lab.
