PERMISSION IS HEREBY GIVEN to the following named petitioner: CITY OF RENTON,200 Mill Avenue South, Renton,
WA.98055, (hereinafter called Permittee)remove an existing 18 inch concrete storm water pipe and install a 24 inch CPEP
storm water pipeline within the Cedar River Pipeline 1,2,3 Right-of-way,in conjunction with the Tobin/Lake Storm System
Improvement Project,said crossing of approximately 10 feet is located at the intersection of South 2nd Street and Lake
Avenue South, Renton,Washington,as shown on the City of Renton drawing"S.Tobin St.-Lake Ave.Storm System
Improvement Project",file name 6575SD, Sheet 2 of 5.Said permit is issued conditioned upon the following terms:
A. The City of Renton must show the Seattle Water Department(SWD)pipelines on their plan and profile drawings.
B. Show the SWD pipelines on all profiles.
C. Contractor shall keep excavating activities as close to he existing manhole as possible(shoring may be necessary).
D. No disturbance to the 66"water pipeline.
E. Cathodic protection facilities are located nearby(see CH2MHill drawing enclosed). Call Les Nelson at 684-5919 for further
information regarding step to be taken for the protection of the pipeline.
F. Potholing of the pipeline may be necessary.
G. SWD must be notified 48 hours before the start of construction at(206)244,26 ir. Z2NZ.
SUBJECT to City of Seattle ordinances and regulations and to the following terms and stipulations:
1. To the fullest extent permitted by law,the Permittee agrees that the City of Seattle shall not be responsible for any
injury, loss or damage of any kind or description which may accrue to or be sustained by any person,firm,corporation or
other entity by reason of the Permittee's sole negligence or to the extent of the Permittee's concurrent negligence in the
construction, maintenance,operation or use of said installation,or the use and occupancy of the property referenced above
by the Permittee, its successors or assigns. In the event any suit or action be brought against the City by reason thereof,the
Permittee, its successors or assigns shall indemnify and save the City harmless therefrom,and shall upon notice to it of the
commencement thereof,defend such suit or action at its sole cost and expense and will fully satisfy the final judgment
rendered in any such suit or action except for that portion,if any,of such injury, loss or damage that results in such judgment,
which is attributable to and results from negligence of the City,its agents,employees or officers.
2. In an emergency the Seattle Water Dept.must be notified immediately at 386-1800.
3. Permittee's use of the City's right of way shall in no way interfere with the City's present or future use of said right of
way for any purpose. Work to be prosecuted with diligence,and with due respect to all property,contracts, persons, rights
and the interests and convenience of the public. Permittee agrees to restore the premises to the condition found,or better.
4. If at any time the City shall install, repair or replace a pipeline or pipelines at said storm water crossing, Permittee
upon written notice from the City shall temporarily remove its storm water pipe at its own expense during the City's installation,
repair or replacement and shall replace same at its own expense under the supervision of the City.
5. Permittee agrees upon being billed therefor to pay for any increase in the City's cost of installing, replacing or
repairing the City's pipelines or other City improvements resulting from the existence of Permittee's storm water pipe
6. Permittee agrees to pay to the City the reasonable cost of repair of any of the City's facilities damaged by the
installation,operation,or maintenance of Permittee's storm water pipe.
7. Permittee agrees that the City shall not be liable for any damage to said storm water pipe by reason of any
construction,alteration or improvement by the City,its agents or representatives,except where such damage is caused by
the sole or comparative negligence of the City,its agents or employees.
8. The City reserves the right to institute an annual fee for this permit.
9. This permit is revocable upon thirty days notice by the Superintendent of Water.
10. This permit is not transferable.
11. One copy of this permit must be on-site during installation by Permittee or Permittee's agent. All work shall be
completed by December 31.1996.
12. This permit is invalid unless approved by the City of Seattle and executed in acceptance by Permittee.
13. Payment of application fee:$500 to cover costs of administration, inspection,etc. If costs to the City of Seattle in
conjunction with this permit exceed the permit fee, Permittee agrees,upon being billed,to pay such reasonable costs.

SUBJECT to City of Seattle ordinances and regulations and to the following terms an tipufations:
1. To the fullest extent permitted by law, the Permittee agrees that the City f Seattle shall not be responsible for any
injury, loss or damage of any kind or description which may accrue to or be s ained by any person, firm, corporation or
other entity by reason of the Permittee's sole negligence or to the extent of a Permittee's concurrent negligence in the
construction, maintenance, operation or use of said installation, or the u and occupancy of the property referenced above
by the Permittee, its successors or assigns. In the event any suit ota ion be brought against the City by reason thereof, the
Permittee, its successors or assigns shall indemnify and save th Ci harmless therefrom, and shall upon notice to it of the
commencement thereof, defend such suit or action at its sole cos d expense and will fully satisfy the final judgment
rendered in any such suit or action except for that portion, if any, of such injury, loss or damage that results in such judgment,
which is attributable to and results from negligence of the City, its agents, employees or officers_
2. In an emergency the Seattle Water Dept. must be notified immediately at 386-1800.
3. Permittee's use of the City's right of way shall in no way interfere with the City's present or future use of said right of
way for any purpose. Work to be prosecuted with diligence, and with due respect to all property, contracts, persons, rights
and the interests and convenience of the public. Permittee agrees to restore the premises to the condition found, or better.
4. If at any time the City shall install, repair or replace a pipeline or pipelines at said storm water crossing, Permittee
upon written notice from the City shall temporarily remove its storm water pipe at its own expense during the City's installation,
repair or replacement and shall replace same at its own expense under the supervision of the City.
5. Permittee agrees upon being billed therefor to pay for any increase in the City's cost of installing, replacing or
repairing the City's pipelines or other City improvements resulting from the existence of Permittee's storm water pipe
6, Permittee agrees to pay to the City the reasonable cost of repair of any of the City's facilities damaged by the
installation, operation, or maintenance of Permittee's storm water pipe.
7. Permittee agrees that the City shall not be liable for any damage to said storm water pipe by reason of any
construction, alteration or improvement by the City, its agents or representatives, except where such damage is caused by
the sole or comparative negligence of the City, its agents or employees.
8_ The City reserves the right to institute an annual fee for this permit.
9. This permit is revocable upon thirty days notice by the Superintendent of Water.

Dear Ms. Kruger:
The City of Renton requests the granting of the necessary permits from the Seattle Water
Department for work within the Cedar River pipeline right-of-way at the intersection of S. 2nd
Street and Lake Avenue S.
The work within the Cedar River pipeline right-of-way includes the removal and replacement of
a storm drainage pipeline and connection of the new pipeline to an existing catch basin. Two
sets of final plans and bid specifications are attached. Because the work is north of the physical
location of the pipelines, I anticipate that the potential for impact is minimal.
The project will be advertised for two weeks beginning on July 31, 1996 and ending on August
14, 1996. Construction is not expected to start until mid-September. Your assistance in
reviewing the plans and issuing the necessary permits and conditions before the deadline for bids
is appreciated. This would allow the permits and any conditions to be issued as an addendum.
In any case, we are requiring in the specifications that all work within the Cedar River pipeline
right-of-way to be done in accordance with the conditions and requirements of the City of
Seattle.

vacation until August 5, 1996, and will contact you when I return to see if you have any
questions.
