TIMIING LIMITATIONS• The project may begin June 1, 1998 and shall be completed by November 1, 1998. Revegetation per provision 14 shall be completed no later than April 1, 1999 ,and shall be monitored through October 15,2002. 2. NOTIFICATION REQUIREMENT: The permittee or contractor shall notify the Area Habitat Biologist(AHB)listed below,by FAX or mail,of the project start date. Notification shall be received by the AHB at least three working days prior to the start of construction activities. The notification shall include the permittee's name,project location,starting date for work,and the control number for this Hydraulic Project Approval. 3. Work shall be accomplished per plans and specifications entitled," SR 167 8411 Ave. S. to S Grady Way Culvert Construction",dated May 2, 1998,and submitted to the Washington Department of Fish and Wildlife, except as modified by this Hydraulic Project Approval. These plans reflect design criteria per Chapter 220-110 WAC. These plans reflect mitigation procedures to significantly reduce or eliminate impacts to fish resources. A copy of these plans shall be available on site during construction. 4. The culvert shall be installed and maintained to ensure unimpeded fish passage. 5. The culvert shall be placed on a flat gradient with the bottom of the culvert placed below the level of the streambed a minimum of 20 percent of the culvert diameter for a round culvert,and 20 percent of the culvert's rise for an elliptical culvert. The 20 percent placement below the streambed shall be measured at the culvert outlet. 6. The culvert shall be installed to maintain structural integrity to the 100-year peak flow with consideration of the debris likely to be encountered. 7. Fill associated with the culvert installation shall be protected from erosion to the 100-year peak flow. The culvert shall be installed and maintained to avoid inlet scouring and to prevent erosion of stream banks downstream of the project. 9. The culvert facility shall be maintained by the owner per RCW 75.20.060 to ensure continued,unimpeded fish passage. If the structure becomes a hindrance to fish passage,the owners shall be responsible for obtaining an Hydraulic Project Approval and providing prompt repair. Financial responsibility for maintenance and repairs shall be that of the owner. 10. The culvert shall be installed in the dry by constructing a sandbag dam or steel sheeting to isolate the work area from the wetlands at the upstream end of the fish ladder and downstream end of the culverts under East Valley Highway. Upon completion of all the work including the channel restoration at the outlet of the culvert the cofferdams may be removed. 11. Disturbance of the streambed and banks shall be limited to that necessary to place the culvert and any required channel modification associated with it. Affected streambed and bank areas outside the culvert and associated fill shall be restored to preproject configuration following installation of the culvert. Within one year of project completion, the banks shall be revegetated with native or other approved woody species. Vegetative cuttings shall be planted at a maximum interval of three feet(on center)and maintained as necessary for three years to ensure 80 percent survival. 12. Equipment used for this project shall operate stationed on bank. However equipment may operate on construction mats within the wetland to gain position to restore the inlet wetlands. 13. Alteration or disturbance of the bank and bank vegetation shall be limited to that necessary to construct the project. Within seven calender days of project completion,all disturbed areas shall be protected from erosion using vegetation or other means. Within one year of project completion,the banks,including riprap areas,shall be revegetated with native or other approved woody species. Vegetative cuttings shall be planted at a maximum interval of three feet(on center)and maintained as necessary for three years to ensure 80 percent survival. 14. If at any time,as a result of project activities,fish are observed in distress,a fish kill occurs, or water quality problems develop(including equipment leaks or spills),operations shall cease and the Washington Department of Fish and Wildlife at(360)902-2601 and Washington Department of Ecology at(425)649-7000 shall be contacted immediately. Work shall not resume until further approval is given by the Washington Department of Fish and Wildlife. 15. Erosion control methods shall be used to prevent silt-laden water from entering the stream. These may include,but are not limited to, straw bales,filter fabric,temporary sediment ponds,check dams of pea gravel-filled burlap bags or other material,and/or immediate mulching of exposed areas. 16. Wastewater from project activities and water removed from within the work area shall be routed to an area landward of the ordinary high water line to allow removal of fine sediment and other contaminants prior to being discharged to the stream. 17. All waste material such as construction debris,silt, excess dirt or overburden resulting from this project shall be deposited above the limits of flood water in an approved upland disposal site. Extreme care shall be taken to ensure that no petroleum products,hydraulic fluid, fresh cement, sediments, sediment- laden water,chemicals,or any other toxic or deleterious materials are allowed to enter or leach into the stream. 19. Fresh concrete or concrete by-products shall not be allowed to enter the stream at any time during this project. All fors used for concrete shall be completely sealed to prevent the possibility of fresh concrete from getting into the stream. 20. All treated wood shall be professionally treated and completely cured prior to installation below the ordinary high water line to minimizes leaching into the water or substrate. The use of wood treated with creosote or pentachlorophenol is not authorized. 21. The fish habitat log structures shall be of fir,cedar,or other approved coniferous species. 22. It is recommended that an aggrieved party contact the Area Habitat Biologist and discuss the concerns. Most problems are resolved at this level,but if not,you may elevate your concems to his/her supervisor. The work is in the Panther Creek watershed in Renton, Washington, and was the subject of your recent application for a Department of the Army permit. we assigned file number 98-4-00001 to the application, which you should use in any further correspondence with us about the work. The regulations which govern our permit program contain a series of NWPs. Each NWP authorizes a specific category of work, provided certain conditions are met. NWP 27 (Federal Register, December 13, 1996, Vol . 61, No. 241) authorizes various categories of "Wetland and Riparian Restoration and Creation Activities. " Enclosed is the entire text of NWP 27 (Enclosure 1) . The regional conditions and certification requirements at the end of Enclosure I must be met. Enclosure 2 is a set of special conditions that apply to all NWPs . This verification that NWP 27 authorizes the Panther Creek riparian restoration activities will be valid for 2 years from the date of this letter, unless NWP 27 is modified or revoked at an earlier date . If the project meets the enclosed conditions, you will need no further authorization from us for the work. You must still comply with other state and local requirements which may pertain to the project . when the project has been completed, please fill out and return the enclosed compliance statement (enclosure 3) . WETLAND AND RIPARIAN RESTORATION AND CREATION ACTIVITIES. Activities in waters of the United States associated with the restoration of former non-tidal wetlands and riparian areas, the enhancement of degraded wetlands and riparian areas, and creation of wetlands and riparian areas; (i) On non-Federal public lands and private lands, in accordance with the terms and conditions of a binding wetland restoration or creation agreement between the landowner and the U.S. Fish and Wildlife Service or the NRCS or voluntary wetland restoration, enhancement, and creation actions documented by the NRCS pursuant to the NRCS regulations; or (ii) On any Federal land; or (iii) On reclaimed surface coal mined lands, in accordance with a Surface Mining Control and Reclamation Act permit issued by the Office of Surface Mining or the applicable state agency. (The future reversion does not apply to wetlands created, restored or enhanced as mitigation for the mining impacts, nor naturally due to hydrologic or topographic features, nor for a mitigation bank.); or (iv) On any public or private land, provided the permittee notifies the District Engineer in accordance with the "Notification" general condition. Such activities include, but are not limited to: installation and maintenance of small water control structures, dikes, and berms; backfilling of existing drainage ditches; removal of existing drainage structures; construction of small nesting islands; plowing or discing for seed bed preparation; and other related activities. This NWP applies to restoration projects that serve the purpose of restoring "natural' wetland hydrology, vegetation, and function to altered and degraded non-tidal wetlands and "natural' functions of riparian areas. This NWP does not authorize the conversion of natural wetlands to another aquatic use, such as creation of waterfowl impoundments where a forested wetland previously existed. Reversion. For restoration, enhancement and creation projects conducted under paragraphs (ii) and (iv), this NWP does not authorize any future discharge of dredged or fill material associated with the reversion of the area to its prior condition. In such cases a separate permit at that time would be required for any reversion. For restoration, enhancement and creation projects conducted under paragraphs (i) and (iii), this NWP also authorizes any future discharge of dredged or fill material associated with the reversion of the area to its documented prior condition and use (i.e., prior to the restoration, enhancement, or creation activities) within five years after expiration of a limited term wetland restoration or creation agreement or permit, even if the discharge occurs after this NWP expires. The five year reversion limit does not apply to agreements without time limits reached under paragraph (i). Enclosure 1 The'prior condition will be documented in the original agreement or permit, and the determination of return to prior conditions will be made by the Federal agency or appropriate State agency executing the agreement or permit. Prior to any reversion activity the permittee or the appropriate Federal or State agency must notify the District Engineer and include the documentation of the prior condition. Once an area has reverted back to its prior physical condition, it will be subject to whatever the Corps regulatory requirements will be at that future date. (Sections 10 and 404) Notification Requirement -- Yes. See National General Condition #13 - Notification, for requirements. Regional Conditions -- 1. Wetland restoration is not authorized in areas falling under the designation of a Federal Superfund site (Comprehensive Environmental Response, Compensation and Liability Act), hazardous waste clean-up site (Resource Conservation and Recovery Act), or State clean-up site (Model Toxics Control Act). 2. Restoration proposed in documented habitat for State-listed endangered, threatened, or sensitive animal species must be beneficial to those listed species present. Puyallup Tribe 401 Certification -- Denied without prejudice. An individual 401 Certification is required for all Section 404 activities. EPA and State 401 Certification -- Partially denied without prejudice. An individual 401 Certification is required for the following: 1. Discharges of dredged Cr fill ,material associated with the reversion of a restored wetland to its prior condition and use, or, 2. Impacts to waters of the U.S. adversely affecting more than 113 (one-third) acre. CZM Consistency Response -- Partially denied without prejudice subject to the 401 Certification conditions. An individual CZM Consistency Response must be obtained for projects requiring individual 401 Certification and located within counties in the coastal zone. -2- NATIONAL GENERAL CONDITIONS FOR ALL NATIONWIDE PERMITS The following general conditions must be followed in order for any authorization by a NWP to be valid. These apply to all NWPs. 1. Navigation. No activity may cause more than a minimal adverse effect on navigation. 2. Proper Maintenance. Any structure or fill authorized shall be properly maintained, including maintenance to ensure public safety. 3. Erosion and Siltation Controls. Appropriate erosion and siltation controls must be used and maintained in effective operating condition during construction, and all exposed soil and other Fills, as well as any work below the ordinary high water mark or high tide line, must be permanently stabilized at the earliest practicable date. 4. Aquatic Life Movements. No activity may substantially disrupt the movement of those species of aquatic life indigenous to the waterbody, including those species which normally migrate through the area, unless the activity's primary purpose is to impound water. 5. Equipment. Heavy equipment working in wetlands must be placed on mats, or other measures must be taken to minimize soil disturbance. 6. Regional and Case-By-Case Conditions. The activity must comply with any regional conditions which may have been added by the Division Engineer (see 33 CFR 330.4(e)) and with any case specific conditions added by the Corps or by the State or tribe in its 401 Certification. 7. Wild and Scenic Rivers. No activity may occur in a component of the National Wild and Scenic River System; or in a river officially designated by Congress as a "study river" for possible inclusion in the system, while the river is in an official study status; unless the appropriate Federal agency, with direct management responsibility for such river, has determined in writing that the proposed activity will not adversely effect the Wild and Scenic River designation, or study status. Information on Wild and Scenic Rivers may be obtained from the appropriate Federal land management agency in the area (e.g., National Park Service, U.S. Forest Service, Bureau of Land Management, U.S. Fish and Wildlife Service.) 8. Tribal Rights. No activity or its operation may impair reserved tribal rights, including, but not limited to, reserved water rights and treaty fishing and hunting rights. 9. Water Quality Certification. In certain states, an individual 401 Certification must be obtained or waived (see 33 CFR 330.4(c)). Enclosure 2 10. Coastal Zone Management. In certain states, an individual CZM Consistency Concurrence must be obtained or waived (see Section 330.4(d)). 11. Endangered Species. a. No activity is authorized under any NWP which is likely to jeopardize the continued existence of a threatened or endangered species or a species proposed for such designation, as identified under the Federal Endangered Species Act, or which is likely to destroy or adversely modify the critical habitat of such species. Non-Federal permittees shall notify the District Engineer if any listed species or critical habitat might be affected or is in the vicinity of the project, and shall not begin work on the activity until notified by the District Engineer that the requirements of the Endangered Species Act have been satisfied and that the activity is authorized. b. Authorization of an activity by a nationwide permit does not authorize the take of a threatened or endangered species as defined under the Federal Endangered Species Act. In the absence of separate authorization (e.g., a Federal Endangered Species Act Section 10 Permit, a Biological Opinion with incidental take provisions, etc.) from the U.S. Fish and Wildlife Service or the National Marine Fisheries Service, both lethal and non-lethal takes of protected species are in violation of the Endangered Species Act. Information on the location of threatened and endangered species and their critical habitat can be obtained directly from the offices of the U.S. Fish and Wildlife Service and National Marine Fisheries Service or their world wide web pages at http://www.fws.gov/—r9endspp/endspp.html and http://kingfrsh.ssp.mnfs.gov/tmcintyr/prot_res.html #ES and Recovery, respectively. NOTE: See Regional General Condition 6 and 7 for details on regional conditions for threatened and endangered species. 12. Historic Properties. No activity which may affect historic properties listed, or eligible for listing, in the National Register of Historic Places is authorized, until the District Engineer has complied with the provisions of 33 CFR Part 325, Appendix C. The prospective permittee must notify the District Engineer if the authorized activity may affect any historic properties listed, determined to be eligible, or which the prospective permittee has reason to believe may be eligible for listing on the National Register of Historic Places, and shall not begin the activity until notified by the District Engineer that the requirements of the National Historic Preservation Act have been satisfied and that the activity is authorized. Information on the location and existence of historic resources can be obtained from the State Historic Preservation Office and the National Register of Historic Places (see 33 CFR 330.4(g)). 13. Notification. Already fulfilled in this case. 14. Compliance Certification. Every permittee who has received a Nationwide permit verification from the Corps will submit a signed certification regarding the completed work and any required mitigation. The certification will be forwarded by the Corps with the authorization letter and will include: a. A statement that the authorized work was done in accordance with the Corps authorization, including any general or specific conditions; b. A statement that any required mitigation was completed in accordance with the permit conditions; c. The signature of the permittee certifying the completion of the work and mitigation. 15. Multiple Use of Nationwide Permits. In any case where any NWP number 12 through 40 is combined with any other NWP number 12 through 40, as part of a single and complete project, the permittee must notify the District Engineer in accordance with paragraphs a, b, and c on the Notification General Condition number 13. Any NWP number 1 through 11 may be combined with any other NWP without notification to the Corps, unless notification is otherwise required by the terms of the NWPs. As provided at 33 CFR 330.6(c) two or more different NWPs can be combined to authorize a single and complete project. However, the same NWP cannot be used more than once for a single and complete project. NATIONAL GENERAL CONDITIONS FOR ALL SECTION 404 NATIONWIDE PERMITS In addition to the General Conditions, the following conditions apply only to activities that involve the discharge of dredged or fill material into waters of the U.S., and must be followed in order for authorization by the NWPs to be valid: 1. Water supply intakes. No discharge of dredged or fill material may occur in the proximity of a public water supply intake except where the discharge is for repair of the public water supply intake structures or adjacent bank stabilization. 2. Shellfish production. No discharge of dredged or fill material may occur in areas of concentrated shellfish production, unless the discharge is directly related to a shellfish harvesting activity authorized by NWP 4. 3. Suitable material. No discharge of dredged or fill material may consist of unsuitable material (e.g., trash, debris, car bodies, asphalt, etc.,) and material discharged must be free from toxic pollutants in toxic amounts (see Section 307 of the Clean Water Act). 4. Mitigation. Discharges of dredged or fill material into waters of the United States must be minimized or avoided to the maximum extent practicable at the project site (i.e., on-site), unless the District Engineer approves a compensation plan that the District Engineer determines is more beneficial to the environment than on-site minimization or avoidance measures. 5. Spawning areas. Discharges in spawning areas during spawning seasons must be avoided to the maximum extent practicable. 6. Obstruction of high flows. To the maximum extent practicable, discharges must not permanently restrict or impede the passage of normal or expected high flows or cause the relocation of the water (unless the primary purpose of the fill is to impound waters). 7. Adverse effects from impoundments. If the discharge creates an impoundment of water, adverse effects on the aquatic system caused by the accelerated passage of water and/or the restriction of its flow shall be minimized to the maximum extent practicable. 8. Waterfowl breeding areas. Discharges into breeding areas for migratory waterfowl must be avoided to the maximum extent practicable. 9. Removal of temporary fills. Affected streambed and bank areas outside the culvert and associated fill shall be restored to preproject configuration following installation of the culvert. Vegetative cuttings shall be planted at a maximum interval of three feet(on center)and maintained as necessary for three years to ensure 80 percent survival. 12. Alteration or disturbance of the bank and bank vegetation shall be limited to that necessary to construct the project. Within seven calender days of project completion, all disturbed areas shall be protected from erosion using vegetation or other means. WSDOT SR-176 (84th Ave S to S Grady Way) Culvert Construction Plans (DI-Drainage Plan, DPI-Culvert Profile, DP2-Ditch Profile, DP3-Fish Ladder Profile, L1-Planting/Habitat Enhancement Plan, L2-Planting Plan and Details) 2. Draft Fish Ladder Plan, Profile and details that were reviewed and approved by Bob Barnard at the WDFW Olympia office. Please issue the Hydraulic Project Approval (HPA) permit for the installation of a 72-inch culvert and associated channel improvements and the construction of a fish ladder in the area of SW 23rd St and SR-167 in Renton. WSDOT will be constructing the project. WSDOT has indicated that if the culvert portion of the project is not advertised by June I st, the funding for the new culvert under SR- 167 will be lost. WSDOT will not advertise the project for construction bids unless the permits for the project are obtained. 'If the WSDOT funding is lost this year, the project funding would have to be reprogrammed for a future year, or the WSDOT could decide to terminate the project. The City of Renton will be funding the construction of the fish ladder upstream of the proposed new WSDOT culvert under SR-167 and the channel improvements downstream of the culvert. WSDOT will advertise the project for one month. The channel work and upstream fish ladder will be included in the WSDOT bid advertisement or added to the bid as an addendum prior to the end of the one month advertisement period. As 1 mentioned in our telephone conversation, the City has hired a consultant (R. W. Beck, Inc.) to prepare the construction plans and specifications for the fish ladder. The construction plans for the fish ladder will be based upon the draft plans and details that were reviewed and approved by Bob Barnard in the WDFW Olympia office. The consultant is adding additional information that is needed for the construction of the fish ladder. The final construction plans for the fish ladder will be re-submitted for your review once they are completed later this month. In order to provide the HPA permit to WSDOT in time for them to meet the June I st advertisement deadline, the HPA permit is needed early in the week of May 25th, if possible. However, as I related to you on the telephone, please include in the permit authorization the following work related to Panther Creek that was proposed in the original JARPA application: • install a restrictor on the 30" culvert at SR-167 Sta 1076+00 (the cross culvert just north of Nendels) • construct the "overflow channel' from the 30" culvert inlet to the standing water portion of the Panther Creek Wetland. Thus the only change from our original JARPA application is the elimination of our proposal to close the SR-167 culvert at Sta 1071+00 (24" culvert at the south end of the Keg Restaurant). We need to defer plans to close this culvert because WSDOT is concerned that closing the 24" culvert would make permitting of their pending ramp widening project more difficult. This biology/wetland report identifies the wetlands in the project area and the impacts of the proposed construction. A wetland delineation was performed in April, 1997 by a WSDOT biologist. SETTING The proposed new culvert crossing is located on SR 167 at Mile Post (MP) 25.65 (SW 23rd Street) in Renton, Washington (Figure 1). In addition to the existing four lane freeway, East Valley Road runs parallel to SR 167 on the west. Surrounding land use is primarily commercial, with wetlands remaining east of SR 167. Panther Creek Wetland is located east of SR 167 at MP 25.65 and a linear wetland, designated Wetland P4, is located directly across from Panther Creek Wetland on the west side of SR 167.1 A larger portion of the existing Panther Creek wetland drains to Wetland P4 and Wetland P4 ultimately discharges to Springbrook Creek via a channel along SW 23rd Street.. The predominant soil type in the project area is Coveland gravely loam, 0-3% slopes. This is a non-hydric soil found in swales on hills (SCS 1989, 1991). It is somewhat poorly drained and may have a perched water table from 0-45.7 centimeters (0-18 inches) below the surface from November through April (SCS 1989). The Panther Creek wetland,Wetland P4, and other wetlands were previously delineated in a May 1994 report by WSDOT titled Wetland Biology Report for Stage 1, SR 167, 15th Street SW to South Grady Way, OL-1511. Panther Creek Wetland meets the City of Renton criteria for a Category 1 wetland requiring a 100 foot buffer. Vegetation includes black cottonwood (Populus trichocarpa) and red alder (Alnus rubra), a scrub-shrub component of hardhack (Douglas spiraea), and an herbaceous component of reed canary grass (Phalaris arundinacea), field horsetail (Equisetum arvense), cattail (Typha latifolia), and yellow iris (Iris pseudacorus). Himalyan blackberry (Rubus discolor) has established along the upland slopes. The wetland west of SR 167 (Wetland P4) is situated within a seasonally inundated drainage channel between SR 167 on the east and existing developed land on the west. Several culverts connect Wetland P4 to Panther Creek Wetland. Prominent vegetation consists of soft rush (Juncus effusus), cattail, reed canary grass, yellow iris, red osier (Corpus stolonifera), hardback, Pacific willow (Salix lasiandra), Sitka willow (Salix Sitchensis), and black cottonwood. Wetlands are discussed separately in the following section of this report. Appendix B provides definitions for wetland plant indicator status categories. Appendix C provides an alphabetical list of site plants mentioned in this report. Appendix D contains the data sheets and Appendix E is the wetland and buffer functional assessment. WETLANDS Wetland Description Wetlands are transitional areas between upland and non-vegetated aquatic environments. They are defined as those areas that are inundated or saturated by surface or ground water at a frequency and duration sufficient to support, and that under normal circumstances do support,a prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands generally include swamps, marshes, bogs, and similar areas (Environmental Laboratory, 1987). Existing Conditions Observations of existing conditions and interpretations were made within the context of the 1987 Corps of Engineers Wetlands Delineation Manual (Environmental Laboratory, 1987) and rated using the City of Renton wetland rating system. 84th Ave S. to S. Grady Way 12129197 4 Panther Creek Wetland Panther Creek Wetland is a City of Renton Category 1 wetland located on the east side of SR 167 at MP 25.65. Panther Creek Wetland is approximately 59 acres in size. Panther Creek and other small drainages provide hydrology. It is a Palustrine forested, emergent and scrub-shrub wetland with an open water component. The dominant vegetation in the wetland is reed canary grass, willows, and cattails. During storm events, Panther Creek discharges a portion of its flow into the south end of the wetland. Soils are 10 YR 2/1 with mottles. The western wetland boundary at the proposed culvert project site is flagged with pink tape Al to AT Wetland P4 Wetland P4 is a City of Renton Category 3 Palustrine wetland and requires a 25 foot buffer. At its northern end it is located adjacent to the edge of shoulder west of SR 167 at MP 25.65 and bordered on the west by the East Valley Road. Wetland P4 is approximately 3.7 acres. Wetland P4 receives some seasonal hydrology from drainage from Panther Creek Wetland. Soils in Wetland P4 are 10 YR 3/1 with mottles. At the proposed culvert project the site is flagged in its entirety with pink tape B 1 to B 14. Functions The functions of these wetlands may include groundwater discharge and sediment/toxicant retention. Sediment/toxicant retention is the process by which suspended solids and chemical contaminants are retained and deposited within a wetland. Additional functions include flood storage, water purification, food chain support, wildlife habitat, and education/recreation opportunities. Impacts A total of approximately 4600 square feet (0.11 acre) of wetlands will be impacted as a result of the construction of the box culvert and culvert plugs. Potential impacts can be minimized by use of the following measures: 1. Restricting clearing and grubbing activities to the maximum extent possible. 2. Use of effective erosion control techniques during construction. 3. Replacing wetland acreage and functions lost due to project construction. 84th Ave S. to S. Grady Way 12129197 5 Mitigation All potential adverse impacts must be addressed, and mitigation measures should include, but not be limited to, the following: • Storm Water Discharge: Applicable Best Management Practices from the Stormwater Management Manual for the Puget Sound Basin will be applied to erosion control and water treatment provisions. • Receiving Waters: Extreme caution should be exercised to avoid construction related siltation and turbidity to downstream resources, including Panther Creek. • Wetlands: The wetland is protected under Presidential Executive Order 11990, "Protection of Wetlands," Governor's Executive Orders EO 89-10 and EO 90-04, "Protection of Wetlands", and WSDOT Directives 22-27 and 31-12 (HR). These orders and directives require the use of all practicable measures to avoid impact and provide mitigation for any unavoidable impacts. The executive orders stipulate that all state agencies shall use the following definition of mitigation, and in the following order of preference: 1) Avoiding the impact altogether by not taking a certain action or part of an action; 2) Minimizing impacts by limiting the degree or magnitude of the action and its implementation by using appropriate technology or by taking affirmative steps to avoid or reduce impacts. 3) Rectifying the impacts by repairing, rehabilitation or restoring the affected environment; 4) Reducing or eliminating the impact over time by preservation and maintenance operations during the life of the action; 5) Compensating for the impact by replacing, enhancing, or providing substitute resources or environments; 6) Monitoring the impact and taking appropriate corrective measures. Mitigation for individual actions may include a combination of the above measures. 84th Ave S. to S. Grady Way 12129197 6 WILDLIFE Existing Conditions No wildlife were observed on site during the field investigation. The open water and associated scrub-shrub thickets of Panther Creek Wetland provides habitat for waterfowl, small mammals, reptiles, and amphibians. Impacts No species individual or population is expected to be adversely impacted due to this project. FISH Existing Conditions With the exception of three-spine sticklebacks, no fish are known to exist in the wetlands addressed in this report. Construction of the box culvert will facilitate future fish passage from Springbrook Creek to Panther Creek if future projects are constructed by the City of Renton to complete the connection. Under this application the City of Renton proposes to implement the following elements defined in the ESGRWP Final Plan and EIS (Sept. 1997): • SW 23rd Street Drainage Channel Alternative 23ST3 -Element 1: Replace SR-167 Culvert Crossings with New Crossing at SW 23rd Street • Panther Creek Alternative PC2 - Element 1: Modify Existing Flow Split at SR-167 These alternatives are described in detail in Sections 8.3.2 and 8.3.3 of the Final Plan and illustrated in the drawings attached to this application. In summary the activities proposed include: • Element 23ST3-1. Close several poorly functioning culverts across SR-167 and replace them with a new SR-167 culvert crossing at SW 23rd Street. A control structure will be installed on the inlet to the culvert to maintain the hydrology of the Panther Creek Wetland. Approximately 110 feet of an existing wetland/swale downstream of the new SR-167 culvert would be deepened to connect the new culvert to existing culverts under East Valley Road. • Element PC2-1. Close one of two SR-167 culverts that Panther Creek currently flows through and install a structure on the other culvert near SW 39th Street that allows low flows to pass into the existing system. Excess flows would be diverted into the Panther Creek Wetland, increasing the frequency of overflow into the wetland that already occurs under existing conditions (Element PC2-1). As a result of the EIS review process, additional measures were added to these elements at the request of the Washington State Department of Fish and Wildlife. The measures are described in Section 2.3.5 of the Final EIS and include: • Create an overflow"channel'from the Panther Creek SR-167 cross culvert to the nearest standing water in the Panther Creek Wetland by mowing/cutting a path through the existing reed canarygrass and planting willows and cottonwoods (where 12/30/97 JARPA Page 3 conditions are suitable) on each side of the mowed path to provide cover and habitat diversity. • Design the proposed SR-167 culvert at SW 23rd Street so as to not preclude fish passage into the Panther Creek Wetland in the future. Implementation of these elements is designed to continue to allow downstream migration of fish in the Panther Creek system while improving the potential for restoring upstream fish passage to Panther Creek in the future (SR-167 is the first of several upstream fish migration barriers on Panther Creek). The project reduces downstream flooding problems and the related impacts while providing a reliable outlet from the Panther Creek Wetland that may be easily accessed and maintained. The project is also designed to maintain and even improve the function of the affected wetland systems. Impacts and Mitigation Measures: The impacts of the proposed activities and related mitigation measures are analyzed in detail in the ESGRWP Draft EIS (December 1996) and Final EIS (September 1997) under Alternatives PC2 - Element 1 and 23ST3 Element 1. The attached EIS Mitigation Document(September 1997) presents the preferred alternative and mitigation measures adopted by the City of Renton for the ESGRWP at the conclusion of the EIS process. Refer to Alternatives PC2 - Element 1 and 23ST3 Element 1 in Tables 1 through 10 of the Mitigation Document for a summary of the impacts and mitigation measures identified for the activities proposed under in this application. 9. Tidal waters-volume: None. 12. Will material be placed in wetlands? Yes. About 840 sq. ft. of Wetland W-4 will be temporarily disturbed for the culvert plug work at the SR-167 stations listed in Section 12b below and then restored. For the new culvert at SW 23rd Street, approximately 300 sq. ft. of Wetland W-4 and 100 sq. ft. of Wetland W-48e will be filled by the culvert and riprap placement. Another 860 sq. ft. will be temporarily disturbed by the construction activity and then restored. a. Has delineation been completed? Yes. See attached report by WSDOT dated May 1994. The wetland boundaries defined in the report are still valid. A supplemental report dated December 1997 (also attached) was prepared by WSDOT concerning the wetland delineation at the location of the proposed culvert at SW 23rd Street. See Sheet 3 for a map of wetlands in the project vicinity, including the City of Renton wetland inventory number and WSDOT designation where applicable. b. Proposed Activities Under this application the City of Renton proposes to implement the following elements defined in the East Side Green River Watershed Project(ESGRWP)Final Plan and EIS(City of Renton, Sept. 1997). In summary the activities proposed include: • Alternative Element 23ST3-1. Close several poorly functioning culverts across SR-167 and replace them with a new SR-167 culvert crossing at SW 23rd Street. A control structure will be installed on the inlet to the culvert to maintain the hydrology of the Panther Creek Wetland. Approximately 110 feet of an existing wetland/swale downstream of the new SR-167 culvert would be deepened to connect the new culvert to existing culverts under East Valley Road. • Altemative Element PC2-1. Close one of two SR-167 culverts that Panther Creek currently flows through and install a structure on the other culvert near SW 39th Street that allows low flows to pass into the existing system. Excess flows would be diverted into the Panther Creek Wetland, increasing the frequency of overflow into the wetland that already occurs under existing conditions(Element PC2-1). • Create an overflow`channel' from the Panther Creek SR-167 cross culvert to the nearest standing water in the Panther Creek Wetland by mowing/cutting a path through the existing reed canarygrass and planting willows and cottonwoods(where conditions are suitable)on each side of the mowed path to provide cover and habitat diversity. • Design the proposed SR-167 culvert at SW 23rd Street so as to not preclude fish passage into the Panther Creek Wetland in the future. Implementation of these elements is designed to continue to allow downstream migration of fish in the Panther Creek system while improving the potential for restoring upstream fish passage to Panther Creek in the future(SR- 167 is the first of several upstream fish migration barriers on Panther Creek). The project reduces downstream flooding problems and the related impacts while providing a reliable outlet from the Panther Creek Wetland that may be easily accessed and maintained. The project is also designed to maintain and even improve the overall function of the affected wetland system. B. Impacts of the Proposed Activities and Mitigation Measures The ESGRWP EIS Mitigation Document(September 1997)presents the preferred alternative and mitigation measures adopted by the City of Renton for the ESGRWP at the conclusion of the EIS process. A detailed summary of the impacts and mitigation measures identified for the activities proposed under in this application are included in Tables 1 through 10 of the EIS Mitigation Document under Alternatives PC2-Element 1 and 23ST3 Element 1. A copy of the Mitigation Document may be obtained by contacting Scott Woodbury of the City of Renton at 425-277- 5547. About 4200 sq. ft. of palustrine wetlands will be temporarily disturbed by construction activities and then restored. Approximately 300 sq. ft. of Renton inventory Wetland W-4 and 100 sq. ft. of Wetland W-48e will be filled by the culvert installation and riprap placement under the proposed SW 23rd Street culvert crossing of SR-167. C. Wetland Mitigation Plan Wetland W-4 is a Category 1 wetland and W-48e is a Category 3 wetland under the City of Renton Wetlands Management Ordinance. A total of approximately 1250 sq. ft. of wetlands will be created adjacent to the outlet of the proposed culvert at SW 23rd Street to mitigate for the wetland impacts in accordance with the City of Renton regulations(see Sheets 10 and 13).
