Last Friday you telephoned me in response to that letter and requested another copy of the conceptual drawing for your record. That drawing in enclosed for your use . You also requested that Puget consider granting the City of Renton an easement for the large drainage channel on the east side of the property, by the entrance driveway. As I mentioned in our telephone conversation, this easement was prepared in conjunction with a previous project at the site . Enclosed for acceptance by the City of Renton is the said Drainage Easement, signed by Puget on October 10 , 1983 . Please send a copy of the recorded easement to my attention. Box 97034 Bellevue,WA 98009-9734 (206)454-6363 7/env/COY Ail DRAINAGE EASEMENT This indenture made this day of 1983 between PUGET SOUND POWER & LIGHT COMPANY, a Washington corporation ("Grantor" herein) , and CITY OF RENTON, a Municipal corporation ("Grantee" herein) ; WITNESSETH: That in consideration of Ten Dollars ($10 . 00) and other good and valuable consideration, in hand paid, receipt of which is hereby acknowledged, and performance by Grantee of the covenants hereinafter set forth, Grantor hereby grants unto Grantee an easement for the purpose . of maintaining an existing open storm drainage channel and five culverts of varying lengths ("Facility" herein) across and under the following property, situated in King County, Washington; See attached Exhibit "A" This easement is granted on the following terms and conditions: 1. Grantee agrees to save and hold Grantor harmless from all loss or damage which may be due to the exercise by Grantee of the right herein granted and from all claims for such damage by whomsoever made and tp indemnify Grantor for all such loss , damage and claims. � ; 2 . Grantor reserves the right to use said land for its own purposes in any way, and to grant rights in said land to others, not inconsistent with the right herein granted to Grantee. 3 . The right hereby granted shall cease and determine whenever Grantee shall have permanently abandoned the use of said Facility. 4 . Grantee, its successors or assigns, shall have the right, upon prior notice, at such times as may be necessary to enter upon said above described property for the purpose of maintaining said Facility, provided, that such maintaining of said Facility shall be accomplished in such a manner that disturbance to the existing private improvements, including all vegetation, shall be minimized. In the event said improvements are disturbed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. 5 . Prior to any maintenance work involving relocation and/or removal of any vegetation from the easement area, Grantee shall give Grantor notice thereof at least 48 hours prior to the scheduled commencement of such maintenance work. 6 . Grantor reserves the right to relocate or modify said Facility. 7. Commercial Storm Drainage Permit ($100.00) 2. Drainage fee of 2% of the Construction Cost 3. A drainage easement over the north triangular portion of property which is a major drainage course. In addition, Puget Power should contact the Washington State Department of Ecology regarding their requirements for a NESPD permit. The improvements would likely include : Grading . Drainage pipes. Catch basins. Valves. Pumps and controls. - Asphalt and concrete .__ - Steel storage tank . Enclosed for your review is a copy of the conceptual site plan for this project, entitled "Shuffleton Drainage Plan, January, 1988 . " Proposed improvements are highlighted in yellow, while property lines are highlighted in blue . At this time , we are not requesting a review of the specific design of the system.
