This notification does not constitute acceptance of the work by the Secretary of Transportation_ Final acceptance will be determined in accordance with Section 1-05.12 of the 1980 Standard Specifications_ The allotted contract time was 45 working days_ The 27 day time extension that was granted revised the contract time to 72 days_ The contract time was overrun by 41 .5 days_ Seventeen and a half days of the overrun occurred before the January 16, 1989 date of substantial completion_ The 17.5 days are subject to liquidated damages at the rate of $500.00 per day in accordance with Section 1-00.9 of the 1980 Standard Specifications_ The 17.5 days at $500.00 per day amounts to $8,750.00. Clark, As you are well aware Tunnel Systems has had considerably difficulties in locating the 48" O. D. X . 500 wall steel casing for the above refer- enced project . We have contacted three local suppliers , N . American Pipe, Best & Co . , and National Pipe & Piling in our search for this ma- terial and have not been successful . I have included a letter from National Pipe & Piling that will substan- tiate that the casing was quoted and located prior to our bid on this project . As the letter from National Pipe & Piling will also show a six week period lapsed after the bid until it was awarded. . In that time the material that was quoted to us by National Pipe and Piling had been sold , and the vendor had no additional 48" X . 500 wall available . With suggestions from Department of Transportation that a Oregon firm , Northwest Pipe & Casing be contacted , that they would have this mate- rial . We did so, and found that the plate would not be available for 60-90 days . We were then informed by DOT that the material was avail- able in St . Louis , Missouri , from Pittsburgh Pipe. We started corre- spondence with this firm and it became apparent that they did not have this material on the ground , that the casing they were quoting had no Mill Test reports available, nor Material of Origin Certificates ,. Tunnel Systems has spent considerable time and effort in search for this material with the aid of Department of Transportation and KAC Con- struction . Your efforts in this matter have been very much appreci- ated , but no where in our search has this material been located on the ground . There has also been a considerable price increase on this ma- terial , since this project was quoted . On 7-5-88 National Pipe & Piling, Inc. offered for sale the following item: Approx. 200 LF, New Domestic 48"OD x .500"W ( 253.65#/LF) DSAW carbon steel pipe, spec. ASTM A-134, Grade B to consist of double random lengths, bevelled ends. You will recall that this quotation carried with it two provisions. One, that this pipe was in stock, subject to prior sale and two, that this quotation would be good for 30 days after which we would need to confirm price and availability. Approximately 6 weeks later we were contacted by you with the request that we confirm our quotation. As you are aware, we were informed that the above described material had been sold and that that particular vendor had no additional 48" x .500W pipe available.
