Re: Firial Irlispection
A final inspection of contract 3458 was made on April 11 ,
1909 in accordance with Section 1-05.11 of the 1988 Standard
Specifications for Road and Bridge Construction_ The
contract work was found to he complete and in compliance with
the contract requirements_ Work was last performed on the
jobsite on February 23, 1989 which shall constitute the date
of completion for this contract.
This notification does not constitute acceptance of the work
by the Secretary of Transportation_ Final acceptance will be
determined in accordance with Section 1-05.12 of the 1980
Standard Specifications_
The allotted contract time was 45 working days_ The 27 day
time extension that was granted revised the contract time to
72 days_
The contract time was overrun by 41 .5 days_ Seventeen and a
half days of the overrun occurred before the January 16, 1989
date of substantial completion_ The 17.5 days are subject to
liquidated damages at the rate of $500.00 per day in
accordance with Section 1-00.9 of the 1980 Standard
Specifications_ The 17.5 days at $500.00 per day amounts to
$8,750.00.
The remaining 24 days are subject to liquidated damages
determined by direct engineering charges_ The direct
engineering charges total $1,221_24; making the total
liquidated damages for this project equal to $9,971 .24_
Liquidated damages in the amount of $10,500.00 were deducted
in the estimate of December 5, 1988_ Therefore, a liquidated
damages amount of $528_6 will be refunded_

Pipe Problems
The Contractor, KAC Construction, is indicating a problem
obtaining American made material for the 48" OD x 0.500 " W steel
pipe (for jacking under I-405) _
The boring subcontractor , Tunnel Systems, at our suggestion
obtained the attached letter dated September 9, 1988 from their
original supplier, National Pipe & Piling, Inc_ The attached
Tunnel Systems letter dated September 12, 1988 was hand delivered
to our office by Mike Clark of KAC Construction on September 12,
1988- National Pipe says they quoted the pipe to Tunnel Systems,
subject to prior sale- Unfortunately, the pipe was sold to others
before Tunnel Systems went to purchase the pipe-
Our research indicates this size pipe is seldom available off the
shelf- It appears Tunnel Systems did have the pipe quoted to them
before the bid opening_ Through circumstances completely outside
the control of the Contractor, the material is no lonq_er
available_
We recommend a time extension be granted for the supply problem_
Do you agree?
We also recommend a cost increase be approved for the difference
in cost between what National Pipe & Piling
g quoted before bid
opening and whatever the new supply source will be- Do you agree?
Alternatively, should we consider Canadian steel with a credit
change order? (This is a Federal Aid project with American made
requirement) _

RE: WSOOT Gypsy Creek Drainage Improvement
Dear Ms . Clark,
As you are well aware Tunnel Systems has had considerably difficulties
in locating the 48" O. D. X . 500 wall steel casing for the above refer-
enced project . We have contacted three local suppliers , N . American
Pipe, Best & Co . , and National Pipe & Piling in our search for this ma-
terial and have not been successful .
I have included a letter from National Pipe & Piling that will substan-
tiate that the casing was quoted and located prior to our bid on this
project . As the letter from National Pipe & Piling will also show a
six week period lapsed after the bid until it was awarded. . In that
time the material that was quoted to us by National Pipe and Piling had
been sold , and the vendor had no additional 48" X . 500 wall available .
With suggestions from Department of Transportation that a Oregon firm ,
Northwest Pipe & Casing be contacted , that they would have this mate-
rial . We did so, and found that the plate would not be available for
60-90 days . We were then informed by DOT that the material was avail-

spondence with this firm and it became apparent that they did not have
this material on the ground , that the casing they were quoting had no
Mill Test reports available, nor Material of Origin Certificates ,.
Tunnel Systems has spent considerable time and effort in search for
this material with the aid of Department of Transportation and KAC Con-
struction . Your efforts in this matter have been very much appreci-
ated , but no where in our search has this material been located on the
ground . There has also been a considerable price increase on this ma-
terial , since this project was quoted .

order . We would also like to suggest a different grade of casing be
specified , possibly a Canadian material which is locally on hand and
readily available

Dear Mr. Sivesind,
Based on recent discussions with you, I think it is important for me
to recap the time frame in which materials for the above referenced
project were quoted.
On 7-5-88 National Pipe & Piling, Inc. offered for sale the
following item:
Approx. 200 LF, New Domestic 48"OD x .500"W ( 253.65#/LF)
DSAW carbon steel pipe, spec. ASTM A-134, Grade B to
consist of double random lengths, bevelled ends.
You will recall that this quotation carried with it two provisions.
One, that this pipe was in stock, subject to prior sale and two,
that this quotation would be good for 30 days after which we would
need to confirm price and availability.
Approximately 6 weeks later we were contacted by you with the
request that we confirm our quotation. As you are aware, we were
informed that the above described material had been sold and that
that particular vendor had no additional 48" x .500W pipe available.
After an extensive search we have determined that this pipe is not
readily available. I regret any inconvenience this may have caused.
National Pipe & Piling would like to be of service to you and we
await your direction as to how we should proceed.

At c,Ur pre-con on July 22, ig88, K. A. C. Construction,
Inc . was informed by Tim Smith that a late start date
wc,uld not be concidered even though I was having
diffu,_ulty on procuring the American - made 48 in.
diameter casing for this project .
Prices for bidding this .j,.-jb can be obtained from the
suppliers prior to bidding, but to have the availability
is something else. As this job was bid c,nce before and
due to some difficulties between D. O. T. and City of
Renton it was not awarded to the low bidder . If the low bidder
had purchased the casinq on k.nowinq he was low bidder and the
awarding of the contract was not done, he would have been left
with a 4B in. casing If cc,nciderable cost .

was goinq to be the cc,ntractc,r on the jc,b. T had m
submittle in cIn the casing by July ''27th 1988,
whicf-i is two days after the pre-cc,n.
Bob Dotson called me 8-'q-88 and gave me a verbal that
the casinq was excepted as of today I have not re,_ieved
a written apprc,val . I informed by suppliers to go
ahead and purchase the casinq and was told it would
be available by e-2-2-88.
Do to length of time taken to have submittle approval

an extension of time.
