Publication dates of this notice are and City of Renton Building and Zoning Department 10-85 CITY OF RENTON, WASHINGTON SHORELINES MANAGEMENT SUBSTANTIAL DEVELOPMENT PERMIT APPLICATION/APPEAL PROCEDURE EARLY CONSULTATION Prior to submitting an application for a Shorelines Exemption from a Substantial Development Permit, the applicant should informally discuss a proposed development with the Building and Zoning Department. The Building and Zoning Department will provide assistance and detailed information on the City's requirements and standards. PROCEDURE: The procedure for approval takes a minimum of 85 days and may take longer if additional information is required of the applicant by city departments to make their recommendations. 1. When the City of Renton Building and Zoning Department receives a complete application for a Shoreline Management Exemption from a Substantial Development Permit, then the applicant shall be required to publish notices of the proposed action in a newspaper of general circulation in the City of Renton (King County). These notices shall be published at least once a week on the same day of the week for two consecutive weeks. A notarized affidavit of publication shall be provided by the applicant to the Building and Zoning Department. (NOTE: The newspaper must supply this affidavit to the applicant.) Notice in the newspaper of the proposed action allows all interested persons to submit their views within thirty (30) days of the last date of publication and to receive a copy of the action taken upon the application. All notices of applications for Shoreline Management Exemption from a Substantial Development Permit shall be substantially in the form as the example provided by the Building and Zoning Department. 2. The Building and Zoning Department determines approval or denial of the permit after the comment period and after the SEPA threshold determination is made. 3. The Department of Ecology commences a thirty (30) day review period after receiving the Administrator's decision during which appeals can be made. 4. If no appeals are filed, work on the project may commence after notification of the end of the review period by DOE. APPLICATION: ❑ 1. APPEAL PROCEDURE: If permit is denied, applicant may appeal to Shoreline Hearings Board, as outlined below. Appeal Initiated by Department of Ecology or Attorney General 1. Either the Department of Ecology or Attorney General may request review of the granting or denying of a permit within thirty (30) days of the action of the Renton Building and Zoning Department. Notice is sent to the Building and Zoning Department and the Hearings Board. 2. The Hearings Board conducts a review as requested and accepts or overturns the decision of the City of Renton. 3. Any part to the review may appeal the Hearings Board decision to Superior Court. Appeal Initiated by the Applicant or by a Private Party 1. Any person, including the applicant, aggrieved by the granting or denying of a permit may request an appeal. The request is sent to the Department of Ecology, the Attorney General, and the Hearings Board. 2. Either the Department or the Attorney General must certify the request as valid for the review to continue. Certification must be given within thirty (30) days. 3. If the request is certified, the Hearings Board conducts a review and sustains or overturns the decision of the City of Renton. 4. Any party who fails to obtain certification or any party to a review before the Hearings Board may appeal to Superior Court. A plan incorporating, into the storm drain project, the retention of the existing detention ponds on public property and private property (if a revised agreement can be made with the property owner to permit such retention). Note: The retention of these ponds has been determined to be important because these ponds contain swales which are valuable for filtering waters moving through the drainage system. Response: The City has no authority at this time to require the property owner to retain the existing pond as is. The City has entered into an agreement which, upon fulfillment of the terms therein, would agree that the retention capacity that the pond provides would no longer be required. A copy of the agreement is attached. The storm drainage project as shown in the plans does not eliminate the existing pond. As stated in your letter the pond is a valuable resource. It provides biofiltration as well as habitat for fowl. We also see incorporating it into a fisheries enhancement program when we do down stream improvements th Gypsy Creek. I believe the best way to accomplish this is by having the pond dedicated for this purpose during future development planning. 2. A letter from you stating anticipated changes, if any, in volume/velocity of storm water run-off between the existing and proposed storm water drainage management systems. This letter should also address plans for mitigation of water management impacts which are likely to result from those changes. In addition, it would be helpful if this included a presentation of expected habitat impacts and proposed mitigation measures, as appropriate. This information will ensure maximum protection of water quality and minimum disruption of the existing natural environment. 200 Mill Avenue South - Renton, Washington 98055 - (206) 235-2631 Don Erickson June 17, 1988 Page 2 Response: This project is Phase I of the Gypsy Creek improvements. At this time during normal flows, water will be running through the existing 24 inch system as it is today. A weir has been placed in the 120 inch manhole so that the new system is only used for flood waters. The only change at this time is to use the existing system to receive flood waters in order to prevent flooding of Denny's Restaurant. The ultimate design in Phase II will be to improve the down stream capacity to handle the 100 year storm and direct the normal flows into the new larger pipes. This will increase the volume and velocity of the system. Phase I plans have been designed to handle the 100 year event. Phase II plans will be designed to handle the 100 year event also. In addition Phase II will be considered to enhance the fisheries. At this time the drainage facilities do not allow for fish migration upstream. The larger pipes will decrease the normal flow velocities during fish migration and allow easier fish passage. We have worked with the Department of Fisheries in the Phase I design to allow for future fish passage after Phase II is completed. In short Phase I plans should not impact the existing habitat. After Phase II installation the new facilities would be used to further enhance the existing habitat by adding a fisheries resource. These facilities also eliminate flooding of Denny's Restaurant. 3. A plan for erosion during the construction phase of the project. Response: Erosion will not be a problem on this project. The stream will always be draining through the existing 24 inch system allowing construction to be performed in the dry. A weir will be installed in the 120 inch manhole so that when the connection is made into the pond water will not flow through. 4. A plan for routing of regular and emergency vehicles in the vicinity of the project site during the construction period. Response: Washington State Department of Transportation Standard Plans which are included as a part of the specifications are attached. One lane of traffic will always be maintained. In order to pick up the flows entering the pond on Mr Kao's property, we will need to extend a culvert a few feet into their property. This would require an easement of 15 feet wide by 10 feet deep. The State intends to do the construction this year. We would like to have the easement executed as soon as possible. Without the easement, we would not be able to connect to the pond. Our cost to relocate the 12" high pressure, had we done so in 1985-1986 , would have been $13 , 680; however in December 1985 , Robert Bray communicated to me the City ' s intent to go under the gas main with the storm drain. At that time Washington Natural Gas company canceled plans to relocate its 12" high pressure gas line. As you know, the projec " was then given to Washington State Department �r Transportation to oversee. The D.O.T. followed yo,,,- attempt to avoid conflict with the existing 12" high pressure gas line, and proposed the installation of twin 42" pipes. This proposal will allow Washington Natural Gas adequate clearance for your construction. The City of Renton is requesting that Washington Natural Gas accept the final design and construction cost increases, totaling $16 ,800. Washington Natural Gas is requesting that we share these additional costs, with Washington Natural Gas paying $13, 680 . as previously planned and the City of Renton paying $3, 120 . The system is designed for the 100 year flood event. The project costs are shared between the State of Washington Department of Transportation and the City of Renton. The State's portion will come from Federal funds which require the State to advertise and award the project. Construction is anticipated in late August and September of 1988. Other work in the area includes the NE 44th Street and Lake Washington Boulevard L.I.D. This project has already received a DNS. Construction timing will have to be coordinated between the two projects. Future improvements are necessary downstream from the I-405 crossing only. A study and design is to be performed this year to determine the improvements. An environmental checklist will be prepared for that project when we have more information and plans. It is our intent to keep as much of Gypsy Creek flowing through open channels as possible. Currently it is flowing in undersized culverts through the Baxter Pole yard before it terminates in Lake Washington. I.D. #334 formed at the Denny's Restaurant, Don Monaghan has raised issues with project coordination between the L. I.D. and the Gypsy Creek/WSDOT job. As I have requested, Chuck has checked with the State DOT people on the possibilities of modifying, reducing the scope, or taking back to the City, the Gypsy Creek/I-405 Culvert Crossing project. After his discussions, any changes will apparently cause some major problems in DOT and affect our WSDOT/City relationships. Because I wish to complete the project and not cause long—term problems, I want to have the project proceed as is. In summary, WSDOT will advertise and hire a contractor to start in August of this year — 45 day construction period. The L. Grady Way and Powell Ave.S.W. ; and, S.W. 7th St. and Hardie Ave.S.W. i' I-405 LAKE WASHINGTON BLVD. N. - JOINT CITY/STATE DEPARTMENT OF TRANSPORTATION GYPSY CREEK DRAINAGE UPGRADING The Public Works Director presented proposed solution to Gypsy Creek flooding east of I-405, north of N. 44th Street, along Lake Washington Blvd. by Denny' s Restaurant. The Washington State Department of Transportation has proposed joint funding construction of a second large storm drain under I-405 to eliminate flooding on City streets and the City cost of $70,000 would be funded by 1/2 Cent Gas Tax Funds. The funds will be budgeted in the 1985 Budget. The Committee recommends acceptance of the proposed drainage improvement and further recommends the Mayor be authorized to sign the City/State Interlocal Agreement upon legal review. RENTON HILL ALLEY PETITION The Public Works Director reviewed the citizen petition requesting improvement of the alley in Block 5, Town of Renton Plat. The petition was signed by 35% of . the abutting property owners. In the report from Public Works Department, it was noted that only eleven of the twenty lots involved had given Right-of-Way for the alley. Because of the significant problems involved, plus high costs associated with a project of this nature, the Committee requested the Public Works Department to draft a policy for upgrading alleys and recommended the matter be referred to the Committee of the Whole. Since most of the natural retention area has been filled in, the 24 inch diameter pipe is inadequate to acccmnodate the runoff from the total con- tributing area. Since the diversion of water was accomplished prior to the construction of SR 405 and the water course was operating prior to the natural retention area being filled, it is not the States responsibility to provide additional capacity under SR 405. ri�he State does have the responsibility to retain or divert any increased run- off cquP to the cor..struction of H.OV lane. The question was asked at the meeting as to whether the 230 acre drainage area could be all, or partially, diverted through the (2) 18 inch diameter culverts through the south half of the May Creek interchange. This possi- bility has been investigated by our District Hydraulics section. The exist- ing system cannot totally handle the 230 acre runoff, however, with the construction of a retention pond at Jones Road and an overflow to the now existing course, the system could be upgraded and workable. This system would not- accormiodate ultimate future development. The diversion of the 230 acre drainage directly to May Creek along the east side of SR 405 was also investigated. 12he elevation of May Creek is �dgher than the flowline of the drainage at the May Creek interchange. This diversion is not possible. -Do. 3 SR 405 Gypsy Creek Drainage Page 2 March 6, 1984 The best solution for an ultimate cure is to bore a 30 inch diameter casing under SR 405 adjacent to the existing 24 inch culvert. Our solution is the most expensive. Our estimate within our right of way is $105,000. This casing would have to be extended across Lake Washington Blvd. on the east side of SR 405 and the outfall improved to Lake Washington on the west side of SR 405. The improvement of the culvert and outfall system on the south portion of May Creek interchange would cost between $50,000 and $60,000. A large item contributing to the cost of this system is an outfall structure over a Metro sewer line at May Creek. We have designed an "in-pipe" retention system to pick up all contributing runoff to the 24 inch culvert by the construction of our HOV lanes in this area of SR 405. This system is estimated to cost $30,000. As proposed in our meeting on February 28th, we would be happy to contribute the $30,000 toward a solution that would solve the problem once and for all. The $30,000 could be applied to a parallel 30 inch casing or to modifying the (2) 18 inch culvert systems south of the May Creek interchange. The necessary modifications could be accomplished at the same time work is under way on the existing contract for the HOV lanes between Sunset Blvd. and Factoria. Please let us know your preferred course of action by March 21, 1984. This will allow time to make the necessary plan modifications prior to work being started in the interchange.
