Fork Springbrook Creek Regional By-Pass Message: Ron, I met with John Hobson on September 8th to sign our agreement and provide a check for the agreed upon amount . At that time , John indicated that the pipe was going to be pulled soon. on Saturday, I visited the canyon where this by-pass pipe had been pulled in. It seems to me that its installation is not quite right . At several places the pipe spans 60 ' to 901 , supported at each end by trees and logs bridging the creek bed, and reaches heights 12 ' above the creek bed. In these instances, the pipe is not round at the support location but deformed into a slight elliptical shape . Walking on it I can make it bounce . With sufficient flow of water, the pipe may collapse and buckle at these support locations. I believe the trees that bridge the creek and obstruct the path of the pipe should be removed, thus allowing the pipe to drop and more closely follow the creek bed bottom. Ron indicated that "fisheries " required that trees in the bed not be cut. I believe it is wrong. It is better to do the job correct now so that it last a hundred years rather then come back in ten to redo it ! Sincerely, BRUCE Bruce W. Initially, to Section 4 I would add a legal description. If the maintenance responsibility is to be perpetual, then it needs to follow the title to the land. In order to follow the title to the land, we need to include a legal description so that the heirs and assigns will have notice of the maintenance responsibility. My second comment is that there should be a sentence added to Section 7 on termination which would allow the city to terminate the agreement if Lobruch, Inc . fails to make the payment to the City of Renton for the cost of construction by the time set forth in the contract. As an aside, the first sentence in Section 10 does not read quite right and I think there might be a word out of place. I might note that the transmittal memo on this matter is dated July 22 , 1992 but it did not reach my office until August 3, 1992 . C:DOCS:92-687:JDH:ps CC: Ron Straka Enclosure AGREEMENT BETWEEN THE PROPERTY OWNER OF KING COUNTY, WA TAX LOT NUMBER 052205-9085 LOBRUCH, INC. and THE CITY OF RENTON for CONSTRUCTION AND PERPETUAL MAINTENANCE OF A STORM SYSTEM The agreement, made and entered into this day of 1992 by and between the City of Renton, Washington, a municipal corporation of the State of Washington and the property owner of Tax Lot Number 052205-9085, Lobruch Inc., a corporation licensed to do business in the State of Washington. WHEREAS, the property owner of Tax Lot Number 052205-9085, Lobruch, Inc. has granted an easement for the construction of the City of Renton/King County North Fork Springbrook Creek Regional Pipeline Project; WHEREAS, a condition of the easement specifies that an optional bid item(s) be included in the City/King County project to allow the construction of a parallel 12" diameter high density polyethylene (HDPE) storm pipe with associated appurtenances to service the grantor property and this work will be included within the scope of the City of Renton/King County North Fork Springbrook Creek Regional Bypass Pipeline project; WHEREAS, when construction bids are closed by the City of Renton, the grantor (Lobruch, Inc.) will be notified and have the option of activating the option for construction of the 12-inch HDPE storm pipe and associated appurtenances as part of the City of Renton/King County North Fork Springbrook Creek Regional Bypass Pipeline Project; WHEREAS, if the grantor elects for this option, the 12-inch HDPE storm pipe and associated appurtenances will be paid in full by the easement grantor (Lobruch, Inc.), prior to the start of construction of the City of Renton/King County North Fork Springbrook Creek Regional Bypass Pipeline project; and, WHEREAS, the City of Renton and King County has agreed to construct the North Fork Springbrook Creek Regional Bypass Pipeline Project through an interlocal cooperative agreement. NOW THEREFORE, in consideration of the mutual covenants herein it is agreed as follows: Section 1: Purpose and Scope The scope of this Agreement is the construction of storm drainage facilities, including pipes, appurtenances and materials to satisfy the condition specified in the easement granted by the property owner of Tax Lot Number 052205-9085, Lobruch, Inc., to allow the construction of the City of Renton/King County North Fork Springbrook Creek Regional Bypass Pipeline project. The subject storm drainage facilities, hereinafter called "the storm drainage facilities serving the grantor property", are shown on Exhibit "A". Section 2: Effective Date of Agreement This Agreement shall be entered into by Lobruch, Inc. prior to the award of the construction contract for the City of Renton/King County North Fork Springbrook Creek Regional Bypass Pipeline project. Section 3: Term of Agreement This agreement shall remain in full force and effect and be binding on both parties hereto. This agreement must remain in effect in perpetuity because of the maintenance requirements. Section 4: Construction, Construction Management, Construction Schedule, and Maintenance The storm drainage facilities shall be constructed in accordance with the terms and provisions of the construction contract documents prepared for the City of Renton/King County North Fork Springbrook Creek Regional Bypass Pipeline project by the City of Renton and King County. The City of Renton shall be responsible for the administration of the project including construction contracting and management. The storm drainage facilities serving the grantor property shall be identified under separate bid items in the construction bids. The subject bid items shall be reviewed and approved prior to 50 percent completion of the North Fork Springbrook Regional Bypass Pipeline Project by the owner of the Tax Lot Number 052205-9085, Lobruch, Inc. In the event the owner of the Tax Lot Number 052205-9085, Lobruch, Inc. elects not to pay in full for the construction of the storm drainage facilities serving the grantor property, the bid items associated with this work will be deleted from the project and will not be constructed. The owner of Tax Lot Number 052205-9085, Lobruch, Inc. shall inspect the construction of the storm drainage facilities serving the grantor property and shall participate in the final inspection and preparation of the "punch list" items for final contractor correction and completion of construction for this work only. Upon completion of construction, the maintenance of said storm drainage facilities, being a 12" diameter HDPE storm pipeline 550 feet in length located in the City of Renton, in the North Fork of the Springbrook Watershed in King County, WA Tax Lot No. Agreement between Tax Lot Number 052205-9085 Property Owner,Lobruch,Inc.and the City of Renton Page 2 793100-0120 and Tax Lot No. 793100-0126, serving the grantor property will be the perpetual responsibility of the current or future property owner of King County, WA Tax Lot Number 052205-9085 or their heirs or assigns (see Exhibit A). The property owner shall have the right to use the easement for maintenance purposes following the construction of the storm drainage facilities. All maintenance activities are to be coordinated with the City of Renton a minimum of one week prior to performance. Section 5: Funding of the Project The property owner of the Tax Lot Number 052205-9085, Lobruch, Inc., or their heirs or assigns, shall be responsible for all construction cost payments for the storm drainage facilities serving the grantor property (see Exhibit B). The cost of the facilities shall be determined at the time the construction bids are closed and based upon the City's selection of the lowest, responsive, responsible bidder selected for award of the City of Renton/King County North Fork Springbrook Creek Regional Bypass Pipeline project. Prior to the City of Renton's award of the construction contract to the lowest, responsive, responsible bidder, the owner of Tax Lot Number 052205-9085, Lobruch, Inc., or their heirs or assigns, shall make payment to the City of Renton for the cost of construction of the storm drainage facilities serving the grantor property based upon the City selection of the lowest responsive, responsible bidder for award of the construction project. Section 6: Legal Relations The property owner of Tax Lot Number 052205-9085, Lobruch, Inc., or their heirs or assigns, shall indemnify and hold harmless the City from and against all claims, costs, demands, expenses, and liability which may result from construction of storm drainage facilities as a result of this Agreement. Section 7: Termination This agreement will be terminated if the property owner of Tax Lot Number 052205-9085, Lobruch, Inc., or their heirs and assigns, decides not to, or fails to act upon the option to construct the storm drainage facilities serving the grantor property prior to 50 percent completion of the North Fork Springbrook Regional Bypass Pipeline Project, or fails to make payment in full for the cost of construction of that portion of the project which serves the grantors property as described in Exhibit "B", for the City of Renton/King County North Fork Springbrook Creek Regional Bypass Pipeline project. Section 8: Permits The City of Renton shall be responsible for obtaining all permits necessary for construction of the storm drainage facilities covered by this Agreement. The property owner of Tax Lot Number 052205-9085, Lobruch, Inc., or their heirs or assigns, shall support the City, upon request, during the application of the required permits for the project. Upon completion of construction and prior to project acceptance and final pay estimate approved by the City Council, the property owner of Tax Lot Number 052205-9085, Lobruch, Inc., or their heirs and assigns, shall review and approve the final pay estimate to certify acceptance of the storm drainage facilities serving the grantor property. If during the construction of the storm drainage facilities serving the grantor property, the cost of said facilities construction is reduced the cost saving shall be refunded to the property owner of Tax Lot Number 052205-9085. Associated change order documentation will be provided to verify the cost change. If during the construction of the storm drainage facilities covered by this agreement, the cost of said facilities construction is increased, the cost increase shall be paid for by the property owner of Tax Lot Number 052205-9085. The associated change order documentation will be provided for the owner's approval to verify the cost increase. Section 11: Amendments Any amendments or modifications to this Agreement shall be made in writing and signed by the parties hereto, and neither the City nor the owner of Tax Lot Number 052205- 9085 shall be bound by verbal or implied agreements made by any official, agent, or representative of either the City or the property owners of Tax Lot Number 052205-9085. The City of Renton is requesting that your Division withhold approval of the construction improvement plans for this project pending review and concurrent approval by the City of Renton. The City has serious concerns regarding the potential stormwater impacts of this project as currently proposed. This plat lies on the east side of-Talbot Road South, near SE 194th Street, the right-of- way of Talbot Road South fronting the plat coincides with the City of Renton's City limits. The construction of this plat requires the construction of water, roadway and stormwater improvements within the right-of-way of Talbot Road South and therefore the applicant must obtain a construction improvement permit from the City of Renton (see the letter to Mr. Denby, the applicants engineer that we copied to you last week). We understand that this project is apparently "vested" in King County's old storm water drainage standards due to the preliminary plat application being accepted several weeks prior to the effective date of the 1990 King County Surface Water Design (KCSWD) Manual. This project, however, requires a construction permit from the City of Renton. As this is a "new" permit, it must comply with all existing City of Renton Codes. In June of 1990 the City formally adopted the Core and Special Requirements contained in Chapter 1 , and the methods of analysis and design standards contained in Chapters 3, 4 and 5 of the KCSWD Manual. Following my staff's recent meetings with the applicant and their engineer, we have determined that the City will require that the construction improvements needed for this project, within the City limits shall be analyzed and designed in conformance with all of the KCSWD Manual requirements. In addition, the performance of the project's on-site stormwater runoff control facilities, required by Core Requirement No. 3 "Runoff Control" and sized using the methods of analysis contained in Chapter 3, shall be met. We have also requested that the applicant's engineer perform additional downstream analysis per Core Requirement No. 2: "Off-site Analysis". This is based on the significant concerns we share with King County's Surface Water Management Division regarding in- stream erosion, flooding potential and aquatic habitat destruction. Currently, the KCSWM Division is jointly funding the implementation of the $300,000 Northfork Springbrook Creek Regional Bypass Pipeline capital improvement project with the City to address these problems immediately upstream and adjacent to this proposed plat. Note, this capital improvement project resulted from the third litigation naming the County and the City by the property owner immediately west and downstream of this proposed plat. The stated purpose of our meeting was to discuss the Pryde Corporation plat in King County and the handling of the surface water runoff from that plat . As originally planned, the surface water was to be directed under Springbrook Road, run through an existing culvert (which may be blocked) , and then flow into Springbrook Creek at approximately a right angle to the flow of the creek. Neither you nor the City of Renton found this solution particularly appealing. It has been proposed that the stormwater runoff should be taken down the east side of Springbrook Road, tie into the city drainage pipe at that location, and then flow with 1 the flow of Springbrook Creek. You indicated that such an approach was much preferable from your point of view. We had a collateral discussion that the flow coming out of the county down 192nd was being diverted down Springbrook Road rather than flowing down 192nd and connecting up with Springbrook Creek. sgzs� The city promised to check into the possibility of having the flow continue on down 192nd. I know the Utilities Department is following through with that . I have also spoken with the county prosecutor' s office and raised this topic with them. Hopefully we can get a thorough review of this concern in the near future . At our meeting the City of Renton also indicated an interest in purchasing all or a portion of your property through direct purchase, life estate or other methodology. We are interested in continuing with those discussions . I 'm sure the Parks Department will be in contact with you in the near future . We have lived on this property for 39 years. When Talbot Road washed out 6 or 7 years ago the pipes carrying the creek under Talbot Road were increased fr m a diameter of 12 and 16 inches to a single pipe with a 60 inch diameter. From that time we have suffered increasing damage to our property. The runoff from rainfalls in the past 3 years have put a volume of water thru this 60 inch culvert that has ripped the top 36 inches of topsoil from our property in an area of approximately one plus acres. This increas- ed volume has killed 15 to 20 trees including a large cedar and others. This in the first 200 feet below Talbot Road. In the next 200 feet the creek has cut a new bed that is 5 feet deeper than it was before and 15 to 20 feet wide. Many trees in this part coijapsed into the creek. Also the runoff last November has torn the understucture from a second culvert leaving it partially collapsed.Also we recieved a letter from your water department to the effect that we should check for a leak in our line as use was excessive. We now find our line has been washed out of the earth by this scouring action and is im- possible to work on as it lies in the creek water and is pinned by very large boulders washed down from the 60 inch culvert. Year by year the runoff increases and the water arrives on our property more quick- ly doing greater damage. The North Fork Plan would pipe the runoff in a 24 inch pipe and run it down a steep hill and dump it in a pond with baffles to reduce the speed of flow.It would then be released toward our property. My quareel with this paln is when you slow down the flow of water to reduce the scouring damage where will you store it? It then follows that if you have no massive storage you are only bringing the water to us in greater am oun�s more quickly. A few years back a retention pond was built at the SE corner of the water shed. The outlet wes piped to the NE corner of water shed and dumped into an area that never had handled this quantity of water. Now you prop- ose to extend this piping to the NW part of the shed and release it onto our property. I see where this solves some of your problems but at our expense. Any plan that falls short of getteing the water down to the valley floor with no damage is only a fraction of what is needed. Furthermore, he claims that in the last three years damage has increased and approximately 36 inches of top soil were eroded from an area of about one acre. Damage is also claimed to trees and the owner's water line. The appellant also claims that runoff has increased yearly, causing greater damage. Issues To Be Addressed: a) Reasons for increasing the size of culverts under Talbot, and relationship to damage on appellant's property, if any. b) Has runoff increased in the last three years? If so, what are the reasons for this? Are we aware of any recent upland developments, with insufficient detention, that could have caused increased runoff? Under Washington Law,whose responsibility is it to address this runoff? c) How does the bypass project address runoff on the appellant's property? He then concludes,that if there is no massive storage, the project would result in "bringing the water to us in greater amounts more quickly". Issues to be Addressed: a) Is "massive storage" or any storage required to prevent scouring damage to the appellant's property? b) Would the quantity of runoff increase as a result of the proposal? c) Would the velocity of runoff increase as a result of the proposal? d) What would the effect of no action be on the appellant's property? 3. RELATIONSHIP OFEXISTING RETENTION POND TO THIS PROJECT Appellant's Claim: When the retention pond was constructed in the south east corner of the water shed several years ago, the appellant claims that it significantly increased the amount of water flowing in the North Fork of Springbrook Creek. The appellant also claims that the project would extend this piping to the northwest portion of the watershed and release the water on his property. Issues to be Addressed: a) Did the construction of the retention (detention?) pond increase flows in the north fork? b) What is the relationship of the retention/detention facility to this project? 4. ADEQUACY OF ENVIRONMENTAL DETERMINATION Appellant's Claim: Although he does not directly state it, the appellant seems to claim the environmental determination was inadequate because it did not consider the impacts of the project on his property. Finally, the appellant claims that: "Any plan that falls short of getting the water down to the valley floor with no damage is any a fraction of what is needed.' If during the construction of the storm drainage facilities serving the grantor property, the cost of said facilities construction is reduced the cost saving shall be refunded to the property owner of Tax Lot Number 052205-9085. Associated change order documentation will be provided to verify the cost change. If during the construction of the storm drainage facilities covered by this agreement, the cost of said facilities construction is increased, the cost increase shall be paid for by the property owner of Tax Lot Number 052205-9085. Anderson Utility Systems Manager Public Works Department City of Renton 200 Mill Avenue South Renton, WA 98055 RE: Springbrook Creek Regional Facilities Dear Mr. Anderson : This letter is a follow-up to a meeting that was held on June 29, 1990 with Randall Parsons and John Hobson of your staff regarding the above-referenced project. During this meeting it was agreed that King County would transfer back the duties for obtaining right-of-way for the project. The duties involve obtaining drainage easements for the Gallagher and Lobruch properties. The Surface Water Management Division has currently reached an impasse in negotiations for these properties and has initiated condemnation actions. It is the Division 's understanding that the City's process for obtaining Use and Possession of property is much faster than through the County process. This faster timeframe may still allow for construction of the project this year. A separate letter of agreement to Lobruch, regarding construction of a sepa- rate pipeline for them, will have to be prepared outlining the terms and tim- ing of payment prior to construction. King County staff that are working on the project and the right-of-way negotiations will be available for discussions so that there is a smooth and efficient transfer of right-of-way duties. The final construction plans, design report, and "specials" for the bid package will be forwarded in approx- imately one to two weeks. In addition, in a phone conversation on July 3, 1990 between Doug Chin of my staff and Randall Parsons, three questions were brought up that need to be addressed. The following are the questions, along with the Division 's response. 1. It was stated that Renton was not willing to maintain the Lobruch pipe- line and that King County should maintain it. King County has no objec- tion to maintaining the pipeline. It should be noted, however, that King County will need an easement from Renton in order to do this. Similarly, it is the Division' s understanding that Renton will still maintain the main pipeline for the project that lies within the City's boundaries and that King County would maintain the portion within its boundaries. Renton would like to wait until construction bids are closed and then notify Lobruch of the exact amount of money needed to build their pipe- line and set a deadline for response for payment to do the work. King County has no objection to this process. 3. Renton would like to assign a percentage benefit to Lobruch Incorporated for the use of the energy dissipator which their pipeline will discharge into. King County defers this responsibility to Renton as part of the transfer of duties for obtaining right-of-way for the project. The zoning on this site is SR ( 9 , 600 ) - a King County residential zoning which provides for the orderly transition of areas from a sub- urban to an urban character . Minimum permitted lot size is 9 , 600 square feet . Given the restrictive development potential of the property due to access , topography and steep slopes associated with the ravine and creek, the highest and best use of the property is for single family development - one site at best . (b) DESCRIPTION OF PROPERTY RIGHTS TO BE ACQUIRED: This is a par- tial acquisition of 39 , 489 square feet for a storm/drainage easement from the westerly portion `of the property. All other characteristics will be unchanged and the after area will contain 3 . 07 acres . (c) EFFECTS OF ACQUISITION: The effect of the acquisition will be to encumber the subject property with a 39 , 489 square foot storm/drainage easement from the westerly portion of the property. The easement area will allow for storm water overflow and prevent fur- ther flooding and erosion. Currently, the easement area is in a ques- tionable building area due to the seismic and erosion hazards and set-back requirements associated with the ravine and Springbrook Creek . According to Michael Watkins , with King County Building and Land Development Sensitive Areas , building on the subject property is questionable and would entail numerous building restrictions . It is determined that there will be no adverse effects on the remainder of the property as a result of this acquisition. ( d) 1 . CORRELATION OF LAND SALES : Several recent sales of residential zoned acreage properties were investigated for this ap- praisal . Three sales were chosen within a five mile radius of subject property. It is believed that the sales researched and used in this report are indicative of the current market in the area . This sale is considered comparable in general location, zoning , highest and best use , size and topography. Although slightly larger in size than the subject , at $9 , 474 per acre , this sale is a good indication of market value for the subject . J Comparable Sale 3 , at $9 , 984 per acre , is located approximately five miles southeasterly of subject . This sale is considered comparable in general location , zoning , available utilities and highest and best use , and superior in access . At $9 , 984 per acre , this sale represents market value for the subject property. All three sales are considered comparable to subject with their mar- ginal developability due to their numerous building restrictions . The sales indicate a current market value of $10 , 000 per acre for subject property, or $ . 23 per square foot . Based on 133 , 729+ square feet , it is estimated that subject land has a current market value of $30 , 757 . 57 , say $30 , 150 . (d) 2 . CORRELATION OF WHOLE PROPERTY SALES : No whole property sales were used in this appraisal as no principle improve- ments are affected by the acquisition . For the purpose of estab- lishing just compensation, the land value is deemed the appropriate measure .
