Dear Mr. Straka,
Thank you, for the careful evaluation of the option for RHA to consider sharing in the cost and
use of the Sunset Terrace Regional Stormwater Facility for the on-site mitigation of flow from
the "Piha" site.
Your November 14, 2013 analysis suggests that RHA's share of the cost is between $194,000
and $269,750 for the expansion necessary to connect any future development of the Piha site to
the regional facility. As discussed, there is yet to be a projected fully designed or funded on the
Piha lot; for that reason RHA declines to participate financially in the subject stormwater facility.
I hereby concur with your recommendation that the City proceed with the Sunset Terrace
Regional Stormwater facility design to not provide flow control for runoff from the RHA PIHA
site. The Sunset Terrace Regional Stormwater facility would therefore not be designed to
provide flow control for the runoff from the RHA PIHA site.
Thank you, again, for enabling your Renton Housing Authority to explore its options as together
we aspire to meet the affordable housing needs of our great city.

The Grantor,for and in consideration of mutual benefits,does by these presents,grant,unto the City of
Renton, a Municipal Corporation, Grantee herein, its successors and assigns,the right, permit, license,
permission and easement to use and occupy the following described real property situated in the County of
King, State of Washington:
LEGAL DESCRIPTION:
That portion of Block 39 of the Corrected Plat of Renton Highlands No.2,as recorded in Volume 57 of Plats,
pages 82-98,records of King County, Washington, lying southwesterly of a line 20 feet northeasterly of and
parallel with the northeasterly margin of NE 101h St and northwesterly of a line 60 feet southeasterly of and
parallel with the southeasterly margin of Sunset Ln NE.
All situate in the Northwest quarter of Section 9,Township 23 North, Range 5 East, W.M., in the City of
Renton, King County,Washington.;
The work to be performed by Grantee is for the purpose of constructing the planned project improvements
associated with the Sunset Terrace Regional Stormwater Facility Project.
The Grantee will provide continuous access to the remaining portion of the Grantor's real property
throughout construction. The Grantee shall,upon completion of any work within the property covered by
this temporary construction easement,restore the surface of the Grantor's real property,and any private
improvements disturbed or destroyed during execution of the work,as nearly as practicable to the condition
they were in immediately before commencement of the work or entry by the Grantee except where modified
by the project's plans and specifications.
This temporary construction easement shall become effective upon execution by the Grantor and shall
continue for two(2)years, at the conclusion of which it shall expire. Grantee's indemnification obligations
below shall survive the expiration or any earlier termination of this temporary construction easement.
It is further understood and agreed that the Grantee shall indemnify and save the Grantor harmless from any
and all claims,damages,costs, expenses(including but not limited to reasonable attorneys' fees)and causes
of action of every kind and description which may accrue to,or be suffered by any person,persons or
property by reason of,arising out of,or resulting from the use and occupancy of said lands and real property
by the Grantee and/or its employees,servants, agents, contractors and assigns.
