REGIONAL STORMWATER FACILITY FOR ON-SITE MITIGATION OF THE PIHA SITE
Dear Mr. Gropper:
Per the FY 2012 Statewide Stormwater Grant Agreement No. G1200544 between the
City and the Department of Ecology, the City is required to design and construct a
facility that will infiltrate three-acres of impervious surface. The cost of designing and
constructing a facility to mitigate for any additional areas needs to be covered by the
private property owner or entity of which areas are being mitigated for.
The City of Renton Surface Water Utility has completed a preliminary cost analysis to
estimate Renton Housing Authority's (RHA) share of the cost for use of the Sunset
Terrace Regional Stormwater Facility for stormwater mitigation for the on-site
improvements on the PIHA site. For this exercise, we decided to do a proportional cost
(including design and construction) based on tributary impervious area draining to the
regional facility.
Per the information provided by SvR Design Company on November 1, 2013,
approximately 0.75 acres of impervious area are proposed to be constructed on the
PIHA site. This will result in a 25% increase of tributary area to the Sunset Terrace
Regional Stormwater Facility.
The City is currently under contract with CH2MHILL (GAC-13-021) for the design of the
facility. Total design cost for a regional facility that will provide mitigation for three-
acres of impervious is $179,003. The estimated cost for additional engineering efforts
to accommodate additional impervious areas from the PIHA site is $44,750 (25%of
current design contract). The RHA will be responsible for the actual additional design
cost to be determined as part of a contract addendum with CH2MHILL. We anticipate
that the actual cost will be less than this estimated amount.

A pre-design report with approximately 15% sizing of the Sunset Terrace Regional
Stormwater Facility was completed in 2012. Appendix E of the report includes a cost
estimate of the regional facility estimated at a range between $597,000 and $900,000
for mitigation of three-acres of impervious). Construction cost for mitigation of
additional mitigation of 0.75 acres of impervious is estimated at a range between
$149,250 and $225,000 (25% of cost estimated in pre-design report for a facility
mitigating for three-acres of impervious). The actual construction cost will be based on
final construction contract amount at time of final pay estimate.
Based on the explanation above, RHA's share of the cost for the use of the Regional
Stormwater Facility for mitigation of the improvements constructed in the PIHA site is
estimated to be between $194,000 and $269,750. The Department of Ecology indicated
that we will need to track the eligible and ineligible grant cost for design and
construction separately. The Department of Ecology will also need to review and
approve the cost share agreement between the City and the Renton Housing Authority.
To move forward with the design of the Sunset Terrace Regional Stormwater Facility, we
will need a letter confirming RHA's intent to use the Sunset Terrace Regional
Stormwater Facility for mitigation of the required on-site improvements of the PIHA
site.

Design infiltration rate of 1.1 inch/hr with the stipulation that all infiltration
facilities be located at least 20 feet from all structures. This memo assumes
similar sub surface conditions for this preliminary analysis. Site specific
geotechnical investigations will be required for design.

Rate Flow Control Standard-Matching Existing.

• Flow Control Options include:
o Flow control may be achieved by installing a traditional detention
system. Based on KCRTS modeling, a 7,500 cubic feet of storage
would be required to meet flow control requirements. This could be
sized in a 43'x43'x4' (LxWxH)vault.
o Flow control may also be achieved by installing a combination of
low impact development (LID) to the fullest extent allowed by site
constraints, likely in conjunction with a traditional detention system.
o Meeting the Project's flow control requirements exclusively with
LID does not appear feasible given the level of proposed impervious
surface coverage needing mitigation,and setbacks.
• For the on-site portion of the Project, the proposed 8,600 square feet of
pollution generating parking lot/driveway is the only area that would require
runoff treatment. Treatment requirements may be met through the use of
Catchbasin Stormfilters or infiltrative BMPs if setbacks and soil property
design conditions are met.
Right of Way Flow Control, Stormwater BMPs and Water Quality
• 425 cubic feet of storage volume would be required in order to meet the
Project's flow control requirements with a vault. A 14'x8'x4' (LxWxH)vault
is one potential configuration that would meet these requirements.
• Pervious sidewalk paving and/or raingardens in the planter strip appear to be
the most feasible options for meeting right-of-way flow control BMP
requirements.
• Water quality treatment is required for the pollution generating portions of the
ROW improvements (new roadway surfaces).
• If raingardens are utilized in the planter strip,they could provide both flow
control and water quality treatment for the roadway surface. Runoff not
infiltrated can be treated using a Catchbasin Stormfilter or another approved
shallow treatment facility.

Dear Mr. Gropper:
Per the FY 2012 Statewide Stormwater Grant Agreement No. G1200544 between the
City and the Department of Ecology, the City is required to design and construct a
facility that will infiltrate three-acres of impervious surface. The cost of designing and
constructing a facility to mitigate for any additional areas needs to be covered by the
private property owner or entity of which areas are being mitigated for.
The City of Renton Surface Water Utility has completed a preliminary cost analysis to
estimate Renton Housing Authority's (RHA) share of the cost for use of the Sunset
Terrace Regional Stormwater Facility for stormwater mitigation for the on-site
improvements on the PIHA site. For this exercise, we decided to do a proportional cost
(including design and construction) based ih tributary impervious area draining to the
regional facility. Ofx
Per the information provided by SvR Design Company on November 1, 2013,
approximately 0.75 acres of impervious area are proposed to be constructed on the
PIHA site. This will result in a 25% increase of tributary area to the Sunset Terrace
Regional Stormwater Facility.
The City is currently under contract with CH2MHILL (GAC-13-021) for the design of the
facility. Total design cost for a regional facility that will provide mitigation for three-
acres of impervious is $179,003. The estimated cost for additional engineering efforts
to accommodate additional impervious areas from the PIHA site is $44,750 (25% of
current design contract). The RHA will be responsible for the actual additional design
cost to be determined as part of a contract addendum with CH2MHILL. We anticipate
that the actual cost will be less than this estimated amount.

A pre-design report with approximately 15% sizing of the Sunset Terrace Regional
Stormwater Facility was completed in 2012. Appendix E of the report includes a cost
estimate of the regional facility estimated at a range between $547,000 and $900,000
(for mitigation of three-acres of impervious). Construction cost for mitigation of
additional mitigation of 0.75 acres of impervious is estimated at a range between
$149,250 and $225,000 (25% of cost estimated in pre-design report for a facility
mitigating for three-acres of impervious). The actual construction cost will be based on
final construction contract amount at time ofdFrfi ' n.
Based on the explanation above, RHA's share of the cost for the use of the Regional
Stormwater Facility for mitigation of the improvements constructed in the PIHA site is
estimated to be between $194,000 and $269,750. The Department of Ecology indicated
that we will need to track the eligible and ineligible grant cost for design and
construction separately. The Department of Ecology will eview and approve the cost
share agreement between the City and the Renton Housikg Authority.
To move forward with the design of the Sunset Terrace Regional Stormwater Facility, we
will need a letter confirming RHA's intent to use the Sunset Terrace Regional
Stormwater Facility for mitigation of the required on-site improvements of the PIHA
site.

Thank you,for the careful evaluation of the option for RHA to consider sharing in the cost and
use of the Sunset Terrace Regional Stormwater Facility for the on-site mitigation of flow from
the"Piha"site. -
Your November 14,2013 analysis suggests that.RHA's share of the cost is between$194,000
and$269,750 for the expansion necessary to connect any future development of the Piha site to
the regional facility. As discussed, there is yet to be a projected fully designed or funded on the
Piha lot; for that reason RHA declines to participate financially in the subject stormwater facility.
I hereby concur with your recommendation that the City proceed with the Sunset Terrace
Regional Stormwater facility design to not provide flow control for runoff from the RHA PIRA
site. The Sunset Terrace Regional Stormwater facility would therefore not be designed to
provide flow control. for the runoff from the RHA PIHA site.

INTRODUCTION
Thank you for the opportunity to provide this proposal for surveying services for the above-referenced project.
Based on preliminary research of recorded documents,we have identified a scope of work and a lump sum fee
for your project.Our surveying services will be provided based upon the following:
S The client is the property owner or an authorized agent of the property owner.
5 The client will provide right of entry onto the property.
S In some cases,the cutting of brush or small trees is necessary to complete the field survey.
S Utilities above and below ground will be shown on the survey to the extent that they can be identified by
normal field observation. Invert elevations to existing underground storm and sanitary sewer structures
will be provided.
SCOPE OF WORK

This scope of work is based on the typical requirements for a boundary and topographic survey in the City of
Renton based on our experience with similar projects. The cost of the standard boundary and topographic
survey is delineated in the fee section of this proposal.
The Boundary Survey includes:
S Research including a review of available Records of Survey for the area.
S Collection of field evidence required for an adequate resolution of the boundaries. This typically includes
street centerline monuments, existing survey monuments on the subject or nearby parcels,and evidence
of occupation such as fences and other improvements.
S Setting of%" steel rods with 2" plastic raps or brass disks with masonry nails in concrete and asphalt at
all corners except where existing monuments are found.
S Plotting of easements based on a title report and supporting copies of recorded easements provided by
the owner.
S Show all horizontal control on the face of the survey with coordinate data in table format.
S Prepare Revised Legal Descriptions for transactions vacating streets and/or lot realignments
The Topographic Survey includes:
5 Location of street edge,back of curb and sidewalk,show Right-of Way widths
S Location of all site improvements including houses, decks, sheds, roof overhangs, sidewalks, steps,
rockeries,retaining walls,fences,eaves etc.
S Location of surface evidence of utilities including overhead power, cable and telephone, storm and
sanitary sewer manholes with inverts, catch basins with inverts, water and gas meters, etc based on a
utility locate performed through Onecall
S Existing topography at 1-foot contour intervals on an accepted vertical datum.
S Location, size and species of trees with caliper greater than 6 inches with elevations at their bases
S Location of adjacent houses
S Location of buildings on adjacent properties
S Tie into City of Renton vertical control.Provide two benchmarks on site.
S The survey will extend 5 feet beyond the property lines and for the full width of adjacent rights of
way.

TERMS AND CONDITIONS
Successor and Assigns
The Client and Consultant each binds himself,his partners,successors,assigns and legal representative to the other party to this
LETTER OF AGREEMENT and to the partners,successors,assigns and legal representatives of such other party with respect to all
covenants of this LETTER OF AGREEMENT. Neither the Client nor the consultant shall assign his interest in this LETTER OF
AGREEMENT without written consent of the other.
Time of Essence
Time is of the essence in this Agreement; therefore, the terms specified in this contract shall be subject to re-negotiation if not
executed within 30 days from the date of the LETTER OF AGREEMENT. Further,if this project extends beyond six(6)months from
commencement because of delays by the Client or such other reasons beyond the control of the consultant, the fees in this
agreement shall be adjusted to reflect current fee schedules.
Government Approvals
It:s understood that the consulting services to be rendered by the Consultant do not in any way guarantee approval of governmental
permits,approvals,licenses,or other necessary actions.
Additional Work and Changes in Scope of Work
Additional work requested by the Client or arising from inaccurate or incomplete information furnished by the Client is not included in
this fee. it is further understood that if there are client-initiated changes and/or additional governmental requirements that are not
covered in the Scope of Work,these changes shall be billed on a time and materials basis according to the current rate schedule.
Other Services
Other services of other professionals,such as traffic consultant,architect,soils,or environmental consultants shall be enlisted as
necessary with the Client's approval. Their fees shall be resolved at that time and billed directly to the Client.
Stop Work Order
Consultant agrees to stop work on this project at the written request of the Client The Consultant further reserves the right to stop
work on this project for cause. "Cause"is defined to ine:iude,but without limitation,failure of the client to comply with the provisions
of'.his agreement; failure of the Client to provide necessary information and/or documentation necessary to complete the project;
deterioration of working relationship of the parties to '.tie extent it impedes project effectiveness; inability of the parties to re-
negotiate the terms of this Agreement according to the provisions contained herein;and failure of Client to bring current accounts 60
days in arrears.Client agrees to pay for all work.according to the records of the Consultant,which are kept on an hourly basis,up to
the time Stop Work Order is executed. By slcning this contract, the Client understands that property may be liened by the
Consultant if payment is not received in full within the timeframe outlined herein
Attorney's Fees
In the event that any party of this LETTER OF AGREEMEN f seeks the assistance of legal counsel to enforce this LETTER OF
AGREEMENT, or to maintain or defend any cause of action arising out of or related to this LETTER OF AGREEMENT,then the
prevA:,-.g party in such action, demand. arbitration or defense shall be entitled to recover from the other said prevailing party's
reasonab!e attorney's fees incurred,together with costs and expenses.
Retainer
A retainer shall be collected as identified in the proposal letter. Said retainer shall be paid prior to commencement of work and will
be applied to the final invoice for services. Costs associated with collection efforts or services will be charged and added to past
due accounts on a time and material basis.
Miscellaneous Fees
The Client shalt pay all permit fees,application fees,or any other fee required to obtain the necessary permits.
Instruments of Service
Drawings, specifications and other documents.including those in electronic form,prepared by the Consultant are Instruments of
Service for use solely with respect to this Project. Consultant shall be deemed the author and owner of all Instruments of Service
and shall retain all common law, statutory and other reserved rights, including copyrights. Upon execution of the LETTER OF
AGREEMENT. the Consultant grants to the Client a nonexclusive license to reproduce the Consultant's Instruments of Service
solely for purposes of constructing, using and rnaint;rining the Project, provided that the Client shall comply with all obligations,
including prompt payment of all sums when due, under this LETTER OF AGREEMENT. Any termination of this LETTER OF
AGREEMENT prior to completion of the Project shall terminate this license. The Client shall not assign, sublicense, pledge or
otherwise transfer any license granted herein to another party without prior written agreement of the Consultant. However, the
Client shall be permitted to authorize the Contractor, and Its subcontractors, materialmen and suppliers to reproduce applicable
portions of the Instruments of Service appropriate to and for use in their execution of the work.
Interest on overdue accounts
Consultant will bill for services rendered on a monthly basis or upon the completion of identified tasks. Client shall pay all fees and
costs invoiced by the Consultant within 15 days of the date of billing or the account shall be considered overdue. Interest at the
annual rate of 18%will be added to subsequent invoicing for all overdue accrued unpaid amounts.
Disclosures
It is hereby disclosed that the Consultant may have completed work on neighboring properties,may own or be a partner in the
development of neighboring properties and may accept employment in the future from neighboring or competing properties or
developers. Further,the consultant may develop and sell properties [fiat will be on the market at the same time as the Client's
property. The Consultant may have relationships with various individuals,firms and organizations that have a financial interest in
the Client's project or a competing project.Should the Client have any questions about these disclosures or any concerns at all
about the Consultant's current or future relationships they should be brought to the attention of the Consultant,

ACCEPTANCE
This represents the entire agreement between the Parties with respect to the subject matter hereof and
supersedes any previous or contemporaneous oral or written agreements regarding such subject matter.
This Agreement may be amended or modified only by a written instrument signed by a duly authorized
representative of each Party. By signing this contract,the Client understands that property may be liened
by the Consultant if payment is not received in full within the timeframe outlined herein.

Explanation of Public Benefit
The Street Vacation Petition for a part of Sunset Lane NE is central to help achieve the Community Vision goals for the Sunset
Terrace Revitalization as identified in their program.The requested Street Vacation is nineteen feet(19')wide along Sunset
Lane NE and 6,170 square feet in area.
The properties to the south of the vacated portion of the street will be developed as a public library operated by the King
County Library System and a market-rate,mixed-use,residential building developed by a for-profit developer which will
provide the seed funding for the development of future public housing projects by the Renton Housing Authority.The
development of the new public library will be a great amenity for the use of current and future residents of the Sunset Terrace
redevelopment and the Sunset area.
This street vacation and property development will help realize some of the goals set forth by the community as a part of its
Revitalization project such as supporting existing communities,providing equitable housing and providing additional retail in
the area.
