PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows : The hearing was opened on March 29, 1977 , at 11: 40 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were sworn. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report , and the report was entered into the record as Exhibit #1. Michael Smith, Planning Department , reviewed Exhibit #1 , and entered the following additional exhibit into the record: Exhibit #2 : Parking & Landscaping Plan. The Examiner asked the applicant if he concurred in Exhibit #1. Responding was : Albert Heglund, Jr. 307 Terry Avenue North Renton, WA 98055 Mr. Heglund questioned Mr. Smith about revisions incorporated into Exhibit #1, which included adding a two foot planter adjacent to the fence along the south property line in lieu of a wheel stop, and incorporating landscaping in the form of ivy against the building. SA-032-77 Page Two Mr. Heglund indicated that a revision had been made on placement of a proposed gate to allow greater flexibility for swing-back. He also reported that although the parking area is relatively limited, it will be restricted to employee parking only. A large tree near the entrance was retained to utilize a visual park-like impact upon entering the area. The Examiner asked for further comments. Since there were none , the hearing on Item #SA-032-77 was closed by the Examiner at 11 : 55 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS : Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS : 1. The Hearing Examiner is required to review the site plan of this proposed development as a condition in the form of restrictive covenants that was placed on a previous rezone action by the City Council. 2. The property is presently zoned B-1, P-1, and B-P. 3. The Comprehensive Land Use Plan indicates a commercial designation for the proposed site. 4 . The request is to renovate an existing railroad power substation facility into an office-type structure with related parking and landscaping. 5 . There is no apparent opposition to the existing substation renovation. The proposed improvement together with the submitted landscape plan will enhance a formerly dilapidated area and will restore an older brick building by the renovation to an office complex. This building rejuvenation will drastically improve the appearance of this area and should upgrade the property values around the site. 6. The proposed site plan is consistent with the intent of the restrictive covenants and conditions established by the Planning Commission at the time of site rezoning. These conditions were also adopted when the Council approved the Planning Commission recommendation to rezone the property. 7. As mentioned in the Planning Department report, the applicant has attempted to retain as many significant existing trees on the site as possible and has incorporated these trees into the proposed site plan. The applicant has also agreed to landscape a portion of the city right-of-way that abuts the property on the east and west sides. 8. The Planning Department has suggested several minor landscape revisions which are indicated in red on Exhibit #2 . 9. The applicant, Mr. Albert Heglund, questioned the staff report and the staff landscape revisions which included adding a two- foot planter adjacent to the fence along the south property line in lieu of a wheel stop and incorporating landscaping in the form of ivy against the building. Mr. Heglund indicated his reasoning for the landscape alteration and requested concurrence in his proposal. The staff concurred with Mr. Heglund ' s rationale. 10 . All agencies in the city that have jurisdiction over this property have been notified and have approved the application. Required utilities are available to the subject site. 11. The Planning Department report accurately sets forth the issues , findings of fact, applicable policies and provisions , and departmental recommendations in this matter and this report itself, being uncontested, is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full herein. SA-032-77 Page Three CONCLUSIONS: 1. The application i.s uncontested by adjacent property owners and . concurs with the Comprehensive Land Use Plan and the restrictive covenants as adopted as a condition of a previous rezone. 2. The appearance of the building will be drastically improved as will the area around the proposed structure due to a significant amount of cleanup, fencing, retention of existing significant vegetation and proposed installation of additional landscaping. This type of renovation is an asset to an older building-that was still in a very sound condition. There are a few other remaining vintage buildings in the City of Renton that are worthy of such renovation. This proposal is an asset to the community and the applicant should be commended for his efforts and his diligence in upgrading a diamond in the rough. Washington Department of Fisheries Request for Permit to Use City Property, Cedar River Adjacent to Boeing Plant---The Board reviewed a request by the Washington Department o Fisheries for permission to use a portion of city-owned property for the installation of a small temporary trap and holding pens . This . is part of an enhancement program for Cedar River sockeye salmon this fall . The program entails capturing adult brood stock in the lower river in late September and October, holding and spawning the fish at the capture site , and then incubating eggs at an appropriate site within watershed. In his August 9 letter , Lloyd 0. Rothfus , Natural Production Division chief, Department of Fisheries , indicated that all of their facilities will be removed from the river immediately f'oi loi,'in ; completion of the trapping and spawning operations . The to Adlich was originally requested was on the east side of the river . However , Department of Fisheries representatives agreed that a site is the west side of the river adjacent to the airport would offer mare security and less interference with their activities . Jim Magstadt pointed out that an FDA grant application is pending for development of the south portion of the riverbank which would include the proposed Department of Fisheries site . He suggested chat [he permit issued for the Department of Fisheries operation include the stipulation "not to interfere with any work in conjunction with the riverbank development program. " It was subsequently moved by GENE COULON, seconded by TED BENNETT, that the permit be granted until November Z. and the Department of Fisheries be notified that if the City receives an EDA grant for the riverbank development, the subject permit would be. modified. to be compatible with the requirements of this project. Plans for Reininp Corporation Shopping Center, Renton Highlands- -The Board reviewed plans for the Reininga Corporation shopping center north of NE 12th on Sunset Boulevard NE . The plans provided for access from Sunset , NE 15th, and NE 13th. Access at NE 13th and NE 15th was not approved. Jim Magstadt expressed concern about access because of the development' s proximity to a low-density residential community. It was the Planning Department ' s recommendation that the plan provide for screening and no vehicle access from 13th and 15th ; pedestrian access would be provided. Mr. Magstadt suggested that the best procedure would be to require an environmental asses.sment report which would provide traffic count data, anticipated flow and would address any other potential environmental problems which may be created as a result of this development . c. Albert Heglund Development , Vicinity Shattuck Avenue Undercrossing- -Mr. Heglund requested a permit to use public right- of-way in order to install a fence to the curb line . In'. exchange for the permit , he offered to develop a small park area on the end of Whitworth Avenue South abutting the railroad right-of-way. Mr. Heglund indicated he would be willing to develop the park if the City would remove the existing blacktop . Following discussion, it was moved by TED BENNETT, seconded by JIM MAGSTADT, that the Board grant a permit to Mr. Heglund to utilize and fence a Z0-foot strip of right-of-way at the minimum fee of $10. 00 a year in exchange for his agreement to plant the street end . as proposed in accordance with the approval of the City 's landscape architect.
