RE: _ VALLIS INVESTOR' S CLINIC DEVELOPMENT-- (FORMER POPE
PROPERTY LOCATED AT 3713 TALBOT ROAD SOUTH)
Ronald Nelson, Building Division and Michael Smith, Planning
Department inspected the subject site on March 6, 1978. Con-
siderable progress has been accomplished on the site within
the past several weeks in alleviating certain problems and
coordinating development activities with both the Planning
Department and Building Division.
No further clearing activity has occurred, however, site clean
up has been undertaken. The large piles of excavated dirt have
been removed, together with most of the brush and tree debris
per city specifications.
A revised landscape plan has been submitted by the applicant
and: is being reviewed by the Planning Department. The trees
remaining around the site will be preserved and incorporated
into the landscaping theme for the clinic. It is both the
applicant' s and Planning Department' s intent to off-set any
tree removal during construction with proportionate additions
to the landscape plan.
The Planning Department and Building Division are presently
developing procedures to improve coordination of the permit
and, inspection process per your request.

I met today at approximately 11 : 30 a . m. with the
contractor and Al Dansereau (owner) at the site
to review the status of the clearing and grading
operation . The cleanup work outlined in my
January 30, 1978, memo had not yet been accom-
plished. I again expressed my concern about the
operation and the present situation and said that
it had to be cleaned up immediately or the entire
operation would be shut down . Mr. Dansereau said
that he was concerned about protecting his
interests on the remainder of the property and
told the contractor to start the required clean-up
immediately. The contractor agreed. Mr. Dansereau
said that he would contact the architect to prepare
a revised detailed landscape plan , which would more
than offset the tree removal on site . I also said
that there would be no further trees removed east
and west of the building as part of the parking and
landscaping plan .

I visited the site at approximately 1 : 30 p .m. today and found
that the contractor had not proceeded according to the previous
agreement established at the site on January 25 , 1978 , and
January 27 , 1978 .
Trees marked to be saved had been taken out without notice to
the Planning Department. The ravine area below the approved
lowest building elevation was covered with dirt. There were
also huge piles of dirt in the areas clearly understood to
be left natural both east and west of the building enveloped .
Trees far beyond the outer building envelope designated at on-
site meetings with both the contractor, owner , and architect
were cleared and removed .
I told the contractor that the ravine area below the lowest
building elevation should be cleared up immediately, together
with the large piles of dirt and debris on both the east and
west sides of the building envelope. This was to be accomp-
lished before any other site work was to be done.
When I got back to the office I immediately called the
architect and AL Dansereau , owner of the property, and
expressed my concern about what had happened and the
immediate steps necessary to improve the situation .

Roy and I met today with Ron Thompson , architect for the
developer, andJoe Starkovich , contractor, out at the site
to review the grading and clearing of the site. We had
also met on January 25 , 1978, on the site to review this
subject. At that time, Al Dansereau and John Starkovich
were present together with Ron Thompson .
On both occasions , we reviewed in detail the care and caution
with which the clearing and grading operation must be handled.
We reviewed the proposed building envelope and emphasized
that , if any trees were near the outside perimeter of the
envelope , they should be saved until we can specifically
review on-site whether or not to remove them. We also stated
that there be no encroachment farther into the ravine than
the absolute established line and farther east, west, or
north than the building envelope established and marked on
that day.
Th-ey indicated that they would proceed with the utmost care
and caution on the area within th.e established building
envelope only as the first phase . We marked the trees on
January 27, 1978, (with the contractor and architect present)
that were close to the outside of the building perimeter that
should be saved for further inspection . We emphasized several
times that no trees or areas outside the building envelope
indicated on the site are to be disturbed until the architect
and the Planning Department further review the possibilities .
The architect could then prepare the final landscape plan
with all the trees to be saved indicated on the plans for
approval by the Planning Department.

D. HISTORY/BACKGROUND:
The subject site was annexed to the City on April 15 , 1959 ,
by Ordinance No . 1743 . The Comprehensive Plan 'in the area was
studied and amended on October 22 , 1974 . The subject site
was rezoned to P-1 on July 11 , 1975 , by Ordinance No . 2944 .
Certain restrictive covenants dealing with retention of the
natural character of the site and ravine area , together with
certain developmental requirements , were filed on July 23 , 1975 ,
and run with the land .

E . PHYSICAL BACKGROUND :
1 . Topography : The northeast portion of the site is relatively
level . The southerly portion of th•e site contains an exist-
ing ravine area with steep slopes averaging approximately
35 percent. The westerly half of the site generally slopes
downward toward the west at an approximate ten percent
grade.
2 . Soils : A majority of the site consists of Indianola Loamy
Fine Sand ( InC ) . This soil has rapid permeability ; available
water capacity is moderate ; runoff is slow to medium; and
erosion hazard is slight to moderate . This soil is used
for timber and for urban development. The ravine area
consists of Alderwood Gravelly Sandy Loam (AgC) . Runoff is
medium, and erosion hazard is severe . The slippage poten-
tial is moderate . This Alderwood Soil is used mostly for
timber. This soil does not appear to be appropriate for
urban-type development.
3 . Vegetation : There are a number of significant evergreen
and deciduous trees , both on the level areas of the site
around the existing residence and within the ravine area .
The restrictive covenants ( see attached ) designate the
existing significant trees and the ravine area for preser-
vation and incorporation into the development of the site .
The ravine area is to be preserved in its natural woodland-
type vegetation or enhanced with suitable native-type .
vegetation .
4 . Wildlife : Existing vegetation on the site may provide
some habitat for birds and small mammals .
5 . Water : There is an existing year-around stream located
near the bottom of the ravine area near the southerly
portion of the subject site .
6 . Land Use : There is an existing single family residence
located on the subject site. There are existing clinics
located south and southeast of the subject site . Valley
General Hospital is located approximately 1/8 mile south
of the subject site . There are existing single family
residences located directly north of the subject site on
the north side of South 37th Street and east of the subject
site on the east side of Talbot . Road South . Except for the
one existing single family residence , the subject site is
undeveloped .
F. NEIGHBORHOOD CHARACTERISTICS :
The area is characterized by a mixture of single family residences
and public/quasi -public uses in the form of the Hospital and
supportive medical clinics .
G. PUBLIC SERVICES :
1 . Water and Sewer: There is an existing 20 inch water main
located along Talbot Road South and an existing Metro sewer
gravity line located along South 37th Street and Talbot
Road South . Storm sewers are not available in the area .
There are drainage ditches , however , and any development
on the site will be subject to suitable storm water reten-
tion and oil /water separation facilities prior to out-flow
from the site.
2 . Fire Protection : Provided by the Renton Fire Department
as per ordinance requirements . See attached memorandum.

3. Transit : Metro Route 145 operates along. S. W. 43rd Street
approximately 1/4 mile south of the subject site .
4 . Schools : The subject site is not to close proximity to
any existing schools , and the proposed project will not
have an effect on existing school population except pos-
sibly indirectly through increased employment opportunities
in the area .
5 . Parks : The subject site is approximately one mile south of
Talbot Hill Park .

J . IMPACTS ON THE NATURAL SYSTEMS :
Development of the site will disturb soil and vegetation ,
increase storm water runoff, and has an effect on noise levels
in the area . However, these can be mitigated by proper develop-
ment controls and procedures and adherence to the existing
restrictive covenants and sound planning principles and practices .
K. SOCIAL IMPACTS :
Changing the use from low density, single family residential to
quasi -public , medical clinic , may result in additional social
interaction at the site as well as in the surrounding area .
L . ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION :
Pursuant to the City of Renton ' s Environmental Ordinance and
the State Environmental Policy Act of 1971 , as amended , RCW
43 . 21C , a Declaration of Non-significance has been issued for
the subject proposal (see attached ) . This declaration is
based on development of the site consistent with the existing
vegetation and natural character of the site and incorporation
of these elements within site development. Retention of the
natural characteristics of the site , as per the restrictive
covenants , is essential in protecting the quality of the
environment of the area and reducing potential impacts to
surrounding properties .

not been prepared; however, the applicant agreed to providing the plan. This plan
will be utilized by staff in finalizing the building and parking locations to
retain as many of the existing trees as possible per the restrictive covenants.
3. Any refuse dumpsters on the site should be reviewed by the Planning Department.
Their location should be compatible with the site plans, and they should be
screened from view in a manner compatible with the architecture of the building.
4. The amount of intrusion of the building into the ravine is reasonable. Due to
the requirements of the restrictive covenants and the physical condition of the
ravine, any deviations from the building location as shown in Exhibit #3 and as
staked on the property should be subject to approval of the Planning Department.
5. Prior to clearing and grading of the site the landscape plan should be approved by
the Planning Department and the storm water retention and oil/water separation
facilities approved by the Public Works Department.
6. The master plan for development of the entire site is a reasonable and useful
tool in evaluating subsequent development. This plan should be provided at
submittal of the next building proposal.
7. In general terms the building design (Exhibit #5) is compatible with the site
and surrounding area. However, additional review of the building design is
necessary to achieve more compatibility. This review can be accomplished by
the Planning Department.
8. A review of the site plan (Exhibit #3) and the King County Assessor's Map
Exhibit #2) indicates that some additional review by the Public Works Department
is necessary to align the proposed access road wi.th South 175th Street. This
alignment is important to facilitating traffic circulation to and from the site
and along Talbot Road South.
DECISION:
Based upon the record, testimony, findings and conclusions, it is the Examiner's
decision to approve the proposal subject to the conditions recommended in the Staff
Report (Exhibit #1) , and furthermore, that the building will intrude no further into
the ravine than what is marked by the existing stakes on the property.

the decision of the Examiner is based on erroneous procedure, errors of law or fact,

shall set forth the specific errors relied upon by such appellant, and the Examiner
may, after review of the record, take further action as he deems proper.

Copies of certain memoranda and comments are attached .
0. PLANNING DEPARTMENT ANALYSIS :
1 . The site plan as proposed appears to be consistent with the
restrictive covenants (see attached) for the site , except
that existing trees have not been indicated. These must
be indicated, and any trees needing removal must be approved
by the Planning Department. Final plan approval may require
minor shifts in parking and building arrangements to save
the existing trees and site character. The parking areas
should be planned and grouped around the existing trees
as much as possible .
2 . The proposed plan is consistent with the minimum setbacks
established by ordinance and the restrictive covenants .
3. The proposed plan is the initial phase of a campus-type
clinic development proposed for the entire site . All
subsequent phases are subject to covenant and ordinance
standards and will require similar •site plan approval by
the Planning Department staff and Land Use Hearing
Examiner.
4. The proposal is generally consistent with the minimum land-
scape buffering requirements of the covenants and ordinance .
However, specific landscape plans indicating trees to be
removed or retained , together with additional landscaping,
have not been submitted. These plans must be submitted to
and approved by the Planning Department prior to develop-
ment on the site as per the restrictive covenants .
5 . It is the Planning Department ' s determination that the
proposed plan does not significantly extend into the
ravine area and is , therefore , consistent with covenant
requirements .
6 . The proposed building does not exceed the 'height limit
established by covenant . However, it must be stressed
that building design be of a character that is compatible
with the Northwest woodland nature of the site. Final
building design should be subject to Planning Department
review and approval .
7 . Suitable access is provided via Talbot Road only , thereby
assuring consistency with covenant requirements .
8. Suitable utilities are available to the subject site . '
However, specific design and changes should be approved
by the Public Works Department.
9 . Suitable storm water retention and oil /water separation
facilities must be provided per approval of the Public
Works Department.
10 . The proposal is consistent with the Comprehensive Plan ,
existing zoning , and land uses in the area .
11 . Thirty-seven ( 37 ) parking spaces are provided for the
proposed 7 ,000 square foot office building ( two floors ,
3500 square feet each ) . Thirty-seven ( 37 ) spaces are
required per the Parking and Loading Ordinance .
12 . The proposed parking area and circulation exceeds 10, 000
square feet. Five percent ( 5% ) interior landscaping is
required by ordinance . This can be accommodated by

as indicated on the site plan . Certain revisions may be
necessary , depending on the final •.l,ocation of existing
trees into the site and parking area landscape theme .
P . PLANNING DEPARTMENT RECOMMENDATION :
Recommend approval, of the site plans subject to :
1 . Final Planning Department approval of the proposed building
and parking area locations prior to commencement of clearing ,
grading , or construction.
2 . A detailed landscape plan must be submitted to and approved
by the Planning Department. Such landscape plan shall include
existing significant evergreen and deciduous trees to be pre-
served and to be removed together with additional landscaping
to be provided throughout the site to supplement and enhance
the existing vegetation and natural character of the site.
Certain plan adjustments may be necessary to enhance the
natural qualities of the site and proposed development as

D. HISTORY/BACKGROUND:
The subject site was annexed to the City. on April 15 , 1959 ,
by Ordinance No . 1743 . The Comprehensive Plan An the area was
studied and amended on October 22 , 1974 . The subject site
was rezoned to P-1 on July 11 , 1975 , by Ordinance No . 2944 .
Certain restrictive covenants dealing with retention of the
natural character of the site. and ravine area , together with
certain developmental requirements , were filed on July 23 , 1975 ,
and run with the land.

E . PHYSICAL BACKGROUND :
1 . Topography : The northeast portion of the site is relatively
level . The southerly portion of the site contains an exist-
ing ravine area with steep slopes averaging approximately
35 percent. The westerly half of the site generally slopes
downward toward the west at an approximate ten percent
grade.
2 . Soils : A majority of the site consists of Indianola Loamy
Fine Sand ( InC ) . This soil has rapid permeability ; available
water capacity is moderate ; runoff is slow to medium; and
erosion hazard is slight to moderate . This soil is used
for timber and for urban development. The ravine area
consists of Alderwood Gravelly Sandy Loam (AgC) . Runoff is
medium, and erosion hazard is severe . The slippage poten-
tial is moderate . This Alderwood Soil is used mostly for
timber. This soil does not appear to be appropriate for
urban-type development.
3. Vegetation : There are a number of significant evergreen
and deciduous trees , both on the level areas of the site
around the existing residence and within the ravine area .
The restrictive covenants (see attached ) designate the
existing significant trees and the ravine area for preser-
vation and incorporation into the development of the site .
The ravine area is to be preserved in its natural woodland-
type vegetation or enhanced with suitable native-type
vegetation .
4 . Wildlife : Existing vegetation on the site may provide
some habitat for birds and small mammals .
5. Water : There is an existing year-around stream located
near the bottom of the ravine area near the southerly
portion of the subject site .
6 . Land Use : There is an existing single family residence
located on the subject site . There are existing clinics
located south and southeast of the subject site. Valley
General Hospital is located approximately 1/8 mile south
of the subject site . There are existing single family
residences located directly north of the subject site on
the north side of South 37th Street and east of the subject
site on the east side of Talbot . Road South . Except for the
one existing single family residence , the subject site is
undeveloped .
F. NEIGHBORHOOD CHARACTERISTICS :
The area is characterized by a mixture of single family residences
and public/quasi -public uses in the form of the Hospital and
supportive medical clinics .
G. PUBLIC SERVICES :
1 . Water and Sewer : There is an existing 20 inch water main
located along Talbot Road South and an existing Metro sewer
gravity line located along South 37th Street and Talbot
Road South . Storm sewers are not available in the area .
There are drainage ditches , however, and any development
on the site will be subject to suitable storm water reten-
tion and oil /water separation facilities prior to out-flow
from the site.
2 . Fire Protection : Provided by the Renton Fire Department
as per ordinance requirements . See attached memorandum.

0. PLANNING DEPARTMENT ANALYSIS :
1 . The site plan as proposed appears to be consistent with the
restrictive covenants (see attached ) for the site , except
that existing trees have not been indicated. These must
be indicated, and any trees needing removal must be approved
by the Planning Department. Final plan approval may require
minor shifts in parking and building arrangements to save
the existing trees and site character. The parking areas
should be planned and grouped around the existing trees
as much as possible.
2 . The proposed plan is consistent with the minimum setbacks
established by ordinance and the restrictive covenants .
3. The proposed plan is the initial phase of a campus-type
clinic development proposed for the entire site. All
subsequent phases are subject to covenant and ordinance
standards and will require similar. site plan approval by
the Planning Department staff and Land Use Hearing
Examiner.
4. The proposal is generally consistent with the minimum land-
scape buffering requirements of the covenants and ordinance .
However , specific landscape plans indicating trees to be
removed or retained , together with additional landscaping ,
have not been submitted. These plans must be submitted to
and approved by the Planning Department prior to develop-
ment on the site as per the restrictive covenants .
5 . It is the Planning Department ' s determination that the
proposed plan does not significantly extend into the
ravine area and is , therefore , consistent with covenant
requirements .
6 . The proposed building does not exceed the height limit
established by covenant . However, it must be stressed
that building design be of a character that is compatible
with the Northwest woodland nature of the site . Final
building design should be subject to Planning Department
review and approval .
7 . Suitable access is provided via Talbot Road only, thereby
assuring consistency with covenant requirements .
8. Suitable utilities are available to the subject site.
However, specific design and changes should be approved
by the Public Works Department.
9 . Suitable storm water retention and oil /water separation
facilities must be provided per approval of the Public
Works Department .
10 . The proposal is consistent with the Comprehensive Plan ,
existing zoning , and land uses in the area .
11 . Thirty-seven ( 37 ) parking spaces are provided for the
proposed 7 ,000 square foot office building ( two floors ,
3500 square feet each ) . Thirty-seven ( 37 ) spaces are
required per the Parking and Loading Ordinance .
12 . The proposed parking area and circulation exceeds 10 , 000
square feet. Five percent ( 5% ) interior landscaping is
required by ordinance . This can be accommodated by

Recommend approval of the site plans subject to :
1 . Final Planning Department approval of the proposed building
and parking area locations prior to commencement of clearing ,
grading , or construction .
2 . A detailed landscape plan must be submitted to and approved
by the Planning Department. Such landscape plan shall include
existing significant evergreen and deciduous trees to be pre-
served and to be removed together with additional landscaping
to be provided throughout the site to supplement and enhance
the existing vegetation and natural character of the site .

COMMENTS :
Introduction The State Environmental Policy Act of 1971 , Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be
prepared for all major.actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
Please answer the following questions as completely as you can with the information

you believe an explanation would be helpful to government decision makers , include your
