REPORT AND DECISION .
APPLICANT: Virgil Gooden FILE NO. SA-222-78
LOCATION: Vicinity of 1550 Union Avenue N.E.
SUMMARY OF REQUEST: Applicant requests site approval for a modular duplex dwelling
in an R-2, Residential Two-Family District.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions.
Hearing Examiner Decision: Approval with conditions.
PLANNING DEPARTMENT The Planning Department staff report was received by the
REPORT: Examiner on October 12, 1978.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application and
field checking the property and surrounding area, the
Examiner conducted a public hearing on the subject as
follows:
The hearing was opened on October 17, 1978 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reporte3 that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report, and the report was entered into the record as Exhibit #1.
David Clemens, Associate Planner, reviewed Exhibit #1, and entered the following
additional exhibits into the record:
Exhibit #2: Robert C. Jackson Short Plat Map
Exhibit #3: Plot Plan
The Examiner asked the applicant if he concurred in Exhibit #1. Responding was:

Mr. Gooden indicated concurrence in Exhibit #1, and entered a proposed landscape plan
for the project in compliance with recommendations denoted in Section P.3 of Exhibit #1.
The plan was labeled as follows by the Examiner:
Exhibit #4: Landscape Plan
The Examiner requested testimony in support or opposition to the request. There was no
response.
The Examiner referenced Section 0.4 of Exhibit #1 which pertains to previously established
restrictive covenants imposed during short plat approval of the site in 1976, and
requested a copy of the covenants to enter as an exhibit in the subject hearing. Mr.
Clemens indicated that a copy would be provided and the covenants, dated May 26, 1978,
were labeled as Exhibit #5 by the Examiner. The Examiner inquired if determination
could be made to establish whether the landscape plan conforms to requirements stipulated
in the covenants. Mr. Clemens indicated that the plan establishes the first twenty-five
feet adjacent to the northern property line to be maintained as a landscape buffer,
denotes retention of existing vegetation on the site, designates that no structure or
building is located within twenty-five feet of the northern property line and no more
than two duplex units will be constructed on the site in conformance with Exhibit #5,
restrictive covenants. Therefore, he indicated Planning Department approval of the
landscape plan as submitted.
The Examiner requested an extension from 14 to 21 days for issuance of a decision on the
subject application due to an existing backlog in the Examiner's office. There was no
objection.

SA-222-78 was closed by the Examiner at 9:25 a.m.
FIND NGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the
Exa 'ner now makes and enters the following:
FIN NGS:
1. he request is for approval of the site plan and landscape plan for a duplex as
equired by restrictive covenants (Exhibit #5) and rezone Ordinance No. 2939,
my 7, 1975.
2. he Planning Department report sets forth the issues, applicable policies and
rovisions, findings of fact, and departmental recommendations in this matter, is
contested, and is hereby attached as Exhibit #1 and incorporated in this report
y reference as set forth in full therein.
3. ursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance
has been issued for the proposal by Gordon Y. Ericksen, responsible official.
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition expressed to the proposal.
6. All existing utilities are available and in close proximity, except sanitary sewers.
The King County Division of Environmental Health Services has approved a septic
tank permit for this proposal.
7. The proposal is compatible with the required lot coverage, height requirements and
setbacks (except for the real yard setback) of Section 4-708 (R-2) , Title IV,
Ordinance No. 1628, Code of General Ordinances. Section 4-708. (4) . (b) requires a
minimum 25-foot rear yard setback. The site plan (Exhibit #3) shows a rear yard
of only 20 feet.
8. Existing restrictive covenants (Exhibit #5) require:
a. Submittal of a landscape plan for approval by the Planning Department.
b. Construction of only one duplex on the lot.
c. Approval of the site plan and landscape plan by the Hearing Examiner.
9. The subject site was segregated on January 23, 1976 (Exhibit #2) .
10. A landscape plan (Exhibit #4) was submitted. This plan appeared not to be of scale
and in conformance with the site plan (Exhibit #3) .
11. Off-site improvements have not been installed and are required.
12. Storm drainage plans have not been approved by the Public Works Department.
CONCLUSIONS:
1. The proposal conforms to the Comprehensive Plan.
2. The proposal conforms to the applicable portions of existing restrictive covenants
Exhibit #5) .
3. The site plan requires revision to conform to the 25-foot rear yard setback. This
will require revision of the relationship of the carports to the building. Such a
revision can be reviewed and approved by the Planning Department for conformance
with the required setbacks of Section 4-708. Further review by the Examiner appears
unnecessary provided revisions to the site plan are not sufficiently major to
constitute a substantially different site plan.
4. Exhibit #4, Landscape Plan, requires revision to accurately coincide with the plot
plan (Exhibit #3) as revised per Conclusion No. 3. The landscape plan must indicate
the size of material to be planted. Otherwise, the concept of the landscape plan
appears acceptable. Final approval of the revised landscape plan can be given by
the Planning Department.

5. Storm dra-nage plans must be submitted to and approved by the Public Works Department.
DECISION:
Based upon the record, testimony, findings and conclusions, it is the Examiner's decision
to approve the proposal subject to:
1. Revision of the site plan (Exhibit #3) to provide for a 25-foot rear yard setback
per Section 4-708. (4) . (b) . The Planning Department is to review and approve this
revised p:Lan for conformance with the setback requirements of Section 4-708; except
if the revised plan is substantially different from Exhibit #3 the Examiner will
review and approve the revised plan.
2. Revision of the landscape plan (Exhibit #4) to conform to the revised site plan and
state the sizes of the proposed plant material. The Planning Department is to
review and approve this revised landscape plan.
3. Submittal of the storm drainage plan to the Public Works Department for approval.
4. Compliance with all other applicable ordinances and regulations of the City of Renton.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in waiting on or before November 2, 1978. Any aggrieved person feeling that
the decision c,f the Examiner is based on erroneous procedure, errors of law or fact,
error in judgment, or the discovery of new evidence which could not be reasonably
available at the prior hearing may make a written request for review by the Examiner
within fourteen (14) days from the date of the Examiner's decision. This request shall
set forth the specific errors relied upon by such appellant, and the Examiner may, after
review of the record, take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires
that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and
meeting other specified requirements. Copies of this ordinance are available for
inspection in the City Clerk's office, first floor of City Hall, or same may be
purchased at cost in said office.

D. HISTORY/BACKGROUND :
The subject site was annexed into the City by Ordinance No .
2472 dated March 28, 1969 . It was subsequently rezoned to R-2
by Ordinance No . 2939 dated July 7 , 1975 , and short-platted as of
recording date on January 23 , 1976.
E . PHYSICAL BACKGROUND :
1 . Topography : The site is relatively level with a slight
rise to the east at approximately a 3 . 5% slope .
2 . . Soils : Arents Alderwood material , 6-15% slopes (AmC ) .
Runoff is medium and the erosion hazard is moderate to severe.
This soil is used for urban development.

3 . Vegetation : Ground cover consists principally of short
grass with some minor shrubs . Numerous evergreens are
located throughout the property.
4 . Wildlife : Existing vegetation may provide suitable habitat
for birds and small mammals .
5 . Water: No water was observed on the subject site.
6 . Land Use : The site itself is undeveloped. A single family
residence is located on the property adjacent to the east .
F. NEIGHBORHOOD CHARACTERISTICS:
The surrounding properties are either undeveloped or contain single
family residences . This is the general pattern observed in the
area .
G. PUBLIC SERVICES :
1 . Water and Sewer: An existing 12" water main extends north-
south along Union Avenue adjacent to the subject site. Eight
inch sanitary sewers are located on Sunset Boulevard N . E .
approximately 700 feet south of the site. However , the applicant
ha's received a septic tank permit from King County to handle
sewage disposal .
2 . Fire Protection : Provided by the Renton Fire Department as per
ordinance .
3 . Transit: Metro Transit Route 107 operates along Union Avenue
S . E . within 1 /4 mile to the south of the subject site .
4. Schools : Sierra Heights Elementary School is approximately
1 /2 mile north of the subject site and McKnight Junior High
School is within one mile to the west while Hazen High School
is approximately 3/4 mile to the southeast.
5 . Parks : Kiwanis Park located within 3/4 mile to the south of
the subject site while North Highlands Park is approximately
1 1 /4 miles to the west.

Introduction The State Environmental Policy Act of 1971 , Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be

D. HISTORY/BACKGROUND :
The subject site was annexed into the City by Ordinance No .
2472 dated March 28, 1969 . It was subsequently rezoned to R-2
by Ordinance No . 2939 dated July 7 , 1975 , and short-platted as of
recording date on January 23 , 1976 .
E. PHYSICAL BACKGROUND :
1 . Topography : The site is relatively level with a slight
rise to the east at approximately a 3 . 5% slope .
2. . Soils : Arents Alderwood material , 6-15% slopes (AmC ) .
Runoff is medium and the erosion hazard is moderate to severe.
This soil is used for urban development.

3 . Vegetation: Ground cover consists principally of short
grass with some minor shrubs . Numerous evergreens are
located throughout the property.
4 . Wildlife : Existing vegetation may provide suitable habitat
for birds and small mammals .
5. Water: No water was observed on the subject site .
6 . Land Use : The site itself is undeveloped . A single family
residence is located on the property adjacent to the east .
F. NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties are either undeveloped or contain single
family residences . This is the general pattern observed in the
area .
G. PUBLIC SERVICES:
1 . Water and Sewer: An existing 12" water main extends north-
south along Union Avenue adjacent to the subject site. Eight
inch sanitary sewers are located on Sunset Boulevard N . E .
approximately 700 feet south of the site. However , the applicant
ha's received a septic tank permit from King County to handle
sewage disposal .
2 . Fire Protection : Provided by the Renton Fire Department as per
ordinance .
3 . Transit: Metro Transit Route 107 operates along Union Avenue
S . E . within 1 /4 mile to the south of the subject site .
4 .. Schools : Sierra Heights Elementary School is approximately
1 /2 mile north of the subject site and McKnight Junior High
School is within one mile to the west while Hazen High School
is approximately 3/4 mile to the southeast.
5 . Parks : Kiwanis Park located within 3/4 mile to the south of
the subject site while North Highlands Park is approximately
1 1 /4 miles to the west.

Pursuant to the City of Renton ' s Environmental Ordinance and
the State Environmental Policy Act of 1971 , as amended , RCW 43-21C ,
a declaration of non-significance has been issued for the subject
proposal .

0. PLANNING DEPARTMENT ANALYSIS :
1 . The subject request is consistent with the Comprehensive
Plan which designates the site as medium density multiple
family and the R-2 zoning of the site.
2 . The existing lot also exceeds the minimum size requirement
for the R-2 zone .
3 . Water service is available on Union Avenue although no
sewer line is . Drainage plans will need approval of the
Public Works Department.
4 . Restrictive covenants as follows were made part of the
Short Plat approval in 1976 to protect adjoining single
family homes located primarily to the north . This lot
does not adjoin any single family homes .
a ) Submittal and approval of detailed landscape plan
showing a suitable combination of trees , shrubs and
ground cover.
b ) The owners agree and covenant that not more than 2
duplex units may be constructed and maintained on the
said premises for the duration of the covenants .
c ) The site plans including landscape plans for any new
buildings or structures shall be reviewed and approved
by the Hearing Examiner .
d ) The covenants shall run with the land and expire on
December 31 , 1999 .
5 . The applicant has yet to provide a landscaping plan for
this development .
P . PLANNING DEPARTMENT RECOMMENDATION :
Recommend approval of the site plans subject to :
1 . Providing the off-site improvements of curb , gutter, side-
walk , and paving as required by the Engineering Department .
2 . Final Public Works Department approval of utilities and
storm drainage plans .

Short Plat approval in 1976 including final approval of
landscaping plans by the Planning Department prior to issuance
of a building permit .
