SUMMARY OF REQUEST: Applicant seeks site approval in a Manufacturing Park zone' for a business park consisting of one 21,100 square foot building to be used as a retail structure and sixteen (16) buildings totaling 293,83 square feet tobe utlz`e as multi-tenant office space and light manufacturing/wholesale. SUMMARY OF ACTION Planning Department Recommendations Approval with conditions. I Hearing Examiner Decision: Approval with conditions. PLANNING DEPARTMENT The Planning Department staff report was received by the ' , REPORT; Examiner on December 27, 1978. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on January 2, 1979 at 10:50 a.m. in the Council Chambers of the Renton-Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning; Department report, ,and the report was entered into the record as Exhibit #1. Gordon ,Y. Ericksen, Planning Director, reviewed Exhibit #1, and entered the following additional'exhibits into the record: ' Exhibit #2: Site Plan LandscapeIrrigation 'Exhibit #3: Conceptual Iigation Design Plan Referencing Planning Department Recommendation .No.• 0.1 of Exhibit #1 regarding landscaping plans, Mr. Ericksen adv,ised •that Exhibit #3 was conceptual in content and submittal of final landscape plans would be required for final approval. He indicated that the landscape plan'should reflect•an increased landscape ,buffer strip on the perimeter of the. site on S.W. 43rd Street and East Valley' Road from 12 feet to 15 feet as previously required in the Glacier Park final plat approval.. He also noted that utility easements must be provided for maintenance and operation per approval of the Public Works Department. Referencing Section P.5 of Exhibit #1, Mr. Ericksen advised •that review and approval of fire protection methods would be required by the Fire Department, and suggested the applicant contact that department. Regarding Section P.7 relating to approval by the Public Works Department of drainage plans, Mr. Ericksen expressed his opinion that the Springbrook Channel would not adequately provide_required storm water retention for the project and indicated 'a' requirement for drainage plans which reflect on-site retention and controliof drainage as 'well as provision of oil-water separators. Regarding Section. P.9 pertaining to final Planning Department approval of signing and exterior building design, he advised that although a preliminary elevation plan had been submitted, a . detailed plan containing specific design would be required prior to final approval. He Submitted theipreliminary plan designating typical elevations of the proposed one and two- atory multi-tenant buildings,. i The plan was labeled as follows by the Examiner: Exhibit #4: ' Preliminary-Building Elevations • . Mr. Ericksen also submitted a photograph of an architectural rendering of the proposed one-story structure, type of signing,, landscaping, and general parking configurations. The photograph was labeled as follows by the Examiner: Exhibit #5: Architectural Rendering of Typical Buildings . J SA-469-78 Page Two Mr. Ericksen indicated Planning Department approval of the general building configuration although he noted that the proposed.,site, p1an,.,doea-_not:include. Lots .No..„1_,_,2 and 4 which wuldrequire subsequent approval at a later date. Mr. Ericksen circled In red-on' Exhibit #2 certain potential internal circulation problems created by the off-set roadway Configuration between Lots No, 5, 6, 7 and B. He also reviewed potential pedestrian access problems which may occur as a result of sidewalk configurations. Mr. Ericksen advised that both matters must be addressed and resolved prior to final approval by the Planning Department. The Examiner asked the representative for the applicant if he concurred in Exhibit #1. Responding was: Mort Thomas Gardner Engineers, Inc. Arctic Building, Penthouse ' Seattle, WA 98104 Mr. Thomas reported certain reservations regarding Planning Department recommendations contained in Exhibit #1. Responding to Mr. Ericksen's concerns, Mr. Thomas reported that storm water retention would be provided on the site; installation of sidewalks would be provided on Lind Avenue S.W. , S.W. 41st Street, East Valley Road, and a bicycle path would be constructed on S.W. 43rd Street in addition to curbs, gutters, and storm drainage as part of the ,five-lane Kent-Renton project. Mr. Thomas objected to extension of access easements from S.W. 43rd Street since adequate frontage exists on all lots with the exception of Lots No. 5 and 8 for which additional access has been designated. He also advised that a 20-foot utility easement has been provided throughout the site on the lot lines in conformance with the request from the Utility Division.. The Examiner requested further testimony in support of the application. Responding was: Ken Peterson Koll Company ' 2723 152nd N.E. Redmond, WA 98052 Mr. Peterson objected to Fire Department recommendations for sprinkling systems provided for all buildings as being premature since final drawings had not been .completed. The Examiner advised that jurisdiction for review of the matter remains with the Fire Department, and suggested that the'applicant'contact departmental representatives. The Examiner 'requested further comments from Mr. Ericksen. Mr. Ericksen reiterated concerns regarding internal pedestrian and vehicular circulation, and requested that consideration be given the matter in the Examiner's decision. The Examiner requested further comments from the applicant. Mr. Thomas reported that the'site architect and developer are fully aware of the. impact of circulation patterns, and plans meet their requirements and desires for the project. Mr. Peterson advised that details of the development are similar to other Koll Company multi-tenancy parks in Tukwila, Redmond and ether areas, and no problems have occurred with pedestrian and traffic' access in the 'past. The Examiner inquired regarding scheduling of developmental phases. Mr. Thomas indicated that Lots No. 3, 5, 6, 7 arid 8 will be developed initially as part of Phase I,_and..Lots No. 1, 2 and 4 win be subsequently sold. The Examiner inquired regarding the preliminary natureof"Bxlliit.#5., architectural.rendering. Responding was: Greg Hume Koll Company - 2723 152nd N.E. Redmond, WA 98052 Mr. Hume indicated that ,although proposed elevations depicted on the' exhibit were conceptual, the. intent of the applicant is to construct buildings according to the plan. The Examiner inquired regarding design and exterior treatment of proposed structures. Mr. Hume reported that Phase I plans include construction of three types of buildings consisting of a service building on Lot No. 3, one-story bight industrial buildings as well as light, industrial buildings with mezzanine offices, and photographs of the proposed structures had been submitted to the Planning Department. Mr. Ericksen advised that further review. of files would be accomplished to obtain submitted photographs to provide to the Hearing Examiner, following closure of the public hearing. The Examiner labeled the photographs .as follows: Exhibit #6: Photographs of Rendering of Proposed Buildings Mr. Ericksen indicated that maximum allowable building height on the site must not exceed proposed elevations of two-story buildings denoted on the plans. SA-269-78 Page Three The Examiner requested a final recommendation from Mr. Ericksen. Mr. Ericksen indicated that the Planning Department recommendation contained in Exhibit #1 would remain as submitted. ' The Examiner requested further comments. Since there were none, the hearing on File No. SA-269-78 was closed by the Examiner at 11:25 a.m. • FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the-following: FINDINGS: a. . Lr _Hs,. __ r A . :: gym. . 1. The request is for approval of a site plan for seventeen (17) industrial, office and commercial buildings (315,637 square feet of floor space) within a proposed preliminary/ plat or a portion of the Orillia Industrial Park final plat. 2. The Planning Department report sets forth the issues, applicable policies and provisions, findings] of fact, and departmental recommendations in this matter, and is hereby attached, as 'Exhibit M1 and incorporated in this report by reference as set forth in full therein. 3. PursuantI1to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended by R.C.W. 43.21.C. , a Declaration of Non-Significance has been1issued for the subject proposal by Gordon Y. Ericksen, responsible official based upon the EIS issued on October 22, 1975 for landfill operations on the site. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. :There was no opposition. to the proposal expressed. 1 6. All existing utilities are available and in close proximity.' 7. The proposal is compatible with the required setbacks, lot coverage, landscaping and height rquirements' of Section 4-730 (M-P) and Chapter 22 (Parking. and Loading) of Title IV; Ordinance No. 1628, Code of General Ordinances. 8. The proposal generally conforms to the final plat of Orillia Industrial Park FP-176-78) . Additional landscaping (15-foot strip) is required along S.W. 43rd Street and the East Valley Road, and additional landscaping is required at access 4points along these streets. ' This landscaping is to be installed with development of the site or individual lots. The amount of landscaping appears to conform with the, reQuired wildlife habitat mitigation of Resolution No. 1923 and the Green River Valley Comprehensive Plan. Staff has not apparently approved the plant material for wildlife habitat mitigation.• 9. Refuse dumpster locations. are not shown on the site plan, Exhibit #2.. These containers must.meet the location and screening requirements of Section 4-730.5. 10. Roof-top !mechanical equipment was not displayed in the submitted exhibits. 11. Storm drainage retention will be provided on-site, and the drainage plan has been reviewed by the Public Works Department. Some revisions of the plan appear necessary for final approval by the department. 1 12. Off-site improvements' are required including bicycle paths which will be provided either by, the applicant or. through LID's that have been formed in the area. 13. Three types of buildings are proposed (Exhibits #5 and 6) which will apparently be of concrete and light earth tones. 14. A preliminary plat application (PP-266-78) has been heard by the Examiner concurrently with this application. Per Finding No. 8 and Conclusion No. 6 the internal circulation is acceptable as proposed, except that per Conclusion No. 6 the 20-foot vehicular! easement between Lots 2 and 3 must be revised to 60 feet or deleted. CONCLUSIONS: 1. The proposed buildings and site plan generally conform to the Comprehensive Plan for the Green! River Valley. The. design is an aesthetic contribution to the environment Introduction, page 1, and Objectives, pages 6 and 8) which will ". .'.enhance the image of the City of Renton." (Goals, page 4) . Wildlife habitat will be partially enhanced by the provided landscaping (Goals, page 4, and Objectives, page 7) . The tax base of the city will be enhanced and a ". . .viable economic.climate. . ." will be provided (Goals, page 4),. Suitable landscaping can be provided at the periphery of J J SA-269-78 Page Four the site (Objectives, page 6) . 2. ,A final landscape plan must be submitted to the Planning Department for review to assure and confirm compliance with the Parking and Loading Ordinance (Chapter 22) , the Green River Valley Comprehensive Plan, Resolution No. 1923 and the final plat of Orillia Industrial Park. The landscape plan submitted, Fxhibit #3, is of insufficient detail-for appropriate evaluation by the staff. In addition, the landscape plan. does not include landscaping for a large portion of the site. Therefore, prior to the final action of the Examiner becoming effective, a final landscapii.ng plan must be reviewed and approved by the Planning Department, 3. Roof-top mechanical equipment may potentially impact adjacent and distant properties; therefore, the Objective, page 8, Comprehensive Plan for the Green River Valley, requires, that this impact be minimized. The Planning Department should review these details for compliance with the design goals and objectives of the Comprehensive Plan, M-P requirements, and the character of the proposal. 4. Signing should be reviewed in the normal administrative processes. No sign details were submitted in the record. 5. Although the building designs (Exhibits #5 and 6) are conceptual, the applicant indicated that the buildings will appear as shown in these exhibits. The detail of the drawings appears sufficient on the basis of this testimony to conclude that the designs and colors conform to the Comprehensive Plan for the Green River Valley. 6. This application: is unusual in that it is being reviewed concurrently with a request for approval of a preliminary plat which will divide the property into eight lots. Because of the impact of the Examiner's recommendation regarding the preliminary plat (expansion of the 20-foot easement to a 60-foot right-of-way or its deletion) the submitted site plan will require revision to.conform to the preliminary plat and the applicable building setback requirements (See Finding No. 14) . It is appropriate that approval of the site plan does not prejudice the preliminary plat in any way which might be construed .to constitute grounds for a variance or exception request. Submittal of the final landscape plan for review and approval of the. Planning Department for compliance with the Parking and Loading Ordinance, Green River Valley Comprehensive Plan,. Resolution No. 1923, and the Orillia Industrial Park final plat:, 4,. Review of refuse dumpster locations. and screening and roof-top mechanical equipment by the Planning Department' for compliance with the Green River Valley Comprehensive Plan. . 5. Final app'iroval of the storm water detention plans by the Public Works Department. 6. Approval of off-site improvements by the Planning and .Public Works Departments. 7. Approval is required of storm drainage plans by the Public Works Department. The applicant stated that storm water detention would be provided on the site. CONCLUSIONS: 1. The proposal conforms to the goals and objectives of the Comprehensive Plan and Land Use Map. 2. The proposal appears to serve the public interest, health, safety and welfare Section 9-1106.2.E. (2) ) . 3. In order to conform to the requirements of the final plat of Orillia Industrial Park FP-176-78) a final landscape plan must be submitted to the Planning Department with the final plat application. This plan must meet the conditions imposed in the final plat. 4. Off-site improvements, stipulated by the Subdivision Ordinance and the final plat, will apparently be completed via a combination of LID's, the applicant or development of each lot. The Public Works and Planning Departments should be adequately assured that these improvements will be installed and should be provided with appropriate documentation by the applicant. 5. Staff 's concerns regarding the storm drainage plan seem alleviated by the applicant's testimony that on-site detention will be provided. This should be confirmed in the final storm drainage plan to be submitted to the Public Works Department for final approval prior to construction or development on the site. 6. Access for the lots in the plat appears adequate as each lot abuts a dedicated public street. A 20-foot access easement between Lots 2 and 3 is also proposed. But the subdivision specifically precludes private streets or alleys (Section 9-1108.24. (4) and (5) ) . This easement for vehicular access constitutes a private road, street or alley per Ak.c.w. 36.75.020. (1) , (4) , (11) , (12) , and (14) ; and Section 9-1102.1 of the Subdivision Ordinance (see attached R.C.W.) . Therefore, the 20-foot easement must be expanded to a 60-foot dedicated public street and/or cul-de-sac (Sections 9-1108.24. (3) or (6) ) or deleted from the plat (similar to the rest of the unspecified circulation system between the lots) . This conclusion is not without some difficulty encountered in existing city ordinances. These ordinances do not specifically and comfortably define a public street or roadway. An alley, however, is defined in Section 9-1102.1. Consequently, the R.C.W. was consulted and the aforegoing conclusion reached. RECOMMENDATION: Approval of the preliminary plat, subject to: 1. Submission of a final landscape plan conforming to the final plat of Orillia Industrial Park (FP-176-78) with the final plat application. 2. completion of off-site improvements per review and approval of the Public Works and Planning Departments. 3. Completion of on-site improvements per review and approval of the Public Works and Planning Departments. 4. Submission of a final storm drainage plan for review and approval of the Public Works Department prior to construction or development on the site. 5. Revision of Exhibit #5 to expand the 20-foot vehicular access easement between Lots 2 and 3 to a 60-foot dedicated public right-of-way or to delete the easement from the plat. PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on July 6 , 1979. In accordance with Section 4-3010, Duties of the Examiner (as amended) , the Examiner shall receive and examine available information, prepare a record thereof and enter findings of fact and conclusions based upon those facts, together with a recommendation to the City Council, for final plat applications. No public hearing is held in conjunction with final plat applications. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of an 8-lot, ±24.7 acre final plat at the northwest corner of the intersection of the East Valley Road and S.W. 43rd Street. 2. The Planning Department report sets forth the issues, applicable policies and provisions , findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit nl and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C.W. 43.21.C. (as amended) , an environmental impact statement was prepared for the subject proposal in 1975 and was determined to be current for the subject proposal by the responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. All existing utilities are available and in close proximity. 6. The proposal is compatible with the required setbacks , lot coverage and height require- ments of Section 4-730 (M-P) of Title IV and Section 9-1108.24 (Subdivision Ordinance) of Title XI Ordinance No. 1628, Code of General Ordinances. 7. The preliminary plat received approval by the City Council on February 26, 1979. The Site Plan was approved, subject to conditions, on January 19, 1979, after a public hearing before the Hearing Examiner. 8. The final plat is both consistent with the Comprehensive Plan and Land Use Map and with the Green River Valley Comprehensive Plan. The final plat also conforms to the approved preliminary plat and the conditions have been satisfied by the applicant. In the case of conditions 1, 2 and 5, the applicant has fulfilled those conditions by submitting the required landscape plan and completing the off-site improvements and deleting the easement. The Board of Public Works has deferred the completion of the installation of on-site improvements and a final storm drainage system - conditions 3 and 4. 9. The Fire Department requires both access for fire equipment and installation of fire hydrants prior to the issuance of building permits for any of the proposed lots. 10. The Utility Department requires that easements for both water mains and sewer lines be shown on the final plat. A profile of the sewer plan is also needed. The dedication of the sewer easement must be shown on the final plat. c- FP-362-79 Page Two CONCLUSIONS: 1. The final plat, as submitted, appears to serve the public interest and the health, safety, and welfare of the general public. 2. The plat meets the goals and objectives of the Comprehensive Plans and is compatible with the M-P zoning of the subject parcel. The site will be compatible with the remaining development in the Orillia Industrial area. 3. The various requirements of the Fire and Utility Departments will be satisfied by conditioning the final approval upon satisfactory compliance of the conditions and therefore the final plat will meet the code and ordinance requirements. RECOMMENDATION: Based upon the record, findings and conclusions, the Examiner recommends that the City Council approve the final plat of Koll/Intereal Northwest; the Koll Final Plat, subject to the following conditions: 1. The installation of fire hydrants and the construction of adequate access subject to the approval of the Fire Department and the Public Works Department prior to the issuance of building permits. 2. HISTORY/BACKGROUND: The subject site was annexed into the City by Ordinance 1745 dated April 14, 1959. The site was rezoned to M-P, Manufacturing Park, on March 14, 1976, by Ordinance 3016. The site was part of a phased fill and grade permit issued on October 13, 1976. The sub- ject site was part of the Orillia Industrial Plat , the final plat of which was approved by the Examiner on August 25 , 1978. Site and Preliminary Plat approval were granted by the Examiner on January 19, 1979. D. PLANNING DEPARTMENT ANALYSIS : 1. Pursuant to the revision of the Subdivision Ordinance , no public hearing is required on this final plat . Hearing Examiner review and recommendation must be submitted to the City Council within 14 ,days of receipt of this report . 2 . The preliminary plat was approved subject to 5 conditions copy attached) . Conditions 1 and 2 have been fulfilled. Conditions 3 and 4 have been deferred by the Board of Public Works as of May 30 , 1979 and bond received on June 2 , 1979. Condition 5 has been deleted as required by the Examiner approval . 3. The Fire Department indicates that access and equipment must be installed and serviceable prior to building construction. PLANNING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER FINAL PLAT: KOLL/INTEREAL NORTHWEST, File No : FP-362-79 JULY 6 , 1979 4. The Utilities Engineering Division advises that all internal water main easements must be shown as part of the plat as well as the water main system as per the approved plan. Also, a sewer plan and profile is needed along with dedication of sewer easements. The plat is being revised to reflect these easements . 5. Traffic Engineering and Building had no further comments. E. DEPARTMENTAL RECOMMENDATIONS : J Based upon the foregoing analysis, recommend approval of the final plat subject to the following conditions : 1. Approval of on-site storm drainage plans , completion of off-site improvements and approval of on-site improvements as per Engineer- ing Division comment . 2. Installation of access and fire hydrants per Fire Department approval prior to the issuance of any building permits for structures. 3. Notation of all internal utility easements on the plat per the approved plan. 4. The submittal of a sewer plan and profile as per #4 of the analysis. 5. Completion of certifications per ordinance requirements prior to recording of the plat . ti 01.14. 266-78 Page Four to be of the conceptual character shown in Exhibit #2. 10. Off-site improvements will be installed either by the Local Improvement Districts ii. the area of by the applicant. Most of these improvements will be installed in the improvement of S.W. 43rd Street and Lind Avenue S.W. Pedestrian sidewalks and bicycle paths will be required in addition along these streets, S.W. 41st Street and the East Valley Road. 11. Approval is required of storm drainage plans by the Public Works Department. The applicant stated that storm water detention would be provided on the site. CONCLUSIONS: 1. The proposal conforms to the goals and objectives of the Comprehensive Plan and Land Use Map. 2. The proposal appears to serve the public interest, health, safety and welfare Section 9-1106. 2.E. (2) ) . 3. In order to conform to the requirements of the final plat of Orillia Industrial Park FP-176-78) a final landscape plan must be submitted to the Planning Department with the final plat application. This plan must meet the conditions imposed in the final plat. 4. Off-si:te improvements, stipulated by the Subdivision Ordinance and the final plat, will apparently be completed via a combination of LID's, the applicant or development of each lot. The Public Works and Planning Departments should be adequately assured that these improvements will be installed and should be provided with appropriate documentation by the applicant. 5. Staff 's concerns regarding the storm drainage plan seem alleviated by the applicant's testimony that on-site detention will be provided. This should be confirmed in the final storm drainage plan to be submitted to the Public Works Department for final approval prior to construction or development on the site. 6. Access for the lots in the plat appears adequate as each lot abuts a dedicated public street. A 20-foot access easement between Lots 2 and 3 is also proposed. But the subdivision specifically precludes private streets or alleys (Section 9-1108.24. (4) and (5) ) . This easement for vehicular access constitutes a private road, street or alley per ft.C.W. 36.75.020. (1) , (4) , (11) , (12) , and (14) ; and Section 9-1102.1 of the Subdivision Ordinance (see attached R.C.W. ) . Therefore, the 20-foot easement must be expanded to a 60-foot dedicated public street and/or cul-de-sac (Sections 9-1108.24. (3) or (6) ) or deleted from the plat (similar to the rest of the unspecified circulation system between the lots) . This conclusion is not without some difficulty encountered in existing city ordinances. These ordinances do not specifically and comfortably define a public street or roadway. An alley, however , is defined in Section 9-1102. 1.
