APPLICANT: Service Paper Company FILE NO. SP-388-79, SA-389-79 LOCATION: Northeast corner of Lind Avenue S.W. and S.W. 34th Street. SUMMARY OF REQUEST: Applicant seeks approval of a special permit for fill and grade of approximately 15,000 cubic yards together with site approval for a 100,000 square foot warehouse structure. SUMMARY OF ACPION: Planning Department Recommendation: Approval of special permit with conditions; Continuance of site approval hearing. Hearing Examiner Decision: Approval of special permit and site plan with conditions. PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on August 22, 1979. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on August 28, 1979, at 9:40 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Roger Blaylock, Associate Planner, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Site Plan as submitted Exhibit #3: Site Plan as amended by applicant with staff comments The Examiner inquired if a cross section diagram for fill material had been included with the application. Mr. Blaylock advised that detailed plans for filling, grading and drainage would be required prior to issuance of the building permit by the Public Works Department. Mr. Blaylock reviewed revisions to Exhibit #3 which include installation of meandering sidewalks and street tree plantings. He noted that because of difficulty in calculating dimensions of proposed parking spaces on submitted plans, the Planning Department recommends continuance of the public hearing until detailed site plans are submitted. The Examiner requested testimony by the applicant. Responding was: Lance Mueller 130 Lakeside Seattle, WA 98122 Mr. Mueller, architect for the applicant, advised that during the submittal process of previous applications, his firm had not been required to submit final landscape plans at this stage but had provided plans denoting the general intent of development. He indicated his understanding that a building permit could be issued subject to submittal of final landscaping plans and the site plan could also be approved on that basis. Mr. Mueller advised that three times the parking area required by the city can be provided on the site, and he suggested possible revisions to plans which include provision of additional parking along the south side of the proposed building adjacent to S.W. 34th Street and relocation of underground tanks. He assured the Examiner that parking requirements would be met and all landscaping and parking areas would be designated on the final plan to be submitted to the Building Division. Mr. Mueller concluded his testimony with a request for completion of the hearing in lieu of the recommendation by the Planning Department for continuance. SP-388-79 Page Two SA-389-79 The 'Examiner requested a completion date for the filling and grading project. Mr. Mueller advised that upon approval of the site plan, revision of the quantity of fill material would be equired as a result of a previous error in calculation, and the project would commence som time prior to the onset of inclement weather this year. The 'Examiner requested clarification of final elevations of the fill project. Mr. Mueller indicated that the finished floor of the building would be established at 21.8 feet from sea level, and final elevation of the grade would be four feet less or 17.8 feet. The Examiner requested testimony in support or opposition to the request. There was no response. He then requested final comments from the Planning Department. Mr. Blaylock advised the necessity of modification in the designation of natural and landscaped areas on proposed plans to preclude detrimental effects from an overgrowth of weeds at the southeast corner of the proposed building. Mr. Mueller indicated concurrence in the recommendation for modification of the plan. The Examiner stated that because the applicant has demonstrated a good faith attempt to meet city requirements, landscaping and parking details may be coordinated by the applicant and the Planning Department as a condition of approval of the request, if such approval is granted, and therefore, the hearing would not be continued. The Examiner requested final comments. Since there were none, the hearing on File No. SP-388-79 and SA-389-79 was closed by the Examiner at 10:04 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a special permit for filling and grading of approximately 25,000 cubic yards together with a site approval for a 100,000 square foot warehouse/ office structure. 2. The Planning Department report sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C.W. 43.21.C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-730 (M-P, Manufacturing Park) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The subject property is located at the northeast corner of S.W. 34rd Street and Lind Avenue S.W. 9. The property is zoned M-P (Manufacturing Park) . 10. The site has been previously surcharged under Special Permit 822-75 and is generally level. The applicant has requested a new special permit pursuant to Sections 4-722 (B) and 4-2303.1.B(2) to complete the filling and grading operation. The record indicated that the amount of fill is greater than the 15,000 cubic yards specified in the application but the exact amount is unspecified. The applicant asked for approval of some quantity not to exceed 25,000 cubic yards. 11. The applicant has also requested site approval under the provisions of Section 4-730.040(9) which requires site approval for all structures in an M-P zone. The applicant proposes to construct a 100,000 square foot warehouse and office structure. 12. The Planning Department indicated that the parking and landscape plans were insufficient for planning purposes and recommended a continuance. The applicant indicated that there was indeed more than sufficient space to provide the required parking. He also stated that the landscaping would be based on the tentative plans and would be Sr ....8-79 Page Three SA-389-79 implemented in accordance with Planning Department requirements. The tentative plans show generalized locations and species. The applicant indicated that they would plant trees from the Planning Department's recommended list of street trees and ground cover. 13. The grading and filling has eliminated all the natural vegetation but the applicant has indicated that natural type vegetation shall be replanted on the site in compliance with Fesolution No. 1923 (Maintenance of Wildlife Habitat) . CONCLUSIONS: Special Permit 1. The subject site has been the object of a previous fill and grading permit (Special Permit 822-75) . The approval of the application will permit the applicant to bring the property up to standards for development in the Green River flood area. 2. The completion of the fill and grade operation will not cause any further degradation to the area or the local environment. Approval will not harm the public welfare nor injure neighboring properties. 3. The proposed grading and filling will permit the use of the land in a manner that is compatible with the Comprehensive Plan and the Green River Valley Comprehensive Plan See Site Plan, next conclusion) . Site Plan 4. The applicant has submitted plans to construct a +100,000 square foot warehouse and office facility on the subject site after completion of the filling and grading. The proposal appears to be compatible with the other development occurring in the vicinity. The structure will be used for the storage and distribution of finished paper products. 5. The plans are also compatible with the zoning of the area which is M-P (Manufacturing Park) and the Comprehensive Plan and Green River Valley Comprehensive Plan designations of the area as suitable for use as manufacturing park. 6. The plans indicate that setbacks and landscaping will also meet the objectives of the Comprehensive Plan for the development of areas capable of supporting natural wildlife and vegetation. 7. The plan as submitted lacks final detail as to the type of landscaping which will be planted and in what manner and numbers. The plans also provide only the gross area which will serve as parking but lacks the required detail of individual stall and aisle designation and location. The applicant indicated that there will be more than sufficient area for the required parking and such parking requirements shall be a condition of approval. The applicant and the Planning Department will also be required to coordinate the landscaping of the subject site to meet the requirements of both the provisions of Section 4-730 and the Green River Valley Comprehensive Plan and Resolution No. 1923 Wildlife Habitat) . DECISION: The Special Permit is approved subject to the following: a. The maximum amount of fill shall not exceed 25,000 cubic yards; and b. The final plans for filling and grading shall be approved subject to approval of the Public Works Department. The Site Plan is approved subject to the following: a. The designation of each required parking space on the plans, and each space s}ia11 meet the minimum requirements of Chapter 22, Parking and loading Ordinance; b. Legal Description : A detailed legal description is available on file in the Renton Planning Department . 5. Size of Property : 4.4 acres 6. Access :Via SW 34th Street and Lind Avenue SW 7. HISTORY/BACKGROUND: The subject site was annexed into the City by Ordinance #1745 dated April 14, 1959. It was rezoned to M-P , Manufacturing Park by Ordinance #2992 dated October 8, 1975. The special permit to fill and grade was initially granted for certain phases on November 19, 1975, subsequent phases to complete the filling project were approved on October 13, 1976. A tentative plat for the subject industrial park was approved by the Planning Department on May 27, 1977 together with certain comments and proposed revisions to the plat. The property was surchanged under Special Permit 822-75. PLANNING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING: SERVICE PAPER COMPANY, File Nos : SP-388-79, SA-389-79 AUGUST 28, 1979 D. PHYSICAL BACKGROUND: 1. Topography : The site is relatively level. 2. Soils : Primary Urban Land (Ur) from the fill operation , soils information has been received from King County Conservation District of the Soil Conservation Service . The property has since been filled with a suitable granular material to a height acceptable to King County Hydraulics for flood proofing. 3. Vegetation : The sparse remaining vegetation consists of scrub grass. 4. Wildlife : The existing vegetation does not provide suitable wild' ife habitat although future landscaping may do so. 5. Water: No surface water was evidenced on the subject site . 6. Land Use : The subject site is undeveloped at this time . E. NEIGHBORHOOD CHARACTERISTICS : The subject site is located in a transitional area from undeveloped wetland to various industrial and commercial uses. F. PUBLIC SERVICES : 1. Water and Sewer: A 12" water main and 12" sanitary sewer run north-south on the E. Valley Road within 300 feet to the east of the subject site . A 24" water main extends north-south on Lind Avenue SW adjacent to the westerly boundary of the property. 2. Fire Protection : Provided by the Renton Fire Department per ordinance requirements. 3. Transit : Metro Transit Route #155 operates along S .W. 43rd Street within 3/4 of a mile to the south of the subject site . 4. Schools : N/A 5. APPLICABLE SECTIONS OF THE COMPREHENSIVE PLAN OR OTHER OFFICIAL CITY DOCUMENT: 1 . Comprehensive Plan, Green River Valley, June 1976, Goals and Objectives. I . IMPACT ON THE NATURAL OR HUMAN ENVIRONMENT: 1. Natural Systems : The soils on the site have been recently disturbed. Development of the site will increase storm water runoff and cause an increase in traffic and noise levels in the area. However, through proper development controls and procedures , these impacts can be mitigated. Population/Employment : The fill and grade permit will have no direct impact on employment . However, the development of the warehouse on the site will generate approximately 30-35 number of employees. 3. Schools : N/A 4. Social : N/A 5. Traffic: The proposed warehouse/office facility will generate approximately 750 additional vehicle trips per day for the ware- housing use (3. 68 trips/1 ,000 square feet + 374 trips) . J. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION : Pursuant to the City of Renton' s Environmental Ordinance and the State Environmental Policy Act of 1971 , as amended, RCW 43-21C, a declaration of non-significance has been issued for the proposed fill and warehouse development . Landscaping will buffer the visual impact of this large warehouse structure . K. AGENCIES/DEPARTMENTS CONTACTED: 1. City of Renton Building Division. 2. City of Renton Engineering Division . 3. The applicant proposes to place approximately 15,000 cubic yards of fill material to raise the building 5 . 3 feet in elevation from 16. 3 to 21 . 8 feet above sea level. 2. The applicant has not submitted a detailed cross section of the proposed fill on the property. Based on rough calculations , the 15, 000 cubic yards is only sufficient to raise the building pad. Additional fill will be necessary to grade the parking area up to the finished building elevation. If the entire site was filled above the flood level of 21 . 8 feet , approximately 25, 000 cubic yards of fill would be ncessary. M. DEPARTMENTAL RECOMMENDATIONS : (SPECIAL PERMIT) The staff recommends that the Hearing Examiner approve the Special Permit for filling and grading requested by Service Paper Company File Number SP-388-79 subject to the following conditions : 1 . That the maximum amount of fill shall not exceed 25, 000 cubic yards . 2 . That detailed plans for filling and grading be reviewed and approved by the Department of Public Works prior to issuance of a building permit . L. PLANNING DEPARTMENT ANALYSIS : (SITE APPROVAL) 1 . The applicant proposes to construct a ±100,000 square foot warehouse/office facility on a ±4. 4 acre site located at the northeast corner of Lind Avenue SW and SW 34th Street . The office portion will be ±4 ,500 square feet with the remaining warehousing for storage and distribution of finished paper products. 2. The proposed warehouse/office facility is consistent with the intent of the Manufacturing Park Zone , RMC 4-730, in respect to permitted uses , setbacks , landscaping and other requirements. lPNNING DEPARTMENT P ELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING: SERVICE PAPER COMPANY, File Nos : SP-388-79, SA-389-79 AUGUST 28, 1979 PAGE FOUR 3. The parking lot design appears to be inconsistent with the requirements of Section 4-22 of the Parking and Loading Ordinance . The site plan does not show the individual parking spaces or aisle width. A total of 89 parking spaces are provided; 88 spaces are required. However, 2 of those spaces are designated as compacts and the Renton Municipal Code does not address the question of compact parking spaces. 4. The site plan shows approximately 3,940 square feet of landscaping areas adjacent to the parking lot in addition to the required landscaping along the public rights-of-way. This complies with the requirement of RMC 4-2204. 8B(3) of the Parking and Loading Ordinance to landscape 5% of the parking area. 5. Ordinance #1923 requires that a minimum 2% of the total site be left in natural vegetation for wildlife habitat . However, the previous filling of the site has eliminated all natural vegetation. The site plan submitted suggests planting field grasses on the north side of the building to meet this requirement . This appears to provide a sufficient area for a wildlife habitat as intended; however, use of the area as a habitat is limited by the fact that the area must be left open to provide fire access. The selection of plant materials will ultimately determine if the natural area actually provides a suitable wildlife habitat . 6. The improvements on Lind Avenue South have not been completed at this time . The LID does not include the construction of the 5 ' wide sidewalks. Therefore , they should be required as a portion of in conjunction with the construction of the building. The improvements along SW 34th are presently under construction by Glacier Park Company. Attached are other departmental comments for your review. M. HISTORY/BACKGROUND: The subject site was annexed into the City by Ordinance #1745 dated April 14, 1959. It was rezoned to M-P, Manufacturing Park by Ordinance #2992 dated October 8, 1975. The special permit to fill and grade was initially granted for certain phases on November 19, 1975, subsequent phases to complete the filling project were approved on October 13, 1976. A tentative plat for the subject industrial park was approved by the Planning Department on May 27, 1977 together with certain comments and proposed revisions to the plat. PHYSICAL BACKGROUND: 1. Topography : The site is relatively level . 2 . Soils : Primary Urban Land (Ur) from the fill operation , soils information has been received from King County Conservation District of the Soil Conservation Service . The property has since been filled with a suitable granular material to a height acceptable to King County Hydraulics for flood proofing. 3. Vegetation : The sparse remaining vegetation consists of scrub grass. 4. Wildlife: The existing vegetation does not provide suitable wildlife habitat although future landscaping may do so. 5. Water : No surface water was evidenced on the subject site . 6. Land Use : The subject site is undeveloped at this time . E. NEIGHBORHOOD CHARACTERISTICS : The subject site is located in a transitional area from undeveloped wetland to various industrial and commercial uses. F. PUBLIC SERVICES : 1. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION: Pursuant to the City of Renton' s Environmental Ordinance and the State Environmental Policy Act of 1971 , as amended, RCW 43-21C, a declaration of non-significance has been issued for the proposed fill and warehouse development . The applicant proposes to place approximately 15,000 cubic yards of fill material to raise the building 5 . 3 feet in elevation from 16. 3 to 21. 8 feet above sea level . 2. The applicant has not submitted a detailed cross section of the proposed fill on the property. Based on rough calculations , the 15, 000 cubic yards is only sufficient to raise the building pad. Additional fill will be necessary to grade the parking area up to the finished building elevation. If the entire site was filled above the flood level of 21. 8 feet , approximately 25,000 cubic yards of fill would be ncessary. M. DEPARTMENTAL RECOMMENDATIONS : (SPECIAL PERMIT) The staff recommends that the Hearing Examiner approve the Special Permit for filling and grading requested by Service Paper Company File Number SP-388-79 subject to the following conditions : 1 . That the maximum amount of fill shall not exceed 25, 000 cubic yards. 2. That detailed plans for filling and grading be reviewed and approved by the Department of Public Works prior to issuance of a building permit . L. PLANNING DEPARTMENT ANALYSIS : (SITE APPROVAL) 1 . The applicant proposes to construct a ±100 ,000 square foot warehouse/office facility on a ±4. 4 acre site located at the northeast corner of Lind Avenue SW and SW 34th Street . The office portion will be ±4 ,500 square feet with the remaining warehousing for storage and distribution of finished paper products. 2. The proposed warehouse/office facility is consistent with the intent of the Manufacturing Park Zone , RMC 4-730, in respect to permitted uses , setbacks , landscaping and other requirements. The parking lot design appears to be inconsistent with the requirements of Section 4-22 of the Parking and Loading Ordinance . The site plan does not show the individual parking spaces or aisle width. A total of 89 parking spaces are provided; 88 spaces are required. However , 2 of those spaces are designated as compacts and the Renton Municipal Code does not address the question of compact parking spaces. 4. The site plan shows approximately 3,940 square feet of landscaping areas adjacent to the parking lot in addition to the required landscaping along the public rights-of-way. This complies with the requirement of RMC 4-2204. 8B(3) of the Parking and Loading Ordinance to landscape 5% of the parking area. 5. Ordinance #1923 requires that a minimum 2% of the total site be left in natural vegetation for wildlife habitat . However, the previous filling of the site has eliminated all natural vegetation. The site plan submitted suggests planting field grasses on the north side of the building to meet this requirement . This appears to provide a sufficient area for a wildlife habitat as intended; however, use of the area as a habitat is limited by the fact that the area must be left open to provide fire access. The selection of plant materials will ultimately determine if the natural area actually provides a suitable wildlife habitat . 6. The improvements on Lind Avenue South have not been completed at this time. The LID does not include the construction of the 5' wide sidewalks . Therefore , they should be required as a portion of iA conjunction with the construction of the building. The improvements along SW 34th are presently under construction by Glacier Park Company. Attached are other departmental comments for your review. M.
