SA-410-79 LOCATION: 300 Rainier Avenue North. SUMMARY OF RE4)UEST: The applicant requests site approval of a proposed 950 square foot addition to the existing Renton Chamber of Commerce structure. SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Approval with conditions. PLANNING DEPARTMENT The Planning Department preliminary report was received by REPORT: the Examiner on September 20, 1979. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on September 25, 1979 at 9:00 a.m. in the Council Chambers of the Renton Municiral Building. Parties wishirg to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Eepartment report, and the report was entered into the record as Exhibit #1. Roger Blaylock , Associate Planner, reviewed Exhibit #1, and entered the following additional exhibit into the record: Exhibit #2: Site Plan with staff comments Referencing Section L.2 of Exhibit #1, the Examiner noted that the proposed planting strip contains a width of from four to 24 feet, and inquired regarding the minimum width required by ordinance. Mr. Blaylock advised that the ordinance requires a width of five feet. The Examiner inquired if the applicant intends to comply with ordinance requirements for width. Mr. Blaylock advised that although compliance with landscaping requirements is required, a question exists regarding responsibility of two separate leases for the building site itself and the public parking lot to the south which is shared by the Chamber and Kiwanis Air Park. The Examiner requested testimony by the applicant. Responding was: Kay Johnson 300 Rainier Avenue N. Renton, WA 98055 Mr. Johnson clarified that although the parking lot is utilized by users of the park to the south, paving was accomplished by the Chamber, which holds the lease on the entire parking lot. The Examiner inquired if the applicant intends to comply with code requirements for the parking lot. Mr. Johnson indicated that the landscaping plan will be finalized when determination is made whether four large, deciduous trees can be successfully moved when building activity is commenced. The Examiner requested further testimony in support or opposition to the request. There was no response. He then requested final comments from the Planning Department. Since there were no further comments, the hearing regarding SA-410-79 was closed by the Examiner at 9:20 a.m. SA-410-79 Page Two FINDINGS, CCNCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a site plan for the expansion of an office building in a P-1 (Public) zone located at 300 Rainier Avenue North. 2. The Planning Department report sets forth the issues, applicable policies and provisions, findings of fact, and departmental recommendations in this matter, is uncontested, and is hereby attached as Exhibit #1 and incorporated in this report by reference as set forth in full therein. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C.W. 43.21.C. , as amended, the subject proposal has been determined exempt from the threshold determination by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-710 of Title IV, Ordinance No. 1628, Code of General Ordinancs. 8. The applicant, the Renton Chamber of Commerce, already occupies a structure on the subject property and proposes an extension on the south side of the present building. 9. The site is basically level. Lawn grasses and landscaping cover a large portion of the site. 10. The subject site is leased from the City of Renton. The site contains both the chamber :building and an accessory parking lot for 42 cars. 11. The applicant proposes to construct an addition to the existing building on the south side. Tie addition would eliminate three parking spaces. The 39 remaining parking spaces p.:ovide more than sufficient parking for the facility. Pursuant to Section 4-2208, :he chamber need provide only 16 parking spaces. 12. The subject site adjoins the Renton Municipal Airport which lies to the east, and the Kiwanis ;fir Park which lies to the south. The subject property is just east of heavily traveled Rainier Avenue North and north of Airpo:-t Way. 13. The proposed 950 square foot expansion will increase the present structure by about 47%. The applicant indicates that they will again landscape the site which is already well landscaped, although the parking strip along Rainier Avenue North narrows below the five fool: minimum requirement of the Parking and Loading Ordinance, Chapter 22. CONCLUSIONS: 1. The proposed plan satisfies the various zoning and parking requirements of the P-1 district and the Parking and Loading Ordinance. 2. The 950 square foot addition will not result in any injury to the general public or neighbor;.ng properties. The applicant indicated an intent to comply with the various landscape requirements and the structure appears to conform with the character of uses on surrounding property. DECISION: Exhibit #2 is approved subject to the installation of landscaping in compliance with the provisions of the codes and regulation of the City of Renton and approved by the Planning Department. The subject proposal is consistent with the Comprehensive Plan designation of Public/Quasi-Public and the Public Use zoning for the site and surrounding area. 2. The 25-foot building addition will require the elimination of 3 parking spaces. This will leave 39 parking spaces. The total building of 3,078 square feet would require 16 parking spaces. The parking lot has existed in its present state since constructed by the City in 1961 . The landscaping strip between the parking lot and Rainier Avenie North varies from 4 feet to 24 feet in width. Even though the existing planting area does not meet the ordinance requirement the average width is in excess of 14 feet . The Parking and Loading Ordinance 2787 became effective in 1973; therefore the parking was legally non-conforming at the time of construction . However, the proposed addition is approximately a 47% increase in the existing structures and this would require that all parking lot dimension including landscaping be complied with. 3. The existing building complies with setback requirements. The proposed addition also complies. M. SM; sh LEASE EXTENSION WHEREAS the City of Renton, a municipal corporation, and the Greater Renton Chamber of Commerce, a non-profit corporation, have previously entered into a certain Lease Agreement for a period extending through December 31, 1980, and WHEREAS the parties wish to extend that Lease Agreement for an additional 20 years under the same terms and conditions with the option to the Lessee to extend that lease for an additional 10 years with the rental for the additional 10 years to be renegotiated upon exercise of the option, and WHEREAS the Greater Renton Chamber of Commerce wishes to re- model and improve the present building, NOW THEREFORE THE CITY OF RENTON and the GREATER RENTON CHAMBER OF COMMERCE hereby agree to extend that certain Lease dated April 11, 1961 for a period of 20 years under the same terms and conditions as the prior lease with an option to Lessee to extend the lease for 10 additional years with rental to be renegotiated upon exercise of the option. The Act also requires that an EIS be prepared for all major acticns significantly affecting the quality of the environment. The purpose of this checklist is to help the agencies involved determine whether or not a proposal is such a major action. Please answer the following questions as completely as you can with the information presently available to you. Warren, City Attorney Re : Requirement for Public Hearing on Non-municipal structures Dear Dave : We have researched your Memo of August 28, 1979, received by this office August 31 , 1979. Section 4-710.3 deals with the requirements of review of a non- municipal improvement. That includes review of the required documents by the Hearing Examiner together with approval of the use. The review is supposed to be conducted under the dictates of Code Section 4-3010 (A) . 4-3010 states as follows : The Examiner shall receive and examine available information, conduct public hearings , prepare a record thereof and enter findings of fact and con- clusions based upon those facts , . . ." This Section is somewhat ambiguous as to whether or not the Examiner is required to do each and every one of those things . However, we believe it the best course to require the public hearing. If the City is going to err it should err on the side of full disclosure. Therefore, we would recommend that a public hearing be conducted. Clemens, Senior Planner Regarding: Requirement for public hearing review of non- municipal structures in the P-1 District In order to clarify our discussion of August 28, 1979 , we have further reviewed the Zoning Ordinance to determine the process for review of non-municipal structures in the P-i District . The particular use in question is the Chamber of Commerce Building which proposes an expansion. This use is apparently a non-municipal use, located on municipal property . Section 4-710-3 requires Hearing Examiner approval , but does not require specifically that such approval be in the forum of a public hearing. The past practice involving more than a dozen applications has been by Site Plan Approval by public hearing either by the Planning Commission or Hearing Examiner. We further reviewed the Hearing Examiner Ordinance which specifies under 4-3010 (A) that the Examiner shall review "site review applications" or "other land use regulatory permits" by conduct( ing) public hearings. This is .an unusual use in that it involves a non-municipal structure on municipal property, and as the ordinance is ambiguous , we would like your opinion on the proper course of review. As indicated above, the past practice has been by public hearing review and approval , but this particular instance has left the question unclear. 1 An early response would be appreciated. Thank you.
