You have expressed that you would prefer to file a three-year service contract with the City by extending the two-year contract you presently hold. This would appear to be a fair option in lieu of a $15 , 000 bond. Upon filing your contract with the City, we would be happy to grant our approval for the final inspection. The Bulk Storage Facilities Ordinance 4-734: (E) (3), pertaining to landscape maintenance and the requirement fcr a three-year service contract, is the only portion of the ordinance Superior has yet to comply with. b. Filing with the City Clerk of a copy of a three-year service contract would eliminate the requirement to post a $15,000 bond with the City Clerk. For informational purposes, Superior Fast Freight presently has a two-year contractual agreement with Evergreen Services Corporation, the landscaping service that did the original installation at our site. Additionally, with the completion of our maintenance facility, Phase II (total completion) of our landscaping requirements is presently being negotiated. Please ver fy the aforementioned items (paragraphs a and b) and notify me by letter f my understanding of the ordinance requirements is correct. The applicant is requesting a deferral of side- walk improvements on S.W. 29th Street. S.W. 29th Street is a cul-de-sac, which could have several other industries fronting on the property in the future. The street is constructed and grades have been established in that area. It is illogical that the applicant would wish to defer the improvement because in a two year period the cost could be substantially higher . From the City' s point of view, deferrals should be granted only in very limited cases. The question of timing of future develop- ment does not appear to be relevant. The City is presently in the position where it seems like only one individual or project holds up the completion of the off-site improvements. RECOMMENDATION: Denial of the request. RJ$: wr 4110. APPLICANT: Superior Fast Freight FILE NO. SA-452-79 LOCATION: Vicinity of 400 S.W. 34th Street. SUMMARY OF REQUEST: The applicant requests site approval for a truck and trailer mechanical maintenance facility in an M-P zone. SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Approval with conditions. PLANNING DEPARTMENT The Planning Department preliminary report was received by REPORT: the Examiner on January 4, 1980. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on January 8, 1980 at 9:45 a.m. in the Council Chambers of the Renton Munic:_pal Building. Parties wish:_ng to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report, and the report was entered into the record as Exhibit #1. Roger Blaylock, Associate Planner, reviewed Exhibit #1, and entered the following additional exhibits into the record: Exhibit #2: Site Plan (entire site) Exhibit #3: Building Elevations Responding to the Examiner's inquiry regarding commencement of construction on the site, Mr. Blaylock advised that a building permit has not yet been issued. He also noted a typographica=_ error in Section I.2, Population/Employment, of Exhibit #1, which states that the proposed building will contain 7,860 square feet, and corrected it to 7,680 square feet. The Examiner requested testimony by the applicant. Responding was: Bruce C. Olsen Consulting Engineer 1411 4th Avenue Seattle, WA 98101 Mr. Olsen advised that previously requested reduction of landscaping area in the first phase of development, File No. SA-202-78, is no longer being pursued and the applicant intends to conform to required landscaping conditions which establish the east buffer zone at a width of 10 feet. Mr. Blaylock indicated his opinion that the buffer area is currently less than 10 feet and should be measured to assure compliance. The Examiner referenced Section 4-730.030.3, Manufacturing Park District, of the Zoning Code, and inquired if the requirement has been met on the east property line which states that no building or structure shall be located closer than twenty (20) feet to any property line not abutting a street or highway. Mr. Olsen advised that the narrowest setback, containing 20 feet, exists on the west property line abutting the Burlington Northern railroad tracks. Referencing the Planning Department recommendation for bonding of all required improvements . in Phase I to be included as a condition of approval of the subject application, Mr. Olsen felt that installation of landscaping could occur during basic construction on the site, and requested permission to occupy the building prior to completion of the landscape project. Mr. Blaylock indicated concern regarding issuance of a temporary building permit in lieu of posting a bond. Responding to the applicant's inquiry regarding progress on the Phase I project, Mr. Blaylock advised that final inspection had been requested on December 17, SA-452-79 Page Two 19 9, comments from various city departments are being accumulated, and the Public Works De«artment should be contacted by the applicant regarding current status of final approval. Mr Olsen inquired if bonding would apply to the second proposed building. Mr. Blaylock indicated that Phase I approval had included landscaping proposals for the entire site in•luding the Phase II project. He noted that although the Building Division has au.hority to defer the landscaping provision until after occupancy of the building, the establishment of timing is the responsibility of the Board of Public Works and application should be made to that body. Mr. Olsen noted that because the second building impinges on the planting areas on two sides, installation of that portion of landscaping would not be possible until the building is nearing completion. Mr. Blaylock noted that the previous site plan had been approved by the Hearing Examiner and could not be modified beyond li ited substitution of comparable species material. The Examiner indicated that because the second phase of development impinges upon the previously approved first phase, it world be possible to permit the Planning Department to provide final approval of the landscaping plan for the second phase. Mr. Olsen noted that although the landscaping ar:a to the north of the new building has not been reduced, the roadway entry has been sh fted slightly to the east on 29th Street; however, no other changes have occurred in th • original site plan. Th- Examiner requested testimony in support or opposition to the application. There was no response. He then requested final comments from the Planning Department. Since there we e no further comments, the hearing regarding File No. SA-452-79 was closed by the Ex; iner at 10:07 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner no makes and enters the following: FI+ DINGS: 1. The request is for approval of a site plan for an additional 7,680 square foot building on a previously developed +6 acre parcel. 2. The Planning Department report sets forth the issues, applicable policies and provisions, and departmental recommendations in this matter, and is entered as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C.W. 43.21.C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by Gordon Y. Ericksen, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. Utility improvements are required by the Fire Department and the Public Works Department. 7. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-730 (M-P; Manufacturing Park) of Title IV, Ordinance No. 1628, Code of General Ordinances. 8. The subject property is located in the vicinity of the 400 block of S.W. 34th Street. The subject site is zoned M-P and pursuant to Section 4-730.040.9, the site plan must be approved by the Hearing Examiner. 9. The site is generally level. The applicant has previously constructed a terminal facility on the site and this large structure dominates the subject property. The proposed building will be 7,680 square feet and will lie on the northernmost portion of the subject property just south of S.W. 29th Street, The new structure will contain a truck and trailer maintenance facility. 10. The subject site was the subject of a site review when the existing facility was proposed and the applicant has not yet complied with the terms of the previous approval (SA-202-78) . These conditions applied to landscape and buffering of property boundaries. The applicant indicated that the new proposal will interfere to some extent with landscaping as previously approved because of on-going construction. 11. The applicant indicated that they have not reduced the perimeter landscaping which is required by Section 4-730.030.2. SA-452-79 Page Three 12. The Planning Department recommended that the exterior treatment of the proposed building snatch that of the existing building for consistency of design. CONCLUSIONS: 1. The proposed addition to the subject property is compatible with the M-P zoning of the subject site. The project is also compatible with the designation of the site for manufacturing type uses by the Comprehensive Plan and the Green River Valley Comprehensive Plan. 2. The applicant indicated that they intend to comply with the various landscape requirements of both the city ordinances and those imposed by the previous site approval (SA--202-78) ; this includes the perimeter landscaping on the north and east sides of the subject property. Installation of the required landscaping for both Phase I and this phase, Phase II, will be required and a bond will be required to assure compliance with these conditions. 3. The utility requirements and improvements shall be subject to approval by both the Fire and Public Works Departments. 4. In order to assure compliance with the goals and objectives of the Green River Comprehensive Plan, the exterior treatment of the new facility should be compatible with the existing facility. The Planning Department should be contacted and that department's approval will be required to assure compliance. DECISION: Exhibit #2 is approved subject to: 1. The installation of landscaping subject to the approval of the Planning Department and the posting of a bond in the amount of 150% of the amount of such installation incomplete at the time of final inspection and prior to issuance of an occupancy permit. 2. Approval of the Public Works and Fire Departments of required utility improvements. 3. Approval by the Planning Department of the exterior treatment of the proposal. 4.
