The applicant' s request is to install the waterline at the time of construc- tion on the southern portion of the lot. Unfortunately, fire protection is not an item over wh.ich the Board of Public Works has authority to defer. The Uniform Fire Code requires specific things, and it would be possible that the Board could be considered liable if anything happened to anyone as a result of a deferral of fire protection. SA-054-80 LOCATION: Vicinity of 1702 Duvall Avenue N.E. SUMMARY OF REQUEST: The applicant requests site approval for conversion of a portion of an existing single family residence to dental clinic use. SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Approval with conditions. PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Hearing Examiner on July 11 , 1980. PUBLIC HEARING: After reviewing the Planning Department report, examining available. information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on July 15, 1980 at 9:05 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report. Steve Munson, Planning Department, reviewed the report, and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: Site Plan as submitted Exhibit #3: Site Plan with staff comments Exhibit #4: Vicinity Map Referencing Section L.6 of the report, which refers to the requirement for a lot line adjustment on the subject site, the Examiner requested further clarification of the matter. Utilizing Exhibit #3, Mr. Munson explained the purpose of the adjustment due to location of the existing building, and the requirement to meet required side yard setbacks of five feet. He noted that the lot line will be extended easterly approximately 12 feet which will establish the property line approximately three feet from the existing garage. Mr. Munson advised that the applicant is aware of the requirement, and the Planning Department anticipates that the adjustment can be satisfactorily accomplished. The Examiner requested testimony by the applicant. Responding was: Shannon O'Neil 2259 70th S.E. Mercer Island , WA 98040 Mr. O'Neil indicated -concurrence in the recommendations contained in the staff report. Responding to the Examiner's inquiry regarding the applicant 's willingness to connect to the sewer line, Mr. O'Neil advised that the entire parcel will be developed under the Planned Unit Development process, and connection to sewer lines will occur upon completion of those facilities and formation of an LID in the area. Mr. O'Neil objected to the requirement contained in Section M.4 of the report which requires site plan approval by the Hearing Examiner upon any further remodeling or reuse of the structure on the subject site, and felt that the requirement would be unnecessary if the clinic use is expanded in the future within the existing residence. The Examiner noted that the existing structure will be serving both as a residence and a dental clinic, and inquired if sufficient parking area exists on site for both uses. Mr. _ Munson responded affirmatively. The Examiner requested testimony in support or opposition to the application. There was a\ SA. 1-80 Page Two no response. He then invited final comments from the Planning Department staff. Since there were no further comments offered, the hearing regarding File No. SA-054-80 was closed by the Examiner at 9:25 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The request is for approval of site plans for a conversion of part of an existing single family dwelling to a dental clinic. 2. The application file containing the application, SEPA documentation, the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. The proposal is compatible with the required setbacks, lot coverage and height requirements of Section 4-711 (B-1 ; Business/Commercial ) of Title IV, Ordinance No. 1628, Code of General Ordinances. 7. The subject site is located in the vicinity of 1702 Duvall Avenue N.E. just north of Sunset Boulevard N.E. 8. The site was rezoned from G (General ; Single Family Residential ; Minimum lot size - 35,000 square feet) to B-i in March of 1980. 9. The site slopes downward slightly from the northwest to the southeast. Most of the site is graded and cleared with some existing conifers along the northern end of the site. An existing single family dwelling is located on the northern portion of the site. 10. There are a number of residential uses in the area surrounding the subject site. There are commercial uses located along Sunset Boulevard and some large areas which still remain undeveloped. Because of the single family uses in the area, the rezone was conditioned upon site plan approval of uses proposed for this site. 11 . The applicant proposes converting approximately 800 square feet of the existing single family dwelling to a dental clinic. The dental clinic requires four parking spaces and the applicant proposed providing seven spaces. 12. The conversion will be required to meet existing building code requirements for the proposed use and the property will have to be connected to the sewer system. In addition, the fire and storm drainage requirements must be met. 13. The Planning Department indicated that the proposed use should be effectively screened from the nearby single family uses. CONCLUSIONS: 1 . The plans as submitted appear to permit the effective reuse of at least a portion of an existing single family home for a dental clinic. This intended use is consistent with both the zoning of the parcel , B-1 , and the uses indicated by the Comprehensive Plan for this area, commercial . 2. The existing trees on the site will afford some measure of buffering for the neighboring single family homes, but subject to approval of the Planning Department, additional landscaping should be provided west, north and east of the proposed use. 3. Par.king for the clinic should be directed away from the portion of the building still maintained for residential purposes. DECISION: Exhibit #2 is approved subject to additional landscaping plantings along the west , north and east property lines surrounding the proposed use. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting other specified requirements. Perme- ability is moderately rapid in the surface layer and subsoil and very slow in the substratum . Run- off is slow to moderate , and the erosion hazard is moderate . This soil is used for timber , pasture , berries , row crops , and for urban development . Water and Sewer : An 12" water main is located on Duvall Avenue N .E . adjacent to the westerly boundary of the subject site , while another 12" main extends east of the intersection of Duvall and Sunset Blvd. N .E. on the north site of Sunset . The applicant proposes to convert approximately 800 square feet of an existing single family residence into a dental practice facility. The total parking requirement for this use is 4 spaces . As submitted , the site plan provides 7 spaces , which meets the Parking and Loading Ordinance requirements for dimensions and maneuverability . 2 . The Building Division advises that the existing structure will have to meet the building code for a new office building . In addition , the facility will be required to connect to a sewer . 3 . Oil/water separation in the storm sewer system must be provided as per Engineering Division . comment . See other comments regarding sewage . 4 . The utilities Engineering Division indicates that a sewer connection will be required for the existing building . 5 . A portable fire extinguisher to be serviced _annually must be provided as per Fire Department comment . The present building must also meet Uniform Fire Code requirements for occupancy type . 6 . A lot line adjustment (LLA-013-80) of the subject site has been filed with the Planning Department . Approval of the propoed realignment of this property should be made a condition of the recommendation for this application . PLANNING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING - JULY 15, 1980 SHANNON O 'NEIL , SA-054-80 PAGE FOUR 7 . The rezone approval (R-456-79 ) was subject to the dedication of a 10-foot wide landscape easement along the east , north, and northern 325 feet of the west property line of the rezone site .. The natural vegetation within the subject site appears to be appropriate to meet the intent of this require- ment . Additional vegetation should be planted in this 10-foot buffer subject to the approval of landscaping plans by the Planning Department prior to the issuance of a building permit . 8 . The_ remodeling of a portion of the single family residence into a dental clinic would appear to be only a temporary use . As the professional dental practice expands , there will be the tendency to convert the rest of the structure into offices or expand the clinic . Any expansion would warrant a new public hearing of the site plan before the Hearing Examiner . 9 . The property to the south of the subject site was rezoned under the same application, file number R-456-79 , in January of 1980 . However , under the conditions imposed no landscape screening was required . Until the time that the subject structure is completely used for a commercial use , the residential use on the subject site should be pro- tected from more intensive commercial uses to the south . A 5-foot wide landscaping buffer should be placed along the southern boundary of the subject site. M. DEPARTMENTAL RECOMMENDATIONS : Based upon the above analysis , recommend approval of the site plan subject to : 1. Satisfaction of items L .2-L .5 . 2 . Satisfactory resolution of the lot line adjustment request as per L.6 . 3. Submission and approval of landscaping plans by the Planning Department prior to the issuance of the building permit . 4.
