OFFICE OF THE LAND USE HEARING EXAMINER
CITY OF RENTON
REPORT AND DECISION,
APPLICANT: C. G. Mirante Construction Company FILE NO. SA-103-80
LOCATION: Vicinity of 519 S.W. 12th Street.
SUMMARY OF REQUEST: The applicant requests site approval for a +2500 square foot
building to be used as a light assembly and storage facility
for a cabinet contractor.
SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions.
Hearing Examiner Decision: Approval with conditions.
PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on November 25, 1980.
PUBLIC HEARING: After reviewing the Planning Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on December 2, 1980 at 9:00 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed the
Planning Department report. Steve Munson, Planning Department, presented the report, and
entered the following exhibits into the record:

Exhibit #2: Site Plan with staff comments
The Examiner requested testimony by the applicant. Responding was:

Mr. Brown indicated concurrence in the report, but requested clarification of Engineering
Division requirements to improve the alley a distance of 90 feet from the subject site to
Seneca Avenue S.W. since the property abuts only 60 feet of the alley. He also inquired
regarding the duration of the site approval in the event the applicant elects to delay
development. The Examiner referenced Section 4-3014 which .specifies a two year period
prior to expiration of the site approval , with an extension allowed through request to
the Examiner for good cause shown.
Mr. Brown also questioned the 42-inch height limitation on fencing in the front yard
setback referenced in Section L. 11 of the staff report. Mr. Blaylock discussed
provisions of the ordinance which specify a height limitation which can be increased
only of storage facilities are proposed or if no doors exist on that side of the building.
Mr. Brown stated his opinion that since landscaping was not required on the westerly side
of the building in the previously executed restrictive covenants and the landscaping would
be adjacent to a warehouse building wall , it would be less expensive to erect a six foot
fence, at least on that portion of the site not in the front yard setback, than providing
five feet of landscaping and a 42-inch fence. The Examiner noted the applicant 's option
to apply for a variance if criteria for such application can be satisfied.
Responding to Mr. Brown's inquiry regarding improvement of the alleyway, Mr. Blaylock
noted that the requirement had been imposed because one of the required parking spaces
is proposed off of the alley and will require access to the public right-of-way. Mr.
Brown inquired if the applicant can recoup some of the expense of that improvement when
remaining properties are developed in the near future. The Examiner indicated uncertainty
regarding latecomers fees for access improvements, and suggested that the Planning
Department could research the matter. He also noted that if no legislation currently
exists regarding the matter, a .revision to the ordinance could be proposed to the City

Council .
The Examiner requested further testimony in support or opposition to the application.
There was no response. Mr. Brown inquired regarding waiving the applicant 's fencing
requirement if adjacent property to the west was developed prior to the applicant's
proposal and fencing was required through site approval . The Examiner stated his
opinion that either party could erect a fence on his own property or a single fence
could be installed on the boundary line with expenses shared through a joint agreement.
The Examiner requested final comments. Since there were none, the hearing regarding
File No. SA-103-80 was closed by the Examiner at 9:22 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1 . The request is for site plan approval of a light assembly and storage facility.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton' s Environmental Ordinance and the State Environmental
Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance
has been issued for the subject proposal by the Environmental Review Committee,
responsible official .
4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. All existing utilities are available and in close proximity.
6. The subject property is located at 519 S.W. 12th Street between Seneca Avenue S.W.
and Lind Avenue S.W. The parcel is 60 feet wide by 100 feet deep, or 6,000 square
feet in area.
7. An existing single family home located on the property will be incorporated into the
new facility which will be approximately 2,500 square feet in area.
8. The applicant intends to provide three (3) parking spaces on site as required by
the Parking and Loading Ordinance (Section 4-2208(3) (A)) . If the applicant were
to conduct sales from this facility additional parking space would be required.
The Planning Department indicated that the three parking spaces are probably
insufficient.
9. The zoning to the east i.s G-6000 (General ; Single Family Residential ; Minimum lot
size - 6,000 square feet) . The subject property and properties to the west and
south are zoned L-1 (Light Industry) .
10. The rezone of the subject property to L-1 required site review by the Examiner and
provision of a 20-foot setback along the north or front property line and a 10-foot
setback along both the east and west property lines. Further, no outside storage
was permitted outside of the building envelope and then only within a view obscuring
fence.
11 . Pursuant to Section 4-2205, all loading and unloading must take place within the
confines of the subject site and no part of any loading or unloading may take place
on any public street or alley nor may any portion of any vehicle used in such
operations project onto any public street or alley. The plans indicated loading
space will be provided along the front of the planned facility.
12. On-site storm water retention and detention is required for the subject proposal .
13. The applicant proposes erecting a six foot view obscuring fence on the western
boundary of the subject property. Section 4-717(C) provides that no fence bounding
a front yard along the front or side property lines may exceed 42 inches in height.
14. The Building Department indicated that fire doors are required on the proposed
structure if the rear wall is located immediately adjacent to the alley. If a
setback of two feet is observed, the fire doors would not be required (Table 5A
of the Uniform Building Code, as amended) .
15. The alley to the rear of the subject property must be improved pursuant to Ordinance
3214, as amended.

16. The Traffic Engineering Division has. indicated that a fee of $20.00 per vehicle
trip per day is required and the subject property will generate approximately 14
trips per day.
17. The applicant submitted conceptual landscape plans for the subject proposal .
CONCLUSIONS:
1 . The proposed site plan appears to be compatible with the goals of the Comprehensive
Plan. The proposal provides landscaping and setbacks similar to that required of
manufacturing park types of development, the type of use designated for this area
in the Comprehensive Plan.
2. The proposal must comply with the general construction and building codes of the
City of Renton including the Building and Fire Codes and the Storm Drainage
Ordinance.
3. The proposed fence may not exceed 42 inches along either the front property line
or along those portions of the side property lines which bound the front yard.
Since the front yard is 20 feet deep, the fence may exceed the 42-inch limit rear
of the front yard setback. The applicant may apply for a variance pursuant to
Section 4-722(G) (1 ) if the criteria enumerated in that subsection can be
demonstrated by the applicant.
4. A specific landscaping plan will have to be submitted and reviewed and approved
when tFe applicant applies for the building permit.
5. The site approval process, unlike the Subdivision Ordinance, does not permit the
Examiner nor the city to impose a general fee for the improvement of the various
traffic ways in. the vicinity of a subject proposal . Therefore the $20.00 fee
imposed for each trip generated does not appear to be a permissible condition of
site plan approval . The imposition of such a fee during site plan review would
unfairly impose costs on only those whose properties require Hearing Examiner
review: This decision in no way affects the ability of the city to collect such
fees under other provisions of the codes, ordinances and regulations of the city
which allow for such collection.
DECISION:
The proposed site plan is approved subject to:
1 . Submission of and review and approval of specific landscape plans.
2. Modification of the screening fence to comply with the provisions of Section 4-717(A) .

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before December 23, 1980. Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact, error in
judgment, or the discovery of new evidence which could not be reasonably available at the
prior hearing may make a written request for review by the Examiner within fourteen (14)
days from the date of the Examiner's decision. This request shall set forth the specific
errors relied upon by such appellant, and the Examiner may, after review of the record,
take further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection in
the Finance Department, first floor of City Hall , or same may be purchased at cost in said
department.

The subject site was annexed into the City by Ordinance
1745 of April 14, 1959 and zoned G-6000 at that time.
It was rezoned to L-1 by Ordinance #3482 of November
12, 1980 , with restrictive covenant requiring site plan

D PHYSICAL BACKGROUND:
1 . Topography : The site is basically level .
2 . Soils : Urban Land (Ur) . This soil is land that
has beeen modified by disturbance of the natural
layers with the addition of fill up to several feet
thick to accommodate industry or housing.
3. Vegetation : The natural vegetation was removed
from the site with the construction of the single
family residence.
4. Wildlife : Existing vegetation on the site may .
provide some habitat for birds and small mammals.
5 . Water : No surface water was observed at the time
of on-site inspection on September 12, 1980.
6. Land Use : An older single family residence presently.
occupies the site .
E ; NEIGHBORHOOD CHARACTERISTICS :
The surrounding properties consist of older single family
residences and developing commercial and light industrial
facilities.
F. PIUBLIC SERVICES:
1 . Water and Sewer : An 8" sanitary sewer is located
adjacent to the southerly border of the subject
site while 6" water mains extend north-south on
Seneca Avenue S .W. and east-west on S.W. 12th Street .
2 . Fire Protection : Provided by the Renton. Fire
Department as per ordinance requirements.
3. Transit : Metro Transit Route #145 operates along
S .W. Grady Way within 500 feet to the north of
the subject site while Route #150 runs along Rainier
Avenue South within 1/4 mile to the east .

J . ENVIRONMENTAL ASSESSMENT/THRESHOLD TETE(RIMINIATI®IM:
Pursuant to the City of Renton 's Environmental Ordinance
and the State Environmental Policy . Act of 1971 , as amended,
RCW 43-21C , a declaration of non-significance was issued
for the subject proposal on November 129 1980 by the
ERC .

L . PLANNING DEPARTMENT ANALYSIS:
1. The proposed use is for a building to be used as
a light assembly and storage facility for a cabinet
contractor and can be considered a permitted use
within the L-1 zone . .
2 . In the rezone approval of November 12, 1980 , the
Hearing Examiner attached the following conditions :
1 ) Provision of a 20-foot setback along the north
property line of which the northern 10 feet
is to be landscaped.
2) - Provision of 10-foot setbacks along both the
east and west property line.
3) No outside storage unless contained within
view obscurring fences and then only within
the building envelope permitted by the Zoning
Code .
Staff review of the submitted site plan indicates
that all of the above conditions have been complied
with.
3 . Eventhough three parking spaces are provided as
required per Section 4-2208 (3)A of the Parking
and Loading Ordinance, it is estimated that more
than three people will be employed in the business .
4. The site plan also indicates a 5 ' wide landscaping
strip along the easterly property line as required
by Section 4-2204 8B-1 of the Parking & Loading
Oridnance.
5 . All other requirements of the L-1 zone appear to
have been complied with (Section 4-712) .
6 . The Engineering Division of the Public Works Dept .
advises that on-site storm water retention/detention
and off-site improvements along S .W. 12th Street
will be required . It is also urged that the site
frontage along the alley on the southerly portion
of the property line be improved unless a waiver
iQ ranuirpd (see comments) .

proposed structure adjacent to the alley unless
the building is moved two feet northerly as indicated
by the Building Division .
10 . The Traffic Engineering Division recommends the
assessment of a $20 roadway improvement fee per
average daily trip generated (14 trips x $20
280) .
11 . A six foot high fence is proposed along the western
property line . This would conflict with the 42"
maximum Section 4-717A) heighih in a front yard.
Since no doors are anticipated on the west side
of the building, landscaping could be placed between
the fence and the building. The building should
be screened by a combination of landscaping and
a . 42" high fence.
12 . The conceptual landscape plan as submitted appears
to meet the intent of the Parking . & Loading . Ordinance.
However , details of size , spacing, quantity , and
type need to be more clearly addressed. A specific
plan will have to be submitted with plans for a
building permit and Planning Department approval
will be necessary .
M. DEPARTMENTAL RECOMMENDATIONS:
Based upon the foregoing analysis, recommend approval
of the proposed site plan; subject to : Satisfaction
of items L-6 through L-11.

COMMENTS-:
Introduction The State Environmental Policy Act of. 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
Please answer the following questions as completely as you can with the information
presently available to you. Where explanations-of your answers are required, or where
you believe an explanation would be helpful to government decision makers , include your
explanation in the space provided, or use additional pages if necessary. You should
include references to any reports or studies of which you are aware and which are rele-
vant to the answers you provide: Complete answers to these questions now will help all
agencies involved with your proposal to undertake the required environmental , review with-
out unnecessary delay.
The following questions apply to your total proposal , not just to the license for which
you are currently applying or the proposal for which approval is sought. Your answers
should include the impacts which will be caused by your proposal when it is completed,
even though completion may not occur until sometime 'in the future. This will allow all
of the agencies which will be involved to complete their environmental review now, with-
out duplicating paperwork in the future. '
NOTE: This is a standard form being used by all state and local agencies in the State
of Washington for various types of proposals. Many of the questions may not apply to
