REPORT AND DECISION.
APPLICANT: Brad Cunningham FILE NO. SA-113-80,

LOCATION: Northeast corner of Lind Avenue S.W. and S.W. 41st Street.
SUMMARY OF REQUEST: The applicant seeks site plan approval to construct a +59,800
square foot addition to an existing warehouse and a variance to
eliminate the five percent interior landscaping requirement.
SUMMARY OF ACTION: Planning Department Recommendation: Approval of site plan;
dismissal of variance.

PLANNING DEPARTMENT The Planning Department preliminary report was received by the
REPORT: Examiner on December 24, 1980.
PUBLIC HEARING: After reviewing the Planning. Department report, examining
available information on file with the application, and field
checking the property and surrounding area, the Examiner
conducted a public hearing on the subject as follows:
The hearing was opened on December 30, 1980 at 9:05 a.m. in the Council Chambers of the
Renton Municipal Building.
Parties wishing to testify were affirmed by the Examiner.
It was reported that the Hearing Examiner and the applicant had received and reviewed
the Planning Department report.' Roger Blaylock, Associate Planner, presented the report,
and entered the following exhibits into the record:

report and other pertinent documents
Exhibit #2: Site Plan with staff comments
The Examiner noted for the record that a variance application was no longer necessary
due to provision of additional landscaping in the proposal . He then requested testimony
by the applicant. Responding was:

Mr. Sconzo indicated concurrence in recommendations contained in the Planning Department
staff report. The Examiner requested further testimony in support or opposition to the
application. Since there was no response, the hearing regarding File No. SA-113-80 was
closed by the Examiner at 9:15 a.m.
FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner
now makes and enters the following:
FINDINGS:
1 . The request is for approval of a site plan for an approximately 60,000 square foot
addition to an existing warehouse. A variance originally thought necessary is
unnecessary and that application has been dismissed.
2. The application file containing the application, SEPA documentation, the Planning
Department report, and other pertinent documents was entered into the record as
Exhibit #1 .
3. Pursuant to the City of Renton's Environmental Ordinance and the State Environmental
Policy Act of 1971 ,' R.C.W. 43..21 .C. , as amended, a Declaration of Non-Significance
has been issued for the subject proposal by the Environmental Review Committee,
responsible official .

4. Plans for the proposal have been reviewed by all city departments affected by the
impact of this development.
5. There was no opposition to the proposal expressed.
6. All existing utilities are available and in close proximity.
7. The proposal is compatible with the required setbacks, lot coverage and height
requirements of Section 4-730 (M-P; Manufacturing Park) of Title IV, Ordinance No.
1628, Code of General Ordinances.
8. The subject site is located on the northeast corner of Lind Avenue S.W. and S.W.
41st Street. The subject parcel is approximately 215,000 square feet in area.
9. The subject site is zoned M-P and the Comprehensive Plan and the Green River Valley
Comprehensive Plan designate the area in which the subject property is located as
suitable for the development of manufacturing types of uses.
10. The site is located in the Orillia Industrial Plat and a prior site approval permitted
the construction of an approximately 71 ,000 square foot office/warehouse/training
facility on the subject site. The addition will result in a +131 ,000 square foot
building.
11 . The applicant proposes to provide 42 parking spaces for the facility, two more than
are required.
12. The Hearing Examiner is not authorized to require the payment of fees related to the
level of traffic generated by a proposal during site plan review.
13. The landscape plan includes about 5.28% internal landscaping and the code requires 5%.
14. The area surrounding the subject site is a mix of undeveloped land and manufacturing/
industrial uses.
CONCLUSIONS:
1 . The subject proposal which will enable the expansion of an existing facility appears
to serve the public use and interest. The expansion will almost double the floor
space of the facility while complying with the requirements of the M-P zone. The
structure will be used for warehousing and office space.
2. The structure will be compatible with the goals of the.Comprehensive Plan and the
Green River Valley Comprehensive Plan. The facility will be landscaped and loading
facilities will be off-street and will not interfere with on-site parking.
3. The proposed expansion is compatible with the existing development and the probable
uses which can be developed in this M-P zone.
4. The development will increase the tax base of the city and provide further employment
opportunities in the city.
DECISION:
Approval of site plan; dismissal of variance.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must
be filed in writing on or before January 14, 1581 . Any aggrieved person feeling that the
decision of the Examiner is based on erroneous procedure, errors of law or fact , error in
judgment, or the discovery of new evidence which could not be reasonably available at the
prior hearing may make a written request for review by the Examiner within fourteen (14)
days from the date of the Examiner's decision. This request shall set forth the specific
errors relied upon by such appellant, and the Examiner may, after review of the record,
take further action as he deems proper.
An appeal to the City. Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting
other specified. requirements. Copies of this ordinance are available for inspection in
the Finance Department, first floor of City Hall , or same may be purchased at cost in
said department.

The subject site was annexed into the City of Renton
by Ordinance #1745 on April 14 , 1959 which was amended
by Ordinance #1764 on May 27 , 1959 and Ordinance #1928
on December 22 , 1961 . It was rezoned from "G" , General
Classification District to M-P, Manufacturing Park District
on December 24 , 1969 by Ordinance #2533. The site was
part of the Orillia Industrial Plat. The final plat
was approved by the Hearing Examiner on August 25 , 1978.
Site approval for an office/distribution and training
center was granted by the Hearing Examiner on November
14 , 1980.

1. Topography: The site is essentially level.
2. Soils : Snohomish Silt Loam (So) . Permeability
is moderate in the upper part of the profile and
moderately rapid in the lower part. There is a
seasonal high water table at or near the surface.
Runoff is slow, and the erosion hazard is slight.
This soil is used for row crops , pasture, and hay.
Urban Land (Ur) . Urban land soil that has been
modified by disturbance of the natural layers with
the addition of fill up to several feet thick to
accommodate industry or housing.
3. Vegetation: Virtually all vegetation has been
eliminated duer to the previous filling and grading
of the subject site.
4 . Wildlife: The existing conditions on the site
do not provide suitable wildlife habitat.
5. Water : No surface water was observed on the subject
site (December 19 , 1980) .
6. Land Use: An office/distribution and training
center presently occupy a portion of the subject
site. Properties to the north and east are undeveloped.
To the south is the Koll Business Park and to the
west and southwest the Benaroya Industrial Park.

1 . Natural Systems : The proposed development will
disturb the soils , remove the vegetation, increase
storm water runoff , and have an effect on traffic
and noise levels on the area. However, through
proper development controls and procedures, the
impacts can be mitigated.

testing/office facility (+70,800 square feet) to
be used for storage.

5. Assessment for the' City ° s future transportation
improvements to accommodate new development •will
total $6,000 for the subject proposal as determined
by the Traffic Engineering Division.
6. On December 18, 1980 the applicant submitted an
additional site plan indicating that the 5% interior
landscaping requirement can be met with the proposed
layout. Staff review confirms this. Therefore,
the variance request is unnecessary and it may
be appropriate for the Examiner to dismiss it.
7. Additional comments of other departments are attached
for consideration,

of the request subject to satisfaction of items L-4
and L-5.
It is also recommended that the Variance application
be dismissed since it appears unnecessary.

IN ORDER TO FULLY DEVELOP THE SUBJECT PROPERTY, INCLUDING
THE REQUIRED PARKING AND MANUEVERING AREA, THE 5% LANDSCAPING
REQUIREMENT IS EXCESSIVE.
ATTEMPTS HAVE BEEN MADE TO INTERRUPT THE BARENESS EXPANSE OF
THE PARKING/MANUEVERING AREA BY PROVIDING LANDSCAPING ISLANDS
AT ALL DRIVEWAY LOCATIONS. HOWEVER, THIS IS LESS THAN THE 5%
REQUIRED BY CODE TO PROVIDE ADDITIONAL INTERIOR LANDSCAPING
BEDS WOULD REDUCE THE VISIBILITY FOR TRUCK DRIVERS AND ELIMINATE
REQUIRED PARKING STALLS.
ADDITIONALLY, TO MAINTAIN THE SAME BUILDING LINES, AS THEY
CURRENTLY EXIST., THE PARKING/MANUEVERING AREA MUST ALSO
CONTINUE AS A NATURAL EXTENSION OF THE EXISTING LOT. THIS
EXTENSION IS NECESSARY TO MAINTAIN A CONTINUOUS, UNINTERRUPTED

RE:MERCURY MARINE FINAL INSPECTION
The Planning Department has received additional plans for
the expansion of Mercury Marine which would preclude compliance
with the requirements for a screening fence and landscaping
to the east of the existing building. The public hearing
has tentatively been seet .for December 30th; however, it
is unknown when the actual construction will begin. The
Planning Department has no objection to allowing a final
certificate of occupancy to be issued subject to posting
of a $1,000 bond to assure compliance with a screening fence
and additional landscaping if Phase 2 is not approved or
if it is not built. We would therefore request that the
Builing Department proceed with securing the appropriate
bonds and any other procedural requirements for final occupancy.

COMMENTS:
Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental values both for their
own actions and when licensing private proposals . The Act also requires that an EIS be
prepared for all major actions significantly affecting the quality of the environment.
The purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
Please answer the following questions as completely as you can with the information
presently available to you. Where explanations of your answers are required, or where
you believe an explanation would be helpful to government decision makers , include your
explanation in the space provided, or use additional pages if necessary. You should
include references to any reports or studies of which you are aware and which are rele-
vant to the answers you provide. Complete answers to these questions now will help all
agencies involved with your proposal to undertake the required environmental review with-
out unnecessary delay.
The following questions apply to your total proposal , not just to the license for which
you are currently applying or the proposal for which approval is sought. Your answers
should include the impacts which will be caused by your proposal when it is completed,
even though completion may not occur until sometime in the future. This will allow all
of the agencies which will be involved to complete their environmental review now, with-
out duplicating paperwork in the future.
NOTE: This is a standard form being used by all state and local agencies in the State

II. PREPARATION OF APPLICATION: Print legibly or type answer to each question.

MEN,T. PLEASE KEEP IN GOOD ORDER. The affidavits must be signed before a

VII. JUSTIFICATION: The Hearing Examiner must find after conducting the public
hearing that the following conditions specified below have been found to
exist:
a) That the applicant suffers undue hardship and the variance is necessary
because of special circumstances applicable to subject property, including
size, shape, topography, locations or surroundings of the subject property,
and the strict application of the Zoning Code is found to deprive subject
property owner of rights and privileges enjoyed by other property owners
in the vicinity and under identical zone classification.
b) That the granting of the variance will not be materially detrimental to
the public welfare or injurious to the property or improvements in the
