Shinpoch, Mayor and Members of the Renton City Council Municipal Building Renton, WA 98055 Re: Denial of Site Approval to Construct an Aircraft Hangar, Fancher Flyways, Inc. , Lease LAG 06-76, Addendum #1 Dear Mayor Shinpoch and Council Members: The Airport wishes to appeal the decision of the Hearing dated February 17, 1981 on the following grounds: I . The Airport has had hangars for airplanes on the Airport for a great many years, also a restaurant and other commer- cial facilities; therefore, a precedent is well established. 2. The above-referenced lease, in Paragraph 3, specifically states that the construction of the hangar must begin by March 1 , 1981 and be completed by September 1 , 1981 . 3. This hangar was originally supposed to have been built on the east side of the Airport until the Boeing Company objected on grounds of interference with the Compass Rose. Boeing, therefore, offered to release the land on the west side of the Airport where the hangar is to be built. This point is brought out to emphasize the fact that this hangar has been in the "works" for several years and the east side site was approved by the Hearing Examiner. 4. Just recently, the Hearing Examiner approved construction of a lunchroom for the Boeing employees on the Airport. It is patently ridiculous that hangers would not be allowed on a public airport. Therefore, we request that the Hearing Examiner's decision be set aside and the building construction be allowed to commence as required by our lease agreement with our tenant. Louie Gebenini February 17, 1981 OFFICE OF THE LAND USE HEARING EXAMINER CITY OF RENTON REPORT AND DECISION, APPLICANT: Fancher Flyways, Inc. FILE NO. SA-136-80 LOCATION: West side of Renton Municipal Airport, south of the Control Tower. SUMMARY OF REQUEST: The applicant requests site approval to construct a metal structure to be used as an aircraft hangar for 13 T-type units. SUMMARY OF ACTION: Planning Department Recommendation: Approval with conditions. Hearing Examiner Decision: Denial. PLANNING DEPARTMENT The Planning Department preliminary report was received by REPORT: the Examiner on February 4, 1981. PUBLIC HEARING: After reviewing the Planning Department report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on September 10, 1981 at 9:45 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report. Roger Blaylock, Associate Planner, presented the report, and entered the following exhibits into the record: Exhibit #1: Application File containing Planning Department report and other pertinent documents Exhibit #2: Site Plan Responding to the Examiner's inquiry regarding allowability of the proposed use in a P-1 zone, Mr. Blaylock advised that the use is not specifically allowed, but because of past precedent and the fact that the Airport Plan allows airport related structures, the application had been processed by the Planning Department. He noted that the discrepancy with the P-1 zone contained within the Zoning Code which does not specifically allow airport hangars has been brought to the attention of the Aviation Committee of the City Council, but no action has been taken to date. Responding to the Examiner's inquiry regarding ownership of the property, Mr. Blaylock advised that the City of Renton is the owner, and the purpose of the request resulted from necessity by the Boeing Company to move the Fancher facility from the east to the west side of the airport because the previous location interfered with compass readings. Mr. Blaylock corrected Section L.l of the report to delete reference to compatibility of the proposed use to existing zoning. The Examiner requested testimony by the applicant. Responding was: Gene Watson G.W. Construction Corp. 1648 S. 310th Federal Way, WA 98003 Mr. Watson submitted a letter from the Boeing Company authorizing use of the roadway on the north side of the proposed hangar if several conditions are met. The letter was entered as follows by the Examiner: Exhibit #3: Letter of Authorization from Boeing Property Management Manager to Girda Wirz, Fancher Flyways, dated February 4, 1981. SA-136- Page Two Mr. Watson requested clarification of the type of landscaping recommended by the city. Mr. Blaylock indicated that due to the nature of the use, trees would not be required, but provision of low landscaping to separate the areas would be desirable. Responding for the record was: Girda Wirz P.O. Box 412 Renton, WA 98057 Ms.; Wirz submitted an attachment to Exhibit #3. The attached plan, which designates the proposed location of the hangar, signs and barricades, was included with Exhibit #3 by the Examiner. Mr. Blaylock indicated concern that the Aviation Committee of. the City Council should be notified of the agreement between the Boeing Company and Fancher Flyways prior to approval of the application by the Examiner. Ms. Wirz advised that a copy of the agreement had been mailed to that committee. There was no response to the Examiner's request for further testimony. The hearing was subsequently closed at 10:04 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The request is for approval of a site plan for an aircraft hangar to be built at the Renton Municipal Airport. 2. The application file containing the Planning Department report, the application, SEPA documentation, and other pertinent documents was entered into the record as Exhibit #1 . 3. ' Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, R.C.W. 43.21.C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee, responsible official. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5• There was no opposition to the proposal expressed. 6.I All existing utilities are available .and in close proximity. 7. The subject site is located on the east side of the West Perimeter Road south of the I control tower at the Renton Municipal Airport. The site is leased by the applicant, Fancher Flyways, from the city. 8. The applicant proposes constructing a metal enamel hangar in which to store 13 airplanes. The site itself is about 1.12 acres and the building will be 14,304 square feet. 9.. The subject site is zoned P-1 which permits the establishment of public and quasi- public uses subject to a site review by the Hearing Examiner (Section 4-710(J)). 10. Airplane hangars are not categorized in the Parking and Loading Ordinance list of uses. The applicant proposed providing 13 parking spaces, one for each airplane. The Planning Department indicated that 15 parking spaces are required analogizing the proposed, use to industrial warehousing. 11.E The Planning Department indicated that landscaping should be provided along the perimeter road adjacent to the proposed parking area to break up the large expanse of asphalt paving in the area and soften the effect of the fence and parking areas. The Planning Department reported that landscaping has been used in all recently approved developments including the Sunbird Restaurant and the Renton Aviation site north of the subject site. 12. The hangar is planned to run almost the entire width of the site, and therefore, planes parked in the western portion of the building will have to taxi across property leased by the Boeing Commercial Aircraft Company. The applicant has received written confirmation for use from Boeing but it•is unknown whether the City Council which negotiates airport lease agreements was aware of the size of the complex and the need for an agreement between the applicant and the Boeing Company for access. SA-136 _- Page Three 13: The specific use proposed by the applicant is not permitted outright in the P-1 zone Section 4-710). The uses enumerated are strictly of a governmental or public service nature. 14. The Comprehensive Plan indicates that the area in which the subject property is located is suitable for public and quasi-public uses. The area is also governed by the Master Study for Renton Municipal Airport and the Will Rogers-Wiley Post Memorial Seaplane Base (Airport Study), which recognizes the specific character of the area as an ongoing airport within a public use area. CONCLUSIONS: 1. The site plan with the landscaping and 15 parking spaces proposed by the Planning Department appears to be well-designed and is compatible with both the Comprehensive Plan and the Airport Study which indicates that additional facilities for parking airplanes is required at the Renton Municipal Airport (Page 40, Master Plan Study for "Airport"). 2. Unfortunately, the current zoning of the airport, P-1, does not permit the type of use proposed by the applicant, and, therefore, the proposal must be denied. The use of the airport for private hangars, while consistent with the legitimate purpose of the airport and is, as indicated, compatible with the Airport Study, cannot be accommodated in a P-1 district as it is now limited by Section 4-710. 3. Nor can the proposed use fit within the types of uses permitted in a P-1 zone under a conditional use permit pursuant to Section 4-722(F) (2)(m) (iii). That section would enable an applicant to establish B-1 (Business/Commercial) uses within a P-1 zone. Again, the uses enumerated for a B-1 zone (Section 4-711(A)(1) cannot be reasonably stretched to permit the proposed hangars. 4. To permit the establishment of prohibited uses in zones from which they are ordinarily excluded would create a bad precedent and possibly open other sections of the code to similar expedient deviations. While the Hearing Examiner has latitude to interpret the current code, such latitude should not be abused to. permit uses which are not enumerated nor similar in scope to those enumerated. Therefore, the site plan is denied. DECISION: ORDERED THIS 17th day of February, 1981. The use of, the airport for private hangars, while consistent with the legitimate purpose of the airport and is, as indicated, compatible with the Airport Study, cannot be accommodated in a P-1 district as it is now limited by Section 4-710. 3. Nor can the proposed use fit within the types of uses permitted in a P-1 zone under a conditional use permit pursuant to Section 4-722(F) (2) (m) (iii) . That section would enable an applicant to establish B-1 (Business/Commercial) uses within a P-1 zone. Again, the uses enumerated for a B-1 zone (Section 4-711 (A) (1) cannot be reasonably stretched to permit the proposed hangars. 4. To permit the establishment of prohibited uses in zones from which they are ordinarily excluded would create a bad precedent and possibly open other sections of the code to similar expedient deviations. While the Hearing Examiner has latitude to interpret the current code, such latitude should not be abused to permit uses which are not enumerated nor similar in scope to those enumerated. The proposal includes the installation of a 14 , 304 square foot aircraft hangar building fot the storage of 13 aircraft in "T" type hangars. This building will replace the hangar proposed on the east side of the airport under Site Approval 024-80. 3 . The proposed use is compatible and directly dependent upon the facilities of the City of Renton Airport. 4 . The applicant has not proposed any landscaping areas. In general, there does not exist any land- scaping east of the West Perimeter Road. However, there is an unpaved area lying between the fence and the on-site parking lot that should be landscaped. 5. The site plan shows provisions for one parking space per airplane hangar for a total 'of 13 spaces. The Parking and Loading Ordinance does not address this specific use. The only comparable section addresses industrial storage buildings at one parking space per 1 , 500 sq. ft. , thus requiring 15 parking spaces . The two additional spaces could be easily added at the north end of the proposed parking area. 6 . The comment from the Utilities Division is unneces- sary in that the project is on the west side of the airport not the east. Watermains are installed, and the new fire hydrant is shown on the plans. 7 . Access to the six hangars facing west is only across property leased to the Boeing Company. Therefore, the Boeing Company must assure access. In a conversation with the applicant, Mrs. Gerda Wirz , on February 3 , 1981 , she stated that the Boeing Company had agreed to give her access and she would present the written agreement to the Hearing Examiner on February 10th at the public hearing. ) M.
