King Subregional David Clemens, Director of the Planning Department, Plan Revisions presented revisions to the King Subregional Plan, which included the definition of Secondary/Metropolitan Center amendment and a new Business/Industrial Area designation proposal ; also, authorization request for the City's representative to support the proposed revisions. ADMINISTRATIVE Mayor Shinpoch reported successful and interesting Suburban Mayor's REPJRT Assoc. meeting, Renton Host City; speaker Mike Nolt of King County Jail explained it is largest prison facility in the state, even surpassing Walla Walla. NEW BUSINESS Councilman Hughes submitted letter from Renton . Merchants Par<ing Association stating concern for customer parking in the area of S 3-d and Wells S 3rd and Wells Ave. because numerous visitors to the Alcoholic Anonymous Office occupy the parking for several blocks. The letter suggested more parking be obtained other than in front of the building or another location obtained for the use of AA meetings with easier access without infringing on merchants' right to access for their handicapped or aging customers. Councilman Hughes also explained the problem of those parking in the area of only moving the car within the same block upon time expiration. Capt. Bourasa noted this was a parking violation. PLANNING DEPARTMENT The Planning Department preliminary report was received by REPORT the Examiner on April 22, 1981 . PUBLIC HEARING: After reviewing the Planning Department report , examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows : The hearing was opened on April 28, 1981 at 9:20 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report. The request is for approval of a reclassification of approximately 12,500 square feet from R-2 (Duplex Residential ) to B-1 (Business/Commercial) . 2. The application file containing the application, SEPA documentation , the Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton' s Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. There was no opposition to the proposal expressed. 6. All existing utilities are available and in close proximity. 7. The subject property is located in the vicinity of 3241 Sunset Boulevard N.E. The site slopes downward from the southeast to the northwest. An existing building on the site is to be retained and converted to office use. The subject site is part of the original plat of the City of Renton. The site was reclassified to R-2 in 1967 by Ordinance No. 2339. At the time of this reclassification, a portion of the same legal lot was rezoned to B-1 . 8. The site is located in an area where low density multifamily and commercial designations meet on the Comprehensive Plan Map. 9. Duplex dwellings are located east of the subject site. They are located on a hill above the subject site which serves to separate them for the subject site. They are located in an R-2 zone. A portion of the subject parcel is currently zoned B-1 , the classification requested for the remainder of the site. The areas to the west and south of the subject site are developed with commercial uses including the Sunset Plaza Shopping Center and the Washington State Department of Motor Vehicles station. These areas are zoned B-l . 10. The residential uses east of the subject site are oriented to the east and front on Monroe Avenue N. E. The subject site has frontage and access along Sunset. The Planning Department has recommended that the easterly residential uses be buffered with rockery and landscaping to avoid the impacts that commercial uses of the site will generate. CONCLUSIONS: 1 . The proponent of a rezone must demonstrate that the request is in the public interest and will not impair the public health, safety and welfare in addition to compliance with at least one of the three criteria listed in Section 3014 which provides in part that : a. The subject site has not been considered in a previous area-wide rezone or land use analysis ; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the property or area. The applicant has demonstrated that the necessary criteria have been met to permit the reclassification of the subject property. 2. The subject site is on the dividing line between areas designated for low density multifamily family uses and areas designated for commercial uses. As such, the surrounding uses and geography help in determining the appropriate classification for the subject site. The site is generally separated from the residential uses by the topographical relief. The site slopes generally upward off of Sunset Boulevard N.E. upon which the site fronts. The nearby residential uses are located further up r , R-029-81 Page Three the slope and are oriented to Monroe Avenue N.E. The slope differential serves to separate the site from the existing residential uses. 3. The subject property is actually currently classified as both R-2 and B-1 ; the latter category best represents the character of the site and surrounding uses and would be more appropriate for the entire site. The site is more closely allied with the commercial uses located on Sunset, and B-1 zoning would allow development of compatible commercial uses. 4. Since the last reclassification of the site to R-2 in 1967, the large commercial areas have been developed along Sunset Boulevard and the Washington State Department of Motor Vehicles building has been established. These uses have detracted from the site's residential amenities. B-1 zoning is more suitable for the subject site. 5. In order to assure that the site which does abut residential uses does not adversely impact those abutting uses, a buffer such as a rockery and landscaping should be constructed. The specific configuration and construction format should be determined by the Planning Department and the City's landscape architect. 6. The reclassification should not adversely affect the neighboring properties, and the buffering will minimize any possible adverse effects. RECOMMENDATION: The City Council should approve the reclassification of the subject site to B-1 subject to the provision of a physical buffer and appropriate landscaping as approved by the Planning Department and the landscape architect. This soil is used for urban development. 3. Vegetation: A few shrubs and some scrub grass are found on the subject site. 4. Wildlife: The existing vegetation may provide some habitat for birds and small mammals. 5. Water: No surface water was observed on the subject site (April 14 , 1981 ) . 6. Land Use: An existing building is on the subject site. Some duplexes are found to the east. with the Driver ' s License Examining Station to the south and the Sunset Plaza Shopping Center to the west and north. ENVIRONMENTAL ASSESSMENT/THRESHOLD DETERMINATION: Pursuant to the City of Renton ' s Environmental Ordinance and the State Environmental Policy Act of 1971, as amended, RCW 43-21C, the Environmental Review Committee issued a final declaration of non-significance for the subject proposal on April 6 , 1981 . City of Renton Utilities Division. 5. City of Renton Fire Department. L. PLANNING DEPARTMENT ANALYSIS: 1 . The proposed rezone is consistent with the commercial designation of the Comprehensive Plan for the subject site but not the low density multiple family designation. 2. The subject site has not been considered since the last area land analysis and zoning (Comprehensive Plan Land Use Report, 1965, and Section 4-3014-C1a) . 3. Although there have not been any recent rezones to B-1 in the immediate vicinity, most of the properties to the south, west and north are either zoned for and/or utlized as commercial land uses. In addition, the residential land uses to the east are by and large located on a hill at a much higher elevation than the subject site. As a result, the orientation of these units is to the east and north (toward Monroe Avenue N.E. and Sunset Boulevard N.E. ) away from the more intensive commercial uses. These factors would suggest that another commercial use may be compatible with the existing land uses if an appropriate screening buffer is installed between the subject site and the residential units. 4 . Both the Traffic Engineering and Design Engineering Divisions advise that the driveway at the southwest corner must be moved 5 feet northeasterly in order to comply with Section 4-2204-2A of the Parking and Loading Ordinance. Traffic also notes that the driveway must be closed up to clean an existing electrical transformer. 5 . Storm water retention/detention will be required as indicated by the Engineering Division. R-029-81 APRIL 28, 1981 PAGE FOUR The Police Department recommends that the followingop measures be taken prior to and during construction for security reasons. a) Pre-wire the existing structure for an intrusion/ hold up alarm. b) Install dead bolt locks. c) Install parking area lighting such that the light shines in on the building. d) Attach large address numbers to the building for ease of location. 7. A latecomer ' s agreement for water will be required and system development charges for water and sewer will apply as per Utilities Engineering Division comment. In addition, water and sewer plans will be necessary and fire hydrant locations must be approved by the Fire Department. M DEPARTMENTAL RECOMMENDATIONS Based upon the above analysis , it is recommended to approve the rezone request subject to: 1 . Installation of a suitable combination of 6 feet high masonry wall or rockery and appropriate land- scaping to screen and buffer the residential area adjacent to the east. 2. Sunset Blvd , Renton Dear Mr. Clemonds , The present comprehensive plan , adopted in 1965 elected to use a transmission line right of way as its boundary . Seperating B-1 zoned property within and to the West of said boundary and R-2 to the East , while ownership of the properties within this zoning division continued on to the section line which runs paralleled to the transmission . The distance between the easterly boundary of the transmission line and the section line is approximately 75 feet and the owners of these properties have developed to the section line. Another point of interest is the physical definition of this section line; rockies rise to a hight of over 10 feet in some places , seperating the property on the East and West side . As a result of this property owners are using R-2 zoned property for parking and have been for sometime . The subject property is currently zoned B-1 and R-2 . It is my proposal to extend the B-1 zoning from the transmission line Easterly to the section line , thus allowing adequate zoning for a remodel of the existing single family house into a small real estate office. It would seem logical to me to have the planning department look into the possibility of moving the line and correcting the exist- ing problem on the other properties as well .
