Clemenstr(,_ Acting Planning Director RE: TEMPORARY USE APPLICATION FOR STAR RENTALS Star Machinery has made application for the installation of an equipment storage yard at the rear of their existing facility located on West Valley Road. The proposed use is a permitted use in the district. Therefore, the request for temporary permit would be inappropriate. A temporary permit application is appropriate only for those uses not allowed in the district. Further, the applicant has not completed the landscaping and paving requirements of the Hearing Examiner issued in 1978. The applicant has occupied the site for nearly two years in violation of these requirements. The Board of Public Works did consider a deferral for some of the items in the applicant ' s proposal. A deferral on these items has expired, and the landscaping has not been completed in accordance with the approved plans. Mr. Rabel' s statement that the landscaping on the northerly side of the property is complete is incorrect. When the applicant made application, he was informed of the deficient items. The applicant indicated that he was not prepared to perform on the items previously required. Based upon the fact that this application is for an expansion of the existing use and cannot be considered as a temporary application, I concluded that no further action by the City was warranted until the existing development is completed, or that the improvements would be assured as a part of this application. When the applicant failed to agree to either installing the improvements or assure their installation as a part of this development, I concluded that the only acceptable course of action for the City was to not proceed with processing of the applicant 's current request.
