Walkway Petition bearing names of residents in area of walkway between Complaint 2103 Aberdeen Court SE and 2100 Aberdeen Court SE reported two Aberdeen Ct. SE and 1/2 years of problems with walkthru easement and asked closure. The letter noted problems of cars driving thru walkway; hang- out for neighborhood children subjecting area residents to the loud noise and vulgar language; property damage such as tearing up shrubs, knocking down small trees , starting small fire, etc. Letter signed by James W. Gambling Tax Letter from Acting Finance Director Bennett requested update of the City' s gambling tax and amusement games ordinance to comply with state law. The letter noted RCW 9.26. 110 sets taxation limit on amusement games at 2% of the gross receipts, less cost of prizes; that only two organizations located in Renton hold State Gambling Commission licenses for amusement games and each usually holds one event per year. Appropriation Parks Director Webley requested appropriation of funds in amount Senior Center of $6,000 from Unanticipated Revenues to pay for totally self- supporting programs at the Senior Center. Dances, classes and special events not funded by the City budget can be offered on a self supporting basis with the participant paying the entire cost of the event. APPLICANT: Church of Christ FILE NO. R-054-81 LOCATION: 2527 N.E. 12th Street SUMMARY OF REQUEST: The applicant seeks a rezone of the subject site from G-7200 to R-3 to permit expansion of an existing church and paving the existing parking lot. SUMMARY OF Planning Department: Approval with conditions. RECOMMENDATION: Hearing Examiner: Approval with conditions. PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT: Examiner on June 24, 1981 . PUBLIC HEARING: After reviewing the Planning Department report , examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows : The hearing was opened on June 30, 1981 at 9:20 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. It was reported that the Hearing Examiner and the applicant had received and reviewed the Planning Department report. Roger Blaylock, Associate Planner, presented the report , and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: King County Assessor' s Map with Zoning Classifications Exhibit #3: Photographs of Subject Site (2) Exhibit #4: Conceptual Site Plan (For illustrative purposes only; not binding upon city or applicant) Referencing Section 4-709A.A. (f) , R-3 Residence District, the Examiner requested Mr. Blaylock to explain how a rezone to R-3 would modify setback requirements. Mr. Blaylock indicated the opinion of the Planning Department that the standards of the R-1 zone could not be met even through application for a variance because of topographical constraints on the site, and it was felt that the Hearing Examiner would have the latitude necessary to review the proposed rezone to R-3. He also noted that a special permit would be required in either zoning category. The Examiner requested testimony by the applicant. Responding was: Joe Breezee 16404 S.E. 135th Renton, WA 98055 Mr. Breezee indicated that he had no comment. The Examiner requested further testimony by parties in support or opposition to the application. There was no response. He then requested an additional period of time of 21 days in which to publish a report on the matter to allow for upcoming vacations. Since the applicant concurred, the hearing regarding File No. R-054-81 was closed by the Examiner at 9:20 a.m. R-054-81 Page Two j FINDINGS0 CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the A Examiner now makes and enters the following: FINDINGS: 1 . The equest is for approval of a reclassification of about 25,400 square feet of property from G-7200 (General ; Single Family Residential ; Minimum lot size - 7,200 squa e feet) to R-3 (Medium Density Residential ) . 2. The application file containing the application, SEPA documentation, the Planning Depatment report, and other pertinent documents was entered into the record as Exhi •it #1 . 3. Purs ant to the City of Renton's Environmental Ordinance and the State Environmental Poli y Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee, responsible offiial . 4. Plan for the proposal have been reviewed by all city departments affected by the impa t of this development. 5. Ther- was no opposition to the proposal expressed. 6. All -xisting utilities are available and in close proximity. 7. The subject property is located at 2527 N.E. 12th Street, just south of McKnight Midd e School and east of Edmonds Avenue N.E. and west of N.E. Sunset Boulevard. 8. The .ubject site was annexed into the city by Ordinance No. 1795 in October of 1959 at w ich time the site was zoned to its current G-7200 category. 9. The . ite is essentially level and has been used for a church and parking lot for the members. The lot is graveled. 10. The bhurch of Christ proposes constructing a church addition and an improved, paved parking lot on the subject site, and has therefore proposed that the site be reclassified to R 3. The setbacks required in a single family zoning district, as the G-7200 lot is c aracterized, would severely limit development. Sections 4-729(C) and 4-706(3) (a) require 100-foot front yard setbacks and 25-foot sideyard setbacks, whereas the setb.cks required of churches established in R-3 zones are subject to the general considerations inherent in a special permit review (Section 4-709A(A) (3) (f) ) ; that is, considerations of the public health, safety and welfare. 11 . As i. indicated above, McKnight Middle School is located north of the subject property on property zoned G-7200, the subject site' s current classification. The church property is located between apartment complexes west and south of the subject site on l .nd zoned R-3, and duplexes east of the site on land zoned R-2 (Duplex Residential ) . Other multiparcel R-3 properties are located east and north of the subject site. 12. Thes- R-3 and R-2 properties were reclassified in the early and mid-1960s. The subject site' s zoning has not been studied since it was annexed. 13. The Comprehensive Plan indicates that the subject site is suitable for the development of -dium density multifamily housing. 14. The reclassification of the site would permit the location of R-3 uses on the site. The church is already located on the parcel , but if removed, the approximately 25,000 square foot lot would permit construction of about 17 dwelling units with a potential to increase the resident population by about 43 persons (2.5/unit) ; increase the school age population by about four students (.25/unit) ; and increase the daily traffic count by about 104 trips per day (6. 1 trips/unit) . CONCLUSIONS: 1 . Thelproponent of a rezone must demonstrate that the request is in the public interest and will not impair the public health, safety and welfare in addition to compliance witF at least one of the three criteria listed in Section 4-3014 which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or L. R-054-81 Page Three c. There has been material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the property or area. The applicant has demonstrated that the necessary criteria have been met to permit the reclassification of the subject property. 2. The classification requested, R-3, is consistent with the Comprehensive Plan designation of the site for medium density multifamily uses. 3. The R-3 requested is also compatible with the surrounding zoning districts, R-3 immediately west and south of the site and R-2 immediately east of the site. The R-3 zoning and potential uses would also be compatible with the uses developed on these adjoining properties, duplexes and apartments, and would also be compatible with the use made of the G-7200 district north, the McKnight Middle School . 4. The church, in fact , does not seek to develop R-3 uses on the subject site, at least expansion is the stated purpose of the reclassification. The church seeks to expand the existing building, and the G-7200 district would impose limitations on churches and considerable restrictions on the site. The special permit procedure required by Section 4-709A(A) (3) (f) should provide safeguards to the residential uses adjoining the church as any expansion would have to be consistent with the public health, safety and welfare. Buffers and landscaping could be used to lessen the impact of church activities on the residential structures located on the adjoining properties. RECOMMENDATION: The City Council should approve the reclassification of the subject site from G-7200 to R-3 subject to review of the church expansion by special permit application. Topography: The subject site is essentially level. 2. Soils : Arents, Alderwood material, 6-15% slopes AmC) . Runoff is medium and the erosion hazard is moderate to severe. This soil is used for urban development. 3. Vegetation: The majority of the site has been graded and consists of gravel. 4 . Wildlife: The existing vegetation provides suitable habitat for birds and small mammals. 5. Water : No surface water was observed on the subject site (June 12, 1981 ) . 6. Land Use: The subject site is presently utilized as an unpaved parking lot. To the east are some duplexes and large apartment buildings are adjacent to the south and west. McKnight Junior High School is located across the street to the north. E. NEIGHBORHOOD CHARACTERISTICS: The area consists of a variety of institutional, multiple family and single family uses. F. PUBLIC SERVICES: 1 . Water and Sewer : A sixteen-inch water main extends north-south along the east side of Edmonds Avenue N.E. and twelve-inch and sixteen-inch mains run east-west on the north side of N.E. 12th Street. An eight-inch sanitary pipe runs north-south along the east side of Edmonds and another eight-inch pipe extends east-west along the northside of N.E. 12th Street. 2. Fire Protection : Provided by the City of Renton as per ordinance requirements. 3. Transit : Metro Transit Route No. 142 operates along Edmonds Avenue N.E. within one-fourth mile to the northwest of the subject site. 4 . Schools : Hillcrest Elementary School is located within one-half mile to the northeast of the subject site while McKnight Junior High School is across the street on N.E. 12th and Hazen Senior High School is within one and three-fourth miles to the east. 5. However, future development will increase storm water runoff and traffic and noise levels in the area. Through proper development controls and procedures, however, these impacts can be mitigated. 2. Population/Employment: Minor. Continuation of the church will result in almost no change. Removal of the church and construction of 17 dwelling units would increase population to approximately 43 people. 2. 5 people per unit. ) 3. Schools : A church would not impact the school system. The 17 dwelling units would produce approxi- mately 4 school children based on . 25 students per dwelling unit. 4. Social: Minor. 5. Traffic : The church activity will not increase appreciably, while the potential 17 dwelling units would generate 104 daily vehicle trips (6. 1 trips per unit) . J. ENVIRONMENTAL ASSESSMENT/HOLD DETERMINATION: Pursuant to the City of Renton's Environmental Ordinance and the State Environmental Policy Act of 1971, as amended, RCW 43-21C, the Environmental Review Committee issued a declaration of non-significance for the subject proposal on June 15, 1981 . The proposed rezone is consistent with the Comprehensive Plan land use designation of medium density multiple family for the subject site and the existing R-3 zoning in the vicinity. (4-3014C-1b) 2. A parcel of property adjacent to the subject site on the east was rezoned to R-2 by Ordinance No. 1945 in 1962. R-054-81 PAG FOUR south and west were rezoned to R-3 by Ordinance No. 2233 in 1966. Three story apartment buildings were eventually constructed on these parcels. Several other multiple family rezones and development have taken place since that time (Sec. 4-3014C-1c) . See the history portion of the applicant ' s letter of justification for further data. 3. According to Planning Department files, no area-wide rezone has occurred in the area since 1962. (Sec. 4-3014C-1a) 4 . As indicated, a future addition and paving of the existing parking lot are proposed for the subject site. Under the present G-7200 zoning, this would impose severe building and landscaping setbacks . Such requirements would in effect prohibit any such improvements. The applicant seeks, therefore, to acquire R-3 zoning which might be less restrictive in such setback requirements for a Special Permit than the G-7200 zone and also more consistent with the existing zoning of the adjacent properties. 5. The Engineering Division advises that off-site improvements will be required on N.E. 12th Street with future development. Storm drainage with detention and oil/water separation must also be supplied. 6. Any future driveways constructed shall provide a minimum width of 18 feet at the throat as per Traffic Engineering Division comment. 7. Policies 9.H-1 , 2, and 3 of the Policies Element of the Comprehensive Plan outline some basic funda- mentals regarded as appropriate to future church development. Location on arterial streets is advised together with adequate setbacks, landscaping and other buffers in the residential areas for which they are recommended. The physical facilities should also be of a size and intensity similar to adjoining residential uses. Any future construction should be guided by these policies. M. DEPARTMENTAL IONS: Based upon the above analysis, it is recommended to approve the rezone request subject to the satisfaction of Item L-5 of the analysis. The subject property is 151 ' x 168' . It fronts on and is accessed from Northeast 12th Street. The lot has been owned by the Church of Christ for nearly 30 years. It is presently zoned G-7200, and we request the zoning be changed to R-3. We shall show that the requested rezone is both appro- priate and timely. History of the Site. The subject site was purchased by the Church of Christ in 1951 , and con- struction of the Church began that same year. At that time, the property was part of unincorporated King County. In 1956, under Annexation Ordinance #1795, the area was annexed by the City of Renton, and the King County zoning designation of G-7200 was retained by the City at that time. Thus, the present single-family residential zoning designation was first put on City of Renton records in 1956. (It may be helpful to refer to the site plan and a Renton zoning map for the following discussion. ) Since 1956, the area surrounding the subject site has been substantially rezoned and redeveloped to multiple-family residential use. The property directly adjacent to the subject site to the east was rezoned in 1962 and is part of a low-density housing development covering several square blocks. The property directly adjacent to the subject site both to the south and to the west was rezoned to R-3 in 1966, and the Church now has three-story apartment buildings surrounding it on both these sides. The only property adjacent to the subject site which still retains the G-7200 zoning classification is the property to the north across Northeast 12th Street. This property, however, belongs to the Renton School District and is the site of McKnight Junior High School . Thus, this property is, in fact, public use and not single-family use as the G-7200 zoning would indicate. R-2 in the 1962 rezone mentioned above. Since 1962, many scattered parcels Of that large, low-density housing development have been rezoned and i redeveloped to R-3 medium-density, multi-family use. One of these is thei. Property on the southwest corner of Northeast 12th Street and Harrington Avenue Northeast. It lies approximately 100 yards east of the subject site 4nd was rezoned to R-3 in 1969. In addition, a parcel approximately 120 k yards south or the subject site was rezoned and redeveloped to R-3 use in 1962. The lot just north of this one was rezoned R-3 in 1971 . These changes, along with the rezones of the property adjacent to the subject r Site discussed above, have made the block containing the subject site a 4. Patchwork of R-2 and R-3 zones. Much of the area around the block has also been rezoned. The block is surrounded by R-2, R-3, and B-1 zoning. Therefore, the neighborhood history since annexation shows a nearly compete Change from single-family to multi-family in terms of both surrounding use and surrounding zoning classification. ro riateness. o be found to be appropriate, the application for rezone must meet one or ore of the conditions listed below. The short history of the subject site nd surrounding area discussed above shows that this application clearly eets all three conditions. Condition #1 . That substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered at the time of the last comprehensive plan land use and/or zoning application or, the proponent must show that the current zoning of the ro ert pre- ceded the last comprehensive plan amendment in the area of, the ro ert _ and zany rezoning which occurred subsequent to the comprehensive p lan amendment." Since the current G-7200 zoning classification predates the annexation of the property by the City in 1956, it clearly preceded the 1965 comprehensive Plan; and, since the subject property has retained its original zoning since pannexation, it clearly preceded any and all of the surrounding R-2 and R-3 , rezones, which have occurred since annexation. Condition #2. May 24, 1981 page three City of Renton Planning Department RE: LETTER OF JUSTIFICATION FOR CHURCH OF CHRIST REZONE FROM G-7200 TO R-3 The substantial redevelopment of the surrounding property since annexation has clearly significantly changed the character of the area from a single- family residential neighborhood. Most notably, the 1966 rezone to R-3 and subsequent construction of the three-story, multi-unit apartment building, along with the paving of required parking and access for these apartments, on the property directly adjoining and surrounding the subject site on both the south and west sides, has had a significant effect on the scale and character of the subject site. This 1966 multi-family development post- dates the comprehensive plan, and it, along with other recent R-3 develop- ments on the block containing the subject site, has clearly changed the scale and character of the subject property significantly. Condition #3. That the property is potentially zoned for the reclassification being requested pursuant to policies set forth n the comprehensive plan and conditions have been met which would indicate the change is appropriate. " The comprehensive plan land use element designates medium-density, multi- family use for the area including the subject site, which is consistent with the requested R-3 reclassification. It seems quite clear that by the conditions listed above, the rezone of the subject site is appropriate. Furthermore, since the Church is an existing use, and this is part of a proposal to bring it into compliance with the City of Renton codes, it is consistent with both plan and policies of the comprehensive plan. One last question regarding appropriateness should be addressed, namely the fact that this application for rezone requests an R-3 medium-density residential classification without proposing an R-3 residential use. The reason for this rezone application is not to allow a new use of the property, but rather to gain a zoning classification consistent with surrounding land use. The present G-7200 zoning classification imposes very restrictive con- ditions for needed special permit under Building Regulations, Section 4-706, Paragraph 3. These conditions, listed under church use in an R-1 zone, impose unfair restrictions on the subject property in terms of setback and perimeter landscaping. These regulations were meant to protect single-family neigh- borhoods, and R-3 will impose the less restrictive conditions for a special permit in a multi-family neighborhood. Under the present G-7200 classifica- tion and R-1 regulations, the Church simply cannot be brought into compli- ance and must remain a non-conforming use. However, if this application for rezone is approved, the property can then be brought into compliance. Churches are allowed in R-3 zones by special permit, and any future redevelopment of the property under k-3 will be appropriate and consistent with the zoning and character of the surround- ing area. Timeliness. A glance at a land use or zoning map, or a review of the history of the site shows that this rezone is timely. Except for the misleading G-7200 zoning of McKnight Junior High School across the street, the subject site is an island of single-family zoning surrounded by multi-family zoning and use. As stated above, this situation imposes unfair restrictions on the site. This rezone is not only timely, but clearly overdue. In conclusion, we hope we have provided sufficient evidence that this appli- cation for rezone from G-7200 to R-3 is both appropriate and timely, and that the requested rezone be granted. The subject property is 151 ' x 168' . It fronts on and is accessed from Northeast 12th Street. The lot has been owned by the Church of Christ for nearly 30 years. It is presently zoned G-7200, and we request the zoning be changed to R-3. We shall show that the requested rezone is both appro- priate and timely. History of the Site. The subject site was purchased by the Church of Christ in 1951 , and con- struction of the Church began that same year. At that time, the property was part of unincorporated King County. In 1956, under Annexation Ordinance #1795, the area was annexed by the City of Renton, and the King County zoning designation of G-7200 was retained by the City at that time. Thus, the present single-family residential zoning designation was first put on City of Renton records in 1956. (It may be helpful to refer to the site plan and a Renton zoning map for the following discussion. ) Since 1956, the area surrounding the subject site has been substantially rezoned and redeveloped to multiple-family residential use. The property directly adjacent to the subject site to the east was rezoned in 1962 and is part of a low-density housing development covering several square blocks. The property directly adjacent to the subject site both to the south and to the west was rezoned to R-3 in 1966, and the Church now has three-story apartment buildings surrounding it on both these sides. The only property adjacent to the subject site which still retains the G-7200 zoning classification is the property to the north across Northeast 12th Street. This property, however, belongs to the Renton School District and is the site of McKnight Junior High School . Thus, this property is, in fact, public use and not single-family use as the G-7200 zoning would indicate. Therefore, none of the properties immediately surrounding the subject site retains the single-family use, and only the school site across Northeast 12th Street has not been rezoned and converted to multi-family use. May 24, 1981 page two City of Renton Planning Department RE: LETTER OF JUSTIFICATION FOR CHURCH OF CHRIST REZONE FROM G-7200 TO R-3 In addition to these changes in zoning and use of the property adjoining the subject site, the neighborhood as a whole has substantially changed. With the exception of the subject site, only one other lot within the block still retains the G-7200 classification. Most of the block was rezoned to R-2 in the 1962 rezone mentioned above. Since 1962, many scattered parcels of that large, low-density housing development have been rezoned and redeveloped to R-3 medium-density, multi-family use. One of these is the property on the southwest corner of Northeast 12th Street and Harrington Avenue Northeast. It lies approximately 100 yards east of the subject site and was rezoned to R-3 in 1969. In addition, a parcel approximately 120 yards south of the subject site was rezoned and redeveloped to R-3 use in 1962. The lot just north of this one was rezoned R-3 in 1971 . These changes, along with the rezones of the property adjacent to the subject site discussed above, have made the block containing the subject site a patchwork of R-2 and R-3 zones. Much of the area around the block has also been rezoned. The block is surrounded by R-2, R-3, and B-1 zoning. Therefore, the neighborhood history since annexation shows a nearly complete change from single-family to multi-family in terms of both surrounding use and surrounding zoning classification. Appropriateness. To be found to be appropriate, the application for rezone must meet one or more of the conditions listed below. The short history of the subject site and surrounding area discussed above shows that this application clearly meets all three conditions. Condition #1 . That substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered at the time of the last comprehensive plan land use and/or zoning application or, the proponent must show that the current zoning of the property pre- ceded the last comprehensive plan amendment in the area of the property and any rezoning which occurred subsequent to the comprehensive plan amendment." Since the current G-7200 zoning classification predates the annexation of the property by the City in 1956, it clearly preceded the 1965 comprehensive plan; and, since the subject property has retained its original zoning since annexation, it clearly preceded any and all of the surrounding R-2 and R-3 rezones, which have occurred since annexation. Condition #2. That since the last previous comprehensive plan analysis or rezoning of subject property, authorized public improvements, permitted private development or other circumstances affecting the property have undergone significant or material change. " May 24, 1981 page three City of Renton Planning Department RE: LETTER OF JUSTIFICATION FOR CHURCH OF CHRIST REZONE FROM G-7200 TO R-3 The substantial redevelopment of the surrounding property since annexation has clearly significantly changed the character of the area from a single- family residential neighborhood. Most notably, the 1966 rezone to R-3 and subsequent construction of the three-story, multi-unit apartment building, along with the paving of required parking and access for these apartments , on the property directly adjoining and surrounding the subject site on both the south and west sides, has had a significant effect on the scale and character of the subject site. This 1966 multi-family development post- dates the comprehensive plan, and it, along with other recent R-3 develop- ments on the block containing the subject site, has clearly changed the scale and character of the subject property significantly. Condition #3. That the property is potentially zoned for the reclassification being requested pursuant to policies set forth in the comprehensive plan and conditions have been met which would indicate the change is appropriate. " The comprehensive plan land use element designates medium-density, multi- family use for the area including the subject site, which is consistent with the requested R-3 reclassification. It seems quite clear that by the conditions listed above, the rezone of the subject site is appropriate. Furthermore, since the Church is an existing use, and this is part of a proposal to bring it into compliance with the City of Renton codes, it is consistent with both plan and policies of the comprehensive plan. One last question regarding appropriateness should be addressed, namely the fact that this application for rezone requests an R-3 medium-density residential classification without proposing an R-3 residential use. The reason for this rezone application is not to allow a new use of the property, but rather to gain a zoning classification consistent with surrounding land use. The present G-7200 zoning classification imposes very restrictive con- ditions for needed special permit under Building Regulations, Section 4-706, Paragraph 3. These conditions, listed under church use in an R-1 zone, impose unfair restrictions on the subject property in terms of setback and perimeter landscaping. These regulations were meant to protect single-family neigh- borhoods, and R-3 will impose the less restrictive conditions for a special permit in a multi-family neighborhood. Under the present G-7200 classifica- tion and R-1 regulations, the Church simply cannot be brought into compli- ance and must remain a non-conforming use. However, if this application for rezone is approved, the property can then be brought into compliance. 1 May 24, 1981 page four City of Renton Planning Department RE: LETTER OF JUSTIFICATION FOR CHURCH OF CHRIST REZONE FROM G-7200 TO R-3 Furthermore, the R-3 classification is consistent with surrounding zoning, land use and the comprehensive plan. Churches are allowed in R-3 zones by special permit, and any future redevelopment of the property under R-3 will be appropriate and consistent with the zoning and character of the surround- ing area. Timeliness. A glance at a land use or zoning map, or a review of the history of the site shows that this rezone is timely. Except for the misleading G-7200 zoning of McKnight Junior High School across the street, the subject site is an island of single-family zoning surrounded by multi-family zoning and use. As stated above, this situation imposes unfair restrictions on the site. This rezone is not only timely, but clearly overdue. In conclusion, we hope we have provided sufficient evidence that this appli- cation for rezone from G-7200 to R-3 is both appropriate and timely, and that the requested rezone be granted.
