APPLICANT: Farmers Insurance Group FILE NO. SA-068-81 LOCATION: Northeast corner of Lind Avenue S.W. and S.W. 43rd Street SUMMARY OF REQUEST: The applicant seeks site plan approval to permit construction of an insurance claims office in an M-P zone. SUMMARY OF Planning Department: Approval subject to conditions. RECOMMENDATION Hearing Examiner:Approval subject to conditions . PLANNING DEPARTMENT The Planning Department preliminary report was received by the REPORT:Examiner on August 27, 1981 . PUBLIC HEARING: After reviewing the Planning Department report , examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on September 1 , 1981 , at 9: 18 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. Roger Blaylock, Associate Planner, presented the Planning Department report and entered the following exhibits into the record: Exhibit #1 : Application File containing Planning Department report and other pertinent documents Exhibit #2: Site Plan with Planning Department staff comments Exhibit #3: On-site landscaping plan Mr. Blaylock noted difficulties with access easements, site design complications due to impending improvements on S.W. 43rd Street and Lind Avenue S.W. , and problems with com- pliance with the Parking and Loading Ordinance requiring 5% interior landscaping. He cited concern regarding the parking area aisle width on the east, as it utilizes a com- mon easement which needs to be filed with the entire document. Responding to the Exami- ner's inquiries regarding access to the property, he indicated that it is confined to access through common easement on the northwest corner of the site. It was recommended that the actual landscaping between property lines and ultimate curb lines along both S.W. 43rd and Lind Ave. S.W. be delayed until completion of roadway improvements in approximately 18 months. A deferral from the Board of Public Works should be requested by the applicant. Relative to provisions for access and parking, the Examiner inquired regarding the adequacy of staffing storage and queue space for cars that may be visiting the site for adjustments. Mr. Blaylock noted that ten more parking spaces than required were provided by the applicant for this reason and suggested that the applicant may have further comment. The Examiner requested testimony by the applicant: Responding was: Ken Peterson 2021 152nd N.E. Redmond, WA 98052 Mr. Peterson, indicating he represents the Koll Company and not the previous owner/seller who is unavailable at this time, suggested that , while he could not speak for the owner, he could provide some clarification. He advised that the deed and the sales agreement include the reciprocal agreement regarding common easement to the north. However, there is no reciprocal easement to the east presently. It was indicated that this could be an oversight, and documents could be adjusted to include it. Responding to Mr. Blaylock regarding the establishment of the original easements on the internal boundaries, Mr. Peterson again noted his unfamiliarity ,with the situation and indicated he thinks there 4, SA-068-81 Page Two are recorded easements only in cases where there are dedicated utilities. The Examiner noted that his review of files pertaining to Koll Business Park revealed that there was discussion regarding internal access and that the City Attorney and Public Works Depart- ment indicated that internal easements by private agreement were permissible but that some evidence will have to be shown to the City that they do exist. He also commented regarding several possibilities for site planning without the easement on the east. Mr. Peterson agreed that all options should be considered in view of the need for more speci- fic information from the absent owner. Responding to Mr. Blaylock, Mr. Peterson advised that the Koll Company still owns the lot to the east of the subject site and would be able to grant the reciprocal easement over their property. Mr. Peterson expressed con- fusion regarding the thirty foot access width requirement at the northwest corner, noting the curb cuts were put in under LID 302 and that they have a valid building permit for Phase II , which does not provide for this width. Discussion followed among Mr. Blaylock, the Examiner an Mr. Peterson concerning the probable background and justification for this change. It was noted that the intention is to get turning vehicles off the street and that the criteria had been changed by five feet between Phase I and the present time. It was confirmed that there was no change in the internal street width. Mr. Peterson indicated that he believes there will be no problem as long as this affects the right-of- way area only. The Examiner requested further testimony in support of the application. Responding was : Jesse William Johnson Lance Mueller and Associates 130 Lakeside Seattle, WA 98122 The Examiner incuired if Mr. Johnson is capable of speaking for the owner of the property. Mr. Johnson responded affirmatively. Mr. Johnson stated that, if the easement to the east is not provided, it will affect the amount of parking which the owner of the prop- erty would prefer but that he believes it is workable. He indicated that providing addi- tional interior landscaping and the thirty foot access width to the north should present no problems. The Examiner noted that thirty foot access requirements may apply to the entire property, necessitating a shift of the siting of the building and landscaping. Mr. Johnson indicated that this would be acceptable. The Examiner requested testimony in support or opposition to the application. There was no response. He then invited final comments from the Planning Department staff. Since no further comments were offered, the hearing regarding File No. SA-068-81 was closed by the Examiner at 9:40 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The request is for approval of a site plan to permit the construction of an insurance claims office in an M-P (Manufacturing Park) zone. 2. The application file containing the application, SEPA documentation, th.e Planning Department report, and other pertinent documents was entered into the record as Exhibit #1 . 3. Pursuant to the City of Renton's. Environmental Ordinance and the State Environmental Policy Act of 1971 , R.C.W. 43.21 .C. , as amended, a Declaration of Non-Significance has been isstied for the subject proposal by the Environmental Review Committee, responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. All existing utilities are available and in close proximity. 6. The subject property is located at the northeast corner of Lind Avenue S.W. S.W. 43rd Street. The site is level as the result of an earlier grade and fill operation. 7. The subject site was annexed into the city in April of 1959 by Ordinance 1/1745. The site was classified M-P by Ordinance 113016 in March of 1976. Orillia industrial plat and a subsequent boundary line adjustment created the subject lot. SA-068-81 Page Three 8. The applicant proposed developing a claims adjustment office for Farmer's Insurance Group. Pursuant to Section 4-730.040(9) of the zoning code, a building site plan must be approved by the Hearing Examiner for property located in M-P zone. 9. The applicant proposes a one-story structure containing approximately 5,456 square feet. The facility will serve as both a general office and as a drive-in inspection site. 10. The applicant proposed providing 42 parking spaces whereas only 27 parking stalls are required. The applicant must provide 5% internal landscaping in the parking lot areas. 11 . The site plan shows evidence of an easement along the north property line to allow access from Lind Avenue S.W. to interior lots located east of the subject lot. Similar easements are indicated on the east side of the subject site. No legal pro- vision for the latter easterly easement exists and access to parking on the east side of the facility will . not be possible without such legal easement executed in favor.of the subject site. 12. The LID fol S.W. 43rd Street is not finalized and construction is not completed along Lind Avenue so that. the applicant has been advised to delay installation of required off-site landscaping and other improvements. 13. The Traffic Engineering Department indicated that the access drive from Lind Avenue S.W. would have to be at least thirty feet wide,whereas the site plan indicates a a narrower access. 14. The applicant must provide for on-site retention of storm water. CONCLUSIONS: 1 . The site plan and proposed use appear to serve the public use and interest. The applicant will provide sufficient parking and queuing space to allow for the on-site inspection of damage claims and on-site parking for both employees and customers . 2. In order to provide all the parking and queuing space proposed, the applicant will have to secure an easement for joint access for the eastern portion of the subject site. Without such easement, there will be no legally enforceable way for the applicant to access the proposed parking on the east side of the subject lot. I. 3. The applicant proposes landscaping and such will have to be approved by the city's landscape architect. Some of the landscaping will be installed at a later date due to the continuing construction on the LIDs in the vicinity. 4. In order to provide for efficient turning movements which minimally interfere with through traffic on Lind Avenue, the applicant must provide an access driveway of not less than thirty feet in width. DECISION: The site plan (Exhibit #'s 2 and 3) is approved subject to the following conditions: 1 . Provision of at least 5% landscaping interior to parking areas. 2. Acquisition of a joint use easement along the eastern property line. 3. On-site storm water detention/retention system. 4. The site was rezoned to M-P, Manufacturing Park, on March 14 , 1976, by Ordinance 3016. The site was part of a phased fill and grade permit issued on October 13, 1976. The subject site was part of the Orillia Industrial Plat, the final plat of which was approved by. the Examiner on August 25, 1978. Permeability is moderate in the upper part of the profile and moderately rapid in the lower part. . There is a seasonal high water table at or near the surface. Runoff is slow, and the erosion hazard is slight. This soil is used for row crops, pasture, and hay. Urban Land (Ur) . Urban land is soil that has been modified by disturbance of the natural layers with the addition of fill-up to several feet thick to accommodate industry or housing. 3. Vegetation: The subject site has been cleared and filled. What vegetation remains consists of low grass and scrub brush. 4. Wildlife: Existing vegetation may provide suitable habitat for birds and small mammals. 5. Water: No surface water was observed on the subject site (August 14 , 1981 ) . However, the site is subject to seasonal high water tables. 6. Land Use: The subject site presently is undeveloped. Properties immediately west and north are or will be developed as storage/warehousing uses with possibly some retail similar to the subject proposal. Future construction shall meet all City codes and requirements of the Fire Marshall as per Fire Department comment. 7. If future construction requires additional fire hydrants, the Utilities Engineering Division indicates that a water plan will be required.
