WASHINGTON 98055 November 2, 1982 Building & Zoning Department City of Renton 200 Mill Avenue Renton, WA 98055 To Whom It May Concern: The Housing Authority of the City of Renton has developed a 28-unit low-rent housing project, Cole Manor, on Lots number 1, 2 and 3 of Tino Cugini's Short Plat #2. The units are nearing completion without access for ingress and egress to N.E. Third Street except for emergency vehicles, according to conditions as set forth by the Hearing Examiner and the Fire Marshall. We understand that a development on Lot number 4 of Cugini's Short Plat #2 is being proposed. The Site Plans allow two entrances for ingress and egress onto N.E. Third Street, a four-lane highway. The development would contain four 10,000 gallon tanks under concrete pads on space abutting Cole Manor, and an 80' x 40' building to be used, we understand, as a car repair shop. The Site Plans show the building within five (5) feet of the property line between Cole Manor and the new development. We also note that future development is shown on a portion of Lot #4. What would be contemplated there? Would such future development cause our family units to diminish in property and aesthetic value? Does anyone know what type of develop- ment would be located there? Couldn't the building be placed on the easterly line of the property? I I! Regarding the Preliminary Report to the Hearing Examiner: Under 'M' , Departmental Recommendations, the Housing Authority approves 1 through 5, if the site approval is granted. We do not wish to stop progress but we also feel these questions should be asked and approval be given only as recommended in the Departmental Recommendations as herein referred to. SUMMARY OF REQUEST: The applicant seeks site plan approval for an auto service building. SUMMARY OF ACTION: Building & Zoning Department Recommendation: Approval with conditions Hearing Examiner Decision: Not approved. BUILDING & ZONING The Building & Zoning Department report was received by the DEPARTMENT REPORT: Examiner on October 26, 1982. PUBLIC HEARING: After reviewing the Building & Zoning Department report , examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on November 2, 1982 at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. Roger Blaylock, Zoning Administrator, presented the Building & Zoning Department report, and entered the following exhibits into the record: Exhibit #1 : Application File including Building & Zoning Department report and other pertinent documents Exhibit #2: Site Plan as submitted Exhibit #3: Site Plan with staff comments Exhibit #4: Site Approval for Superstructures, File No. SA-066-81 , adjoining property (by reference) Exhibit #5: As-built drawings for Superstructures, received May 5, 1982 by reference Exhibit #6: As-built drawings for sidewalks located along N.E. 3rd Street Exhibit #7: Letter received November 2, 1982 from James Colt, Mt. Olivet Cemetery, regarding retention systems on site and recharge of aquifer Mr. Blaylock noted that concerns and requests included in Exhibit #7 are already conditions of approval of the Environmental Review Committee. Corrections to the staff report were provided as follows: Section B.7. Existing Zoning, should include L-1 as well as B-1 denoted; Section B.9. Comprehensive Land Use Plan Designation is incorrectly denoted as commercial and should be revised to medium density multifamily designation. Blaylock advised that although the Comprehensive Plan designation is incompatible with proposed development, the project conforms to uses allowed in existing zoning categories on site. Multifamily development to the west and north of the property will require substantial buffering from the subject commercial use, and recommendations for provision of landscaping and a concrete fence were discussed. Responding to the Examiner's inquiry regarding Phase II plans, Mr. Blaylock advised that the second phase is yet to be determined; however it may be reserved for expansion of the Phase I building area or redevelopment of the site for another use. Section L. 1 which states that the proposal is consistent with the Comprehensive Plan designation was corrected; to denote inconsistency. Responding to the Examiner's request for clarification of the proposed use, whether it be an auto repair shop, service station, gas station or all of the uses, Mr. Blaylock advised that three service bays would be located in the facility along with gas pumps, and sales and administrative offices. To buffer the site from adjacent multifamily development, the proposed building would be faced away from existing development and blocked by a 17-foot solid concrete block wall to deflect noise towards the east. SA-066-82 Page Two Mr. Blaylock pointed out discrepancies on the applicant 's site plan submissions relating to property lines and sidewalk locations, described setback requirements for abutting residential and commercial properties, and reported the following modifications in the departmental recommendation: eliminate Section M. 1 ; revise Section M.2 to read: Construction of an eight (8) foot concrete fence along the western and northern property lines to provide buffering between the two uses; addition of Section M.6 to require screening of rooftop equipment. The Examiner requested testimony by the applicant. Responding was: Louis Peretti 115 Monterey Place N.E. Renton, WA 98056 Mr. Peretti indicated knowledge of the discrepancy between the property line and the sidewalk. He advised concurrence in the staff recommendation for elimination of the requirement for a 15-foot landscaped setback along the western and northern property lines and requirement for a concrete fence along those boundaries since continuation of the back wall of the building is desired. Addressing the staff recommendation for redesign of the site to allow emergency vehicle access per code requirements, Mr. Peretti stated that a thorough study of access to service stations has been accomplished by him throughout the United States and the site plan as presented will allow efficient access. Section M.5 requiring a 10-foot landscaped setback was felt to be excessive along N.E. 3rd Street. Referencing Section L.8 which requires a latecomers' fee for water, Mr . Peretti outlined history of utility extensions and agreements, expression objection to the latecomers' fee. The Examiner clarified that the issues of contention are not within his jurisdiction because they had either been imposed by the Environmental Review Committee or were required by code. Discussion indicated that although Mr. Peretti had received the public hearing notice at his business address (other than that listed above) , he did not receive the report published by the Environmental Review Committee for his project. Mr. Blaylock indicated that all correspondence and reports had been mailed according to city records. Further discussion revealed that although the service station is not currently proposed to be a 24-hour operation, such a use may occur in the future; current plans for service include tune ups, lubrications, replacement of brake linings; design of the building will be "L" shaped and uses may not be limited to entirely automobile related uses; and three vacant commercial parcels exist to the east of the site. The Examiner requested testimony in opposition to the proposal . Responding was: Floyd Shaff Chairman of the Board Renton Housing Authority P.O. Box 2316 Renton, WA 98056 representing: A. J. Ladner, Executive Director same address) Mr. Shaff reviewed history of the adjacent Housing Authority development containing 28 units of from one to three bedrooms. He indicated concern regarding location of a service station within five feet from the property line of the Housing Authority development, and questioned development of Lot 4 which is yet to be determined. Reduction of aesthetic value of residential property was discussed and a suggestion made to shift the proposed structure to the easterly boundary of the site. Responding to the staff recommendation, Mr. Shaff indicated no objection to the conditions as denoted and the five foot building setback would be acceptable if the solid concrete fence were constructed along the western property line. The Examiner inquired if there is any reason why the building could not be oriented towards the east property line instead of the west property line. Mr. Peretti advised that because traffic flow is generated from east to west, visual exposure of the building is imperative to the business use and provides the rationale for location of the building. Responding to the Examiner 's inquiry regarding impact to multiple family housing to the west, Mr. Peretti felt that noise impacts would be predicated upon each individual 's tolerance. However, he felt that the noise would be minimal . The Examiner requested final comments. Mr. Blaylock indicated staff concern with placement of the building on the east side of the site which would orient the building towards the multifamily development instead of away from it. Since there were no further comments, the hearing regarding File No. SA-066-82 was closed by the Examiner at 9:55 a.m. SA-0L_ 32 Page Three FINDINGS, CONCLUSIONS & RECOMMENDATIONS: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Louis Peretti , filed a request for approval of a site plan for gaso- line service station. 2. The application file containing the application, SEPA documentation, the Building and Zoning Department report, and other pertinent documents was entered into the record as Exhibit #1. 3. Pursuant to the City of Renton 's Environmental Ordinance and the State Environmental Policy Act of 1971, RCP 43.21C, as amended, a Declaration of Non-significance has been issued for the subject proposal by the Environmental Review Committee (ERC) , responsible official . 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. The subject property is located on the north side of N.E. 3rd Street between Index Avenue N.E. and Harrington Avenue N. E. , as extended. 6. The subject property was annexed into the city in June of 1956 by Ordinance 1549. In April of 1964, part of the subject site was reclassified to B-1 (business/ commercial ) by Ordinance 2085. The remainder of the site was classified to L-1 light industry) . The site was subdivided by Tino Cugini in August of 1979, and site plan review was required of any proposed use of the subject site (Short Plat 384-79) . 7. The subject site is primarily classified B-1. A rather small triangle at the extreme southwestern end of the property is classified L-1. 8. The Comprehensive Plan designates the area in which the subject site is located as suitable for the development of multi-family housing at medium densities. 9. North of the subject site' s B-1 district is an R-1 (single family residential , minimum lot size 7,200 square feet) district. West of the site is G-1 (general , single family residential , minimum lot size 35,000 square feet) district. Across N. E. 3rd Street to the south is the remaining portion of the L-1 district, which includes the small portion of the subject site. 10. Immediately west and north of the subject site is the recently authorized low income housing complex. North of N. E. 4th Street is a single family subdivision. Most of the properties south of the site south of N.E. 3rd Street are undeveloped. The sub- ject site is also undeveloped. 11. The applicant proposes erecting a 3,200 square foot gasoline service station on the approximately 38,000 square foot site. The proposal will also contain two pump islands. Four (4) 10,000 gallon tanks containing gasoline will be buried beneath the site. 12. The Housing Authority of the City of Renton raised a number of concerns regarding the location of the proposal immediately adjacent to its housing complex. That agency did not oppose the project directly but questioned the effects the project would have on the property value and aesthetic value of the housing complex. 13. Site plan review was required because of the sensitive nature of the mixed zoning of the original short plat and the various elements of the Comprehensive Plan, as it applied to the subject site. 14. City staff originally recommended that the proposed gasoline station be moved 15 feet south and east to provide additional landscape buffering areas. The Police Department and the Policy Development Department are concerned about the buffering between the proposed use and the multi-family complex next door. The proposal would have to be set back ten feet from N.E. 3rd Street (Section 4-716), a major arterial street. The Fire Department has indicated that the on-site maneuvering is not adequately provided for in the site plans. The Fire Department would have final review and approval authority over fire relating aspects of the site plan. 15. Mt. Olivet Cemetery requested that the conditions imposed by the ERC regarding storm water recharge be enforced by the city in the development of this site. Those condi- tions were imposed and no appeal filed therefrom, and they are, therefore,effective for the subject site. SA-066-82 Page Four CONCLUSIONS: 1. The applicant has failed to demonstrate why a gasoline service station should be permitted to be located immediately adjacent to residential development. The proposal not only violates the general goals and policies of the Comprehensive Plan requiring segregation of incompatible uses but also violates the map element designation of the site for multi-family uses. That designation led to the estab- lishment of a well designed housing complex for low income residential on property which abuts the proposed use on both the north and the west. The residential units will be within 15 to 20 feet of a full service gasoline station with pumps, islands and service bays. The housing complex was separately reviewed and approved by the City Council , and that complex's residential amenities will be jeopardized by per- mitting an intrusive gasoline station on the subject site. The subject site actually wedges its way into the residential complex, as it intrudes into the open end of the "L" shaped housing complex. 2. While the housing complex provides a landscape buffer, such buffer will not effec- tively screen out the noise or odors of the service station. The proposed solid concrete wall may screen out some of the noise and some of the light and glare, but this is not certain. 3. The proposed use is incompatible with the quiet necessary for residential enjoyment. The station could operate 24 hours per day. The fact that the housing is for low income residential should not preclude the city from effectuating desirable land use patterns. All residents should have an equal opportunity to obtain sound housing." (Policy 4.A.2) While the complex was developed to cater to low income residents, they also deserve the residential amenities implied in good land use planning. Permitting the operation of a gasoline service station with four 10,000 gallon gasoline storage tanks adjacent to a residential complex is detrimental to the public health, safety and welfare. 4. The fact that other similar juxapositions may already exist in the city is not reason to permit further inconsistent and incompatible arrangements of residential and commercial development. Incompatible uses should be gradually eliminated" (Policy 4.A.4) and not intro- duced. Commercial areas should be compatible with adjacent land uses. " (Policy 5.A.7) The site can be utilized for other commercial development of a less intrusive nature. Certainly, since the map element of the Comprehensive Plan designates the area for multi-family residential uses, the applicant must make some effort to employ the commercial zoning of the property in a fashion which is compatible with the existing uses. 5. "Boundaries of districts should be buffered by uses compatible with each district. " Policy 3.B.3) While the identity of this district is somewhat unclear, a gasoline service station certainly does not provide development compatible with the multi- family housing complex next door. Transitional commercial uses could provide convenience services to the residential areas immediately adjacent to the site to the north and west without imposing intense commercial development such as the proposed gasoline station with its attendant odors, noise, and glare. 6. "Urban development should be permitted, when it is compatible with the natural and human environment." (Policy 1.A.2) Conversely, it could be stated that urban development should not be permitted when it is incompatible. A gasoline service station immediately abutting residential development is an incompatible use. The various goals and policies cited herein provide ample justification to deny the applicant ability to develop the intended use on the subject site. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk accompanying a filing fee of $25.00 and meeting other specified requirements. PAGE TWO D. PHYSICAL BACKGROUND: 1 . Topography: The site is essentially level. 2. Soils : Arent, Everett Material (An) . Permeability is rapid and available water capacity is low. Runoff is slow and the erosion hazard is slight. This soil is used for urban development. 3. Vegetation: Scrub grasses exist on the site. At sometime in the past most natural vegetation was removed. 4 . Wildlife: Some rodents and small birds inhabit the subject site. 5. Water: No surface water was observed on the subject site (October 22, 1982) . 6. Land Use: The subject site is undeveloped at this time. Properties to the east and south remain undeveloped. A small multiple family complex is nearing completion adjacent on the west and north. E. NEIGHBORHOOD CHARACTERISTICS: The area is in transition from generally undeveloped and low intensity land uses to a mixture of multiple family and commercial. F. PUBLIC SERVICES: 1 . Water and Sewer : A sixteen (16) inch water main runs along N.E. 3rd Street in a northeasterly - southwesterly direction and an eight (8) inch water main runs east-west on N.E. 4th Street. DEPARTMENT ANALYSIS: 1 . The proposal is consistent with the Comprehensive Plan designation of Commercial and the present zoning of B-1 , Business Use. 2 . The proposal is to construct a 3,200 square foot building on a 38,000 square foot commercial lot. The building will house an auto service facilityincludinggasolinepumps. The building will have a maximum height of seventeen ( 17) feet and will be constructed from concrete block and brick. PAGE FOUR 3. The Environmental Review Committee has issued a declaration of non-significance subject to two conditions. The first conditions is that no left turns shall be permitted onto or out of the subject site on to N.E. 3rd Street. A median barrier shall be installed by the applicant on N.E. 3rd Street to preclude left turns. The second condition was that the storm water retention system be designed to recharge the natural aquifer. 4 . The project proposal generally complies with the goals and policies of the Comprehensive Plan. However, it does appear to be in specific conflict with the intent of several policies which suggest the separation of incompatible uses. In this specific case, we are dealing with a high intensity commercial activity and an adjoining multiple family activity. Policy 5.A. 7 on page 11 , Policy 5.B. 3 on page 12, Policy 4.D. 2 & 4 .C. 5 on page 9, and Policy 3.C. 3 on page 7, all suggest that setbacks and adequate landscape screening should be provided between dissimilar uses. The specific proposal would allow the construction of an eighty (80) foot long, seventeen (17) foot high commercial building without windows only five feet from the residential property line. Even though the site plan approval for the multiple family residential development required substantial landscaping along their eastern property line, it would appear that the commercial activity would intrude into the residential function. The building itself will provide partial site screening of the subject site from the residential development to the west and north. However, glare from the parking lot will intrude into the residential area unless a solid sight obscuring fence is constructed south of the proposed building along the western property line. To assure the establishment of adequate buffers on the entire commercial site prior to the development of the second phase, the western and northern perimeters of the site should be landscaped with comparable landscaping materials that have been utilized in the adjacent multiple family development. To provide sufficient area for the landscaping buffer, the parking lot and building should be located at least fifteen (15) feet from the western and northern property lines. Landscaping should be installed in this fifteen (15) foot area at the present time. 5. Both the Police and Policy Development Departments are concerned with the buffering between the proposed service center and the adjacent residential uses. In addition, Policy Development has voiced concerns with the compatibility of building architecture, lighting and the effects of noise with the existing multiple family residential. Providing sufficient buffering between the two uses should reduce the noise, glare and aesthetic impacts of the proposal upon the existing adjacent uses. The Building Division advises that a ten (10) foot landscaped setback is required along N.E. 3rd Street per ordinance requirements. 7. The Fire Department is concerned with on-site maneauvering of emergency vehicles. It does not provide a clear twenty (20) foot access drive for ingress and egress. Furthermore, the site plan suggests a potential difficulty with maneauvering large gasoline tanker trucks on the site to service the gasoline pumps. It would appear that the entire function would have to be relocated slightly to the north to allow appropriate emergency access and maneauvering for vehicles. 8. The Utilities Division of the Public Works Department advises that latecomer ' s fees will be required for water in the amount of $913.34 . 9. Department comments are attached for the Examiner ' s and the public review. M. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the site approval, file SA-066-82, be approved subject to the following conditions : 1 . Provision for a minimum of a fifteen (15) foot landscaped setback along the western and northern property lines. Landscaping plans to be approved by the City's Landscape Architect. 2. Construction of a six (6) foot sight obscuring fence along the western property line south of the building to the public right-of-way. 3. Redesign of the site to allow emergency vehicle access per code requirements and maneauvering of gasoline tank trucks on the subject site. Approval to granted by the Fire Department and Building and Zoning Departments. 4 . Provision for lighting to compatible and directed away from the multiple family use area and the public right-of-way. 5.
