Program 1984- Funding for the proposal , which proposes four lanes with sidewalks 1989 (colt. ) on both sides, is currently being sought through EDA fund applications, and it appears the project ranks high in priority. Councilman Stredicke indicated his opinion that due to timing of state project , priority item 25, Sunset Boulevard NE, 1-405 to NE Park Drive, will be one of the first to be accomplished. MOVED BY STREDICKE, SECONDED BY ROCKHILL, CLOSE THE PUBLIC HEARING. CARRIED. Springbrook/ Policy Development Department proposed Springbrook/Alberthal Albertha Annexation for 2. 7 acre site located along the east side of Annexation Talbot Road South adjacent to Springbrook Watershed to ensure protection of city water supply and key transmission main. Set public hearing for July 11 , 1983. MOVED BY TRIMM, SECONDED BY CLYMER, COUNCIL ADOPT THE CONSENT AGENDA AS PRESENTED. CARRIED. CORRESPONDENCE Paul A. Friedrich, Assistant Administrator of Valley General Long Ran,le Hospital , provided the hospital ' s updated progress report on Planning its long range planning process. Numerous meetings with various Process Update - hospital representatives, elected officials and consumers were Valley General held from March through June, this year, and a 60 member Consumer Hospital Advisory Council formed. The following alternatives for hospital service to the community are currently being reviewed: 1 ) traditional hospital ; 2) community medical center; 3) regional referral hospital such as Harborview; or' 4) combination of alternatives. First draft of the committee' s recommendation will be publicly reviewed on July 7, 1983. Councilman Rockhill requested fiscal responsibility by hospital administrators in view of escalating medical costs and suggested referral to other facilities within limited distance for certain services. Councilman Hughes concurred, noting concern with charges being imposed following treatment and limited coverage to Medicare patients. Park and Ride Councilman Stredicke advised the State Department of Transportation Lot - Hic_ hlands is no longer pursuing plans to locate a Park and Ride lot at the Highlands Community Church site; but will report back to Council following review of other alternative locations in the Highlands. Open Space Citing recent newspaper article regarding reclassification by King Classification County Assessor Harley Hoppe of Longacres Race Track to open space Longacres Race category, Councilman Stredicke requested investigation of the Track matter. Mayor Shinpoch agreed to research whether or not the designation has been changed, and, if so, whether or not the King County Assessor has authority for approval of the revision. Shinpoch, Mayor Members of Renton City Council Municipal Building Renton, WA 98056 RE: Zoning Information Request (B-1, L-1 and MP Zones) Dear Mayor and Council Members: In response to the City Council's request of June 13, 1983, to distinguish the difference between the B- 1 (Business Use); L-•1 (Light Industrial); and MP (Manufacturing Park) Zones, the following is offered by the staff: B-1: The B-1, Business Use Zone, generally allows retail sales and services, entertainment, and multiple family residential uses. Offices have been considered retail services. L-1: The L-1, Light Industry Zone, allows all uses in the B-1, Business Use Zone, plus certain industrial uses which are considered "light" in character such as (1) auto body repair shops, 2) clothing manufacturing, (3) commercial bakeries, and (4) warehousing. MP: The MP, Manufacturing Park Zone, allows all uses permitted in the L-1, Light Industry Zone. However, it differs by imposing greater setback requirements (60 feet compared to zero), and performance standards for (1) noise, (2) smoke, (3) dust, (4) odors, (5) toxic gasses, (6) vibrations, and (7) glare and heat. Anderson File Number - R-013-83 Petition for Reconsideration Sir: Re would like this letter to constitute our Petition for Reconsideration of the Hearing Examiner ' s recommendations of April 25, 1983 , and his letter of May 6 , 1983. First, we would like a clarification of the Hearing Exam- iner ' s final paragraph in his letter of May 6 , 1983. Spec- ifically, what constitutes "appropriately fenced and land- scaped. . . " It was our understanding that because detailed site plans (dated April 29 , 1983) were submitted with our May 4, 1983 , Petition for Reconsideration, the landscaping and set backs as shown were acceptable. It now appears that there might be some confusion on that point. We intend to put up a wooden fence the length of the western property line. This would be between 48" and 72" high depending on the Hearing Examiner ' s requirement. Substan- tial landscaping would be used to buffer the actual building structure from the one family residence to the west. How- ever , it is our desire, as shown on the April 29th site plan, to have a sidewalk on the northwest corner of the property to service the alternate entrance and exit. We plan to have two feet of landscaping in this area which is north of the building structure. " It was our understanding the submitting of detailed site plans to the Planning Department and then to the Hearing Examiner, with our Petition for Reconsideration, would be sufficient. Those plans were drawn after consulting with the various interested departments of the City of Renton. Time is of the essence for both the building partnership and present property owners. The business owned by partners, Minietta and Anderson (Anderson & Associates , Inc. ) will be a major tenant in the proposed building. Anderson & Assoc- iates , Inc. , is presently leasing space in a local office building. This lease expires in September 1983 and it is important to have the proposed building completed by that date. The present property owners, Mr. and Mrs. George Little, need to purchase another homesite. They have found the home they wish to purchase but their decision is based on the rezone of this property. The building partnership has gone to considerable expense to have detailed plans drawn in advance of the approval of the rezoning because of the deadlines referred to above. The westerly abutting property, while one of the few remaining single family homes in this area, is nonetheless entitled to protection from more intense uses. Therefore, consideration of the policies enunciated by the Comprehensive Plan concerning incompatible uses requires buffering greater than that indicated in the zoning code. While the code may indicate a smaller buffer, that is only applicable to existing zones. Since your request is to reclassify the site, it is within the city's authority to condition the rezone as necessary to effectuate good land use planning. Therefore, the requirement for a larger buffer. This is especially so where, as in the instant case, your proposal does not meet the designation in the Comprehensive Plan. (This plan is part of the April 12 , 1983, Public Hearing file. ) The con- tractor was told a few days later the site plan appeared to be acceptable. Based on this , we hired Architect Rodney G. Parr & Associates to draw tentative plans . These plans were entered into the record at the April 12 , 1983 , hearing. It should be mentioned, that prior to drawing these plans , a representative of the architectural firm also called the City of Renton Building/Zoning Department and was told the tentative plan appeared acceptable. 15 SO. Kaufman May 4 , 1983 City of Renton Page Two After the April 12 , 1983 , hearing, it was obvious that if Departmental Recommendation lb. be accepted by the Hearing Examiner, we could not build the building where we desired, that is near the east side of the property. The recom- mended twenty foot set back from Maple Street would not allow sufficient space for parking on the west side of the property. Our representatives again went to the Building/Zoning Department to see if this tentative plan was acceptable and again, we were given tentative assurances that the final decision would not be more restrictive than the Departmental Recommendations. Based on this, we went back to the archi- tect and he drew the attached plan with the building on the west side of the property. Now, apparently "to protect the single family home to the west . . . " , the Hearing Examiner recommends a ten foot set back instead of a six foot set back on the west side. (See April 25, 1983 , report Conclusions 4. ) This would make the enclosed plan unaccept- able and make it virtually impossible for us to use this piece of property for our needs. It should also be pointed out that we went ahead with archi- tectural expense based on "tentative approval" as time is of the essence for both the building partnership and the present property owners, Mr. and Mrs. George Little. Specifically, we request reconsideration of Recommendation lb. and request that the set back from the west side of the property be set at six feet. The reasons are as follows: 1) The Hearing Examiner 's recommendation was based on his conclusion that a ten foot set back from the western boundary is necessary to protect the single family home to the west. This conclusion is incorrect. Attached is a note signed by the property owner to the west, Alice M. Ashley. She has no objection to the six foot set back. In fact, she has indi- cated she would like to see the building built on the west side of the property so the parking lot is not next to her property. Fred J. Kaufman May 4 , 1983 City of Renton Page Three We feel both the letter from Mrs . Ashley and the attached site plan constitute new evidence. First, the site plan had not been drawn at the time of the Public Hearing. Second, as the Department Recommendations called for a six foot set back, no reasonable person would have assumed that a letter from Mrs. Ashley indicating that the six foot set back was accept- able to her would be necessary. It should also be pointed out that there are no other residences left west of the property to protect. 2) The Code calls for a five foot set back from side yards and a ten foot set back from rear yards. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on April 5, 1983. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on April 12, 1983, at 9:45 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. Roger Blaylock, Zoning Administrator, presented the Building and Zoning Department report. The following documents were entered into the record as follows: Exhibit #1: Application file containing the Building and Zoning Department report and other pertinent documents. Exhibit #2: Assessor's Map showing the subject site and its relationship to the vicinity. Exhibit #3: Site Plan Map for illustrative purposes, which is not binding upon the City nor the applicant at this time. Mr. Blaylock reported that the Environmental Review Committee has placed the following conditions upon the proposed rezone: 1. Positive outflow for storm drainage shall be provided; 2. Participation in street improvements on Grady Way between Maple Avenue S. W. and Rainier Avenue South for additional capacity is required. Based upon a fractional share of the acreage, the amount of charge for the subject property will be $6,493.50. Mr. Blaylock further indicated the ERC issued a Declaration of Non-Significance, the appeal period expiring on April 11, 1983 and that there have been no objections received to that declaration. The Examiner asked if parking along the alleyway would be maneuvering on the public right-of-way or would the maneuvering take place in the parking lot. Mr. Blaylock stated the maneuvering would take place in the alleyway; he does not believe there would be any restrictions to backing into an alleyway. Minietta/Anderson: R-013-83 April 25, 1983 Page 2 Mr. Blaylock reported that the Building and Zoning Department recommends approval of the rezone, subject to the following conditions: 1. Filing of restrictive covenants requiring: a. Site plan approval, including landscaping approval; b. Building setback requirements of twenty (20) feet from all public rights-of-way and six (6) feet from the western property line; c. Require construction off six (6) foot solid sight-obscuring fence prior to the occupancy of the structure. There should be provision to allow the elimination of the six (6) foot setback and the six (6) foot solid sight-obscuring fence if the property adjacent to the west is rezoned either B-1 or L-1. The Examiner called for testimony from the applicant. Testifying was: Jack Ewing 622 S. Central Kent, WA 98031 Mr. Ewing reported he is the Engineer for the proposal and asked that the architectural site plan be entered into the record. The Examiner entered the following into the record: Exhibit #4: Architectural site plan of elevations and landscaping for the proposed improvements to R-013-83. Mr. Ewing indicated with respect to improvements on Grady Way, the applicant has no problems in terms of the dollar amount; the problem is with the time schedule. He stated if no time frame is established for the street improvements to Grady Way, then it is not timely to provide the $6,493.50 at this time. In terms of the overall zoning, because of the size of the lot, the MP zone is inappropriate for that area. He feels the area should be looked at as an L-1 or B-1 zone as it is being treated now. In terms of the site-obscuring fence along the west property line, there is an existing 4-foot high fence along the northern 40 feet of that west property line. It is felt by the applicant that this fence (which encroaches slightly on the property and belongs to the neighboring property owner) is adequate; that it is not logical to construct a six-foot fence adjacent to the four-foot fence and in terms of the zoning code, there is provision for a 42-inch high site-obscuring fence in conjunction with landscaping. Mr. Ewing suggested a four-foot fence be used which would be consistent with the existing fence on the property. In regards to the sewer line extension and talking to Mr. Monaghan, it is their understanding that the sewer line is supposed to be on Maple Avenue, not along the west property line; they have no problems with this as long as there is a latecomer's agreement that is attached to the extension of that main line. Mr. Ewing asked for clarification in terms of the water main extension required. He stated there is an existing 12-inch main in Maple and an existing 6-inch main in 12th and he cannot see where there would be any water main extension required by the City. In terms of the curbing on the alleyway, he is still somewhat confused by the requirement. If it is consistent with what is shown on the site plan, there is no problem; if it is something else, he does not understand what the requirement is. Mr. Ewing stated that the site plan shows a two foot separation from the alley to the first parking stall; this is consistent with the parking that is on the north side of the alley for the two existing office buildings. In terms of the parking spaces where they will be backing out or maneuvering into the alley, they have provided the added depth (8 feet) so they have 24-inch turning line so that the stalls are 8' oversized. Mr. Ewing further stated that Maple Avenue, in terms of the overlay, would be a standard condition as long as it is only the west half of the street; if talking about overlaying the entire street, he feels the office building which is on the east side of Maple should also participate, the same as it relates to 12th Street. Again, they are talking about a half street improvement rather than the whole street. The storm drainage issue was one they will have to address, as well as Mr. Gray and the other property owners in the area, and they have no problem with that position. Minietta/Anderson: R-013-83 April 25, 1983 Page 3 In meeting with the City staff prior to the application and reviewing what has been proposed in the site plan, it has been proposed for a 20-foot setback along 12th Street, which is consistent with the existing residential uses in the area and also the other office building; however, with Maple Avenue not being a major street, nor ever intended to be anything other than a collector, the applicant is consistent with the B-1 zoning code in providing 5-foot setback from Maple, not 12 feet. There is a 7-foot strip from the back of the sidewalk to the property line that will also be landscaped, but that is part of the public right-of-way. There is also one other variation that was not mentioned, but is shown on the site plan and that is the two parking spaces that are at the southwesterly portion of the site are within five feet of the right-of-way so there would be a five foot landscaping strip on that area rather than the provision for ten feet. The site plan, as presented, is consistent with the B-1 zoning code. The Examiner stated he is concerned about zoning to B-1 rather than Manufacturing Park or Light Industrial and that the City, according to the Comprehensive Plan, is not trying to condone possible retail use of any of this property; they are trying to make sure it is used during the rush hours. Mr. Ewing stated either L-1 or B-1 is permitted use for this facility; it makes no difference. The Examiner called for further testimony in support of the application. There was none offered. The Examiner then called for testimony in opposition to the application. None was offered. The Examiner called on Gary Norris, Traffic Engineer for the City, to explain the curb requirements referred to in Report 6-b. Mr. Norris reported that curb requirements at the alleyway were in relationship to the access of the alley on the northernmost part of the property. The City is trying to avoid having backing out of a stall and making 180 degree turns into the alley; they required curbing which is marked on the plans that were submitted for review, through that first stall to give a ten foot space and put the cars into a perpendicular entrance to the alley. He indicated the curb on the east side of the parking stall itself would direct the cars back at a 90-degree angle, rather than allowing use of the parking stall itself for maneuvering. Mr. Norris stated the intent regarding improvements at Grady Way and Maple was that they had many different proposals for development discussed for the property in this area and they have been major proposals and all lead to a major problem of access to that entire site either by Lind Avenue or by Grady Way and the City thought it pertinent if, at the beginning stages of development, to allow some kind of mechanism to provide accessability to the property and the manner proven most effective to date is to assess each of the individual properties on a fair share basis. In this case, it was the square footage of the land which resulted in the $6,493.50 figure. At this time, there is not a construction program on line for this; however, the City is constrained by State Law which only allows retention of a developer's money for five years; the money is held in escrow and the interest received goes directly to the developer, so the City is not necessarily getting the use of the money over the period of time it would be held. If the City does not, in that five-year period, develop a program to make those improvements, then the money reverts back to the developer. The Examiner stated that the condition was imposed by the ERC and it was not challenged at that time; the condition is not subject to the Examiner's review except if there was an appeal from that condition, and he has no jurisdiction over the setting of the fee or the timeliness question. The Examiner then called for further testimony. Testifying, after affirmation, was: Bob Bergstrom Engineering Supervisor City of Renton The Examiner asked Mr. Bergstrom what the Engineering Department means by a positive outflow storm drainage. Minietta/Anderson: R-013-83 April 25, 1983 Page 4 Mr. Bergstrom stated the proposed water main extension revolves around the existing 6-inch main at S. W. 12th Street; the Maple Avenue S. W. 12-inch water main was installed by the City in the mid 60's to serve water flows to the then developing area along Longacres in the Valley. The 6-inch water main on S. W. 12th Street may or may not be adequate and at this point, the City does not know that, but if it is proven by the Fire Marshal's Office that the system is at or near capacity, then the proper mechanism for upgrading that would be for the City to ask that the main be rebuilt in the future and the property owner would be asked to sign a temporary service agreement committing them to share costs equally with others in the Valley along S. W. 12th Street. At this point in time, it is uncertain if the existing 6-inch S. W. 12th Street main provides adequate flow to the area. Whether that condition will be imposed on the property owner is up to further design decisions that will be made. The Examiner then asked if there is a 12-inch main in Maple and whether that would provide sufficient flow. Mr. Bergstrom indicated the entire area was originally single family homes and a 6-inch main was built to accommodate the area; if the area is now changed to light industrial, a stronger grid water main system would have to be constructed in that area and it turns out that if the six-inch line does not provide that type of support, then it must be upgraded. However, it could possibly be done at a later date when there are more people to share that cost and the developer would not bear the full brunt of the costs. The Examiner asked what the meaning was of the term "positive outfall". Mr. Bergstrom responded by stating that a request was made by the Public Works Department to provide gravity storm sewer flow out of the entire area to some type of system that is operational. We now have two major drainage conduits to drain this neighborhood with an existing drainage system in Grady Way that was designed to drain the highway; there is also a second drainage system that the State Department of Transportation constructed when I-405 was built, and it is an open-ditch type system that runs along the south side of the 40-foot roadway at the Lind Avenue overcrossing bridge. The City is requesting the property owner provide drainage into that system; it is the only thing around which has enough capacity to handle major urban development in the proposed neighborhood. Mr. Bergstrom further indicated that the City is working with the Washington State Department of Transportation to increase the capacity in conjunction with the Department of Transportation's I-405/HOV lanes that are being rebuilt. The Examiner asked if the applicant needed special approval from the Department of Transportation or could they merely tie into the system. Mr. Bergstrom responded that a permit may be necessary if the applicant goes all the way to the freeway right-of-way. The Examiner called for further comments or testimony. Mr. Blaylock indicated that the City would take the position that the Examiner does have the right to consider a rezone to L-1 since there has been a public hearing discussing the merits of both the B-1 request and the L-1 alternative and would not require a new application to rezone to L-1. There being no further comments, the hearing was closed at 10:05 a.m. The Examiner asked for an additional week to consider this matter. There being no objections, he advised the report would be issued within 21 days. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicants, Mary A. Minietta and Delbert B. Anderson, filed a request for approval of a reclassification of property from R-1 (Single Family Residential; minimum lot size - 7,200 sq. ft.) to B-1 (Business/Commercial). 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents, was entered into the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC). Minietta/Anderson: R-013-83 April 25, 1983 Page 5 4. Plans for the proposal have been reviewed by all City Departments affected by the impact of this development. 5. The subject site is located at 1123 Maple Avenue S.W. The site is actually on the corner of Maple and S.W. 12th Street. 6. The site was annexed into the City by Ordinance 1928 in December of 1961. New zoning designations changed the original General zoning of the site to its current R-1. 7. An existing vacant single family home is located on the subject site. The vegetation on the site consists of lawn grass and other ornamental scrubs. 8. The site is essentially level, but is located in an area of potential ponding. Positive storm water control measures are necessary in the area of the subject site and staff has recommended that plans and profiles for a storm drainage system be submitted for approval. 9. The applicants propose to develop a 6,000 sq. ft. warehouse on the approximately .34 acre site if the rezone is approved. 10. The Comprehensive Plan designates the area in which the subject site is located as suitable for the development of manufacturing park uses. Similar requests have been granted in the area. (See Gray Rezone, Ordinance 3270; Dalpay Rezone, Ordinance 3308; Lewis Rezone, Ordinance 3482.) Building setbacks and landscaping of these setbacks have been required in these rezones to comply with the Green River Valley policies for areas designated for manufacturing parks. 11. The area contains a wide variety of uses, including older single family dwellings, commercial uses, and light industrial and warehousing uses. A single family dwelling is located west of the site, while existing office buildings are located east of the site. 12. The site is part of a multi-block R-1 district. An L-1 (Light Industrial) Zone is located west of the site, straddling Lind Avenue S.W. Immediately north of the site is a B-1 Zone, the category requested for the subject site. 13. I-405 is located east of the site and Grady Way is located north of the site. 14. The area is in transition from older single family uses to light industrial and office uses. CONCLUSIONS 1. The proponent of a rezone must demonstrate that the request is in the public interest and will not impair the public health, safety and welfare in addition to compliance with at least one of the three criteria listed in Section 4-3010, which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the property or area. While the request is not entirely compatible with the Comprehensive Plan designation of manufacturing park for the area, the nature of the lot and surrounding development indicate that the request is justified. 2. The older single family homes in the area have begun to give way to industrial uses and office uses as the area begins its transition to more intensive uses as a result of the construction of I-405. The request would permit the applicants to reasonably redevelop the site with uses approximating those indicated in the Comprehensive Plan. Minietta/Anderson: R-013-83 April 25, 1983 Page 6 3. In order to provide some fidelity to the designation in the Comprehensive Plan, the applicants should provide setbacks from streets and adjoining development similar in nature, if not exactly in size, to that provided in manufacturing park zones. Therefore, the applicants should execute restrictive covenants providing for a 20 foot setback from any adjacent public right-of-way with appropriate landscape treatment, subject to approval of the City. This provision is intended to approximate the provisions of the Manufacturing Park. As such, the requirement is not dependent on the nature of an abutting street, but is intended to enhance the visual image of the City and its various districts as set forth in the Comprehensive Plan. 4. To protect the single family home to the west, a 10 foot setback with fence and landscaping should be provided. While the area is in transition, the policies element of the Comprehensive Plan requires that dissimilar districts be protected from intrusive uses, and landscaping and fencing should be liberally utilized to serve this policy. 5. The rezone of the property will continue the transition to the south of the existing business zone. It will also be compatible with the L-1 zone now located to the west along Lind Avenue. 6. Because the Comprehensive Plan designated the site and area for manufacturing park uses, it would be inappropriate to develop retail uses on the subject site. Therefore, further restrictions should be placed upon the use of the property to limit the site to office use, rather than permit retail trade. RECOMMENDATION: The City Council should reclassify the subject property from R-1 to B-1, subject to the following conditions: 1. The applicant execute restrictive covenants which specify that the site will provide: a. Twenty (20) foot setbacks along all adjacent streets. b. Ten (10) foot setbacks from dissimilarly developed zoning districts which must be fenced by view obscuring means and landscaped as approved by the City. c.No retail use shall be developed on the property. 2. NEIGHBORHOOD CHARACTERISTICS: The neighborhood is a mixture of residential and business uses interspersed with vacant lots. There is evidence of some transition of uses from residential uses to business uses with a concentration of non-residential uses primarily along S.W. Grady Way. To the east and north of the subject site are existing office buildings, while to the west is a single family residence. Across S.W. 12th Street to the south is vacant land. F. PUBLIC SERVICES: 1.Water and Sewer: A twelve-inch water line is adjacent to the property along Maple Avenue S.W. and a six-inch water line is adjacent to the property along S.W. 12th Street. An eight-inch sanitary sewer line is located along the alley adjacent to the north property line of the subject site. 2. Fire Protection: Provided by the City of Renton as per ordinance requirements. 3. Transit: METRO Transit Route #145 operates on S.W. City of Renton Parks & Recreation Department. L. DEPARTMENT ANALYSIS; 1. The applicant Delbert B. Anderson and Mary A. Minietta, are requesting a rezone of .34 acres located on the northwest corner of S.W. 12th Street and Maple Avenue S.W. from R-1 to B-1 to construct a 6,000 square foot office building. 2. The Environmental Review Committee determined that there were be no adverse impacts on the environment or adjacent properties and have imposed the following conditions on the proposed rezone: a. Positive outflow for storm drainage shall be provided. b. Participation of street improvements on Grady Way between Maple Avenue S.W. and Rainier Avenue South for additional capacity is required. Based upon a fractional share of the acreage, the amount of charge for the subject property will be $6,493.50. 3. The Land Use Hearing Examiner must review four specific criteria under Section 4-3014(C) to determine that the circumstances surrounding the rezone request are adequate to recommend approval of the reclassification. The following evidence clearly demonstrates the rezone request is appropriate. a. That substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered at the time of the last area land use analysis and area zoning. The subject site was annexed to the city in 1961. Both the city-wide comprehensive plan adopted in 1965 and the Green River Valley Comprehensive Plan adopted in 1975, clearly show the area as designated for manufacturing park activities. The R-1 classification was applied in 1982, as a result of a major change in combining several single family residential zones to one classification. b. That the property is potentially classified for the proposed zone being requested pursuant to the policy set forth in the Comprehensive Plan and the conditions have been met that would indicate that the change is appropriate. The proposed rezone to B-1, Business Use, is not directly in conformance with the Comprehensive Plan Land Use Element designation of Manufacturing Park for the subject site. However, the city has approved a number of rezones in the general area to both B-1, Business Use and L-1, Light Industrial as a result of the strict application of setback requirements in the manufacturing zone which would preclude the function and development of these small lots and blocks. The result has been to impose restrictive covenants establishing minimum setbacks for buildings and specific landscaped areas. This policy has been utilized since the late 1960's with the most recent application in November, 1982, under Ordinance #3666. PRELIMINARY REPORT TO THE HEARING EXAMINER ANDERSON, DELBERT B. & MINIETTA, MARY A.: R-013-83 APRIL 12, 1983 PAGE 4 c. That since the last previous land use analysis of the area, zoning of the subject property, authorized public improvement, permitted private development, or other circumstances affecting the subject property have undergone significant and material change. Since 1975, the general area has undergone a substantial transition from the older single family residential development to commercial and industrial activities. Development of the property to the north, west and east to office uses suggest that the request is both appropriate and timely. d. Timeliness: The final test to determine whether a rezone request is appropriate is to address the question of timeliness. The subject property is the next incremental parcel to be developed both from the north and from the east. The residence located immediately to the west of the subject site must be screened by the proposed development. Public utilities, including streets, sewer and water are available to the subject site. It does appear that storm drainage may be an issue which has to be resolved prior to the actual construction of a building on the site. Thus, it would appear timely to allow the rezoning of the subject site. 4. The Policy Development Department has raised the concern over appropriate buffering between the anticipated office parking lot and the single family residence. The proposed site plan shows a varying width of landscaping which does not in itself provide adequate screening and separation of the uses. Policy Development suggests that a six (6) foot high noise/visual screen consisting of fencing/berm/landscaping along the west property line should be installed as an interim land use buffer. Removal could be allowed if the property to the west is intergrated with this use. It would appear that this is a logical requirement to screen the existing single family residence from the intensity of the proposed office building and parking lot. However, because of the variable width of the landscaping proposed on the site plan, a six (6) foot fence should be constructed along the property line to protect the single family residence. 5. The Engineering Division advises that the following conditions will apply: a. Plan and profile of all off-site improvements. b. Plan of on-site storm drainage. c. Original mylars of a and b above. d. Detail solution to storm drainage problem (ERC condition for positive outflow). e. Extension of the sanitary sewer south across the property to the center of S.W. 12th Street. f. Overlay of Maple Avenue S.W. may be required. 6. The comments from the Traffic Engineering Division suggests that modification will have to occur to the parking lot which may in turn effect the structure: a. Provide conduit and junction boxes for future street lighting. b. Curb ten (10) feet of space at the entrance of alleyway. c. Northwest corner of property parking space to have five (5) foot clearance from property line. PRELIMINARY REPORT TO THE HEARING EXAMINER ANDERSON, DELBERT B. & MINIETTA, MARY A.: R-013-83 APRIL 12, 1983 PAGE 5 7.Utility Engineering Division advises that (1) water main extension will have to be provided, (2) extension of sanitary sewer to south from alley to S.W. 12th Street along the west lot line of the property, (3) that a late comer's agreement for sewer in the amount of $2,177.77 is payable, and (4) that system development charges of $.04 per square foot of property is required for both water and sewer. 8. The site plan locates the building twenty (20) feet from the right-of-way for S.W. 12th Street and twelve (12) feet from the right-of-way for Maple Avenue S.W. The rezones that have been considered in the general area to allow zoning classifications less than the manufacturing park zone have required that restrictive covenants be imposed for both site plan approval and establishment of a minimum of twenty (20) foot setback from all public rights-of-way along with a ten (10) foot setback from adjacent property lines. The site plan, as presented, provides a fairly detailed presentation of the development of the site. It does lack completeness in relationship to the landscaping treatment surrounding the building which is considered a part of site plan review. The issue of building setback from Maple Avenue S.W. is critical in relationship to the other developments in the area. All other developments have been required to setback a minimum of twenty (20) feet as part of the restrictive covenants and there does not appear to be any logic for allowing the building to be setback only twelve (12) feet, except that Maple Avenue probably will not become a major street such as in the case of Lind Avenue or S.W. 16th where other requirements have been imposed. Compliance with this general requirement, if imposed, would reduce the square footage in the building and resolve some of the conflicts with parking spaces proposed along the northern property line. 9. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the rezone request, R-013-83, be recommended for approval to the City Council subject to the following conditions: 1.Filing of restrictive covenants requiring: a. Site plan approval including landscaping approval. b. Building setback requirements of twenty (20) feet from all public rights-of-way and six (6) feet from the western property line. c. Require construction of a six (6) foot solid sight-obscuring fence prior to the occupancy of the structure. Our plan is generally consistent with the proposed zoning but not specifically consistent as to setbacks, due to smaller parcels created by prior platting.
