Hearing Examiner Decision: Approval, subject to conditions. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPO RT: received by the Examiner on August 2, 1983. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on August 9, 1983, at 9:00 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The Examiner opened the hearing, affirmed the witnesses, and entered the following documents into the record as follows: Exhibit #1: Yellow file containing the application, staff report, and other pertinent information on posting and publication. Exhibit #2: Site Plan showing the subject site, building, and parking areas. Exhibit #3: Landscape Plan for the proposal. Exhibit #4: Review comments of the Policy Development Department. Roger Blaylock, Zoning Administrator, presented the staff report. He noted that Ordinance 3732 recently rezoned this property to B-1 with certain restrictive covenants attached thereto and that the property complies with the Comprehensive Plan designation. Discussion was held regarding reorganization of the parking space plans to comply with the code requirements since there is insufficient aisle space for 90-degr^e parking stalls along the alley and the width of the alley is not sufficient to accommodate bacing out in both directions. Mr. Blaylock reported the staff recommends approval of the application, subject to the following three conditions: 1. Securing from the adjacent property owner to the north a 4-foot perpetual easement for access over their property. 2. Elimination of the parking space at the northeast corner of the building with redesign to increase the aisel width to minimum standards of 24 feet. 3. Increase the curb cuts to a minimum of 24 feet. MINIETTA/ANDE R S ON SA-047-83 August 17, 1983 Page 2 The Examiner called on the applicant or representative for testimony. Responding was: Lloyd Small 14211 S. E. 165th Place Renton, WA 98056 Mr. Small indicated he felt the alleyway was adequate to allow a two-way traffic flow. He further stated that he had consulted with the Planning Department of the city and they had agreed that the 90 degree angle parking required only a 24' driveway; that the property owners have spent approximately $10,000 on redesign of the project and feels this should be taken into consideration. The Examiner explained that the question exists whether 60 degree parking was the final plan. That can be accommodated. The question would be the safety aspects of the alleyway and that would have to be a determination of the Board of Public Works. Mr. Small stated the applicants are in agreement with the staff's recommendations with the exception of the alleyway. The Examiner called for further testimony in support or opposition. The architect for the project entered his name into the record as follows: Larry Ho 11320 - 116th Place N.E. Kirkland, WA 98033 The Examiner called for further testimony in support or opposition to the application. Responding was: Larry Brown 13975 Interurban Avenue S. Seattle, WA 98168 Mr. Brown reported one of his clients has a proposed office building at the corner of Lind & Grady; preliminary site plan approval indicated access only from the alleyway into the site for a 3,000 sq. ft. office building. If one-way access was designated for the alleyway coming westbound, it would force all of the traffic into this project, making it very difficult to keep tenants in the building and for the customers. Mr. Brown stated he would support an eastbound alleyway if the decision of the Examiner is for a one-way alley in this matter. Mr. Blaylock noted there would be a problem when someone was attempting to make a left-hand turn from Lind into the alley; that this could back traffic through the intersection. The Examiner noted that these are considerations that the Board of Public Works and the Traffic Engineering Division will have to determine for that area. The Examiner called for further testimony in support or opposition of the application. There being none, the hearing was closed at 9:35 a.m. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicants, Mary A. Minietta and Delbert B. Anderson, filed a request for approval of a site plan for an office building. 2. The application file containing the application, SEPA (State Environmental Policy Act; RCW 43.21C) documentation, the Building and Zoning Department Report, and other pertinent documents was entered into the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA, the subject proposal is exempt from environmental review. 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. MINIETTA/ANDB RSON SA-047-83 August 17, 1983 Page 3 5. The subject property is located in the vicinity of 1123 Maple Avenue S.W. The site is level and is located on the northwest corner of Maple and S. W. 12th Street. 6. The subject site was annexed into the city by Ordinance 1928 in December of 1961. The site was zoned G- 6000 upon annexation. The site was reclassified to B-1 by Ordinance 3732 in June of this year (1983). Covenants required that the site plan be approved by the city after a public hearing. 7. The Comprehensive Plan designates the area in which the subject site is located as suitable for the development of manufacturing park uses. 8. The subject site is vacant. An alley is located immediately north of the subject site. 9. The area is developed with a variety of uses including some older single-family homes, new office uses and vacant land. This area between Grady Way and I-405 appears to be in transition to office and light industrial uses. 10. The applicant proposes constructing a 6,412 sq. ft. office building containing two floors. The applicant proposed parking for 28 vehicles in two separate areas. Access to one of the parking areas (7 stalls) would be via the alley with maneuvering occuring in the alley. Access to the, other parking area would be via 12th Street or the alley with all maneuvering taking place in the parking lot. 11. Staff review indicates that there is insufficient aisle space for 90 degree parking stalls along the alley, but sufficient space exists for 60 degree parking. Regarding the 60 degree parking, the alley width would not permit backing out to occur in both directions. The circulation pattern for the alley parking would be one-way only. Concerns were raised about limiting traffic in the alley to one-way traffic. This could involve impacts upon other alley parking and would have to be a safety matter resolved by the Traffic Engineering Division as well as the City Council. 12. The aisle width for the Maple Avenue parking lot must be modified to meet code requirements. This modification will require elimination of one parking stall. 13. The location of the building, less than 10 feet from the property line, will necessitate special fire wall provisions to meet the fire code. 14. The site plan submitted by the applicant has fully utilized the buildable portions of 1-.e site and there is almost no latitude in manipulating either the building or the parking areas. 15. The curb cuts under 24 feet in width must be redesigned to meet the code requirements. 16. While the Traffic Engineering Department has recommended that the driveway entrances be located 50 feet from Maple Avenue, the required location of the building is such that it cannot be achieved. The building must be set back from an adjoining single-family home. CONCLUSIONS: 1. The site plan appears to serve the public use and interest. The plan provides adequate parking for the proposed use and the use itself is generally in conformance with the Comprehensive Plans for the area. 2. The office building will provide additional commercial space, increasing the tax base and providing an additional locational choice for new office uses in the north end of the growing industrial valley. 3. The site plan so fully utilizes the site that options for relocating parking along the alley do not exist. As proposed, the 90 degree parking would provide inadequate aisle space on the subject site. While the other properties utilizing the alley may not provide adequate space, they are probably pre-existing non- conforming uses. MINIETTA/ANDERSON SA-047-83 August 17, 1983 Page 4 The applicant can slant the parking to 60 degrees, but because of the tight site plan, the parking can only be realigned in one direction. Staff have pointed out that this could present a traffic safety issue, but in fact 90 degree parking would probably present even greater hazards in backing into the alley than would the 60 degree parking. 4. The alternative option would be for the applicant to acquire an easement for maneuvering on the property to the north. Any revision to one-way circulation in the alley could infringe upon other users and this cannot be resolved in this proceeding. 5. The curb cuts must meet the code standard of 24 feet. The aisle width must also be modified to the 24 foot standard. DECISION: The SITE PLAN is approved, subject to the following conditions: 1. The curb cuts be widened to comply with the code requirements of 24 feet. 2. The parking stalls located off the alley be realigned to 60 degrees or the applicant acquire an easement to utilize the northern property for maneuvering for parking. 3. This application is in compliance with that directive. 3.A total of 28 parking spaces are provided to meet the parking needs of the 5,312 square feet of office space within the building, the 236 square feet of storage space, and the 864 square feet of stairways. Evaluation of the code requirements for net area would equal a total requirement of 27 parking spaces for the building and uses as proposed. 4. The site plan as presented is not scaled correctly and does not represent a true presentation of the parking areas under the code requirements. The northern portion of the parking lot aisle is only 21 and 22 feet wide as drawn. The parking spaces along Maple Avenue S.W. can actually be moved over under code requirements to within two feet of the propertY line since it is a sawtooth pattern. This would increase the aisle width witl.'n this section to approximately 22 and 23 feet. The only solution appears to be eliminating one of the parking spaces at the northeast corner of the building and widening the access aisle on the north. The number of parking spaces will comply with code requirements. 5. The Public Works Department is the only department making substantial comments. The Utilities Division advises that both a latecomer's agreement for sewer in the amount $2,177.77 is applicable along with systems development charges for water and sewer in the amount of $1,209.92. The Traffic Engineering Division states that the driveway widths are to be a minimum of 24 feet exclusive of tapers. In addition, the Traffic Engineering Division recommends that the edge of the driveway be at least 50 feet from the extended curb line of Maple Avenue S.W. This is not a specific code requirement and cannot be complied with because the building has been specifically moved from the eastern side of the lot to the western side of the lot at the direction of the Land Use Hearing Examiner. 6. The Building Division of the Building and Zoning Department states that specific building design modifications are necessary because the building is located only 6 feet from the west property line. The windows on the west along with the wall will be required to be fire protected. Also, the west wall. will require a parapet. If the building were 10 feet away, these items would not be required. The alley is only 16 feet wide, and the applicant has only provided 4 feet of on-site paving for a total aisle width of 20 feet. Code requirements for a 90° parking stall would be 24 feet for the adjacent aisle width. The site plan does not specifically comply with this code requirement; however, the property immediately to the north across the alley has provided 8 feet of paved aisle width on their side of the alley. So, in fact, we have a total distance of 28 feet of paving between the adjacent parking spaces utilizing the same aisle. It would appear, if the applicant can obtain an easement from that property owner, the intent of the ordinance would be complied with, and there would be functionally a 24-foot wide paved aisle per code requirements. 8. The application as submitted is a maximum use of the subject site. The site plan has taken full advantage of all minimum requirements for parking design and building setbacks with some minor modifications. 9. The Environmental Review Committee issued a memorandum of concurrence on the proposed project; however, there is an underlying declaration of non-significance with the following two conditions applied: a. Positive outflow for storm drainage shall be provided. b. Participation in street improvements on Grady Way between Maple Avenue S.W. and Rainier Avenue S. for additional capacity is required. Based on a fractional share of acreage, the amount charged for the subject property will be $6,493.50. M. DEPARTMENTAL RECOMMENDATION: Based on the above analysis, it is recommended that the request for site plan approval, file SA-047-83, be approved subject to the following conditions: 1. Securing from the adjacent property owner to the north a 4-foot perpetual easement for access over their property. 2.
