APPLICANT: BEVAART CONSTRUCTION CO. FILE NO. SA-056--83 LOCATION: 3700 West Valley Highway SUMMARY OF REQUEST: Applicant seeks site plan approval to allow a 40' x 120' column supported roof addition over an existing asphalt work area/truck load area. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval, subject to modification of building plans. Hearing Examiner Decision: Denial. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on September 14, 1983. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on September 20, 1983, at 9:30 a.m. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following documents were entered into the record as exhibits: Exhibit #1: Yellow file containing the application, star report and other pertinent documents relating to posting and publication. Exhibit #2: Site plan showing the existing structure and the proposed addition. Roger Blaylock, Zoning Administrator, presented the staff report. He stated the applicant is applying for his client, Van Daal, Inc., who owns the building and wants to cover their work area of 4,800 sq. ft., to be located on the north side of the existing building. Mr. Blaylock further noted the request does not specifically meet the intent of the Comprehensive Plan of providing a park-like setting for manufacturing operations. This would be located close to the street without being screened. The Policy Development Department has recommended that the western and northern sides of this addition be enclosed to minimize adverse appearance from storage of materials and supplies; and that the Fire Department is requiring sprinklers be installed in the addition. Mr. Blaylock reported the staff recommends approval of the request, subject to the modification of the building to require solid walls on the west side and a solid wall or loading doors on the north side. The Examiner called for testimony from the applicant or representative. Responding was: Bruce Rowe 1313 E. Prospect Street Seattle, WA 98112 BEVAART CONSTRUCTION CO. SA-056-83 September 27, 1983 Page 2 Mr. Rowe stated he was Chairman of the Board of Van Daal, Inc.; that he started the company in 1960; that he was appearing on behalf of the President of the company; and that he was owner of record of the building in question. He noted he made reference to this because he wanted the Examiner to note his interest in the property and in the business. Mr. Rowe further indicated that the building is highly visible from the highway and annual maintenance is already performed on the building and the landscaping to maintain an attractive site. He presented the Examiner with 13 photographs showing pictures of the Van Daal building and other surrounding businesses. The Examiner entered the photographs into the record as follows: Exhibit #3: Thirteen (13) photographs of the Van Daal, Inc. building and surrounding businesses. Mr. Rowe stated this is to be a temporary structure and must be removed when Van Daal's lease expires on the property; that this is not a manufacturing operation, merely cutting the length of the reinforced steel by machine rather than by hand; they are already marketing the steel. The Examiner expressed concern whether this activity is permitted on the outside of an enclosed building and inquired if there was a way this structure could be enclosed. Mr. Rowe indicated it was a small operation and if they expand any larger, they will have to move from the present site. The Examiner indicated he would take under consideration whether they have already outgrown this facility and this site. Mr. Rowe pointed out that the operation was not noisy; that he had to approve any modifications to the building and there is a possibility of moving this operation within the next two years because of the volume growth for the business. Discussion was held with respect to installation of sprinklers within the building and whether this would be required in this instance. Mr. Rowe suggested Van Daal be required to post a bond for the removal of the structure at the end of a 2-year period. The Examiner stated he would need some clarification before making that decision. Mr. Rowe indicated he is willing to cooperate with the City to show their good intentions. Mr. Blaylock suggested the area immediately west of the building be landscaped and that a partial wall be installed to eliminate any visual impact and reduce noise, and the installation of loading doors on the north side. The Examiner called for further testimony. There being none offered, the hearing was closed at 10:10 a.m. The Examiner reported he would issue his decision within 14 days. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicants, Bevaart Construction Co., filed a request for approval of a site plan for a shed addition to a manufacturing building. 2. The application file containing the application, the State Environmental Policy Act SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents, was entered into the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA, a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), responsible official. BEVAART CONSTRUCTION CO. SA-056- 83 September 27, 1983 Page 3 4. Plans for the proposal have been reviewed by all city departments affected by the impact of this development. 5. The subject site is located at 3700 West Valley Highway. The site is on the east side of the roadway between the roadway and the railroad right-of-way. 6. The subject property consisting of an approximately 3.4 acre lot is relatively level. 7. A manufacturing plant engaged in construction activities including rebar cutting exists on the subject site. 8. The subject site was annexed into the city in April of 1959 by Ordinance 1745, at which time it was automatically zoned G (General; Single Family Residential). The site was reclassified to M-P (Manufacturing Park) in December of 1967 by Ordinance 2380. 9. The Comprehensive Plan designates the general area in which the subject site is located as suitable for the development of manufacturing park uses. 10. The applicant, a lessee of the property, has erected an addition to the existing structure which consists of a column supported roof which save for its connection on the south side is without walls. 11. The addition is approximately 28 feet tall by 120 long and 40 feet deep. Seven columns support the long (100) foot length at intervals of 20 feet, while the corner columns and the north wall of the existing building support the roof structure along the 40 foot dimension. 12. The addition is intended to protect a large cutting machine from the elements. The machine's functions are to convey large reinforcing steel rods to a cutting blade where they are cut to specified dimensions and further conveyed to a location where a fork lift loads them for transport or storage. The rods are loaded at one end, cut somewhere near the center of the apparatus, and removed at the other end. The areas where loading and unloading occur must be open to provide access for fork lift maneuvers. 13. The lease for the property requires that the structure be removed once the lease terminates. 14. Staff originally recommended that the structure be enclosed. Additional recommendations by the Fire Department and the Public Works Department indicate that the true nature of the applicant's structure was not understood. The Environmental Checklist submitted indicated that the proposal consisted of a roof to be placed over an existing asphalted work area/truck load area. The blueprints submitted with the application identify the proposed structure as a "LOADING AREA ROOF." 15. The M-P zone requires that outside storage be screened from public view. Further the intent of the zone as referenced by staff was to create a park like environment in which certain manufacturing and warehousing operations would take place. 16. The applicant proposed screening the shed along the periphery of the site with additional plantings and fencing. CONCLUSIONS 1. The addition does not appear to conform to the goals and policies of the Green River Valley Comprehensive Plan nor the general Comprehensive Plan. While the shed-like addition may be an integral part of the applicant's manufacturing operation the use does not appear to be one allowed unenclosed in the M-P zone. The outside operation of industrial machinery other than loading equipment would appear detrimental to the purposes, goals and policies of the Comprehensive Plan and to the city's desire to promote and provide aesthitic high quality development in the Valley which in turn provides a high quality working environment and enhances the image of the city. BEVAART CONSTRUCTION CO. SA-056-83 September 27, 1983 Page 4 2. Outdoor storage while permitted must be screened from public view (Section 4-730.030 (5)), that is along public roads and sidewalks, and screened from neighboring properties. This requirement was enacted to insure that manufacturing uses would provide both a place of employment and an environmentally sound addition to the city. Certainly if storage must take place behind screening the primary operation must be screened from public view to provide a reasonable approximation of a business park-like atmosphere. 3. While the applicant has already constructed the addition prior to receiving the necessary approval, the plans seem to have inadvertently misled staff as to the nature of the addition. The Fire Department indicated that the structure should contain sprinkler fire protection, the Public Works Department required storm water retention, and the Building and Zoning Department recommended enclosures. The labeling of the plans as a "roof for a work area/truck load area" apparently had the wrong connotation. Staff review treated the area as a covered storage area, whereas the site contains actual manufacturing processes albeit cutting. This operation should take place indoors to conform with the policies and goals of the city, as should any other operation in an M--P zone. 3 If the subject application were approved the city would set a precedent permitting any ragtag manufacturing operation to take place out of doors, in plain view and in complete disharmony with the principles, policies and goals of the Comprehensive Plan regarling manufacturing parks. Approval of this request would return the city to the past when any type of manufacturing operation could take place anywhere, in any manner and in any type of building, shed or assemblage of thrown together structures. 4. The language of this decision should not be read to necessarily criticize the applicant's addition, although as with most manufacturing equipment it is not very aesthetic on a relative scale, but as an attempt to avoid a precedent which would eventually allow all manner of unsightly additions to otherwise well designed manufacturing plants. The use the applicant has proposed should be confined within a building in order to accomplish the goals and policies of the Comprehensive Plan. Unfortunately, if the applicant has outgrown the current structure, a reasonable addition could be designed which would allow the proposed operation to be accomplished indoors. The current addition does look as though it were an afterthought and not part of a well designed manufacturing park building. DECISION: The request for site plan approval is denied. Warren, City Attorney Renton Record-Chronicle The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision- maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council All communications concerning the the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as well as Appeals to the City Council. Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be filed in writing on or before October 11, 1983. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request for review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. DEPARTMENT ANALYSIS; 1.The applicant is seeking site plan approval to allow construction of a 40' x 120' column supported roof addition over an existing asphalt work area and truck loading area. This 4,800 sq. ft. expansion represents an 8.4% increase in the present building size (56,900 sq. ft.). The proposal calls for only a covered roof structure and no substantive walls on either the east, west and north sides. 2. Proposed use specifically complies with the Comprehensive Plan designation of Manufacturing Park and the current M-P, Manufacturing Park Zoning, of the subject site. However, the proposal does not specifically meet the intent of providing a park-like setting for manufacturing operations. The Policy Development Department has stated its specific concern in relationship to aesthetics and the placement of a manufacturing operation in a very visible location without appropriate screening from public rights-of-way and other properties. They have specifically recommended that the west and northern walls should be enclosed to minimize adverse appearance from the storage of materials and supplies. In most situations, manufacturing areas, or storage areas, have been enclosed and provided with large access doors for operation. 3. Modification of the original site plan resulted in relocation of several parking places and a need for an additional five spaces based upon the manufacturing use of the expansion. The Public Works Department advises that drain lines for the area that will be converted from parking to building will have to be relocated and revised. In addition, it appears that since there will be an expansion of the sprinkler system in the development, that the systems development charge may apply.
